Your current Policy Schedule to this Policy is part of the Policy and provides further details about Your insurance in relation to You. The Benefits applicable to Your insurance are paid from MLC s Statutory Fund No. 1. Important Notice This Policy is designed purely for protection insurance and is not a savings plan. Unlike some other types of life insurance which have investment or savings components, this Policy will never have a surrender or cash value. General terms These general terms apply to this Policy. These terms should be considered before the sections that follow. This document should be read together with Your current Policy Schedule. This Policy is a contract This Policy is a contract that consists of: the terms contained in this document (Policy Document); Your current Policy Schedule issued for this Policy; and any future documents that change this Policy. The Policy starts on the Start Date shown in Your current Schedule. The Policy is governed by the laws of New South Wales. Who is this Contract with? This contract is between You as the Policy Owner and MLC. You have been issued this Policy on the basis that You have a Loan from NAB. NAB Mortgage Protect is not compulsory insurance and similar insurance can be arranged with another insurer of Your choice. When this Policy commences All the terms and conditions of Your insurance cover are effective from the Start Date of the Policy. We guarantee to renew Your Policy each year provided You continue to pay Your premiums, unless Your Policy ends in accordance with the Policy terms and conditions. If there is more than one Policy Owner If there is more than one Policy Owner, this Policy will be jointly owned by all of them. Changes of address and payment method that may apply to Your Policy may be made by a single Policy Owner. All other changes and cancellation of the Policy must be by instruction by all Policy Owners. Interpretation In this Policy Document unless the context otherwise requires: defined terms are capitalised; singular words includes the plural and plural words includes the singular; other parts of speech and grammatical forms of a word or phrase defined in this Policy Document have a corresponding meaning; specifying anything after the words include or for example does not limit what else is included; and a reference to a government or medical body (including an institute, association or authority), whether statutory or not: which ceases to exist; or whose powers or functions are transferred to another body, is a reference to the body which replaces it or which substantially succeeds to its powers or functions. Access to Information about Your Loan from NAB To enable us to determine the Benefits, Premiums payable and also for the assessment of claims, We need access to information about Your Loan from NAB. You consent to our obtaining information from NAB and the provision by NAB of information as is reasonably necessary for the proper administration and servicing of the Policy and assessment of any claim on the Policy. If You want to cancel the Policy and the cooling-off period You can cancel the Policy at any time. If You notify us within 14 days (the cooling off period) that You wish to cancel We will return to You all the money paid to us under this Policy (other than any government fees or charges that apply). This cooling-off period starts from the first of: Your receipt of the first Policy Schedule issued to You; and the end of the fifth business day after the first Policy Schedule was issued to You. Variation of terms of the Policy In addition to changes to the Benefits and Premiums payable under the Policy, We may also vary the terms of the Policy providing that the change is an improvement to the Benefits under the Policy. If You have a complaint You are welcome to call the MLC Client Service Centre on 132 295. In most cases We can deal with Your complaint over the phone. If We cannot resolve Your complaint over the phone, MLC has formal procedures for dealing with complaints and You will need to write to us. Currency Premiums and Benefits under this Policy must be paid in Australian dollars. Transfer of ownership You cannot transfer the ownership of this Policy to someone else. Definitions Applying to Your Insurance MLC/We/us Refers to MLC Limited in its capacity as insurer and issuer of NAB Mortgage Protect. You/Your Refers to You as both the policy owner(s) and the life/lives insured. Benefit Means the amount(s) shown in Your current Policy Schedule for which We insure You. Disablement The definition of Disablement varies according to Your employment status. If You re Gainfully Employed for at least 15 hours per week and have been so employed on a continuous basis for six months or more immediately prior to the date of Your Disablement, then You ll be assessed as Disabled if, as a result of injury or sickness, You re unable to continuously and totally carry out all the normal duties of Your usual occupation and You re not engaged in any Gainful Employment. If You re unemployed or not Gainfully Employed for at least 15 hours per week or have not been so employed on a continuous basis for six months or more immediately prior to the date of Your Disablement, then You ll be assessed as Disabled if, as a result of injury or sickness, You: a) are continuously and totally unable to do any two or more of the following groups of activities of daily living without physical help from someone else: bathing or showering dressing moving from place to place, into and out of bed, and into and out of a chair eating and drinking using the toilet, or b) have severe cognitive impairment (with a score of 15 or less out of 30 in a Mini Mental State Examination) which leads to the need for continuous supervision to protect Yourself or other people.
