A glossary of terms used in this guide The information contained in this guide relates to the admission of children to reception classes for the 2015/16 academic year. It also applies to children who will transfer from infant school to junior school in September 2015. Nursery schools generally cater for children between the ages of three and four. Within the primary phase of education, there are three types of school: Infant schools generally cater for pupils aged between five and seven. However, if the school has a nursery unit, it will cater for pupils aged between three and seven. Junior schools cater for pupils aged between seven and 11. Primary schools generally cater for pupils aged between five and 11. However, if the school has a nursery unit, it will cater for pupils aged between three and 11. Community and voluntary controlled schools are funded by Derbyshire County Council with the headteacher and governing body responsible for running the school. The admissions policy is determined and administered by the county council. Voluntary aided schools are jointly funded by Derbyshire County Council and a voluntary organisation, usually a church diocesan board. The headteacher and governing body run the school. The admissions policy is determined and administered by the governing body. Catholic schools are voluntary aided schools. Foundation schools are funded by Derbyshire County Council but responsibility for running the school rests with the headteacher and governing body. The admissions policy is determined and administered by the governing body. Academies are funded directly by central government and responsibility for running the school rests with the headteacher and academy trust. The admissions policy is determined and administered by the academy trust. All of the above schools are called mainstream schools. Enhanced-resource schools are mainstream schools with additional resources, such as extra staff, for certain children with Statements of Special Educational Needs or an Education, Health and Care Plan. Pupils are not generally taught separately and are included in the mainstream classes. Special schools are attended by children with Statements of Special Educational Needs or an Education, Health and Care Plan. Special schools provide for pupils whose disability requires a more comprehensive approach than a mainstream school or an enhancedresource school can provide. Some experience of mainstream school may be possible. The council handles admissions for all special schools. The normal area is a defined geographical area, made up of the area around the school, which the school serves. You will be advised of your normal area school if you apply online or by phone. Alternatively, you can enter your postcode into an interactive tool on our website, www.derbyshire.gov.uk/admissions to find out what your normal area school is. You can also find out from the Admissions and Appeals Team by emailing admissions@derbyshire.gov.uk or ringing the Admissions and Appeals Team on 01629 537479. School normal area maps can be viewed via Search for a School at www.derbyshire.gov.uk/education/schools_colleges If you consider your child Catholic, it means he or she is also resident in the normal area of a Catholic school. If you are unsure about your child s status regarding the Catholic school serving your area, contact the diocese for advice. The number is on page 4. We use the word parent throughout the guide. It means anyone who has a parental responsibility in accordance with the terms of the Children Act 1989. A few children with special educational needs require a detailed assessment by us. This was called a statutory assessment of special educational needs, however from 1 September 2014 it will be called an education, health and care needs assessment. The child s requirements are set out in a document called a Statement of Special Educational Needs / Education, Health and Care Plan. The council is not presently able to write to parents reminding them of when their child should start school. If you are a parent living in Derbyshire, excluding Derby city, the information contained in this guide explains how you can apply for a primary school place for your child whether that school is in or outside Derbyshire. If you are requesting a place at a school outside Derbyshire we will send the form to the neighbouring council for consideration and liaise with them through the process. The decision on whether the child can be offered a place will be taken by the council which runs the school, or the governing body if it is a voluntary aided, academy or foundation school. You may want to check with the school s home council how places are allocated in that area. This does not include independent schools. Similarly, if you live outside Derbyshire but want your child to attend a Derbyshire school you should make the application through your home council who will liaise with us. Even if you have already approached a school or feel you have put your child s name down at a school that is not a formal application. A formal application can only be made by following the process explained in this guide. We invite you to state preferences for any three schools and give your reasons. Make sure your application is in by midnight on 15 January 2015. Obtaining a place for your child in a primary school How does it work? You fill in one application only, no matter how many schools you want to apply for. There is no need to fill out a separate application for each school. Only make one application online or by phone. Derbyshire County Council acts as a clearing house for admitting all Derbyshire pupils to primary, infant and junior schools. Transfer from infant to junior school When children are due to leave infant school and need to move to a different school for their junior education, parents must make an application. A place in a particular infant school does not guarantee a place at the associated junior school. Similarly, a place at a particular junior or primary school does not guarantee a place at a particular secondary school. The closing date for parents to return forms is midnight on 15 January 2015. Applications are needed from all parents, including those who want their child to attend their normal area school. Please note there is no automatic right to a place in any particular school, even where a child lives in the normal area of a school, has a sibling in attendance or attends an associated primary school. Supplementary Forms Some voluntary aided, academy and foundation schools may want you to fill in supplementary forms or provide documentation in addition to an application you make to us. Look at the school s brochure to see if this is the case. This is so that they can apply their own admission criteria. For example, they might want proof of your address or proof that your child has been baptised. Supplementary forms are available from the relevant school and also from Derbyshire County Council, including online. Any additional paperwork of this type should be returned to the school by the closing date. This supplementary paperwork is not instead of our application form. You will still need to make an application to us. Special Educational Needs If your child has a Statement of Special Educational Needs or an Education, Health and Care Plan his or her admission is dealt with through the statement. You will fill in one application form either online or by phone on which we invite you to state three preferences for any primary, infant or junior school. We ask you to put your preferences in priority order, with your most preferred school first. The closing date is midnight on 15 January 2015. All applications are considered against each school s published admission number (the number of places available in the year group). If there are more applications than there are places available at a school, places will be allocated according to the school s published admissions criteria. If a child can be offered a place at more than one school, then a place will be offered at the highest priority school possible. We will offer you one place only. If you apply online your offer will be emailed on 16 April 2015 or you can log on to get the result. If you don t have an email address your offer will be posted second class on 16 April 2015. For more information on admissions policies for community and voluntary controlled schools see pages 11 to 13. Voluntary aided, academy and foundation schools decide their own policies. See pages 54 to 69. We will post your offer second class on 16 April if you have no email address. 15 May 2015 Requested date for submitting an appeal in relation to Derbyshire schools if you are not happy with the school allocated to your child. 17 July 2015 Appeals normally heard by this date. How to apply From 10 November 2014 you can apply online at www.derbyshire.gov.uk/admissions. If you do not have access to the internet, you can apply by ringing Call Derbyshire on 01629 533190. You only make one application online or by phone. You are invited to state three preferences. Please note, if you apply online or by phone, your application will be acknowledged automatically. Need help? If you wish to access independent advice or information on school admissions or appeals you can contact Coram Children s Legal Centre at www.childrenslegalcentre.com or call 08088 020 008. Applying online We prefer you to make your application online which means you need not wait for the post before finding out which school your child has been offered a place at. If you have applied online we will email you with the outcome and you can view your offer online on 16 April. Log onto www.derbyshire.gov.uk/admissions and you will find the online application form. This will be made available from 10 November 2014 until the deadline of midnight on 15 January 2015. The system will then close for a short period after this date and time and then re-open to accept late applications. Internet access is available free of charge at all Derbyshire libraries and children s centres. Some schools may also let you apply online using their computers. The online application form will enable you to make your application and send it to us immediately. You will receive confirmation that your application has been received. Even after you have made your application you will be able come back and make amendments at any time up until the deadline. The advantages of making your application online are that you have the assurance that your application has been received and you will also be able to keep a record of the application you made. When you apply online, you will need to give a username and