INTRODUCTION - DEMANDS AND NEEDS This document contains a summary of the main Policy terms and conditions. Sections 1 and 2 of the Policy are provided to You on Your registration at www.candis.co.uk/legalcare free of charge as part of Your Candis membership. The policy is designed to help You pursue a personal injury claim in the UK courts, as a result of an accident which was not Your fault. The full terms, conditions and exclusions that apply to this protection can be found in the Policy document. 2. TYPE OF INSURANCE AND COVER PROVIDED Sections 1 and 2 of this Policy are supplied to You at no additional cost beyond Your membership of Candis. The protection provided by this Policy is as follows: a) Section 1(a) Protection against legal costs that:
You may incur in pursuing compensation for losses and personal injury resulting from a specific and accepted claim in the courts of the United Kingdom arise from an incident that occurred before the start of this insurance are up to the Policy limit of 1,500 are incurred with Our agreement. b) Section 1(b) Protection against unrecoverable legal costs that: You, or a member of Your family permanently resident in Your home, may incur in pursuing compensation for damage, loss or personal injury arising from a specific personal injury claim in the courts of the United Kingdom arise from an incident that occurred after the start of this insurance are up to the Policy limit of 5,000 are incurred with Our agreement. c) Section 1(c) An optional After The Event (ATE) Legal Expenses insurance which provides cover for Your opponent s legal costs and Your disbursements that: arise when You are pursuing a specific personal injury claim in the courts of England and Wales under a Conditional Fee Agreement are up to the Policy limit are incurred with Our agreement. d) Section 2(a) Protection against Rehabilitation and Life Style treatment costs and expenses that: result from a specific personal injury protected by Us under Section 1(a) of this insurance are up to the Policy limit of 1,000 are incurred with Our agreement. e) Section 2(b) Protection against Rehabilitation and Life Style treatment costs and expenses that: result from a specific personal injury protected by Us under Section 1(b) or 1(c) of this insurance are up to the Policy limit of 1,000 are incurred with Our agreement. 3. SIGNIFICANT FEATURES AND BENEFITS This Policy will protect You against the costs of legal representation and defence. Your opponents legal costs will also be covered if: the court orders You to pay them following a final judgement against You We agree that Your claim should be discontinued. In addition You will be covered for treatments, goods and services delivered to You in connection with Your rehabilitation. Under Section 1(b) Protection against unrecoverable legal costs, at Your request We will extend the level of protection provided for legal expenses incurred as a result of a compensation claim that: follows a personal injury caused by an identified third party and where You are not at fault occurs on a date after this insurance commences occurs within the life of the Policy is made by any member of Your family that is permanently resident in Your home. 4. SIGNIFICANT EXCLUSIONS OR LIMITATIONS The following exclusions apply to all Sections of this Policy: Pursuit of a Claim in circumstances where the Insured Person is entitled to Legal Aid Any Claim arising out of any deliberate and/or criminal act Any Claim relating to an accident that occurred when the Insured Person was under the influence of alcohol or that arises from the Insured Person taking a drug, which is not lawfully available, or is lawfully available only on prescription by a qualified doctor or dentist, other than a drug prescribed by a qualified and competent medical practitioner
Any Claim involving a Motor Vehicle where the Insured Person or driver is found not to be in possession of valid motor insurance for the Vehicle, valid M O T or a valid driving licence Any Claim where the Insured Person s Vehicle is found to have been unroadworthy at the material time Any Claim relating to defamation libel or slander Any Claim relating to medical negligence or to pharmaceutical or drug related claims including, but not limited to, claims relating to tobacco or tobacco products Any Claim which is part of multi-party or group action, or resulting from one or more events arising at the same time, except where the Insured Person may be one of eight or fewer claimants involved in the same Road Traffic Accident. The significant limitations applying to indemnity under this Policy are that We will not pay costs, expenses, fees or disbursements where: You fail to cooperate with Us or Your solicitor You fail to complete any treatment recommended within Your rehabilitation programme You pursue a claim outside the stated jurisdictions You, or Your representative fail to advise Us of any change to facts or circumstances that could materially effect the outcome of Your claim You abandon the claim without Our consent or that of Your solicitor the conduct of the claim is affected by You causing delays, defaulting or failing to give prompt instructions Your solicitor fails to comply with the pre-action protocol, the Civil Procedure Rules or an order of the court You seek to enforce a judgement or to appeal without Our prior written consent the costs, expenses, legal costs and disbursements being claimed were without Our agreement, or You became liable for them before the Policy began You also wish to make a claim in respect of Section 2 Rehabilitation indemnity unless We have first accepted Your claim under the relevant heading of Section 1 (legal expenses) of the Policy. 5. DURATION OF COVER In respect of Section 1(a) Protection against legal costs, cover will end when the first of the following events occur: Your compensation claim is completed the limit of protection provided by the Policy is reached. In respect of Section 2(a) Rehabilitation costs, cover will end when the first of the following events occur: completion of Your rehabilitation programme expiry of a period of 52 Weeks from the date of the accident which Your Claim relates to, or from the date You were discharged from Hospital as an Inpatient following treatment You received as a result of Your Claim, whichever is the later the limit of protection provided by the Policy is reached. All other Sections of the Policy will expire 12 months from the start date and will cover events occurring within that period and which fall within the limits of the Policy. A separate statement of cover will be issued in respect of the optional After The Event (ATE) insurance as detailed in Section 1 (c) of the full Policy if this is recommended to You. 6. REVIEWING YOUR COVER You should regularly review the cover provided by any insurance Policy to ensure it remains adequate for Your needs. 7. YOUR RIGHT TO CANCEL This is a group policy: there is no right to cancel this policy within 14 days of the date of issue.

HOW TO CLAIM UNDER THIS POLICY If You wish to make a claim under this Policy You should contact the Candis Legal Care Helpline on 0844 856 0677 or you can write to Us at: The Claims Department London, EC3P 3DQ Alternatively You can contact Your nominated solicitor, whose details are provided in Your Policy document. 9. WHAT TO DO IF YOU HAVE A COMPLAINT If You wish to register a complaint please contact Us by writing to: The Customer Satisfaction Manager London, EC3P 3DQ Please include Your Policy number and the name of Your solicitor. If You cannot settle Your complaint with Us, You may be entitled to refer it to the Financial Ombudsman Service. 10. THE FINANCIAL SERVICES COMPENSATION SCHEME (FSCS) We are covered by the FSCS. You may be entitled to compensation from the scheme if We cannot meet Our obligations. This depends on the type of business and the circumstances of the claim. Insurance advice and arrangement is covered for 100% of the first 2,000 and then 90% of the remainder of the claim, without any upper limit. Further information about compensation scheme arrangements is available from the FSCS website at www.fscs.org.uk. Full details are included in Your Policy document. 11. PREMIUM PAYMENT The premium for this insurance has been paid as part of Your membership of Candis. If You decide to add additional sections to Your Policy, a new schedule of insurance will be issued to You. 12. LAW AND LANGUAGE APPLICABLE TO THE POLICY We can both choose the law that will apply to this contract. English Law governs the contract unless it says differently anywhere else in the Policy. The language used in this Policy and any communication relating to it will be English. 13. DATA PROTECTION The data supplied by You will only be used for the purposes of processing Your Policy, including underwriting, administration and handling any claims which may arise. The data supplied will not be passed to any other parties other than those that We have mentioned in this document. Data may be exchanged and stored world wide It is important that the information You gave Us is kept up to date. Please notify Us of any changes. You are entitled to inspect the personal data which We hold about You, subject to payment of an administration fee.
