CHANGE OF TERMS NOTICE TO ALL CUSTOMERS This Change of Terms Notice to all Customers consists of four parts. Part I applies only to Consumer Deposit Account customers; Part II applies only to Ease by Bank of Hawaii Account customers; Part III applies only to Business Deposit Account customers; and Part IV applies to both Consumer and Business Account Customers By maintaining your account from and after the stated effective dates of these changes, you are agreeing to the terms as amended by this Change of Terms Notice to All Customers. If you do not agree with any amended term, you must close your account prior to the effective date. Please read and keep this with your deposit account disclosures for future reference. PART I: Important Notice to All Consumer Deposit Account Customers The following are changes to your Consumer Deposit Account Agreement and Disclosure Statement ( Deposit Agreement ) and Bankoh Consumer Electronic Financial Services Agreement and Disclosure Statement ( Electronic Financial Services Agreement ) which are contained in the booklet titled Consumer Deposit Account Agreement and Disclosure Statement and Bankoh Consumer Electronic Financial Services Agreement and Disclosure Statement ( Account Agreements ), FEE SCHEDULE for Personal Checking and Savings Accounts ( Fee Schedule ), and Bank of Hawaii Mileage Check Card Agreement (for consumers) ( Mileage Check Card Agreement ), collectively referred to as the Consumer Deposit Agreements : A. Change to the Deposit Agreement, Electronic Financial Services Agreement, Fee Schedule, and Mileage Check Card Agreement Effective immediately, we are changing the names of all Bank of Hawaii Visa Check Cards. Therefore, any and all references to Bank of Hawaii Black Visa Check Card, Bank of Hawaii Visa Check Card, and Bankoh Hawaiian Airlines Visa Check Card in the Consumer Deposit Agreements and any other applicable Bank of Hawaii agreements or disclosures shall refer and apply to the Bank of Hawaii Black Visa Debit Card, Bank of Hawaii Visa Debit Card, and Bankoh Hawaiian Airlines Visa Debit Card, respectively. B. Changes to the Deposit Agreement 1. For all Bankohana customers, beginning with statements issued after November 24, 2015, we are changing the day upon which we determine the combined average daily balance in your related Bankohana accounts for qualification purposes. Therefore, we are replacing the paragraph titled Balance Calculation in the subsection titled Bankohana Account in the section titled ACCOUNTS with the following: Balance Calculation. We determine the combined average daily balance in your related Bankohana accounts three business days prior to the last business day of that statement cycle by adding together the following amounts: (1) The average daily balance of your Bankohana Account, (2) The average daily balance of your related deposit accounts and (3) The outstanding principal balances of all qualifying loans. If you have a Level II Account or a Level III Account, the following additional balances (three business days prior to the last business day of that statement cycle) will be included in the combined balance requirement: (4) The outstanding principal balance of all related mortgage accounts (up to a maximum of $10,000 per account) and (5) The balance of all of your qualifying accounts at BISI. 2. Effective from and after November 24, 2015, for all Bankohana customers, we limit the safe deposit box benefit to one discount per Bankohana Account, provided that the first person named as lessee on the safe deposit box matches the primary owner of the Bankohana Account. We are also clarifying the benefit as a discount rather than a credit. Therefore, we are replacing the bullet point titled Safe Deposit Box Rental in the paragraph titled Account Benefits in the subsection titled Bankohana Account in the section titled ACCOUNTS with the following: Safe Deposit Box Rental. You will receive one $30.00 discount against safe deposit box rental fees at the time your rental payment is due if you have a Level - II Account or a Level - III Account, or one $15.00 discount if you have a Level - I Account, provided that the first person named as lessee on the safe deposit box matches the primary owner of the Bankohana Account. Rental is subject to availability. Automatic payment of your rental fee from a Bank of Hawaii checking or savings account is required. C. Changes to the Fee Schedule Effective from and after December 1, 2015, the following changes will be made to your Fee Schedule (All symbol references and footnotes are contained at the end of this Section C): 1. The Monthly service fee for Regular Savings accounts will be increased to $5.00 if the