In order to effectively support attorneys working in many different areas of law, Coast Guard Legal Technicians should have a basic understanding of the sources of American law, the framework of the government, and its court systems. This learning module will introduce you to the following; the development of the American Legal System, the Constitution and Bill of Rights, the various parts of government, and the different court systems. This learning module is divided into four parts; reference, lesson, reading assignments, and a knowledge check assessment. NJS Online - Article 32 Investigating Officer This LAWgo covers Article 32 of the Uniform Code of Military Justice. Article 32 requires a thorough and impartial investigation before every general courtmartial. This LAWgo is designed to be a practical course for the Investigating Officer (IO), although any participant in an upcoming investigation may find the materials helpful. It gives a general orientation to the purpose and structure of the Article 32 investigation, from appointment of the IO, through the conduct of the hearing, and submission of the IO s report. It is meant as a companion course to the Article 32 Investigating Officer s Guide published by Naval Justice School. After using this LAWgo, you should: 1) Know and understand the foundational rules for the Article 32 investigation. 2) Know and understand the procedures for an Article 32 investigation.3) Know and understand the requirements for the Investigating Officer s Report. NJS Online - Introduction to Cyberspace Operations This is a four week course which provides an unclassified overview of Cyber Law and Cyberspace available to a majority of second and third tour judge advocates and a prerequisite to the Advanced Cyber Law Course offered by MARFORCYBER. NJS Online - Conferences This course will discuss Department of the Navy policies and procedures related to the organization and funding of official conferences. NJS Online - Defending the Mentally Ill This LAWgo will introduce various topics relating to successful practices and strategies in defending an accused who may have issues with respect to competency for trial. While aimed at defense services judge advocates with little or no experience in this area of practice, this lesson will also be a solid refresher for any judge advocate practicing military justice. The majority of this lesson focuses on the sources, case law and rules necessary to providing effective representation. Topics include: expert assistance, sanity boards, competency, negating mens rea, mental responsibility, sentencing and other relevant issues. This lesson will take 2-3 hours. NJS Online - Estate Planning Refresher This is a four unit course on estate planning. Students MUST have access to DL Wills software to participate in this course. The course will walk through basic estate planning, to include pre-residuary trusts, residuary trusts, SGLI, DD-93, health care powers of attorney, living wills, durable financial powers of attorney and creating blended family wills. Students will engage the subject matter through a combination of practical exercises, short video lectures, and will drafting, with an anticipated work load of 2-4 hours per unit. NJS Online - Ethics for Defense Counsel This is an introductory level course with focus on reinforcing the ethical responsibilities of a Defense Counsel (DC). The course will cover three topic areas: 1) dealing ethically with your client, 2) dealing ethically with the Court, and 3) working ethically with opposing counsel. It also highlights common mistakes made in practice and the consequences of failing in your ethical obligations. NJS Online - Ethics for Trial Counsel This is an introductory level course which focuses on reinforcing the ethical responsibilities of a Trial counsel (TC). While the civilian and military justice systems share many similarities, it is important that a Coast Guard Legal Technician understand the very distinct differences between the two. This learning module will provide you with a brief overview of the military justice system, the sources of law for the military justice system, the different types of courts-martial, and introduce you to the different individual roles within the system. This learning module is divided into four parts; references, lesson, reading assignments, and a knowledge check assessment. NJS Online - Law of The Sea This four-week course begins with a primer on the law of the sea and then moves into more advanced topics to include excessive maritime claims with exploration of the current tension in the South China Sea, the law of naval mining, and will conclude with anti-piracy operations. Instructors will include current and former professors from the Naval War College - Professor Raul (Pete) Pedrozo, Professor Sean Henseler, and CDR James Kraska, USN, JAGC. Students will learn about these topics through a combination of self-paced study, recorded lectures, academic articles, and exams. NJS Online - LN Mid-Level INSTRUCTOR APPROVED: This four-week online course is designed to increase the skill and professional efficiency of military paralegals of the Department of the Navy. Specific areas of instruction include freedom of expression, search and seizure, absence offenses, Freedom of Information Act, legal assistance, charge sheet preparation, and adminstrative