Public Liability Insurance Our Public Liability Insurance extends to meet to the needs of Sports Clubs and Associations, Sports Coaching Businesses, individual Sports Coaches and Trainers and Sports Event and Camp organisers. Whatever the type of sports organisation or activity, we may be able to provide the necessary public liability protection against compensation claims. What is Public Liability Insurance? This insurance aims to protect you from the financial implications of claims made by a third party, for example, club members, a member of the public or someone who is lead or taught where your activities cause them injury or damage to their property. Although a claimant must be able to demonstrate that they have suffered a loss as a result of negligence, a claim can be brought against you even if there is little or no proof. If that happens, this insurance can provide you with the required cover for legal defence costs so that unsubstantiated claims can be dealt with swiftly and so Public Liability Insurance could be an essential part of the cover you need. Our insurance includes: 2 million Public Liability cover as standard. Option to increase cover to 5 million or 10 million for an additional premium. Up to 10% No Claims Discount. Optional 15% Double Excess Discount. Cover for coaching children. Option to add Employers Liability Insurance giving up to 10 million cover. Employers Liability Insurance Our Employers Liability Insurance can be taken alongside our Public Liability Insurance in order to meet your statutory requirement under the Employers Liability (Compulsory Insurance) Act 1969. You need Employers Liability insurance by law, even if you are a club relying solely on volunteers and when you take out a policy you must display a certificate where people can easily read it. What is Employers Liability Insurance? This insurance aims to protect you from the financial implications of claims made by employees, volunteers or subcontractors who suffer a bodily injury, illness or death which arises out of and in the course work they are undertaking for you. You are not required to cover sub-contractors or, for example, self employed coaches, provided they have their own Public Liability Insurance in place. Our insurance includes: 10 million Employers Liability Insurance as standard. Includes up to 1 million in respect of legal costs and expenses for each occurrence under the Corporate Manslaughter & Corporate Homicide Act 2007. Up to 5 million for injuries and illness caused by terrorism. No excess on claims. Cover for residents of the United Kingdom only. Professional Indemnity Insurance Our Professional Indemnity Insurance can be taken alongside our Public Liability Insurance. What is Professional Indemnity Insurance? If you give advice or instruction as part of your activities, this insurance aims to provide protection to coaches, trainers and instructors from their legal liability to compensate third parties who suffer injury or loss as a result of errors or mistakes in the instruction or advice they give. So it can be essential protection for you or your club because it means expensive legal and defense costs can be taken care of. Sports Equipment Insurance Our Sports Equipment Insurance can be taken alongside our Public Liability Insurance. What is Sports Equipment Insurance? Whatever your sports business, if you own the sports equipment you use you may want to ensure that it is protected against physical loss or damage. We will provide settlement on a New for Old basis although we may consider an option to repair or replace the equipment. Our insurance includes: Cover for up to 30,000 worth of equipment although we may consider applications for a greater amount of cover. A single item limit of 1,000 although we may consider more valuable items. 100 excess per claim. Optional Loss of Key protection up to 2,000. Cover for residents of the United Kingdom only. Policy Summary Features - What are the main benefits of the policy? Exclusions & Limitations - What isn t covered? Public Liability The indemnity limit is 2,000,000 for any one occurrence with the option of increasing cover to 5,000,000 or 10,000,000 for an additional premium. The policy provides cover for but not limited to: Accidental bodily injury caused to a third party. Accidental bodily injury to participants unless endorsed otherwise. Accidental damage caused to a property of a third party including premises hired or rented to you. Legal defence costs against claims indemnified by this policy. Policies written on a claims occurred basis which means we will cover claims for incidents that have taken place during the period of insurance irrelevant of when the claim is made. Overseas Personal Liability. Public Liability Exclusions & Limitations Any liability arising from but not limited to: Bodily injury to any employee arising out of and in the course of their employment. Or caused by any product supplied other than food or drink provided to be consumed on your