ΙΙ. DESCRIPTION OF INSURANCE COVER The Insurer must provide assistance to the Insured Persons who are in an unfavourable position due to the immobilisation of their Insured Vehicle due to a failure or accident during the effective period of this insurance. The assistance to the Insured is provided using the personnel and means of the Insurer or of its associates. The cover includes: 1. the Vehicle s on-site repair, when possible. If there has been a failure of the Insured Vehicle, the Insurer must organise and pay the cost of the on-site attempt to repair the failure by sending one of its associates. However, the Insurer will not bear the cost of spare parts, where such parts are required. The on-site repair also includes changing a problematic tyre with the Vehicle s spare wheel. 2. moving the Vehicle back onto a public road, if it has moved off the road due to an accident, through the use of a special hoist truck and while making every possible effort, using all the means available to the Insurer or to third parties, however being relieved of all liability for any damage it may cause to the Vehicle exclusively due to the particular situation and circumstances of the Accident, up to a limit of 3,000. Similarly, if it is impossible not to damage the Insured Vehicle while hoisting, securing or transporting it in order to complete its transportation, the Insurer will not be held responsible. 3. to have the Insured Vehicle transported to a repair garage or a location chosen by the Insured. If the Insured Vehicle is immobilised due to a Failure or Accident and also if it is found after having been stolen and provided that this theft had been reported to the competent authorities, the Insurer must transport the Insured Vehicle to the nearest suitable repair garage for repair or to a location chosen by the Insured, always within Greece and provided that the Vehicle cannot be repaired onsite at the location where it was immobilised to a degree that it can safely travel on its own. If the repair garage chosen by the Insured is closed at the time of the transportation due to this being a holiday or a weekend, the Insurer shall undertake the Insured Vehicle's storage and its subsequent transportation to the repair garage specified by the Insured on the first business day following its storage. If the Insured Vehicle remains in the storage area for reasons that are due to the Insured for more than three (3) business days after the Insured Event, the Insured must pay to the Insurer storage fees ( 5.00 per day) for the excessive period. It is pointed out that for each event, the Insurer s obligations towards the Insured are fully performed when the Insured Vehicle has been transported from the accident site to the location chosen by the Insured. In every case where a second transportation is required for the same event (e.g. from one repair garage to another), this will not be considered a provision of Roadside Assistance under Law 3651/2008, Article 8, par.10 and therefore cannot be performed by the Insurer; instead, it can only be performed by a Public-Use Tow Truck Company, under the responsibility of and with all costs being borne by the Insured. If the Insured Vehicle is immobilised abroad and cannot be repaired on-site in order to restore its ability to safely travel on its own, the Vehicle will be transported to the nearest and most suitable place for its repair. The Insured Vehicle may be transported to the location chosen by the Insured, within Greece, provided that the repair work required for the Vehicle would take longer than 3 business days. NB: The Insured Vehicle will be transported to the location chosen by the Insured within a reasonable time frame and, in any case, within 48 hours for events in Greece and within 10 days for events outside Greece. 4. transporting the insured passengers from the point of immobilisation (due to Failure or Accident) or theft (provided that this has been reported to the competent authorities) of the Insured Vehicle a) to the location to which the Insured has chosen for his/her Vehicle to be transported, provided that the distance of this transfer is longer than 50 kilometres; or b) to the Insured s Usual Place of Residence if the Insured has chosen to have the Vehicle repaired in the area where the Failure or Accident occurred and provided that the Vehicle cannot be repaired, to a degree that would enable it to travel safely, within 24 hours and that the Vehicle s repair location is more than 50 kilometres away from the Insured s Usual Place of Residence. In this case, the Insured may request that the Insurer cover the cost of the Insureds continuing their trip to their destination, provided that the cost of them continuing their trip is not higher than the cost of them returning to the Insured s Usual Place of Residence. The above transportation can be carried out by a means of transport provided by the Insurer or by public transport, the cost of which will be borne by the Insurer, or by renting a vehicle with an engine size similar to that of the Insured Vehicle but no more than 1.4 litres, which the Insurer will provide to the Insured for a period up to 72 hours, provided that at least three (3) Insureds were in the Vehicle when it was immobilised. It is agreed that the method of transportation will be chosen by the Insurer. 5. Hotel accommodation for the Insureds, for up to 3 days, with a maximum daily cost per insured of 100.00 in Greece and 220.00 outside Greece, provided: a) all three (3) of the following conditions are met at the same time: the Insured has chosen to have his/her Insured Vehicle repaired within the prefecture in which it was immobilised; the Insured Vehicle cannot be repaired on that same day to a degree that would allow it to move safely on its own; and the location where the Vehicle was immobilised is more than 50 kilometres away from the Insured s Usual Place of Residence. b) the Insureds are entitled to transportation pursuant to the provisions of paragraph 4, and this transportation, for any reason not due to the Insureds fault, has been scheduled by the Insurer to take place on the following day, provided that the transportation distance exceeds 50 kilometres. 6. the services of a chauffeur, in the case of death, illness or accident of the Insured Vehicle s driver that renders the driver unable to drive the Insured Vehicle and no-one among his/her fellow travellers are able to replace him/her, so that the chauf- 3 VEHICLE INSURANCE POLICY