password. Online applications will be issued with a unique identification number. Please make a note of these details. The process should be easy to follow but if you have any problems you can ring the Admissions and Appeals Team on 01629 537479 or make a telephone application. What information will I need to hand when I m applying by phone? You will need to have made a decision about the three preferences we invite you to make and your reasons. Your child s full name. Your child s date of birth. Your child s address and postcode. Why should I apply by phone? It s quick and easy to do usually around 15 minutes to complete a telephone application. Call centre staff can make sure the application is filled in correctly. Calls will be recorded as part of our commitment to training, audit and quality assurance. Call charges may vary and calls from mobile phones may cost considerably more. You will receive a copy of your completed application form either by email or in the post. If you want to change your mind you can phone Call Derbyshire, quoting your user name, password and unique identification number, and amend your application up until the call centre closes on 15 January 2015. Important points Get your application in on time via the internet or call centre. If you miss the deadline we will not be able to consider your application until the ones that we received on time have been dealt with. Don t name the same school more than once as a preference this will not increase your chances of a place. We will withdraw a school place where false information has been used to secure an offer. Think about listing your normal area school. You may want to consider including the normal area school as one of your preferences, though it does not have to be your first preference. If you do not include the normal area school as one of your preferences, it may fill up with pupils who have said they would prefer to go to that school. This could mean the only school with available places may be further away and could mean you have to pay for transport to a distant school. If you do not make an application you cannot assume your child will get an automatic place at your normal area school. We will first offer places to those who have expressed a preference. If you do not make an application we will only be able to give your child a place at your normal area school if places are still available. If your normal area school is full we will give your child a place in the nearest school which has room. This could mean you paying transport costs to a distant school. Consider how your child will get to school when making your preferences. You are responsible for getting your child to school. If your child gets a place at a distant school, this could mean that you pay transport costs. Details of the transport policy are on page 16. Read these carefully before deciding your preferences. Only make one application online or by phone. Late applications received after the closing date will be included only if the reason for the delay is considered exceptional and appropriate evidence has been provided. Other late applications will not be considered until after applications received by the closing date have been dealt with. Who decides the rules? In community schools and voluntary controlled schools, Derbyshire County Council decides the rules for getting places. In voluntary aided Church of England, Catholic and Methodist schools, as well as foundation and academy schools the governors decide admission rules for their school. The rules are known as admissions criteria. Under the 1996 Education Act, you have a legal right to express a preference for which school you want your child to attend. The county council and school governors have a general duty to meet this preference as long as it does not prejudice the provision of efficient education or the efficient use of resources or the council or governors are required to take extra measures under the Key Stage 1 class size legislation. Even if your child attends a nursery class at a school or co-located children s centre you must make a new application for a reception place. Children do not transfer automatically. Similarly, a new application must be made for transfer from infant to junior school. Parents should be aware that some junior schools do not have sufficient places to admit all pupils from the local infant school. Attendance at a particular nursery gives no priority for a place at an infant or primary school. Similarly, attendance at a particular infant school gives no priority for admission to a particular junior or primary school, except in Eckington. In law there is no automatic right to a place in any particular school. We will offer you one place at the highest priority school possible. Where we cannot offer a place at any of your chosen schools your child will be allocated a place at the normal area school if places are still available or the next nearest school with places available. The rules for getting a place at a Derbyshire school on request up to their published admission number (as shown in the list at the back of the guide) which takes account of the amount of accommodation available. In the case of offers for places in schools in neighbouring councils, they make the decision and we make the offer on their behalf. Admissions criteria Community and voluntary controlled schools Individual pupils who have a Statement of Special Educational Needs or an Education, Health and Care Plan which names the school will be admitted. In deciding on admissions to all community and voluntary controlled schools in Derbyshire, the following order of priority will be adopted. Different rules apply in Eckington and part of the Long Eaton area. These rules are set out below and on the next page together with a list of the schools to which they apply. 1. Looked after children and children who were looked after but ceased to be so because they were adopted (or became subject to a residence order or special guardianship order). 2. Children living in the normal area* served by the school at the time of application and admission who have brothers or sisters attending the school at the time of application and admission. 3. Children living in the normal area served by the school at the time of application and admission. 4. Children not living in the normal area served by the school but who have brothers or sisters** attending the school at the time of application and admission. 5. In the case of voluntary controlled church schools, children whose parents request a place on religious grounds.*** 6. Other children whose parents have requested a place. When in the case of 2, 3, 4, 5 or 6 above, choices have to be made between children satisfying the same criteria, those children living nearest to the school (measured by the nearest available route) will be given preference.**** APPLYING FOR A PLACE You should bear in mind that school admissions for children starting school for the first time and for children transferring from infant schools to junior education are considered on an annual basis so it is not possible to confirm that a place is available at a school before 16 April in the year before your child will join. Each year primary schools have to admit eligible pupils Eckington Area The admissions criteria for schools in the Eckington area are as follows: Eckington Birk Hill Infant and Killamarsh Infant, Marsh Lane Primary, Ridgeway Primary and Renishaw Primary Schools. As in all community and controlled schools, individual Page 10 Page 11

pupils who have a statement or education, health and care plan which names the school will be admitted. (i) Looked after children and children who were looked after but ceased to be so because they were adopted (or became subject to a residence order or special guardianship order). (ii) Children who have brothers or sisters** attending the school at the time of application and admission. (iii) Other children whose parents have requested a place. If there is insufficient room to admit all applicants, those children living nearest to the school measured by the nearest available route would have priority.**** Eckington Junior and Killamarsh Junior Schools (i) Looked after children and children who were looked after but ceased to be so because they were adopted (or became subject to a residence order or special guardianship order). (ii) Children attending these schools main contributory infant schools (Birk Hill Infant and Killamarsh Infant) and who have brothers or sisters** attending the school at the time of application and admission. (iii) Children attending these schools main contributory infant schools (Birk Hill Infant and Killamarsh Infant) at the time of application. (iv) Children whose parents have requested a place at the school who have brothers or sisters attending the school at the time of application and admission. (v) Other children whose parents have requested a place. When in the case of (ii), (iii), (iv) or (v) above, choices have to be made between children satisfying the same criteria, those children living nearest to the school (measured by the nearest available route) will be given preference.