Amendments noted where applicable.] Be it ordained by the Township Committee of the Township of Barnegat, County of Ocean and State of New Jersey: 26-1. Definitions. ARTICLE I False Alarm Systems ALARM SYSTEM Any device designed, when actuated, to produce or emit a sound or transmit a signal or message for the purpose of alerting others to the existence of an emergency situation requiring immediate investigation by alarm police, fire or other agent. FALSE ALARM The activation of an alarm system by causes other than those to which the alarm system was designed or intended to respond. 2601 9-5-00

26-1 BARNEGAT CODE 26-3 FIRE DEPARTMENT The volunteer fire company or companies located within the Township of Barnegat. TOWNSHIP ALARM ADMINISTRATOR The Township Administrator or any other person authorized by the Township Committee to be responsible for the enforcement of this chapter and any administrative duties regarding the regulation and control of alarm business, agents and systems in the Township. The Barnegat Township Police Department shall be known as the Township Alarm Administrator. 26-2. Required inspections and information. A. The Township Alarm Administrator or his/her representative is authorized, at reasonable times and upon oral notice, to enter any premises in the Township of Barnegat to inspect the installation and/or operation of any alarm device as official business. B. All businesses having fire alarms must submit the names, addresses and emergency numbers of persons to contact, if the alarm is activated, to the Township Alarm Administrator and shall update and/or amend this list monthly. This list is confidential and shall be used by the Police and/or Fire Department when necessary to make contact due to official business. 26-3. False alarms. A. The Township Alarm Administrator shall keep a written record (the police event/dispatch card) of all false alarms which summon the Fire Department to investigate. B. [Amended 8-21-00 by Ord. No. 2000-37] Upon four (4) false alarms, in. any new calendar year, a written warning will be sent to the owner or lessee of such alarm system with a copy of this chapter. After five (5) false alarms in any new calendar year, the Township

26-3 ALARM SYSTEMS 26-3 Alarm Administrator shall charge the owner or lessee of such alarm an administrative inspection fee, as outlined in Section 26-4. (1) In the event that a fifth false alarm occurs prior to the receipt of the warning, the administrative inspection fee will be imposed. 2602.1 9-5-00

The Township Alarm Administrator is authorized to have any alarm device connected to the township offices or the Fire Department, that does not meet the requirements of this chapter or is responsible for excessive false alarms, excessive false alarms being more than ten (10) in one (1) calendar year, disconnected. D. Should any disconnection result due to power failure, all liability shall be upon said subscriber for all losses whatsoever during the period of disconnection, and no liability shall befall the Township of Barnegat. E. In order to reconnect to the township offices or the Fire Department, the alarm subscriber must submit, in writing, to the Township Alarm Administrator, proof that the problem with his alarm has been corrected. Approval may be given on a trial basis for sixty (60) days. A reconnect fee will be charged. F. The owner, lessee or alarm business, after consulting with the Township Alarm Administrator, may appeal said administrator's decisions to the Township Committee. 264. Fees. A. The following administrative inspection fees shall be applicable as a result of excessive false alarms: (1) Zero (0) to four (4) no fee (2) Fifth false alarm: one hundred dollars ($100.) (3) Sixth false alarm: one hundred fifty dollars ($150.) (4) Seventh false alarm: two hundred dollars ($200.) (5) Eighth false alarm: two hundred fifty dollars ($250.) (6) Ninth false alarm: three hundred. dollars ($300.) 2603 5-5-97
