PERSONAL SEARCH OF THE LOCAL LAND CHARGES REGISTER Prescribed Fee Since August 2010 there is no fee. Appointments Arranged by telephoning the Local Land Charges Section direct line: 01246 345303. Please state the name of the person or company carrying out the search together with the address of the land against which the search is to be made. Available Times: Monday to Friday, 1000 to 1200 hrs and 1400 to 1600 hrs. At least 24 hours before the time booked, please email or fax confirmation of the appointment, the address to be searched, and enclose a plan showing the extent of the property outlined in red or by cross-hatching. Only one appointment may be booked by a member of the public, personal search company or solicitor each day. Subject to availability (ie the Council will accommodate personal searches of 20 properties per day in total), appointments may be arranged in advance and may be added to at a later date, up to the maximum of 10 properties. Procedure Please go to the main reception desk, Town Hall, Rose Hill, Chesterfield, to obtain a visitor s badge and directions to Planning Services Reception. An extract from the Register of Planning Applications and Decisions will be made available for inspection. 2

The result of a search of the Local Land Charges Register will be given to you in reception or emailed if preferred. Please note, staff within Council departments have no legal obligation to give supplementary advice or opinion. PROCEDURE FOR OBTAINING PROPERTY DATA TO BE ABLE TO ANSWER ALL THE QUESTIONS ON THE CON29 REQUIRED ENQUIRIES OF LOCAL AUTHORITY FORM (2007 Edition) Information which is available free of charge The Council holds statutory and non statutory registers, which are open for inspection, free of charge, during office hours. Examples include: Public Sewer Maps, via Design Services, Tel No: 01246 345395 Please note, copies of these maps may only be obtained from Yorkshire Water. Environmental Protection Act Authorised Processes, Environment and Safety Information Act 1985, Sunday Trading, Food Premises Registration, all via Environmental Services, Tel No: 01246 345718 Derbyshire County Council also has public registers including: Public Rights of Way, Publicly Adopted Highways and Register of Local Common Land and Village Greens. Other public property information which is not found on public registers: 3
Local Plans etc (Enquiry 1.2) and Conservation Areas (Enquiry 3.10), available at Planning Services Reception, Radon Gas (Enquiry 3.13) available from the radon website, www.ukradon.org. Information Available with effect from 6 th April 2009 To avoid the need to contact the various relevant services at the Town Hall and off-site, the remainder of the property data may be obtained by writing to Local Land Charges, enclosing a plan of the property and the relevant fee - please see attached price list. Cheques should be made payable to: Chesterfield Borough Council The enquiries will be sent to the relevant services for answering. When all the replies have been collated by Local Land Charges, they will be dispatched by email or post together with a receipt for any monies paid. This new service will be run on the same basis as is operated for official searches, i.e. via Local Land Charges, and with an agreement for departments to turnaround replies to enquiries in 5 working days. Other Information For information, highways enquiries are answered by Derbyshire County Council and these replies may be obtained either direct from: or via Local Land Charges. Development Control Section, County Hall, Matlock, Derbyshire, DE4 3AG, Street Works: A table of approved schemes is now available via a link on the Highway Searches page of Derbyshire County Council s website www.derbyshire.gov.uk. This is up to date up to the approval date at the beginning of the financial year. Drainage enquires are via Yorkshire Water Safe-Move for the whole of the Chesterfield Borough Council area. 4