**** Parklands Infants and Harrington Junior (Long Eaton) The admissions criteria for these schools are as follows: As in all community and controlled schools, individual pupils who have a statement which names the school will be admitted. (i) Looked after children and children who were looked after but ceased to be because they were adopted (or became subject to a residence order or special guardianship order). (ii) Children living in the normal area served by the schools at the time of application and admission who have brothers or sisters attending the schools at the time of application and admission. (iii) Children living in the normal area served by the schools at the time of application and admission. (iv) Children not living in the normal area served by the schools but who have brothers or sisters attending the schools at the time of application and admission. (v) Other children whose parents have requested a place. When in the case of (ii), (iii), (iv) or (v) above, choices have to be made between children satisfying the same criteria, those children living nearest to the school (measured by the nearest available route) will be given preference. Definitions * Living in the normal area, is defined as the child having settled residence in a property which is the child s only or main residence. Documentary evidence including proof of residence at the property concerned may be required e.g. council tax/utility bills, sale/rental agreements. The County Council reserves the right to withdraw any offer of a school place which has been obtained as a result of misleading or fraudulent information. Please note a place cannot be guaranteed for any child, even those living in a school s normal area (or, in the Eckington area, attending a contributory primary school). **The term brother or sister includes: (a) a half-brother and/or a half-sister (b) a legally adopted child being regarded as a brother or sister (c) a step-brother and/or step-sister residing in the same family unit ***Parents seeking a place at a voluntary controlled school on religious grounds need to have a supplementary form completed by a Minister, Priest or Pastor or Religious leader if the child is a member of another Christian Church or world Faith, who know the family and can confirm regular attendance at public worship (Regular worship is defined as attendance at public worship at least once a month). The form is available from the Admissions and Appeals Team or online and should be returned to the Admissions and Appeals Team. Baptismal certificates, where appropriate, should also be supplied. Exceptional circumstances will be considered if explained in writing by the relevant religious leader. ****Route Measurement The Children and Younger Adults Department has a Geographic Information System (GIS) to measure the nearest available route. It is measured by a standard walking distance calculated to within two metres. This measurement is taken from the postal address file, normally the house front door. For schools the grid reference is taken from the postal address file and will normally be the centre of the school. Footpaths that are known and assessed as suitable by the Council when places are allocated will be used in distance calculations. Please note that not all footpaths are recorded on the GIS system, and not every route is assessed as suitable. If you are seeking to rely on a minor footpath or a newly developed route as your nearest available route, you may wish to check that the route is one recognised by the County Council for school admission purposes. Routes brought to the attention of the Council will be added to the GIS system if they are assessed as suitable. However, new routes recognised after school places have been allocated during a normal admissions round will not be taken into account during the same admissions round. Residence in all categories The home address used for school admission purposes is the address where the child is residing at the time of both application and admission. Where an application includes more than one address due to shared parental responsibility, we will use the address where the child resides for the majority of the school week (where they usually or mainly sleep between Monday and Friday). Parents and carers are required to submit full details with supporting information to enable us to determine which address to use for the purpose of admission. Where parents provide evidence that the child resides equally at both addresses during the school week, and we are unable to reach a decision based on the information received, parents will be asked to notify the Council of the mutually agreed address to be used for the purpose of school admissions. Please note the same address will be used in the assessment of eligibility for home to school transport assistance. Where the county council has reasonable grounds for believing the home address is not the child s only or main residence it reserves the right to carry out investigations which may include visits to the property. What to do if both parents cannot agree on the school(s) to be applied for Parents are expected to consult with each other and agree on the school(s) for which they wish to express a preference. The Council is unable to investigate whether applications have been agreed, or to resolve disagreements between parents. In the absence of agreement between parents the Council will process the preference of the parent who has care of the child for the greater part of the school week (see definition of residence). In cases where the Council is unable to determine the home address (see definition of residence), and/or there is no parental agreement or Court Order, the Council will be unable to process the application further until the matter has been resolved. Parents are encouraged to resolve disagreements as soon as possible, as delays may affect the availability of places at preferred schools. Once a school place has been offered, any disagreement on the child s placement will be a matter for parents to resolve. Voluntary aided, academy and foundation schools The criteria for admissions to aided, academy and foundation schools are decided by each school s governing body and are listed briefly on pages 54 to 69 of this guide. Full details can be obtained directly from the school. Withdrawing an offer For admission procedures to be fair it is important that all the information you provide is accurate. If we find that any information provided by parents is misleading or fraudulent, the county council reserves the right to withdraw any offer of a school place. Children of multiple births Where the final place to be allocated within the Published Admission Number would separate children of multiple births a place(s) will also normally be offered to the other child/children. What to do if I have changed my mind about the school I want my child to attend You can change your mind easily as long as it is before the deadline on 15 January 2015. If you have made an online application just log on and amend your form. If you have made an application by telephone you must contact Call Derbyshire on 01629 533190. But if you change your mind after the deadline preference changes will only be accepted where the council agrees there is good reason for doing so, for example a change of address. Supporting evidence may be required. You should be aware that whilst a change in your preference order may be accepted by the council, dependent on the point it is received in the allocation process it may not be possible to action the change until after the offer date, particularly if the change involves a school(s) in other council areas and preference information has already been exchanged. You should also bear in mind that if you wish to add a new school to your preferences this may be treated as late. If you do change your mind after the deadline you must either email the Admissions and Appeals Team on admissions@derbyshire.gov.uk or call them on 01629 537479. My circumstances have changed, such as change of address or change of current school If you or your child s circumstances change, such as a change of address or a change of current school, you must contact the Admissions and Appeals Team immediately by emailing admissions@derbyshire.gov.uk or by calling them on 01629 537479. Changing your child s school at other times You may want to apply for your child to change schools other than when they are due to start primary, junior or secondary education. This could be because of a change of address. These are known as in-year admissions. In-year applications for admission to school Changing a child s school is a very important step to take; it can affect your child in many ways. Guidance notes are provided by the council to help you through the in-year application process. It is important to read the notes before completing an application. If you want to apply for a place at a school in Derbyshire you can do this online at www.derbyshire.gov.uk/admissions If you cannot access the internet you can apply by phone by ringing Call Derbyshire on 01629 533190. Internet access is available at all Derbyshire libraries, Children s Centres and some schools may also let you use their computer and telephone facilities to make an application. You may also complete a paper application form. To obtain a paper form, email admissions@derbyshire.gov.uk or phone the Admissions and Appeals Team on 01629 537479 and ask for an in-year application form. Alternatively, some schools in Derbyshire will accept approaches direct, but may still require you to complete the council s application form. Please note schools are required to notify the council of all applications and their outcomes. lf you want to apply for a place at a school in another council area you should contact the council where the school is located in the first instance. Contact details are on page 70 of this guide. For children with statements of special educational need or an Education, Health and Care Plan parents should contact the SEN Section at County Hall on 01629 536539 or email sen.admin@derbyshire.gov.uk. How does it work? The law enables parents of children seeking a school place to express preferences. Parents should note that admission authorities cannot necessarily guarantee a place for any child, even where they move into the school s normal area. In law there is no automatic right to a place in any particular school. You are invited to name 3 schools at which you wish your child to be considered for a place. You should think very carefully about your choice of school(s); these should then be listed in priority order (i.e. beginning with your most preferred school). It is advisable to consider including your child s normal area school as one of your preferences though it does not have to be your first preference. The Council operates a Fair Access Protocol (available at www.derbyshire.gov.uk/admissions) to ensure that children without a school place who find themselves in challenging circumstances are admitted to school as quickly as possible. Do schools have waiting lists? For primary and junior transfer applications, waiting lists will be maintained by Derbyshire County Council for oversubscribed Derbyshire schools. Waiting lists will be set up on 16 April 2015 and maintained until 20 December 2015. Children s names will automatically be placed on these lists where it has not been possible to offer a place and they have given this preference a higher priority than the school at which they have been offered a place. A vacancy arises only when the number of offers to a particular school falls below the published admission number (PAN) or, in cases where an admission authority has offered places above the PAN, when offers fall below the revised number. (This excludes places secured through the appeals process). Priority on the waiting list is determined according to the published admission criteria. This means that a child s position on the list is not fixed and can go up or down the list as vacancies arise and/or further applications are received. The date of application does not affect waiting list order. Some voluntary aided, foundation