separations. Prerequisites: This course is open to second-tour Legalmen in paygrades E-5 and E-6. NJS Online - LOS Excessive Maritime Claims This LAWgo is a 2-3 hours course covering Excessive Maritime Claims with a case study of the South China Sea and China's claims. NJS Online - LOS Piracy This LAWgo will be a 2-3 hour course covering LOS regarding Piracy with a focus on the Horn of Africa, Somalia, Gulf of Aden, and Bab el Mandeb. NJS Online - MRE 201 - Judicial Notice This LAWgo will provide a basic refresher to the rules governing Judicial notice of adjudicative facts during a case. This is not intended as a full course of instruction, but will provide a foundation for further training on the basic requirements for and correct usage of judicial notice. After using this LAWgo, you should: 1) Know what types of facts can be judicially notices under the rule. 2) Understand the basic requirements for requesting judicial notice. 3) Identify issues associated with litigation involving Judicial Notice. NJS Online - MRE 702 & 703 Working with Experts This LAWgo will provide a basic refresher to the rules governing the qualifications and uses for experts during a case. This is not intended as a full course of instruction, but will provide a foundation for further training on the correct usage, proper acquisition, and effective direct and cross examination of expert testimony. After using this LAWgo, you should: 1) Know the rules about obtaining and presenting experts. 2) Understand the basic differences between expert consultants and witnesses and the uses for each. 3) Identify issues associated with litigation involving expert consultants and witnesses. NJS Online - Military Spouses Residency Relief Act (MSRRA) This course will outline the protections afforded to military spouses under the MSRRA, and provide practical guidance for invoking those protections. NJS Online - Multi-Week Survey NJS Online - Naval Mining INVITATION ONLY: This is a three month follow up survey course for the Naval Justice School's multi-week instruction. This LAWgo is a 2-3 hours course and provides an overview of the legal aspects of Naval Mining with special emphasis on Iran and the Straits of Hormuz. NJS Online - Non-Federal Entities and Outside Activities NJS Online - NJP for the Staff Judge Advocate This course will discuss Navy policies and procedures for interacting with Non- Federal Entities, as well as the rules for personnel engaged in activities outside of DoD. This course will discuss the rules governing Article 15 hearings and Non-Judicial Punishment, and the SJA's role in the process. NJS Online - Notary Certification Process This self-paced course contains the training necessary to complete the Navy's notary certification requirements. To obtain certification, students must score at least a 75 on the assessment. You will have two opportunities to pass the assessment, and you may use any resource you like in taking the test. NJS Online - OJAG Organizational Structure Overview This course is a prerequisite for attendance of the O-4 Leader Development Course. This period of instruction will give you a brief overview of the organizational structure of The Office of the Judge Advocate General of the United States Navy. This provides a foundation for understanding the fundamentals. NJS Online - Sexual Assault - Initial Disposition Authority This block of instruction provides a basic overview of the Sexual Assault Initial Disposition Authority (SA-IDA) requirements for the Navy and the Marine Corps. This course will review the limitations put in place on O-5 commanders and will emphasize which offenses must be forwarded to the SA-IDA for disposition. After using this LAWgo, you should: 1) Understand which offenses cannot be disposed of by an O-5 commander and which ones must be forwarded to the SA-IDA; 2) Understand the key differences between the Navy and Marine Corps SA-IDA withholding requirements. NJS Online - Ethics for the SJA Part I This is a four-week, introductory level examination of ethics issues that attorneys routinely encounter while serving as Staff Judge Advocates (SJAs) or command services attorneys. Students will engage the subject matter through a combination of assigned reading, short video lectures, and discussion board participation, with an anticipated work load of two (2) to four (4) hours per week. The course is primarily intended for Judge Advocates currently serving in or transitioning to designated Ethics Counselor billets, or working in support of a designated Ethics Counselor. It will serve as a building block for future online ethics courses of instruction. NJS Online - Introduction to Article 31, UCMJ - USCG but has been made available to all users as a stand alone lesson. As a Coast Guard Legal Technician, it is important to understand the purpose and function of Article 31 of the Uniform Code of Military Justice (UCMJ). More specifically, knowing the importance of Article 31(b) rights and the effects these rights can have on a case can prove to be invaluable to your legal office. This learning module will give you a brief overview of Article 31, UCMJ and additional sources of law that work hand in hand with it. In addition, this lesson will introduce you to when these rights must be read, who must warn of these rights, and procedures to follow when these rights are invoked.