The Disablement must be as a result of You sustaining accidental bodily injury, sickness or disease, which is certified by a Registered Medical Practitioner and confirmed by MLC s medical adviser. Your Disablement must be regularly confirmed by a Registered Medical Practitioner and You must not be engaged in any Gainful Employment. Any reference to Disablement should also be read as referring to Disability and Disabled. Draw Down (in relation to a loan) Means when Your Loan account is activated, eg actually having the money transferred from the bank to Your account. You will be charged interest from the date of the Draw Down. Economic Costs (or break costs) Means a fee which may be payable if You as the borrower under the Loan makes certain changes such as switching the Loan from a fixed to variable rate or fully prepaying out the Loan prior to the expiry of the fixed rate period. Economic cost is the lender s estimate of its loss resulting from the change. Employed by Your Family Means employed by an employer which is not a listed public company, or a related body corporate of a listed company, and in which an immediate family member of Yours is, or was, either: a) a director, majority shareholder or partner of the employer, or b) in control of the employer. Gainfully Employed Means being in active employment for remuneration, payment or profit. Any reference to Gainfully Employed should also be read as referring to Gainful Employment. Involuntary Unemployment Means a period during which You re not working and are actively seeking employment, and are registered with Centrelink or other Government approved job placement agencies as a job seeker, commencing on the date of registration and continuing during such period as You re not Gainfully Employed where becoming unemployed was a result of: the termination of Your Gainful Employment by Your employer, or being made redundant from Your Gainful Employment by Your employer, or if You re Self-Employed or a partner in a business partnership, the business ceasing trading permanently due to actual or imminent insolvency or business factors beyond Your reasonable control and being wound up or placed in the control of an insolvency administrator, or if You re a partner in a business partnership, Your status as a partner is discontinued without Your actual or implied consent, agreement or approval (for example, against Your consent You re forced out of the partnership) and You cease to work with that business. Loan Means a Principal and Interest Loan, Interest Only Loan or Line of Credit provided to You by NAB. Loan Amount Means the total amount You are borrowing, sometimes referred to as the loan principal. Loan Repayment(s) Means the regular minimum amount You need to pay NAB for borrowing the Loan Amount, as set out in Your Loan Agreement. Mini Mental State Examination Means the Mini Mental State Examination (MMSE) test which samples various functions including arithmetic, memory and orientation to assess cognition. NAB Means National Australia Bank Limited ABN 12 004 937. Pay Out/Paid Out (in relation to a loan) Means to repay the total outstanding Loan Amount. Your Life Cover benefit is paid against Your loan amount. This should cover the total loan other than when You are in arrears more than two months or there are economic costs, such as extra break costs for paying out a fixed interest loan. Policy Owner Means the person or persons named in Your current Policy Schedule as the Policy Owner.
Policy Schedule Means the Policy Schedule issued to You with this Policy and updated from time to time. An updated Policy Schedule will be issued each year and will replace the previous Policy Schedule. Pre-Existing Condition Means an injury, illness or symptom(s) that first occurs or appears before the start of Your insurance, or for which You have experienced symptom(s) or received medical treatment prior to the start of Your insurance leading to a diagnosis after the start of Your insurance, unless You were not aware of, or and could not be reasonably expected to be aware of, the condition or symptom(s). Where the Loan is increased, Pre-Existing Condition also means any injury, illness or symptom(s) that first occurs or appears before the date of increase, or for which You have experienced symptom(s) or received medical treatment prior to the date of increase, unless You were not aware or could not reasonably be expected to be aware of the injury, illness or symptom (for the increase in the Loan). Premium Means the money paid to us (or owed to us) for the Insurance We provide under this Policy. Registered Medical Practitioner Means a registered and qualified medical practitioner and includes a specialist medical practitioner who is recognised and qualified to provide a diagnosis as a specialist, who is not the insured person or spouse of, or related to, the insured person. Self-employed Means when You re employed by Yourself, or an employer, which is not a listed public company or a related body corporate of a listed public company, and You re, or were, either: a director, majority shareholder, or partner of the employer, or in control of the employer. Start Date Means the date from which You are covered for a Benefit as shown in Your current Policy Schedule and is otherwise known as the Commencement Date. Terminal Illness Means any illness that, in our opinion after consideration of medical evidence, is likely to lead to Your death within 12 months from the date We are notified in writing. Waiting Period Means the initial period of Disability or Involuntary Unemployment for which We don t pay benefits. 