premises. Damage to property belonging to you. Contractual liability. Any advice, tuition or instruction given. Activities not declared to the underwriters. The ownership, possession or use of any motor vehicle or trailer. The use of aircraft, hovercraft and boats/watercraft other than boats/watercraft which are less than 5 metres in length and on inland waterways. Deliberate acts. Liquidated, punitive, aggravated and exemplary damages including all fines and penalties. Employers Liability The indemnity limit is 10,000,000. The policy provides cover for but not limited to: 1,000,000 in respect of legal costs and expenses for each occurrence under the Corporate Manslaughter & Corporate Homicide Act 2007. Bodily injury to an employee arises out of and in the course of their employment. Bodily injury to an individual working on behalf of the business including volunteers and sub-contractors. Injuries and illness caused by terrorism up to a 5,000,000 limit. Professional Indemnity Insurance The indemnity limit is 250,000. The policy provides cover for but not limited to: Legal liability for any negligent act, error or omission which arises out of the exercise or conduct of your business. Legal liability for any negligent act, error or omission which arises out of the use of self employed or contract hire persons. Legal liability resulting from any advice, tuition or instruction given for a fee. Loss of or damage to documents. A fraudulent, criminal or malicious act by an employee or former employee. Equipment Insurance The cover will provide but is not limited to: Physical loss or damage to equipment owned by you. Replacement on a new for old basis. Cover for any item up to the value of 1,000. Cover for all items up to the maximum sum insured. Cover for loss of keys. Employers Liability Exclusions & Limitations Any liability arising from but not limited to: Bodily injury to anybody not classed as an employee. Bodily injury to an employee not arising from their employment. Bodily injury to an employee carried in or on any vehicle or getting on or off a vehicle. Bodily injury to an employee in circumstances which require insurance or security under any road traffic legislation. War and similar risks. Any bodily injury incurred within the jurisdiction of the USA or Canada, or any territory which operates under the laws of the USA and Canada. Professional Indemnity Insurance Exclusions & Limitations Any liability arising from but not limited to: Liability involving transport or property owned by you. Liability arising out of employment. The supply of goods. Any act, error or omission by you which is dishonest, fraudulent, criminal or malicious. Any contractual liability. Any claim made outside of the United Kingdom. Any injury, or illness to any third party. Any loss or damage to the property of a third party. Equipment Insurance Exclusions and Limitations Including but not limited to: The first 100 (your excess amount) of any claim. Loss or damage caused by wear and tear. Your Questions Answered Some important facts about our Sports Liability Insurance are summarised over the next few pages. This summary does not describe the full terms, conditions and exclusions of this policy which can be found in the policy document called the Guide to Your Sports Liability Insurance which is available on our website or upon request. Who provides the policy? Where the benefits in your policy are insured, different insurers may underwrite them. For clarity we have detailed which insurers underwrite the benefits you may have. The table below details which part of your policy is underwritten by whom. Public Liability Employers Liability Professional Indemnity Equipment Insurance W. R. Berkley Insurance (Europe), Limited General & Medical Finance Ltd is authorised and regulated by the Financial Conduct Authority (FCA). Issues relating to administration and sales provided by General & Medical Finance Ltd benefit from the Financial Ombudsman Service. What is the duration of my policy? With the exception of cover provided for Events & Camps, this insurance has a 12 month term. The term will be detailed within your Certificate of Cover. For annual policies, you will be sent renewal documents before your policy continues for another year. You should review the renewal documents to ensure that the cover and policy remains suitable for your needs. How can I pay my premium? Our preferred method of payment is annually or monthly by Direct Debit however you may pay your annual premium by debit/ credit card or by cheque. There will be a 1.5% charge for credit card payments although debit card payment will not be charged. Monthly payments are only available if your annual premium is over 250. Does it cost more to pay monthly? No. Unlike some other insurance companies General & Medical do not charge their clients extra, or any form of interest, to pay their premiums monthly. Will my premiums go up at renewal? Your premiums are reviewed annually and may reflect the cost of any claims