Driver Personal Accident Confirmation of Benefits By virtue of you being registered as a member of BlaBlacar and being a driver on a eligible trip, you receive Personal Accident benefits free of charge for the duration of the eligible trip, by virtue of an insurance policy issued to Comuto SA. Comuto SA is the only policyholder under the insurance policy and only it has direct rights against the insurer. The benefits you receive do not give you direct rights under the policy of insurance but enable you to receive the benefits described below. You must notify AXA (Travel Insurance) of any incident that you feel could give rise to a claim under these terms and conditions. Strict compliance with these terms and conditions is required if you are to receive their benefit. Benefits under the policy of insurance issued to Comuto SA are underwritten by Inter Partner Assistance SA. You should read this document carefully to make sure you understand the benefits provided. Unless another law is agreed in writing, these benefits are governed by English law. If there is a dispute, it will only be dealt with in the courts of England or of the country within the United Kingdom in which your main residence is situated. Meaning of words These words are listed in alphabetical order and whenever they are used in this document in bold typeface they have the meanings set out below. Accidental Bodily Injury Bodily injury caused solely and directly by accidental, external, visible and violent means and sustained during a eligible trip whilst carrying any BlaBlaCar passengers in, or whilst any BlaBlaCar passengers are entering, your motor vehicle which directly and independently of any other cause results within one year in your death or permanent total disability. Please note: Accidental Bodily Injury shall include exposure to the elements. AXA AXA Travel Insurance 10/11 Mary Street, Dublin 1, Ireland (company number 426087). Eligible trip A trip posted by a driver which is booked in advanced via the online booking system of BlaBlaCar Website, using a UK mobile number, and carrying, at least one BlaBlaCar passenger whose place of pick up or place of destination is situated within the UK. Insurer Inter Partner Assistance SA (IPA), a Belgian firm of Avenue Louise, 166 bte1, 1050, Brussels, which is authorised by the National Bank of Belgium. Some of the services under the policy will be provided by IPA s agent, AXA Travel Insurance (company number 426087), of 10/11 Mary Street, Dublin 1, Ireland. All companies are members of the AXA Assistance Group. BlaBlaCar Passenger A member of BlaBlaCar with a mobile phone who booked an eligible trip. Permanent Total Disability Disablement which, having lasted for a period of at least 12 consecutive months from the date of occurrence during a eligible trip will, in the opinion of an independent qualified specialist, prevent you from engaging in, or giving any attention to, any business or occupation for the remainder of your life. Place of Destination The destination as advertised by you to BlaBlaCar where you will leave a BlaBlaCar passenger. Place of Pick up Meeting point as advertised by you to BlaBlaCar to pick up a BlaBlaCar passenger

You, Your The driver registered with BlaBlaCar with a UK mobile phone number and carrying at least one passenger in the vehicle as part of an eligible trip. General Conditions You must comply with the following conditions to have the full protection of the agreement. If you do not comply, AXA may refuse to deal with your claim or reduce the amount of any claim payment. 1. If any information provided by you, or anyone acting on your behalf, to AXA is inaccurate or if you fail to disclose any information which might reasonably affect the insurer's decision to provide cover to you, your right to any benefits. 2. Fraudulent claims: throughout your dealings with AXA, AXA expects you to act honestly. If you or anyone acting for you: a) knowingly makes a fraudulent or exaggerated claim; or b) knowingly makes a false statement in support of a claim; or c) submits a knowingly false or forged document in support of a claim; or d) makes a claim for any loss or damage caused by your wilful act or caused with your agreement, knowledge or collusion. Then a) AXA may prosecute fraudulent claimants; b) AXA will not pay any fraudulent claims; c) AXA will be entitled to recover from you the amount of any fraudulent claim already paid;. d) AXA may inform the Police of the circumstances. 3. All benefits payable under this policy shall be paid to you or, in the case of benefits paid after your death, to your legally appointed personal representatives. Receipt of benefits will be regarded as a full discharge of liability. 4. We will always communicate with you in English.
Personal Accident Benefit What is covered In the event of you suffering accidental bodily injury on a eligible trip, the insurer will pay the appropriate benefit set out below: Death 50,000 Permanent Total Disability 50,000 This benefit is payable in addition to any third party liability or other insurance you may have. This benefit is not payable under more than one of the items shown above. Please note that cover is only operative whilst any BlaBlaCar passengers are entering, or you are carrying any BlaBlaCar passengers, in your motor vehicle. What is not covered The insurer will not pay any benefit if the accidental bodily injury results directly or indirectly from: 1. any trip which is not an eligible trip; or 2. war, hostilities (whether war be declared or not), terrorist activity, revolution, military or usurped power, civil commotion or any similar event; or 3. Your suicide or self-inflicted injury or deliberate exposure to exceptional danger; or 4. Your engagement in any criminal activity; or 5. You being under the influence of alcohol or drugs, other than under the direction of a registered medical practitioner provided that such direction is not given due to your treatment for drug addiction or dependence; or 6. any existing defect or chronic or recurring disease, disorder or other condition which you were aware of at the start of the eligible trip or which you have suffered in the 12 month period prior to the eligible trip; or 7. if the accidental bodily injury arises from or is traceable to or is caused by any gradually developing deterioration whatever the cause of that deterioration. Claim Conditions You must comply with the following conditions to have the full protection of these benefits. If You do not comply we may refuse to deal with your claim or reduce the amount of any claim payment.
1. Notice of any claim should be given within 120 days of the date of the event giving rise to that claim together with, at your expense, such information and proof as AXA may reasonably require. If such notice and information are not given within this 120 day period then, other than in exceptional circumstances, no benefits will be paid in respect of the claim. 2. AXA may require you, at its expense, to be examined by a medical examiner of its choice. If you fail to attend any such examination, no further benefit shall be payable. 3. AXA may also arrange for an agent to visit you. The purpose of any such visit will be to gather details relating to your claim in order to ensure an accurate assessment. It is essential that you make yourself available for any such visit. If you fail to do so, no further benefit shall be payable.