1. Insurance and benefit amounts Cover provided by this Policy Life, Disability, and Involuntary Unemployment Cover are provided together under this Policy. You cannot remove any of the covers from this Policy. The following sets out the Benefit, conditions that apply to payment of the Benefit and limitations and exclusions. The maximum Benefit amount allowable The Benefits under this Policy are set out in the Policy Schedule. The Benefits are first determined by the Loan Amount at the time of commencement of the Policy, and must not exceed the maximum amount of cover allowable. The maximum amount of cover that is allowable for Life Cover, Disablement Cover and Involuntary Unemployment Cover is as follows: Cover Maximum Benefit Amount Life A lump sum up to $1m Disablement A monthly benefit up to $10,000 for up to 24 months for each Disablement Involuntary Unemployment A monthly benefit up to $10,000 for up to 90 days for each period of Involuntary Unemployment Annual changes to the Benefit amount You will receive a Policy Schedule each year, at the anniversary of the Start Date, to replace the previous one. Each Policy Schedule will set out Benefit amounts, reflecting the outstanding amount on Your Loan (for Principal and Interest Loans and Interest-only Loans) or the credit limit (for line of credit Loans)) and the Premiums You will need to pay. The Life Cover Benefit amount (and Premium payable) in each Policy Schedule will be based on and aligned with the outstanding amount on Your Loan (for Principal and Interest Loans and Interest-only Loans) or the credit limit (for line of credit Loans). The Benefit amount and Premium
payable shown on Your Policy Schedule will be based on Loan information as advised to us by NAB as at the date of or proximate to when the Policy Schedule is issued. The Disability Cover and Involuntary Unemployment Cover Benefit amounts (and Premium payable) in each Policy Schedule will be based on Your Loan Repayments (for Principal and Interest Loans) or 0.75% of the Life Cover Benefit (for line of credit Loans and Interest-only Loans). The Benefit amounts and Premium payable shown on Your Policy Schedule will be based on Loan information as advised to us by NAB as at the date of or proximate to when the Policy Schedule is issued. 2. Life Cover What We will Pay If You die or are Terminally Ill whilst the Policy is in force, We will pay the Benefit provided by this Life Cover insurance ( the Life Cover Benefit ) to NAB and, if relevant, to You or Your estate as follows: For Principal and interest or interest-only Loans For Line of Credit Your Loan Amount will always be Paid Out to a maximum of $1 million. If Your Loan Amount is less than the Life Cover Benefit stated in Your Policy Schedule the difference will be paid to You or Your estate. We will pay the total Loan limit up to a maximum of $1million, even if You owe less. The difference will be paid to You or Your estate. The Life Cover Benefit payable will be calculated by us by reference to the date of Your death or the date You are diagnosed as meeting our definition of Terminal Illness. You do not have to return the Life Cover Benefit paid for Terminal Illness if You live longer than 12 months. Exclusions A Life Cover Benefit payable will not include the following: any Loan Repayments (including interest) in arrears for more than two months before the date we receive your claim, any accrued interest exceeding two months before the date we receive your claim, and any part of the Loan balance resulting from Economic Costs, penalty interest charges and statutory charges on the Loan. A Life Cover Benefit will not be payable for death or Terminal Illness or claims directly or indirectly as a result of: a Pre-Existing Condition suicide or attempted suicide within 13 months of starting or increasing Your Loan (for the increase in the Loan) intentional self-inflicted injury or illness being under the influence of alcohol or drugs, or involvement in criminal activity. 3. Disablement Cover What We will Pay No Disablement benefit provided by this Disablement Cover insurance is payable in respect of the Waiting Period of 30 days. If, whilst the Policy is in force, after the Waiting Period You remain Disabled We will pay the Benefit provided by this Disablement insurance ( the Disablement Cover Benefit ) to NAB and, if relevant, to You as follows: For Principal and Interest Loans For Line of Credit facilities and Interest only loans Your Loan Repayments up to $10,000 per month. 0.75% of Your Life Cover up to $7,500 per month. If the Benefit is more than the Loan Repayment due, the difference will be paid to You. The Disablement Cover Benefit payable will be calculated by Us by reference to the date of Your Disablement. We will pay the Disablement Cover Benefit, whilst You remain Disabled until the earlier of: We have paid a Disablement Cover Benefit for a period of 24 months; and Your Policy ending. There is no limit to the number of Disablement claims You may make whilst the Policy is current and, providing You meet the definition of Disablement, the Disablement Cover Benefit will be paid for each Disablement for a maximum period of 24 months. This is subject to whether the claim is a recurring Disablement in which case the terms concerning recurring Disablement apply.