minimum balance requirement is not met. Therefore, the subsection titled REGULAR SAVINGS in the section titled SAVINGS ACCOUNTS is replaced with the following: REGULAR SAVINGS Minimum opening deposit (except for accounts opened online) $100.00 Minimum opening deposit for online accounts ( ) $300.00 Minimum daily balance required to avoid monthly service fee $300.00 Monthly service fee if minimum balance requirement not met $ 5.00 2. The Minimum opening deposit for online accounts and the Minimum daily balance required to avoid monthly service fee for Bonus Rate Savings accounts will be increased to $600.00. Therefore, the subsection titled BONUS RATE SAVINGS in the section titled SAVINGS ACCOUNTS is replaced with the following: BONUS RATE SAVINGS Minimum opening deposit (except for accounts opened online) $100.00 Minimum opening deposit for online accounts ( ) $600.00 Minimum daily balance required to avoid monthly service fee (3) $600.00 Monthly service fee if minimum balance requirement not met (3) $ 5.00 Minimum monthly deposit required to obtain interest at Bonus Rate when no withdrawals are made $ 25.00 1
3. The fee for Cash withdrawals at Qualified ATMs (other than Bank of Hawaii ATMs) within the U.S. and its Territories will be increased to $2.75. Therefore, item #12 in the section titled OTHER FEES FOR CHECKING, SAVINGS, AND PACKAGED ACCOUNTS is replaced with the following: 12. Automated Teller Machine (ATM) transactions a. Therefore, item #13 in the section titled OTHER FEES FOR CHECKING, SAVINGS, AND PACKAGED ACCOUNTS is replaced with the following: 13. International (12) POS Transactions using the Bank of Hawaii Visa Debit Card, Bankoh Hawaiian Airlines Visa Debit Card and Bank of Hawaii Black Visa Debit Card (15) will be charged an International Service Assessment fee. 2.50% of the transaction amount in U.S. dollars 5. The fee for each replacement card for Bankoh BankCard, Bank of Hawaii Visa Debit Card, and Bankoh Hawaiian Airlines Visa Debit Card will be increased to $20.00. Therefore, item #14 in the section titled OTHER FEES FOR CHECKING, SAVINGS, AND PACKAGED ACCOUNTS is replaced with the following: 14. D. Change to the Mileage Check Card Agreement Effective immediately, the name of the Mileage Check Card Agreement will be Mileage Debit Card Agreement. Therefore, all references to Mileage Check Card Agreement shall refer and apply to the Mileage Debit Card Agreement. PART II: Additional Important Notice to all Ease by Bank of Hawaii Account Customers Effective from and after December 1, 2015, the following are changes to your Ease by Bank of Hawaii Account Addendum to Account Agreement and Disclosure Statement and Fee Schedule ( Ease Addendum ) in the section titled FEE SCHEDULE FOR EASE BY BANK OF HAWAII ACCOUNT (All footnotes are contained at the end of this Part II): 1. The fee for each replacement card for the Ease by Bank of Hawaii Visa Debit Card will be increased to $20.00. Therefore, item #8 is replaced with the following: 8. PART III: Important Notice to All Business Deposit Account Customers The following are changes to your Business Deposit Account Agreement ( Business Deposit Agreement ), and your Business Services Agreement for Bankoh by Phone, Business BankCard, Bank of Hawaii Visa Check Card for Business, and Business Depository Services ( Business Services Agreement ) which are contained in the booklet titled Business Account Agreements, and also to your Fee Schedule for Business Checking and Savings Accounts ( Fee Schedule ): A. Change to Business Deposit Agreement, Business Services Agreement and Fee Schedule Effective immediately, we are changing the names of the Bank of Hawaii Visa Check Card for Business to Bank of Hawaii Visa Debit Card for Business. Therefore, all references to Bank of Hawaii Visa Check Card for Business in the Business Deposit Agreement, Business Services Agreement, Fee Schedule and any other applicable Bank of Hawaii agreement shall refer and apply to the Bank of Hawaii Visa Debit Card for Business. B. Changes to the Business Deposit Agreement 1. Effective immediately, the last paragraph in the subsection titled Payment of Interest in the section titled INTEREST ON DEPOSITS is replaced with the following: In all cases, if you close your account or transfer your account to Pending Close Status (refer to Termination/Closing Your Account under Additional Terms and Conditions For Your Deposit Account of the Business Deposit Agreement) before interest is credited to your account, you will receive the accrued interest. If your account has a zero balance on the day accrued interest is scheduled to be paid to your account, you will receive the accrued interest. If your account has a zero balance after accrued interest is paid and any applicable service charges are assessed, your account may automatically close. 