What To Do If You Have Been Injured in an accident The most common types of personal injury result from automobile accidents. Insurance companies go to extraordinary lengths to deter injured victims from recovering for the injuries, damages and losses they have sustained. Insurers routinely refuse to fully compensate injured victims and try to rush quick settlements by telling victims that they do not need a lawyer to represent them. The laws regarding personal injury claims, medical malpractice, products liability and car accidents are complicated. A single wrong move can result in an entire case being dismissed without a recovery. The laws governing personal injury are tough and insurance companies are tougher. Injured victims need aggressive, experienced legal representation, specifically experienced in pursuing and recovering damages in personal injury claims. After you are involved in an accident there are several things you should do to protect your rights and interests. There are also several things you should NOT do. Here are some thoughts on both to help you protect your legal rights since insurance companies will do everything they can to protect theirs. What You should Do: 1. Call 911 to report the accident. Obtain the police officers names, telephone numbers and a copy of the police report, or incident number. 2. Obtain immediate medical assistance. It is important to determine what injuries you have sustained in an accident. Sometimes injuries occur internally and can cause serious problems if not identified timely. Other injuries may not be apparent at the onset due to the shock of the accident, and you may not be aware of them until later. Some accidents result in long term, or permanent injuries with extensive future medical costs. 3. Write a detailed summary of all facts surrounding the accident and do not share that with anyone other than your attorney. Minor facts which may not seem relevant and may quickly be forgotten may be extremely important to your case. Therefore write down as much as possible directly following an accident - 4 -

for future use, such as: license plate numbers; names of persons involved and any statements of liability made; weather conditions; the time and date; traffic conditions; cause of the accident. 4. Obtain and save the names, telephone numbers and addresses of all persons involved in an accident. Obtain the name of their insurance company, the policy number, telephone number and address. 5. Be sure to get telephone numbers and addresses of all witnesses. 6. Hire an experienced personal injury lawyer as soon as possible. It is important that your claim be properly investigated and documented. Material witnesses must be located and interviewed, any evidence must be preserved. What You should not do: 1. Do not speak with insurance representatives. Do not give them any report about what happened. After an accident, insurance representatives are trained to contact injured victims right away. They are told to elicit written or recorded statements and to attempt to befriend you. Do not give them any recorded or written statements. Their interests are not the same as yours. Insurance adjuster s goals are to protect their company and to limit what they have to pay to an injured person. You need to tell any adjuster who contacts you that you have an attorney and that they should call your attorney directly. 2. Do not sign anything without the approval of your lawyer. Insurance companies and adjusters frequently request people to sign authorizations to obtain information or releases of all claims. Be sure to show these documents to your attorney before signing anything.