or inflation. How do I make a claim on my Sports Liability Insurance policy? We make every effort to pass on as much detail as possible about this Insurance. This should enable you to make a preliminary judgement as to whether or not a claim is likely to be met. Tel: 020 7220 5330 Can I cancel my policy? Cooling off period: If you change your mind, where the period of insurance shown in the certificate of cover is 30 days or more, you may cancel your policy during a 14 day cooling off period. This period commences on the day your cover starts, or on receipt of your policy documentation, whichever is the latter. We will refund any premium you have paid at the date of your cancellation, providing no claims have been made. If you have incurred any eligible claims costs, we will require you to pay the associated costs and any return of premium is subject to this. After the cooling off period, the policy will remain in place for the period shown on your certificate of cover.please note: If the period of insurance is less than 30 days, the cooling off period will only apply for the period prior to the cover commencing. If you wish to cancel your cover at your renewal date you should tell us, as soon as possible before your renewal date. We will confirm to you, in writing the date on which your cover will cease, which will be the day immediately prior to your policy renewal date. A 14-day cooling off period also applies at renewal, commencement of which is from your renewal date. What do I do if I have a complaint? To avoid misunderstandings, you must read the information supplied when taking out your cover. If you are unsure about any aspect, you should contact us. We aim to provide a high level of service to all our clients but occasionally things can go wrong. When this happens we will do what we can to put things right. Complaints Procedure If you have any questions or concerns about your policy or our service you should, in the first instance, telephone our Client Relations Department on 0800 970 9442 or email info@generalandmedical.com. We will aim to address any concerns over the telephone within 24 hours. If you remain dissatisfied or if you have any questions or concerns about this document, or the handling of a claim which cannot be resolved by reference to your broker or intermediary then you should direct your enquiry to: The Quality Assurance Manager, General & Medical House, Napier Place, Peterborough, PE2 6XN. If you are still unhappy with any issue connected with the handling of your insurance policy or claim then you should direct Your enquiry to: W.R. Should your complaint relate to policy coverage or a claims decision, W.R. Berkley Insurance (Europe), Limited will acknowledge receipt of your complaint and tell you when you can expect to receive a further response. For complaints relating to the administration or sale of your policy, we will send you a written acknowledgement of your complaint within 2 working days and we will aim to resolve your complaint within 2 weeks. If your complaint is not resolved to your satisfaction within that time we will write to you again with the next steps we will be taking to resolve it. In the unlikely event that your complaint remains unresolved 4 weeks after being made, we will send you either our final response or a letter explaining why we are not yet in a position to resolve Your complaint and when we will be in contact again. In relation to General & Medical Finance Ltd, if after 8 weeks of making your complaint we have still not given you our final response we will write to you giving the reason for the delay and an indication of when we expect to be in a position to give you our final response. In any event, if after 8 weeks your complaint has not been resolved to your satisfaction, or we have not given you our final response, you may then be able to refer it to: The Financial Ombudsman Service, South Quay Plaza, 183 Marsh Wall, London, E14 9SR. In relation to W.R. Berkley Insurance (Europe), Limited, if your business has an annual turnover of less than 2m Euro and have less than 10 employees and you are not satisfied with the way in which a complaint has been dealt with, you may ask the Financial Ombudsman Service to review your case. The level and extent of any compensation depends on the nature of the contract and the circumstances of the claim. Which type of customer am I? Sports Clubs & Associations will typically be either a club providing facilities to members/non-members to partake in sporting and/or leisure activities on its premises or a club/group or association of clubs/groups who have members playing sport either on a competitive or non-competitive basis and are looking to take an annual policy. A Sports Coaching Business will likely be a Limited company, typically with employees, that provides coaching services to adults and/or children and are looking to take an annual policy. A sole trader or partnership providing the same services comes under Sports Coaches & Trainers.