and academy schools may maintain waiting lists beyond this date. Please check with the school concerned. Some neighbouring councils have different rules on waiting lists. Please check with them if applicable. The Council does not maintain waiting lists for in-year admissions for community and controlled schools. Some voluntary aided, academy and foundation schools in Derbyshire and schools in other council areas may maintain waiting lists for in-year admissions and if your application is refused you should contact the school to place your child s name on the waiting list. If you wish to place your child s name on the list for a Derbyshire school for the next academic year you will need to make a new application in the term preceding the new academic year to update their application details and confirm your continuing interest. Priority on the waiting list is determined according to the school s oversubscription criteria. A list of neighbouring councils is given on page 70. Appeals When parents are unable to obtain a place for their child at the school they want, they can appeal against the decision to an appeal panel independent of the council and the school. Appeals in the primary and junior transfer round will normally be heard by 17 July 2015 and for in-year admissions will be held within 30 school days of the appeal being lodged. Alternatively you can contact the Admissions and Appeals Team by emailing admissions@derbyshire.gov.uk or ring 01629 537499. For appeals in respect of places at schools not in Derbyshire, parents are advised to contact the council which maintains the school in the first instance. A list of neighbouring councils is on page 70. The decision reached by the independent panel will be binding on the council and the parents. A further application in respect of the same school will not be entertained in the same academic year unless significant and material changes in circumstances arise. Infant (Key Stage 1 and Foundation) Appeals By law, subject to certain limited exceptions, no infant class may contain more than 30 pupils. Infant classes are those in which the majority of pupils will reach the age of five, six or seven during the school year. Admissions authorities can refuse to admit a child if to do so would require the school to take action such as employ an extra teacher or build an extra classroom to keep infant classes at 30 or less. Parents can appeal in this situation but the appeal panel can only uphold an appeal in limited circumstances. The panel must dismiss the appeal where: a) it finds that the admission arrangements complied with admissions law and were correctly and impartially applied; or b) it finds that the admission arrangements did not comply with admissions law or were not correctly and impartially applied but that, if they had complied and had been correctly and impartially applied, the child would not have been offered a place; and it finds that the decision to refuse admission was one which a reasonable admission authority could have made. The threshold for finding that an admission authority s decision to refuse admission was not one that a reasonable authority would have made is high. The panel will need to be satisfied that the decision to refuse to admit the child was perverse in the light of the admission arrangements i.e. it was beyond the range of responses open to a reasonable decision maker or a decision which is so outrageous in its defiance of logic or of accepted moral standards that no sensible person who had applied his mind to the question could have arrived at it. How will my child get to school? Transport to the normal area school We provide assistance with transport for full-time infant, junior and primary school pupils who do not live within two miles walking distance of their normal area school. It is measured by the shortest available route. Bus passes or refunds are issued where appropriate and special contract transport is arranged if public transport is not available. There may be exceptions to the transport rules if we agree that the route to the normal area school is hazardous for a child, accompanied if necessary, to undertake on foot. Spare places on a contract bus may be provided on a concessionary basis for children who are not normally entitled to free transport, however a charge will be made of 325 per academic year. Transport to faith schools The provision of subsidised transport to faith schools will cease in September 2015, with protection offered to pupils in key years i.e. those entering Year 6 and Year 11 in 2015 who were previously entitled by right to assistance. Spare seats will be available to all pupils on this transport and will be sold on a first come first served basis. The contribution charge for these seats will be consistent with other charges for local authority provided transport. In September 2015 this will be 325 per academic year for a primary pupil. Transport to other schools For more information please refer to our transport policy available on www.derbyshire.gov.uk/get2school Transport for pupils with special educational needs and/or disabilities Transport will be provided for pupils with special educational needs and/or disabilities who attend their nearest school, where the journey exceeds the statutory walking distances as outlined above or in other cases in accordance with the council s special educational needs transport policy. Provision of transport will not generally be made if the preferred school is further away from the child s home than another school considered appropriate by the council. If a parent s request for help with transport is refused and they feel that they may have special family circumstances which warrant help, then they can ask for the decision to be reviewed. The review will give the opportunity for the parent to state the particular reasons they feel their child should receive help with transport. Sustainable modes of travel As part of our Sustainable Modes of Travel Strategy the authority is actively supporting all schools in encouraging children and parents to make less use of the car for the journey to and from school and to consider walking, cycling and use of public transport as viable alternatives. School travel plans have now been adopted by all schools in Derbyshire and, through their implementation, the authority will continue to provide this support. From September 2014 all pupils in Key Stage 1, Reception, Year 1 and Year 2 will be offered a Universal Infant Free School Meal which will be funded by the Government. As well as this all pupils, regardless of their age, whose parents receive the following support payments are entitled to receive free school meals: Income Support Income Based Jobseeker s Allowance Income Related Employment and Support Allowance support under part VI of the Immigration and Asylum Act 1999 the guarantee element of State Pension Credit Child Tax Credit, provided they are not entitled to Working Tax Credit and have an annual income (as assessed by HMRC) that as of 6 April 2014 does not exceed 16,190. Children who receive Income Support or Income Based Jobseeker s Allowance in their own right are also entitled to receive free school meals. As well as the pupil receiving a free school meal the school will also qualify for the Pupil Premium which provides additional funding for the school. ADDITIONAL INFORMATION Parents who send their children to a school which is not their normal area school will not normally receive assistance with transport (children living outside the county attending Derbyshire schools should apply to their home council). However, assistance with transport will be provided when a child attends a school, other than the normal area school, which is beyond the two mile limit but is closer to the child s home than the normal area school. Early years education All children have the right to a free early years education place in the term* following their third birthday, subject to the availability of places. Free places are available for up to 15 hours per week over a minimum of two days and may be taken with one or two early years providers. Providers should, where reasonably practicable, be flexible in how they offer the free entitlement. Some providers will be able to offer additional hours for which parents will be charged, but no parent will be obligated to do this. Free early years education funding is also available for eligible two year olds the term following their second birthday in some schools and many day nurseries, pre schools and childminder settings. If the household income is less than 16,160 a year and/or parents are on certain benefits, children can access up to 15 hours per week with an early years provider. Some parts of Derbyshire provide council-run nursery schools or classes. Children may be considered for a place on a part-time basis of up to 15 hours per week, but usually they cannot join until the start of the term following their third birthday. Parents should contact the head teacher of the relevant school or setting which they wish their child to attend. If too many places are requested in council-run schools or nurseries, governors will use the following order of priorities: 1. Children in care, or who have a safeguarding plan. 2. Children living in the normal area served by the school at the time of application and admission (including those living in another council s area). For a definition of living in the normal area see note * on page 12. 3. Children not living in the normal area served by the school but who have brothers or sisters attending the school at the time of application and admission. See note ** on page 12. 