We are also approving SITA's request for a waiver of 14 CFR 221.1S0(b)(2). SITA will not have to maintain and install one or more CRT devices and printers connected to its on-line tariff database in the Public Reference Room at the Department. As an alternative to installation of such hardware, we are approving SITA's request to load the SITA Fare Filing Service client software on DOT's PC's used for public access to SITA's system. Carriers wishing to use SIT A as their tariff filing agent may do so by filing a power of attorney pursuant to 14 CFR Part 221 Subpart P. Enclosed is an executed copy of the maintenance and security agreement for your records. We are placing a copy of the agreement, SITAs' letter and a copy of this letter in Docket DOT-OST-2011-0033. MAINTENANCE AND SECURITY AGREEMENT WHEREAS, SIT A, a corporation organized under the laws of the United Kingdom and qualitled to do business in Georgia, wishes to obtain approval to file tariffs electronically with the United Sates Department of Transportation pursuant to 14 CFR Part 221, Subpart R, and WHEREAS, The United Sates Department of Transportation (the "Department"), after review of the application of SIT A filed pursuant to 14 CFR Part 221, Subpart R, and pursuant to such regulations, wishes to approve SIT A's application, NOW THEREFORE, SIT A agrees as follows: 1. SIT A will maintain in force a disaster recovery plan, equivalent to or better than, the plan as reflected in SIT A's Business Continuity and Disaster Recovery Program in effect as of 1 November 2009. Attached hereto, as Attachment A and made a part hereof, is a copy of the current SIT A Business Continuity and Disaster Recovery Program. 2. SIT A will have in force and effect maintenance agreements, equivalent to or better than, those agreements that are presently in effect for SITA's operating system. Attached hereto, as Attachment B and made a part hereof, is a listing of those agreements. SIT A will provide all information relative to these agreements that will not violate our confidentiality obligations 3. SIT A will maintain a security system that is equivalent to or better than the security system presently in effect at SITA's offices. The security system shall provide protection to the computer system so that unauthorized personnel shall not have access to either the hardware, software or the data base. A description of the Oracle Virtual Private Database (VPD) technology SIT A uses is attached as Attachment C. 4. SIT A will maintain tariffs and amendments filed electronically in accordance with the requirements in 14 CFR Part 221.202 in Attachment D. SIT A hereby warrants to the Department that: 1. SIT A will install and maintain equipment and software in the SIT A System in accordance with Industry Practice and as reasonably recommended by equipment and supplier vendors and manufacturers. 2. Access to SITA's System shall be restricted to SITA employees and contractors that will insure compliance with the requirements of 14 CFR Part 221, Subpart R.
3. All of the contracts listed and the Attachment B to this Agreement are in effect as of the date hereof and will be maintained in effect, or equivalent or better contracts will be substituted therefore~ FURTHER, SITA AGREES THAT: The Department of Transportation retains the right to audit SITA's implementation of the Maintenance Agreement for the SITA Fare Filing Service with the Department. For the purpose of this Agreement, any software package or system is to be classified as part of the ability to execute any commends that affect the data, security or operation of the SIT A Fare Filing Service used by the Department. As such SIT A will ensure written authorization from airlines wishing to use the SIT A electronic air fare filing service is filed with the Department of Transportation (DOT) to ensure compliance with CFR 221 subpart P. Where an airline elects to use the SIT A electronic air fare filing service, SIT A will undertake with the airline a commitment that all fares to and from United States of America will only be filed using the SIT A service. SIT A undertakes that it will enter into a maintenance and security agreement with the DOT, prior to approval by the DOT of SIT A's application. Prior to approval, SIT A will complete a user acceptance plan for the initiation and acceptance of the SIT A Service. The aim of the acceptance plan will be to satisfy the DOT that the service provided by SIT A is fully operational in the designated DOT offices and accepted for production use by the DOT. The service being offered by SIT A to the airline community is based on a new generation system platform available using standard internet connections and standard desktop PCs using Microsoft Windows