2. For all Bankohana customers, beginning with statements issued after November 24, 2015, we are changing the day upon which we determine the combined average daily balance in your related Bankohana accounts for qualification purposes. Therefore, we are replacing the paragraph titled Balance Calculation in the subsection titled Bankohana Business Account in the section titled BANKOHANA FOR BUSINESS ACCOUNTS with the following: Balance Calculation. We determine the combined average daily balance in your related Bankohana Business accounts three business days prior to the last business day of that statement cycle by adding together the following amounts: (1) The average daily balance of your Bankohana Business account, (2) The average daily balance of your related deposit accounts and (3) The outstanding principal balances of all related loan accounts. C. Changes to the Fee Schedule Effective December 1, 2015, we are making changes to certain fees. The following changes will be made to your Fee Schedule for Business Checking and Savings Accounts ( Business Fee Schedule ) (All footnotes and symbol references are contained at the end of this Section C): 1. The fee for each replacement card for the Business BankCard and Bank of Hawaii Visa Debit Card for Business will be increased to $20.00. Thus, all references to Business Services Agreement for Bankoh by Phone, Business BankCard, Bank of Hawaii Visa Check Card for Business, and Business Depository Services shall refer and apply to the Business Services Agreement for Bankoh by Phone, Business BankCard, Bank of Hawaii Visa Debit Card for Business, and Business Depository Services. PART IV: IMPORTANT NOTICE TO ALL CONSUMER AND BUSINESS ACCOUNT CUSTOMERS We are clarifying and updating the Funds Availability policy for both consumer and business deposit account customers to reflect better availability for ATM deposits and deposits made on Saturdays, Sundays, and U.S. federal holidays at certain branches. Therefore, the entire section titled FUNDS AVAILABILITY including the subsection titled Additional Rules for Accounts in the State of Hawaii in the Deposit Agreement and Additional Funds Availability For State Of Hawaii Only in the Business Deposit Agreement is replaced in its entirety with the following: FUNDS AVAILABILITY In some circumstances, we may either wait to credit your account, or credit your account but place a hold on the amount of a deposited check or item until final disposition is made with respect to the check or item. If your account is a State of Hawaii branch account and we do this, we will do so in accordance with the Additional Rules for Accounts in the State of Hawaii provisions in the following section, and we will provide you with an estimate of the number of days we will maintain the hold on the amount of the check or item, or when your account will be credited. We may place a hold or send for collection any check drawn on a foreign or remote bank, and in addition, if your account is a non-state of Hawaii branch account, we may place a hold on the amount of a deposited check or item, for example, if a deposited check is for a large amount. If we do this, we will give you an estimate of the number of business days we will maintain the hold on the amount of the check or item. Please understand, however, that these estimates will not always be accurate because of uncertainties in the check collection process which we cannot predict or control. Please ask if you need to be sure when funds from a deposit will be available. For accounts opened online, funds we obtain by electronic transfer from another institution to open the account will be available within 2 to 4 business days after the date your online account was credited. Additional Rules for Accounts in the State of Hawaii Your Ability To Withdraw Funds. Our general policy is to make funds from your cash and check deposits available to you for withdrawal on the business day of your deposit. Electronic direct deposits also will be available on the day we receive the deposit. Once they are available, you can withdraw the funds in cash, and we will use the funds to pay checks that you have written. For determining the availability of your deposits, every day is a business day except Saturdays, Sundays and U.S. federal holidays. If you make a deposit at a Bank of Hawaii branch or at a Bank of Hawaii ATM on a business day that we are open before the cutoff hour we establish for that location (Note: Some offices have a cutoff hour as early as 3:00 p.m.; Bank of Hawaii ATMs have a cutoff hour