4. Other children whose parents have requested a place. Where, in the case of 3 or 4 above, choices have to be made between children satisfying the same criteria, those children living nearest to the school (measured by the nearest available route) will be given preference. See note **** on page 12-13. Please note: Parents have no automatic right to a nursery place for their child in their normal area school. Parents should not be allocated places in more than one council-run school for their child. The rules on admissions and appeals, as explained on pages 11 to 13, do not apply to nursery schools and classes. If a child cannot be admitted to a nursery class at their parents preferred school they should make representations to the headteacher in the first instance. Providers of nursery education should adopt an inclusive approach, promoting equality of opportunity, particularly to the most disadvantaged, children in care and children with a disability or special need. *Term 1: September December Term 2: January March Term 3: April August Transferring from early years to primary education Primary education Children who have received early years provision or attended a council run nursery school or class will normally go into full time infant education in September in the school year in which they become five years old. A place in a school s nursery class or co-located chiidren s centre childcare setting does not guarantee a reception place, a new application must be made for a reception place. By law, you must arrange for your child to start school full time at the beginning of the term (in this context, a term is as detained in legislation, see below) after his or her fifth birthday unless you make arrangements to educate your child otherwise than at school. All children are eligible for a full-time place in the September following their fourth birthday. On the offer of a place you have the right to defer admission until your child reaches statutory school age, provided the place is taken up within the same academic year. You can also request that your child attends part-time until they reach compulsory school age. If your child is summer born (i.e. born between the beginning of April and end of August) and you do not take up a reception place in the academic year and choose to make an application for the following September, the application will normally be considered for admission into year 1. Exceptionally, if your child is summer born and you do not feel they are ready for school you can request that they enter reception class in the September after their fifth birthday. If you are considering this option you should in the first instance discuss it with your child s pre-school provider, prospective future headteacher and any other professionals involved as soon as possible. If after discussion you then wish to make a formal request you should contact the Admissions and Appeals Team for a copy of the Council s policy on the admission of children outside of their normal age group by emailing admissions@derbyshire.gov.uk or call 01629 537479. Requests should be submitted in summer term 5 preceding the year of admission and will need to be accompanied by evidence to show that delayed admission into reception would be in the child s best interests. All relevant factors will be considered when assessing requests against the Council s policy on the admission of children outside of their normal age group. Please note that if a request is not agreed then a place may be offered in year 1. Note In this context term relates to one third of the academic year i.e. autumn, spring and summer. Parents should note that we operate a six term year for example Derbyshire s autumn term one and two are equivalent to one term as defined in legislation. Don t forget you can look at our glossary if there are any terms you are unsure of the meaning of. Children s centres Derbyshire has 54 children s centres across the county. These provide a range of services to children under 5 and their families. This includes the provision of early years education with day care in some centres as well as a range of services including family support, health access and links to Jobcentre Plus, training and adult education. Extended services childcare Many schools now offer before and after school activities for which there is a small charge. This can either be delivered by the school or by a partner organisation. Children with special educational needs The term special educational needs is used when children have a learning difficulty or disability, which makes it harder for them to learn than most children of the same age. A child with special educational needs may need extra help or different help from other pupils of the same age. Only a few children with special educational needs require a detailed assessment by us. This assessment was called a statutory assessment of special educational needs, however from 1 September 2014 it will be called an education, health and care needs assessment. Following education, health and care needs assessment, the Council may decide to issue an Education, Health and Care Plan which describes your child s needs and how they should be met. It also gives you the opportunity to express a preference for which school your child should attend. More information about our provision for special educational needs is available on www.derbyshire.gov.uk or www.derbyshiresendlocaloffer.org It is Derbyshire s policy to meet children s needs, wherever possible, in mainstream schools including those schools with enhanced resource status. Most children with statements of special educational needs or Education, Health and Care Plans will be educated in mainstream schools, but places at enhanced resource and special schools are given to some pupils with statements. For school places for children with a current statement of special educational needs or an Education, Health and Care Plan parents should contact the Special Needs Section of Derbyshire County Council on 01629 536539 or email adminsupport.sen@derbyshire.gov.uk Placing a child outside their normal age group The year group with which a child is taught has implications for a child s social as well as educational development. We believe it is better for children to stay within their peer group. For children whose attainments either fall significantly below or exceed the expected levels at a particular key stage, the Council considers that in almost all cases a child s individual needs can be met by schools without accelerated or delayed admission to another year group. Exceptionally a child may be admitted outside of their normal year group. Such a decision will be based on the circumstances of each case and before making a formal request parents are strongly advised in the first instance to discuss the matter with their child s pre-school provider/current headteacher, prospective future headteacher and any other professionals involved. If after discussion, parents then wish to make a formal request they should contact the Admissions and Appeals Team for a copy of the Council s policy on the admission of children outside of their normal age group by emailing admissions@derbyshire.gov.uk or call 01629 537479. Requests should be accompanied by evidence to show that the child s admission outside of their normal age group is in the child s best interests. All relevant factors will be considered when assessing requests against the Council s policy on the admission of children outside of their normal age group. Please note that if a request is not agreed then a place may be offered in another year group. School charging policy Charges may not be made for any cost associated with anything your child does during the school day. Schools may ask for voluntary contributions for school visits. Each governing body is required to tell parents details of the school s charging and remissions policy. Will my child have to wear uniform? Uniform is decided by each school s board of governors. Other financial assistance The county council has no general scheme of assistance to provide school clothing, clothing grants or any other financial help to parents. In exceptional circumstances, where a child is prevented from attending school, the council s education welfare service can give advice on what financial help might be available. The distance will be measured by the local authority and that data will be supplied to the governors. In a very few cases, it may not be possible to decide between the applications of those pupils who are the final qualifiers for a place (eg children who live at the same address or have the same distance measurement). In this exceptional situation, if there is no other way of separating the applications then the governors will admit the additional child above the planned admissions number. Pennine Way Junior Academy, Church Gresley If the number of applications for admission to the school exceeds the school s Published Admission Number, the following order of priority is used to allocate the available places: 1. Children in care and adopted children as defined in the School Admissions Code (2012). 2. Children living in the Pennine Way Junior School catchment area; 3. Children having a brother or a sister currently attending at the time of their admission. Brother or sister includes a half-brother or halfsister, a legally adopted child who is regarded as a brother or sister, a step-brother or step-sister who resides in the same family unit; 4. Children attending Church Gresley Infant and Nursery School but being outside the normal catchment area; 5. Children who have medical or social grounds provided this is supported by a written statement of evidence from a doctor or social worker at the time of original application; 6. Other children on the basis of proximity of the child s home to school as measured by the shortest walking route with those living nearest being given priority. Proximity will also be used on a tiebreaker in the event of oversubscription in any of the above criteria. Denby Free CE Voluntary Aided Primary 1. Children in Public Care. Looked after children are those who are either looked after by the local authority or children who were looked after but cease to be so because they were adopted (or became subject to a residence or special guardianship order). 2. Children with a sibling already on the school roll at the time of application and admission. For the reasons of clarity a definition of sibling is as follows: A brother and/or sister A half-brother and/or half-sister A legally adopted child regarded as a brother or sister A step-brother and/or step-sister residing in the same family unit 3. Children who live within the ecclesiastical parish of St Mary the Virgin. 4. Children whose parents/guardians have requested a Christian education. A letter of support from a priest, minister or pastor, who knows the family and can confirm *regular attendance at public worship, must be included with the application. 5. Other children whose parents request a place and who can be accommodated within the admission number. The order of applicants within any of the above criteria will be determined by their proximity to the school. This will be by the nearest available route. St Andrew s CofE/Methodist Aided Primary, Dronfield Woodhouse A pupil with a Statement of SEN which specifies the school will be given automatic priority for admission. 1. Children who are either looked after by the local authority or children who were looked after but cease to be so because they were adopted (or became subject to a residence or special guardianship order). 