Disability for part of a month If You re Disabled for only part of a month Your Disablement Cover Benefit will be calculated and paid proportionately, at 1/30th of Your minimum monthly Loan Repayment for each day You are Disabled or 1/30th of 0.75% of Your Life Cover Benefit, as applicable. Recurring disablement If the same Disability recurs within six months of Your return to work after a period of Disability, We will consider it a continuation of the original Disablement. The Policy must be in force when the Disablement recurs. We will not impose a new Waiting Period for the Disability insurance. You can claim as soon as the Disablement recurs. To be a recurring Disability the cause of the Disablement must be the same or related to the cause of the original Disablement. If the Disability recurs after the six months of Your return to work after the original period of Disability, We will treat the further occurrence as a new claim. Disablement whilst You are overseas If You are overseas at the time of Disablement, We will pay the Disablement Cover Benefit whilst you remain Disabled for a period of up to 6 months. If You remain Disabled and return to Australia we will pay the Disablement Cover Benefit whilst you remain Disabled for up to 24 months, taking into account any Benefits paid to You in respect of the period whilst you were overseas. Exclusions A Disablement Cover Benefit payable will not include the following: any Loan Repayments (including interest) in arrears for more than two months before the date we receive your claim, any accrued interest exceeding two months before the date we receive your claim, and any part of the Loan balance resulting from Economic Costs, penalty interest charges and statutory charges on the Loan. A Disablement Cover Benefit will not be payable for Disability directly or indirectly as a result of: a Pre-Existing Condition any sickness, disease or symptoms contracted within the first month of starting or increasing Your Loan (for the increase in the Loan ) intentional self-inflicted injury or illness engaging in professional racing of any kind except foot racing being under the influence of alcohol or drugs involvement in criminal activity, or war or warlike operations 4. Involuntary Unemployment Cover What We will Pay No Involuntary Unemployment Benefit provided by this Involuntary Unemployment insurance is payable in respect of the Waiting Period of 30 days. If after the Waiting Period You remain Involuntarily Unemployed We will pay the Benefit provided by this Involuntary Unemployment Cover insurance ( the Involuntary Unemployment Cover Benefit ) to NAB, and if relevant to You as follows : For Principal and Interest Loans For Line of Credit facilities and Interest only loans Your Loan Repayments up to $10,000 per month. 0.75% of Your Life Cover Benefit up to $7,500, per month. If the benefit is more than the Loan Repayment due, the difference will be paid to You. The Involuntary Unemployment Cover Benefit payable will be calculated by Us by reference to the date of Your Involuntary Unemployment. We will pay the Involuntary Unemployment Cover Benefit, whilst You remain Involuntarily Unemployed until the earlier of: We have paid an Involuntary Unemployment Cover Benefit for a period of 90 days; and Your Policy ending. The following limits also apply to the Involuntary Unemployment Cover Benefit: one claim per calendar year for each person insured under the Policy; and a total of three claims for each person insured under the Policy. Involuntary Unemployment for part of a month If You are Involuntarily Unemployed for only part of a month the Involuntary Unemployment Cover Benefit payable will be calculated and paid proportionately, at 1/30 th of Your minimum monthly Loan Repayment for each day You are
Involuntarily Unemployed or 1/30th of 0.75% of Your Life Cover Benefit, as applicable. Exclusions Involuntary Unemployment Cover Benefits payable will not include the following: any Loan Repayments (including interest) in arrears for more than two months before the date we receive your claim, any accrued interest exceeding two months before the date we receive your claim, and any part of the Loan balance resulting from Economic Costs, penalty interest charges and statutory charges on the Loan. Involuntary Unemployment Cover Benefits will not be payable for Involuntary Unemployment directly or indirectly as a result of: being under the influence of alcohol or drugs involvement in criminal activity written or verbal notification of impending unemployment within 60 days of starting or increasing Your Loan (for the increase in the Loan) Your fixed term contract, and seasonal or casual work ending Your choosing to end Your employment Your position automatically ceasing under a partnership agreement or law unemployment due to industrial action unemployment due to normal and uncomplicated pregnancy or childbirth becoming unemployed when Employed by Your Family, or Your business temporarily ceasing to trade if You re Self Employed or in a business partnership. 