This document is a guide to the list of school policies, procedures and duties that governing bodies of maintained schools are required to comply with as of 30th June 2011. Please note that the list is by no means exhaustive and will need to be updated in light of changes in government legislation. Additional information can also be found in Governors Briefing papers. Many schools will also choose to adopt a range of additional policies and documents not indicated below. Policies Policies contains the regulations and guidance that underpin a governing bodies decision-making process. Policies describe what must be done and the rationale behind them. The governing body must adhere to statutory policies as they are enshrined in law. Procedures A procedure is a series of actions or operations that have to be executed in the same manner on each occasion. Governing bodies may produce procedures to indicate how a policy will be implemented. The procedures indicated in this list are those that are required by law. Duties A duty is an obligation that governing bodies must make arrangements to comply with. Governing bodies must comply with the statutory duties listed here. Additional Duties of the Governing Body Election of chair and vice chair. Admission arrangements in foundation and voluntary aided schools: it is the duty of the governing body to consult with the local authority where it is proposed to make any changes to admission arrangements and policy. Committees: the governing body must determine the constitution, membership and terms of reference of any committee including statutory committees and review them annually. Delegation of functions: An annual review of functions delegated to headteacher and committees and agreement of level of budget which the headteacher can expend without reference to the governing body or finance committee. Arrangement for the approval of the annual budget: the governing body must decide annually whether the approval of the budget will be delegated to a committee or agreed by the full governing body. Approval of the budget together with the figure must be recorded in the minutes of the governing body on an annual basis. Receipt of the audited school fund account: The governing body must receive an annual report from the bursar on the auditing of the school fund account. Appointment of an independent examiner for the school fund account: An independent examiner (auditor) must be appointed annually. This may not be a governor or member of school staff. A relative of a governor / member of staff maybe appointed provided the governor / member of staff has no involvement with the school fund account. Receipt of the end of year (outturn) statement. The GB shall note annually receipt of the outturn statement at the year end. Approval for education visits which have a residential, adventurous or overseas element. General authority to approve all 1 day non adventurous trips maybe delegated to a member of the senior leadership team at the beginning of the year. The Governing Body (and / or headteacher) should ensure that all statutory assessments are conducted and results are forwarded to parents and appropriate bodies. The requirement source for the majority of the above is taken from The Guide to the Law for Governors, 2010, Section 157 and 175 of the Education Act 2002 and Safeguarding Children in Education and Recruitment (DfES 2006).