2. Siblings, including half brothers and sisters or adopted/foster brothers and sisters of pupils already in the school and living at the same address at the time of the proposed admission. 3. Children of whom at least one parent or carer has regularly worshipped at a Christian church, which is a member of Churches Together in England, for a period of at least 6 months prior to the date of the application. Regular attendance means an average attendance of at least once per month. Church attendance must be verified by a letter from the relevant priest, minister or churchwarden. 4. Residence in the ecclesiastical parish of Dronfield with Holmesfield, the normal catchment area of the school. A map of the ecclesiastical parish is available in school. 5. Other children whose parents have requested a place. Should the number of applicants of equal merit exceed the remaining places available, the shortest walking distance from home to school will be used as the final determinant. Distance will be measured by the shortest walking route from the front door of the child s home address (including flats) to the main entrance of the school. The current Local Authority system for measuring this will always be used. William Gilbert Endowed CE (Aided) Primary, Duffield After the admission of pupils with a Statement of SEN, the following criteria will be applied: 1. Children looked after by a Local Authority or adopted children who were previously in care (as defined in the school admissions code). 2. Children from families living in the ecclesiastical parish (beneficial area) in which the school is situated with siblings. Older siblings should be attending the school at the time of application and admission. (See map, which is available at school). 3. Children from families living in the ecclesiastical parish (beneficial area) in which the school is situated, without siblings. 4. Children of whom at least one parent or carer has regularly (Footnote 2) worshipped at their local Church for a period of at least 1 year prior to the date of application. (Footnote 3). 5. Children living outside the area but with a sibling already attending the school. 6. Children living outside the area without a sibling already attending the school. In the event of the school being oversubscribed in any of the above criteria the distance tie-breaker will be applied: Distance will be measured from the front door of the child s home address to the main entrance of the school (using the Local Authority s computerised measuring system). Those living closer to the school receive the higher priority. If the distance between two or more children s homes and the school is the same, the allocation of the place will be made by the drawing of lots. In cases where the last available place pertains to a single place of residence from which two or more applications have been received (twins, triplets, etc.) the statutory limit may be exceeded. Children who have brothers or sisters already attending the school. (iii) 4. Children of parents resident in the Parish (or beneficial area) in which the school is situated. (iv) 5. Other children. Children whose parent/s* (the church attendance of one parent is satisfactory to fulfill the criteria) are regular (i.e. at least once a month) worshippers at another Anglican Parish Church and who must support their application with a letter of confirmation (specifying both the regularity and duration of [for the period of at least one year prior to the application] church attendance) from the Parish Priest or a Churchwarden. Children whose parent/s* (the church attendance of one parent is satisfactory to fulfill the criteria) are regular (i.e. at least once a month) worshippers at a Christian Church recognised as a member of Churches Together in England and who must support their application with a letter of confirmation (specifying both the regularity and duration of [for the period of at least one year prior to the application] church attendance) from the Priest or Minister concerned. (b) (iii) Sibling means a child who matches the criteria below who will be educated in school at the time of admission. Children who have one or both natural parents in common. Children who are related by a parent s marriage. An adopted or fostered child. (iv) Resident means that the child s ordinary place of residence is a residential property at which the person or persons with parental responsibility is/are living at the time the application for the school place is made. When the school is oversubscribed a tiebreaker will apply. In the case of a tie, priority will be given to the child living nearer to the school, measured by the shortest walking route from the front door of the child s home address (including flats) to the main entrance of the school, (using the Local Authority s computerised measuring system). The Fitzherbert CE Voluntary Aided Primary, Fenny Bentley 1. Children in public care, including those children recently leaving public care through adoption, residence order or special guardianship. 2. All children whose Statement of special educational (SEN) needs names Fitzherbert as choice of school. 3. Residence in the parishes (beneficial areas i.e. Church boundaries) of Fenny Bentley, Thorpe and Tissington (a map is available in the school). 4. Siblings, adopted, step or foster brothers / sisters of pupils who are resident at the same address who are in school at the time of application and admission. 5. Children of regular worshippers at the Parish Church who live outside the school s defined area. Regular worship means attendance of one service per month over a sustained period of time (12 to 24 months). This application must be supported by a letter from the relevant priest or church warden. 6. Other children whose parents have requested a place. 7. Children of staff, employed at the school for at least 2 years or who meet a particular skills shortage. Where, in the case of 4, 5, and 6 above, choices have to be made between children satisfying the same criteria, those children living nearest to the school (measured by the nearest available route) will be given preference. Other children whose parents have requested a place at Fritchley CE (Aided) Primary School. In the case of a tie-breaker, the order of applicants within any of the above criteria will be determined by their proximity to the school, measured by the nearest available route. The allocation of places within that place of residence will be made by the drawing of lots. Where applications for admissions exceed the number of places available, the priority will be determined as follows: 1. Looked after children and children who were looked after but ceased to be because they were adopted (or became subject to a residence or special guardianship order). 2. Children resident in the ecclesiastical parish of Holy Trinity Dinting: a map is available in school. 3. Children who will have siblings in school on the date that they will take up the place (siblings are brothers and sisters, as well as step, adopted or fostered brothers and sisters resident at the same address). 4. Children of whom at least one parent or carer has regularly (1) worshipped at their local church for a period of at least one year prior to the date of application (2). (1) Regular means an average attendance of once per month. (2) Church attendance must be verified by a letter, from the relevant priest, minister or churchwarden. (the application should be supported by a letter, signed by a priest, minister or pastor indicating regularity and duration of church attendance). 5. Other children whose parents have requested a place. Tie Breaker In the event of Governors having to make a choice between applications of equal strength, places will be allocated on the basis of those children living nearest to the school (measured by the nearest available route). Longstone CE Voluntary Aided Primary, Great Longstone Children who have a statement which names the school will be admitted before the oversubscription criteria are applied. In the event of places being over subscribed, the governors will take into account the following criteria, in order of priority: 1. Looked after children and children who were looked after but cease to be because they were adopted (or became subject to a residence or special guardianship order). 2. Residence in the ecclesiastical parishes of Ashford in the Water, Sheldon, Longstone and Wardlow, and the civil parish of Cressbrook. 3. Siblings of pupils who will already be on the roll of the school at the time of the admission. For the purposes of this criterion, siblings shall include children brought up in the same household. 4. Any other child whose family has applied for a place and who does not qualify for consideration within the above criteria. In the case of over-subscription in any of the above criteria, the following will be used as a tie-breaker: The distance the child lives from the school. This will be judged using Derbyshire County Council s geographic information system to calculate the shortest available route by road. The calculation will be made from the child s home front door to the centre of the school. Hathersage St Michael s CE Voluntary Aided Primary The Governing Body will use the priorities below when considering parents (see footnote (i)) requests for the admission of their children to the School. 0. Children with a Statement of Special Educational Needs. 1. Children in public care and children who were looked after but ceased to be because they were adopted or became subject to a residence or special guardianship order. 2. Children of families residing within the parish of the school. (The parishes of Hathersage and Outseats). 3. Siblings (see footnote (ii)), adopted or foster brothers/sisters of pupils attending the school in the year of admission. 4. Children whose parents have requested education in the Christian Faith and who can provide evidence that one parent has regularly attended a Christian church for one year (see footnote (iii)). 5. Others that don t fall into any of the above categories. Tie-breaker: Pupils living nearer the school would have preference. This would be judged by the shortest, safe walking route. A pupil with a Statement of Special Educational Needs which specifies the school will be given automatic priority for admission. In the event that applications received by the governors exceed the number of places available, preferences for admission will be determined using the following criteria: 1. Children in care (Looked After Children). 2. Siblings, including half brothers and sisters or adopted/foster brothers and sisters of pupils already in the school and living at the same address at the time of the proposed admission. 