5. Where Two People are insured under the Policy Where two persons are insured under the Policy, both persons shall be joint Policy Owners of the Policy. Notice to one of the Policy Owners in relation to any matter concerning the Policy shall be taken to be notice to both Policy Owners. Life Cover Only one Life Cover Benefit is payable under the Policy. If one of You dies or becomes Terminally Ill You ll receive the Life Cover Benefit and the Policy will end. In the event that both persons insured die at the same time the Life Cover Benefit is payable in respect of the person determined by fact or law to have died first and who satisfies all other requirements in the Policy for the Benefit to be payable. Any amount of the Benefit that is payable to the estate shall be the estate of that person. Disablement Cover and Involuntarily Unemployment Cover If one of You becomes Disabled or Involuntarily Unemployed, You ll receive either the Disablement Cover Benefit or the Involuntary Unemployment Cover Benefit as applicable. If You both become Disabled or Involuntary Unemployed at the same time, You ll receive just one Disablement Cover or Involuntary Unemployment Cover Benefit. The Benefit shall be payable in respect of the person determined by fact or law to have become Disabled or Involuntarily Unemployed first. We ll only pay one Disablement Cover or Involuntary Unemployment Cover Benefit at a time. If You re receiving a Disablement Cover or Involuntary Unemployment Cover Benefit and You die or become Terminally Ill, We ll pay Your Life Cover Benefit and the Policy will end. 6. Premiums and charges When Premiums are payable Premiums for this Policy and the frequency of payment of Premiums are shown in the current Policy Schedule. Premiums are payable in advance. Premium Rates can change We may change one or more components of our Premium Rates for Your risk classification at any time but: We will give You one month s written notice before We change Your Premium; We will only change Your Premium as at the anniversary date following any change; and We will not single You out for a change in Premium. Premiums refunded whilst Benefits are being paid We will refund any Premiums that You pay whilst You are being paid a Benefit. Premium Rates available on request Premium Rates for each type of insurance are available on request.
If Premiums are not paid This Policy will be cancelled and cover will cease if: a Premium is not paid in full by the date that it is due to be paid; and after providing You with notice as required by the applicable law, the Premium is still not paid in full by the end of that notice period. We will deduct any unpaid Premium from any Benefits paid under the Policy. Refunding Premiums If Your Policy is cancelled at Your request Your Policy will end on the receipt of Your cancellation request. Any Premium paid by You for a period after that date will be refunded. Government charges We reserve the right to recover from You the cost of any duty, tax, excise, impost, charge or deduction of the Commonwealth or any State or Territory Government, as they may apply to this Policy from time to time. There is no GST charged on the Premium. Family Law charges We reserve the right to charge a fee if We have to comply with a Family Law injunction or order which alters the rights, liabilities or property interests of You and to recover any legal costs incurred by us in responding to matters arising from an order or injunction. Claims We will pay a Benefit when We have proof satisfactory to us: that all the events entitling You to payment of the Benefit have happened; and of Your age. We may ask for further proof or information to be satisfied that You are entitled to the Benefit. Any proof or information that You must provide is at Your cost. If We require a medical examination by an appropriate specialist We appoint, We will pay for it. Medical information or reports required by us to support a claim under this Policy must be from a Registered Medical Practitioner in Australia and, in respect of specialist medical evidence, is from an appropriate specialist in a relevant medical field. A Benefit will only be paid if the Policy is in force when the events leading to the claim happen. If We do not accept a claim We will provide our reasons for non-acceptance. Time for Making Claims Subject to further terms below, a claim (together with the proof and information that We need) for the payment of the Benefit should be made within reasonable time after the event entitling You to payment of the Benefit under this Policy. If You do not make a claim within reasonable time or have unreasonably delayed making a claim, it may affect the assessment of Your claim and MLC may not be able to pay a Benefit. Claim forms are available by calling our MLC Client Service Centre on 1300 857 113 or writing to us at GPO Box 4397, Melbourne, VIC, 3001. For claims for Disability and Involuntary Unemployment Covers, the following special requirements apply: You (or someone representing You) should tell us You are Disabled or Involuntarily Unemployed within 30 days of the beginning of Disablement or Involuntary Unemployment; We will send You, or Your representative, a claim form or arrange a representative to contact You to complete the claim form; You should return the claim form to us (completed where required by You and Your Registered Medical Practitioner) within 90 days of the Disablement beginning. If You do not get a claim form, You must still provide details of the Disablement to us within 90 days, including the nature, cause and extent of the Disablement. We may ask for more information to help us assess Your claim; You should return the claim form to us (completed where required by the Insured, their employer and Centrelink) within 90 days of the Involuntary Unemployment beginning. If You do not get a claim form, You must still provide details of the Involuntary Unemployment to us within 90 days. We may ask for more information to help us assess Your claim;
Your Benefit will be reviewed regularly. We may require further proof of Disablement or Involuntary Unemployment if it continues. 8.