operating systems (XP Professional preferred). The service is based on Oracle database technology, security for all actions taken by the U.S. DOT is managed by the Oracle Vilwal Private Database functionality, which ensures and provides complete data security for all data submitted to the US DOT and actions taken by U.S. DOT personnel. Details of the Oracle Virtual Private Database functionality have been included as an attachment to the Maintenance and Security agreement entered into by the U.S.DOT and SITA. The service provides a means for airlines to supply to the U.S. DOT a justification for the filing and allows the U.S. DOT to review the filed data and to take whatever action it deems necessary. All information contained within the system is confidential and only available to the originating airlines, SIT A as its agent and the U.S. DOT. Any comments the U.S. DOT wish to make for internal use are stored as confidential to only authorized U.S. DOT users of the system. SITA as owner of the system will be able to view U.S.DOT internal remarks but will not be able to change them. Public remarks can be entered by the U.S DOT and these will only be made available to other users of the system and the general public once a final action has been taken by the U.S.DOT. SIT A will make available to the general public a means to view air fare filings that have been filed by the airlines or SITA as its agent to the U.S.DOT, along with their associated status and any public remarks recorded by the U.S.DOT. SIT A seeks a waiver to the requirement in CFR 221 that requires SITA to provide a CRT and printer, The SITA service is fully internet enabled and SITA seeks the DOT's approval to load the SITA Fare Filing Service client software on DOT PC's used for public access to DOT services. The SITA fare filing service will be provided to the U.S. DOT free of charge, and there will not be any charges for the required public access to the SIT A electronic fare filing service. ~.- The U.S.DOT will have the sole ability to approve, suspend, disapprove or reject any air fare tariff filed with the U.S~DOT using the SITA service. The U.S. DOT will be able to record both private and any public remarks regarding any action it takes and the system will automatically electronically timestamp with date and time (GMT) all actions taken by the U.S~DOT, SITA or its authorized airlines users. The SIT A service is so designed that once a filing has been completed and is transferred to the U.S.DOT for action, fares information (fares, add-ons, rules footnotes, general rules, and conditions of carriage) cannot be updated or changed in any way. It is planned that SITA will hold 2 years of data, which will be directly accessible online (i.e. directly via the system) and 8 years of historical archived data. Archived data is accessed by a user request (via the system) that will return the requested data in minutes or hours depending on system load at the time of the request. Data in electronic form can be made available to the U.S.DOT in predefined SIT A data formats and or standard MS Office application formats. The Service will be operated from the SITA datacenters based in Atlanta, Georgia, USA. The SIT A data centre in Atlanta comprises of two data centers 20 miles apart. Both operate 2417 and are fully secure environments. A copy of the SIT A Data Centre disaster recovery plan will be included as an attachment in the Maintenance and Security agreement. SITA will seek from the U.S.DOT approval for the planned downtime schedule. SITA seeks a waiver from the requirement for system availability as outlined in CFR 221 SITA will afford any duly authorized Agency official all reasonable access to our facilities to meet requirements that may be set out by the U.S.DOT from time to time. SITA will enable any notice or disclaimers required by the U.S.DOT and will so design the system that any end user will have to acknowledge the notices or disclaimer before they are allowed access to the system. SIT A will ensure that the system is so designed that log-on security in line with industry practice is provided with appropriate database rights to ensure all data stored or presented to the US DOT can only be actioned or viewed by approved personnel. A general sign on code will be provided for public access with rights limited to view-only of fare filings made to U.S~DOT SIT A confirms that it has read and evaluated the conditions contained in 14 CFR 221.180 (Requirements for electronic filing of tariffs), 14 CFR 221.202 (The filing of tariffs and amendments to tariffs and other sections of Subpart R and except as noted above where SIT A is seeking waivers, SITA confirms that it is able to comply with the 14 CFR Part 221.