3. Children of whom at least one parent or carer has regularly worshipped at a Christian church, which is a member of Churches Together in England, for a period of at least 6 months prior to the date of application. Regular attendance means an average of at least once per month. Church attendance must be verified by a letter from the relevant priest, minister or churchwarden. 4. Residence in the ecclesiastical parish of Killamarsh, the normal catchment area of the school. 5. Other children whose parents have requested a place. Linton Primary Foundation If the school is oversubscribed, after the admission of pupils with a Statement of Special Educational Needs where the school is named in the statement, priority for admission will be given to those who meet the criteria set out below, in order: 1. Children in Care or children who were previously looked after but immediately after being looked after became subject to an adoption, residence or special guardianship order. 2. Children living in the normal area served by the school at the time of application and admission. A map of the school s normal area is available in school. 3. Where the child has a sibling attending the school at the time of admission. 4. Where the child has medical reasons, special needs or social grounds (supported by other agencies) for admission. 5. Children who live outside the normal area of the school. Where in the case of 2, 3, 4 or 5 above choices have to be made between children meeting the same criteria, those children living nearest to the school by the shortest available walking route (as measured by the DCC Children and Younger Adults GIS system) will be given preference. Sibling is defined as: A brother and/or sister A half-brother and/or half-sister A legally adopted child being regarded as a brother or sister A step-brother or step-sister residing in the same family unit. Litton CE (Aided) Primary Children who have a Statement of Special Educational Needs which names the school will be admitted. 1. Children in public care and children who were in care and became subject to an adoption, residence or special guardianship order. 2. Children who have siblings, (step/half/adoptive brothers or sisters living at the same address) at the school at the time of admission. 3. Children whose main residence is in the ecclesiastical parish of Tideswell. 4. Children where one parent can demonstrate that they have regularly, on an average of once per month attended a Christian church during the preceding 12 months prior to application. Attendance should be verified by a member of the church leadership. 5. Children from the wider area who live the closest distance to the school, measured by the most direct walking route as measured by the LA GIS system (outlined in the LA admissions document for parents). In the event of the above criteria resulting in a tie break to the taking of a place, we will use the closest distance to the school as the deciding factor measured by the Local Authority GIS system. St Laurence CE (Aided) Primary, Long Eaton All children whose statement of special educational needs which names the school must be admitted. 1. Children in public care. This means children who are looked after by the local authority, or children who were looked after but ceased to be because they were adopted (or became subject to a residence or special guardianship order). 2. Children who have a sibling attending the school at application and admission (the term sibling shall include step and/or half brothers or sisters resident at the same address as well as adopted and/or fostered siblings). 3. Children living in the normal school area of Long Eaton. 4. Children living outside the normal school area whose parents are supportive of the Christian ethos of the school. 5. Children with special needs that could be best provided for at St Laurence. 6. Other places to be allocated by proximity to the school. In the event of the governing body having to make a choice between candidates who tie on the criteria above then the precedence will be given to the children living nearest to the school measured by the most direct walking route. The children and younger adults service (CAYA) has a geographical system (GIS) to measure the nearest available route. It is measured by a standard walking distance calculated to within two metres. This measurement is taken from the postal address file, normally the house front door. Matlock St Giles CE Voluntary Aided Primary 1. Children looked after in public care including adopted children. 2. Children living within the beneficial area of the school (within the boundaries of the ecclesiastical parish of Matlock) and children living in the village of Riber. 3. Siblings, adopted or foster brothers/sisters of pupils attending the school at the time consideration of the application is given and living at the same address as the sibling at the time of application. 4. Children who live outside the beneficial area of the school but whose parents/guardians/carers has regularly (1) worshipped at St Giles Church, Matlock for a period of at least one year prior to date of application (2). 5. Children who have worshipped at an Anglican church other than St Giles Church for a period of at least one year prior to the date of application. 6. All other children. When there are more applications than available places pupils will be admitted on the basis of the shortest walking distance from school measured to the main entrance to the school. (Distance will be measured by the shortest walking route from the front door of a child s home address to the main entrance of the school using the LA s computerised measuring system with those living closer to the school receiving the higher priority.) (1) Regular means an average attendance of once per month (2) Church attendance must be verified by a letter from the relevant priest, minister or churchwarden. Fairmeadows Foundation Primary, Newhall If the school is oversubscribed after the admission of pupils with a Statement of SEN where the school is named in the statement, priority for admission will be given to children who meet the criteria set out below in order: 1. Children in Care or a child who was previously in care but immediately after being looked after became subject to an adoption, residence or special guardianship order. 2. Children who have siblings currently attending the school at the time of their admission. The term sibling includes a half-brother or half-sister, a legally adopted child who is regarded as a brother or sister, a stepbrother or step-sister who resides in the same family unit. 3. the school. A separate application for a place in reception must still be made. 4. Children of staff at the school where a member of staff has been employed at the school for two or more years at the time at which the application for admission to the school is made. 5. Proximity of the child s home to the school measured by the local authority computer generated measuring system (information on this is available on request) with those living nearest being given priority. Proximity will also be used as a tiebreaker in the event of oversubscription in any of the above criteria. If after application of all criteria set out in the list there is still oversubscription, then the remaining places available shall be determined by random allocation. Any applicants who have not been allocated a place will be given a numbered ball, which will be placed in an opaque bag. A number of balls equal to the number of remaining places will be drawn by an independent party. This will take place in the presence of all interested parties. In this case children of whom at least one parent or carer has regularly (1) worshipped at St. George s Church or any other Anglican church for a period of at least one year prior to the date of application (2). (1) Regular means an average attendance of once per month. (2) Church attendance must be verified by a letter from the relevant priest, minister or churchwarden. 5. Resident in the Parish of St George s Church but outside the catchment area. A map defining the Parish of St. George s Church forms part of this policy and can be viewed in school upon request. Home address is determined by the address which child benefit / tax credit is paid to. 6. Other children whose parent(s) have requested a place. The order of applicants within any of the above criteria will be determined by their proximity to the school. This will be by the nearest available route. The LA has introduced a GIS system to assist where it is necessary to measure by the nearest available route. It is anticipated that this will be available to measure by a standard walking distance calculated to within 2 metres. Children living in the catchment area (as defined by the Local Authority). 3. Children who have brothers or sisters attending the school at the time of admission. The term brother or sister includes: a half-brother and/or sister a legally adopted child regarded as a brother or sister a step-brother and/or sister residing in the same family unit 4. Other children whose parents have requested a place. Where choices have to be made between children satisfying the same criteria, those children living closest to the school (measured by the nearest available route as defined by the Local Authority) will be given preference. Redhill Primary (Foundation), Ockbrook Parents are advised that priority is given to pupils who live in Ockbrook but this in itself does not guarantee a place. Where applications for admission into the school exceed the number of places available, the following criteria will be applied in the order set out below, to decide which children to admit. Where after the application of any criterion, there is still a case of oversubscription, the next criterion in the list shall be applied. If after application of all criteria set out in the list there is still oversubscription, then the remaining places available shall be determined by the drawing of lots. All children whose Statement of Special Educational Needs names the school will be admitted. 1. Children in care or a child who was previously in care but became subject to an adoption, residence or special guardianship order. 2. Children living in the designated area, which is the parish of Ockbrook as defined by the LA in 1993; 3. Children who have siblings currently attending the school at the time of application; who also will be on the school roll at the time the child starts school; (The Schools Admissions Code states that a child cannot be allocated a place at a school on the basis that a sibling or other relative is a former pupil, including siblings who were on roll at the time of application but will have left by the time the child starts school). 