as early as 12:00 noon), we will consider that day to be the day of your deposit. Cutoff hours are posted on Bank of Hawaii ATMs and vary by location. If you make a deposit after the cutoff hour or on a day that we are not open, we will consider that the deposit was made on the next business day we are open. ATM Deposits. If you deposit cash or checks at a Bank of Hawaii ATM (whether before or after the cutoff hour) on any calendar day, up to $200 of the amount may be withdrawn by ATM, point-of-sale transaction, and/or in person at one of our branches. The same availability applies to ATM deposits made that day by any other cardholder. The remainder of the deposit(s) that day will become available (e.g., by ATM, POS or check) on the next business day. Note: If you make a deposit to a Bank of Hawaii ATM which does not permit deposits to be made in an envelope, you will receive access to all of your ATM cash deposit on the day of your deposit. Your ATM check deposits, however, will be subject to the $200 availability limit described in the preceding paragraph. In-Branch Weekend and U.S. Federal Holiday Deposits. Certain of our branches are open on Saturdays, Sundays and U.S. federal holidays. If you make an in-person deposit to a Bank of Hawaii employee at one of those branches, funds from cash and check deposits will be available to you for withdrawal on that calendar day. Longer Delays May Apply. In some cases, we will not make all of the funds that you deposit by check available to you on the day of your deposit. For example, if you make your deposit by mail, at an Instant Teller, or after the cutoff hour, your funds will be available on the first business day after the day of your deposit. Also, depending on the type of check you deposit, funds may not be available for withdrawal until the third business day after the day of your deposit. However, if you make a deposit to your checking account, the first $200 of your deposits may be available for withdrawal on the first business day after the day of your deposit. If we are not going to make all of the funds from your deposit available on the day of your deposit, we will notify you at the time you make your deposit. We will also tell you when the funds will be available. If your deposit is not made directly to one of our employees, or if we decide to take this action after you have left the premises, we will mail you the notice by the first business day after we receive your deposit. If you will need the funds from a deposit right away, you should ask us when the funds will be available. 5
In addition, funds you deposit by check may be delayed for a longer period under the following circumstances: We believe a check you deposit will not be paid. You deposit checks totaling more than $5,000 on any one day. You redeposit a check that has been returned unpaid. You have overdrawn your account repeatedly in the last six months. There is an emergency, such as failure of computer or communications equipment. We will notify you if we delay your ability to withdraw funds for any of these reasons, and we will tell you when the funds will be available. They will generally be available no later than the eighth business day after the day of your deposit. Deposits Made at a Non-State of Hawaii branch. If you make a deposit to your State of Hawaii account at a Pacific Island branch, we may delay your ability to withdraw funds. Your funds will generally be available no later than the twentieth business day after the day of deposit. Special Rules For New Accounts. If you are a new customer, the following special rules will apply during the first 30 days your account is open. Funds from electronic direct deposits to your account will be available on the day we receive the deposit. Funds from deposits of cash, wire transfers and the first $5,000 of a day s total deposits of cashier s, certified, teller s, traveler s and federal, state and local government checks will be available on the first business day after the day of your deposit if the deposit meets certain conditions. For example, the checks must be payable to you. The excess over $5,000 will be available on the eighth business day after the day of your deposit. If your deposit of these checks (other than a U.S. Treasury check) is not made in person to one of our employees, the first $5,000 will not be available until the second business day after the day of your deposit. Funds from all other check deposits will be available on the eighth business day after the day of your deposit. Mobile Deposit Service. For funds availability on deposits made via Mobile Deposit Service, please refer to the e-bankoh Consumer Agreement and Disclosure Statement.