feur will transport the vehicle and its insured passengers to the Usual Place of Residence or to their destination, if the cost of travelling to the destination is not higher than the cost of travelling to the Usual Place of Residence. The chauffeur service is provided only if the distance that the Insured Vehicle must travel exceeds 50 kilometres. 7. the procurement of spare parts for the Insured Vehicle s repair and their dispatch to the corresponding repair garage when such parts cannot be found at the garage itself. As a matter of course, the Insured will bear the cost of the spare parts, as well as any customs duty applicable. 8. the loss of keys. If the Insured locks the Insured Vehicle s keys inside the vehicle or loses them, the Insurer undertakes to take all the necessary actions to help the Insured. More specifically, the Insurer undertakes to either: a) send a second set of keys - if this exists - to the location of the Insured; or b) transport the Insured Vehicle, where possible, to an authorised repair garage or dealership chosen by the Insured, either within the prefecture where the Insured Vehicle was immobilised or within the prefecture of the Insured s Usual Place of Residence. The vehicle will be transported under the Insured s exclusive responsibility and the Insurer will not be held in any way responsible for any damage caused during transportation. With regard to the potential storage and the time of transportation of the Insured Vehicle to the Insured s Usual Place of Residence, the provisions of paragraph B3 above will apply. 9. assistance if the Vehicle is out of fuel. If the Insured Vehicle is immobilised due to running out of fuel, the Insurer will see to the Insured Vehicle s transportation to the nearest petrol station. CLARIFICATIONS If the Insured Vehicle needs to be loaded onto a ship to be transported, the corresponding sea transportation costs shall be borne by the Insured, provided that the Insured would have paid for such costs even if the Loss had not occurred. The Insured must always carry the Car Insurance Policy document with him/her in order to prove that the Roadside Assistance cover is in effect. Otherwise, and in accordance with Greek Law 3651/2008 (on roadside assistance), the Insurer may refuse to provide any Indemnity. If, for the above reason, the Insurer refuses to serve the Insured and it is subsequently proven that the Insured was entitled to Roadside Assistance cover, the Insurer must cover then expenses made by the Insured for the necessary Roadside Assistance services, up to an amount of 150 and after the Insured has produced the relevant payment receipts. C. CONDITIONS AND DURATION OF ROADSIDE ASSISTANCE COVER The Roadside Assistance insurance comes into effect on the date specified in the Car Insurance Certificate entered into by the Insured with ERGO S.A. and will be in force for as long as said insurance policy remains in force with the relevant Roadside Assistance cover enabled. At the moment of contracting the insurance, the Insured Vehicle must be fully operational and must not have sustained any damage that would prevent it from moving on its own. The Roadside Assistance insurance premium is not affected by the pricing factors applicable to the Motor Insurance Branch (such as the bonus-malus system, special discounts and so on). The Insurer reserves its right to readjust the insurance premium and modify the Roadside Assistance terms and conditions at every renewal of the Car Insurance Policy entered into by the Insured with ERGO S.A., or even to suspend the Roadside Assistance cover. D. CLARIFICATIONS - SPECIAL CASES 1. a) The Roadside Assistance cover does not entitle the Insured to request or agree the provision of services by any third party and to then claim from the Insurer the amount which the Insured paid or promised to pay to such third party. b) The Roadside Assistance services consist of benefits in kind and not in cash, except where otherwise provided in this policy. In the case of force majeure, the Insurer may ask the Insured to pay for the necessary services himself/herself and then send the relevant payment receipts to the Insurer. Specifically in this case, the Insurer shall reimburse the Insured for the expenses in question. 2. The Insurer is not obliged: a. to provide Roadside Assistance services if: weather conditions are unfavourable and the streets are hard to access due to floods, fog, landslide, snow or ice and the repair vehicles and tow trucks cannot move, even with the aid of snow chains. the streets are inaccessible due to exceptional circumstances (earthquake, broken or faulty bridges and so on). b. to put snow chains on the Vehicle. c. to tow the Insured Vehicle when this is impossible due to the Vehicle having been immobilised in an underground parking station. d. to transport or move other vehicles in order to free the Insured Vehicle. e. to transport the Insured Vehicle if the failure can be repaired at the location where it was immobilised. f. to provide assistance for a failure which does not prevent the Vehicle from being driven safely to the nearest repair garage. g. to transport an Insured Vehicle which is bearing a load if such load has not been previously removed so that the Vehicle can be transported safely. 4 VEHICLE INSURANCE POLICY

If, despite these efforts, the Vehicle has not been recovered, the Insurer will not be held responsible and all its obligations for this particular recovery will cease to apply. If the Vehicle is eventually recovered and, due to the particular circumstances, the Insured s car sustains damage, the Insurer will not be responsible for providing compensation. c. for any loss of or damage to personal belongings or components of the Insured Vehicle. 4. The Insurer reserves the right: a. to provide the personnel and equipment it chooses or to collaborate at its own discretion with natural or legal persons who/ which have the suitable means for providing the Insurer s services; b. to use the available means which it finds to be expedient for dealing with each assistance case; c. to serve other insured vehicles which it meets while transporting the Insured Vehicle. 5. This report, which must include all the possible damage caused to the Insured Vehicle while it was being transported, must necesarily be signed by the Insurer or the transportation agent and also by the owner/driver of the Insured Vehicle. Each party signing that report must receive one copy thereof. Any disagreements between the Insured and the transportation agent must be recorded in that report and must be reported by the Insured to the Insurer within 24 hours of the Vehicle s collection. No claim will be accepted if submitted outside of this 24-hour period. E. EXCEPTIONS - FORCE MAJEURE This insurance cover does not apply in the following cases: a. If the Insured Vehicle is being driven by a person who does not hold a driving license as required by Law. b. If the Insured Vehicle is being driven without the consent of its main or legal holder. If the purpose of this negligence was obviously to defraud or mislead the Insurer, then the Insurer will be relieved of all its obligations towards the Insured. 2.