4. Where parents can demonstrate that admission to the school is necessary for the social or medical well being of their child. Supporting evidence from a doctor or social worker will be required at the time of application. This statement should provide independent advice which sets out why the child s needs would be better met at Redhill Primary than elsewhere. 5. Children of staff at the school where the member of staff has been employed for two or more years at the time at which the application for admission to the school is made. 6. Other children by distance from the school with priority for admission given to children who live nearest to the school as provided to the school by the Derbyshire County Council Geographic Information System, with those having the shortest distance taking the highest priority, (see note below). Should Derbyshire County Council not provide this information then the proximity shall be measured by the distance as the crow flies from the entrance to the School reception to the front door of the child s home with those having the shortest distance taking the highest priority. Note The County Council has a Geographic Information System (GIS) to measure the nearest available route. It is measured by a standard walking distance calculated to within two metres. This measurement is taken from the postal address, normally the house front door. For schools, the grid reference will be the centre of the school. Pilsley C of E (Aided) Primary, Bakewell Children who have a Statement of Special Educational Needs which names the school will be admitted. 1. Children in public care and children who were in care but became subject to an adoption, residence or special guardianship order. 2. Residence within the normal area, as defined by the home estate of Chatsworth (map held at school and on the school website). 3. Siblings, adopted/foster brothers or sisters of pupils still attending the school and residing at the same address. 4. Children of whom at least one parent or carer has regularly worshipped at a church recognised by Churches together in Britain and Ireland for a period of at least six months prior to the application. Regular means attendance of on average once per month. Church attendance must be verified by a letter from the relevant priest, minister or senior lay person. 5. All other children not eligible under the above criteria. In the event of governors having to make a choice between candidates with cases of equal strength, preference will be given to families who live nearest to school, as measured by the nearest available route. This will be done according to the County s Geographical Information System and will measure the walking distance from the front door to the centre of the school. If an admission is requested for twins or other multiple births, Governors will not split siblings. The Curzon CE (Aided) Primary, Quarndon Where applications for admissions exceed the number of places available, the following criteria will be applied in the order set out below to decide which children to admit. Children who have a statement of Special Educational Needs that names The Curzon Primary School will be admitted. 1. Children looked after in public care. Looked after children are those who are either looked after by the local authority or children who were looked after but ceased to be so because they were adopted (or became subject to a residence or special guardianship order). 2. Children whose home is in the Parish or beneficial area in which the school is situated, and who have one or more siblings currently attending the school at the time of application and admission, and of whom at least one parent or carer has regularly worshipped at a Christian church for a period of one year prior to the date of application. 3. Children whose home is in the Parish or beneficial area in which the school is situated, and who have one or more siblings currently attending the school at the time of application and admission. 4. Children whose home is in the Parish or beneficial area in which the school is situated, and of whom at least one parent or carer has regularly worshipped at a Christian church for a period of one year prior to the date of application. 5. Children whose home is in the Parish or beneficial area in which the school is situated. 6. Children who have one or more siblings currently attending the school at the time of application and admission, and of whom at least one parent or carer has regularly worshipped at a Christian church for a period of one year prior to the date of application. 7. Children who have one or more siblings currently attending the school at the time of application and admission. 8. Children of whom at least one parent or carer has regularly worshipped at a Christian church for a period of one year prior to the date of application. 9. All other children whose parents have requested a place. Siblings are considered to be children who live at the same address and either have one or both natural parents in common; or are related by a parent s marriage, or are adopted or fostered. In the event of an over-subscription of children meeting any of the above criteria, the Governors will give priority according to the proximity of the child s home to the school the local authority s system will be adopted to measure the shortest distance from home to school as the shortest walking route that is available all year round. Immaculate Conception Catholic Primary, Spinkhill Please note that children who have a Statement of Special Educational Needs that names the school are required by law to be admitted. Where there are more applications for admission than the planned admission number stated (footnote 1), the Governing Body will apply the following criteria in strict order of priority: Should the planned admission number be reached mid category, the Governing Body, as the admissions authority will make a decision based on distance with priority for admission being given to children who live nearest to the school as the crow flies. The distance will be measured from the main entrance of the child s home to the main entrance of the school by the Local Authority and provided to the school. In circumstances where two or more children live the same distance from the school the offer of a place will be decided by drawing lots. The first name drawn will be offered the place. Catholic children (see footnote 2) who:- 1. are Looked After Children or previously Looked After Children (footnote 3). 2. are siblings (footnote 4) of Catholic children attending Immaculate Conception school at the time of admission. 3. live within the parish of the Immaculate Conception. 4. Looked After Children or previously Looked After Children (footnote 3) who are not baptised Catholics. 5. Children who have siblings (footnote 4) attending Immaculate Conception Catholic Primary School at the time of admission. 6. Catholic children who live in other Catholic parishes but who do not have a sibling in the school. Children who are members of: 7. Orthodox churches as recognised by the Catholic Church (footnote 5) who have sought the written support of their minister and live within the parish of the Immaculate Conception. 8. Other Christian Churches who are full members of Churches Together in England (footnote 6) at the time of application, whose parents have sought the written support of their minister and live within the parish of the Immaculate Conception. 9. Children who are members of other World Faiths whose parents wish their children to be educated in a Christ centred environment and whose parents have the written support of their Religious Leader. 10. Children with a specific educational, medical or emotional need, who do not come under any of the above categories, provided that appropriate written evidence from a suitably qualified professional eg Doctor, Social Worker is submitted with the application indicating why Immaculate Conception Catholic school is the most appropriate setting. 11. Children whose parents are seeking a Christian environment for their children s education. 12. Other children. Tintwistle CE (Aided) Primary 1. Looked after children or adopted children who were previously looked after. 2. Children with any special medical or social circumstances affecting the child where these needs can only be met at this school. 3. Children who are resident in the parish of Tintwistle. 4. Children who have a sibling in school who will still be attending school the following year. 5. Children of staff who have been employed in the school for more than two years or who will meet a skills shortage. 6. Children whose parents are involved in the work and worship of Christ Church or URC, Tintwistle. 7. Children whose parents are involved in the work and worship of a Christian church, as recognised by Churches Together in Britain and Ireland. 8. Children who live nearest to the school, measured along the shortest safe walking route. If there are not enough places to admit all applicants meeting any one criterion, the governors will apply the subsequent criteria, in order of priority, to all these applicants. Children with a statement of special educational needs naming the school do not form part of the oversubscription criteria and should have a note from the local authority indicating that they will be admitted. Notes (a) Professional supporting evidence from e.g. a doctor, psychologist, social worker, is essential if admission is to be made under the criterion for special medical or social circumstances, and such evidence must set out the particular reasons why the school in question is the most suitable school and the difficulties which would be caused if the child had to attend another school. (b) A map showing the boundaries is available from the local authority. (c) Siblings include step, half, foster, adopted brothers and sisters living at the same address and full brother and sister living apart. (d) A parent is any person who has parental responsibility for or is the legal guardian of the child. (e) By involved in the work and worship of a church we mean named on the electoral roll of the church. It is sufficient for just one parent to be involved. Parents wishing to inform the school of their commitment to the church should complete the school s supplementary form. This information will be verified with your incumbent or minister or other church officer. (f) Shortest walking routes will be calculated by the Local Authority using postal addresses to within 2m of the front door. The school s grid reference is calculated from the centre of the school.
