A copy of this licence document must be carried on the vehicle and be available at all times for Inspection. 2. The licence cancels all previous licences. PART A The Licence is a general authorization issued pursuant to the Passenger Transportation Act, and in the case of an extra-provincial undertaking pursuant to the Motor Vehicle Transport Act, 1987 (Canada), and is authorized to provide the passenger transportation services which are included within the meaning of a general authorization, under the Passenger Transportation Act. 1. One or more motor vehicles as general passenger vehicles between points in the Province of British Columbia pursuant to the Passenger Transportation Act. 2. One or more motor vehicles as general passenger vehicles from any point in British Columbia and beyond the British Columbia border when engaged in an extra-provincial undertaking pursuant to the Motor Vehicle Transport Act, 1987 (Canada). 3. One or more motor vehicles as general passenger vehicles from the British Columbia border to any point in British Columbia and vice versa when engaged in an extra-provincial undertaking pursuant to the Motor Vehicle Transport Act, 1987 (Canada). PAGE 2 The Licence holder issued for this General Authorization has indicated that it will be operating commercial passenger vehicles in accordance with the following Inter-City Bus exclusion(s) as stated in the Passenger Transportation Regulation: Passenger Transportation Regulation, Section 2 (1) excerpt: (a) the commercial passenger vehicle (i) picks up passengers from one or more locations in a municipality, (ii) transports those passengers to a location outside of the originating municipality, and (iii) returns those passengers to the originating municipality; (b) no passengers board the bus other than those passengers referred to in paragraph (a)(i); (c) none of the passengers referred to in paragraph (a)(i) disembark in the originating municipality without having first gone to the location referred to in paragraph (a)(ii). Passenger Transportation Regulation, Section 2 (2) excerpt: the commercial passenger vehicle is operating as a connector bus. A connector bus is defined as a commercial passenger vehicle operating exclusively between one fixed terminating point (the base ) and another fixed terminating point (the facility ) that is a port, as that word is defined in section 5 of the Canada Marine Act, an airport or a terminal operated by a ferry operator, as that term is defined in the Coastal Ferry Act, if (a) in travelling from the base to the facility, all passengers picked up at or after the base are dropped off only at the facility, (b) in travelling from the facility to the base, the commercial passenger vehicle carries as passengers only those passengers who were picked up at the facility and drops off those passengers at or before the base, and (c) the licensee operating the commercial passenger vehicle has written authorization from the operator of the facility to pick up the passengers at that facility. PART B PAGE 3 The Licence is a special authorization issued pursuant to the Passenger Transportation Act, and in the case of an extra-provincial undertaking pursuant to the Motor Vehicle Act, 1987 (Canada), and is authorized to provide the passenger transportation services within the meaning of a special authorization, under the Passenger Transportation Act under the terms and conditions as specified below. Special Authorization: Inter-City Bus (ICB) Terms & Conditions Service: Transportation of passengers must be provided to and from each route point on a scheduled basis according to the minimum frequency that is set for the authorized route. Schedule: The licence holder must publish, in a manner accessible to the general public, a schedule for each route with the time and location of each stop, and must carry in each vehicle a copy of the schedule that the vehicle is following. Engaged Carrier Authorization: The holder of this licence may only operate as an inter-city bus when engaged by another licensed operator in the following limited circumstances: 1. The other licensed operator must have a special authorization to operate an inter-city bus under a licence issued pursuant to the Passenger Transportation Act (British Columbia) or the Motor Vehicle Transport Act (Canada), 2. The holder of this licence must have signed written authorization from the other licensed operator specifying the terms by which the licence holder is engaged including the time period for which the written authorization is valid, 3. The holder of this licence must operate its vehicles in accordance with all the applicable terms and conditions of the other licensed operator s licence, and 4. The holder of this licence must carry in its vehicles a copy of the written authorization referred to in paragraph 2 and a copy of the terms and conditions of the other licensed operator s licence when operating under this engaged carrier authorization. PAGE 4 Express Authorization: Transportation of standees is authorized only when all of the following conditions are met: 1. The licence holder has current and proper insurance coverage for the transportation of standees 2. Passengers are not permitted to stand for a period that is longer than 30 minutes or for a distance that exceeds 30 road kilometers, and 3. Freight and passenger baggage is not carried in the passenger compartment when standees are being transported. Route Overlap: The licence holder may publish schedules and operate vehicles in a way that consolidates the District of Tofino City of Nanaimo portion of Routes 1 and 2 on the condition that: Route Number: 1 of 3 Terminating Point 1: City of Nanaimo Terminating Point 2: District of Tofino (a) passengers traveling northbound via the consolidation point of Nanaimo are able to continue their trip to their destination north and west of Nanaimo, and (b) the scheduled wait time at the consolidation point of Nanaimo does not exceed 30 minutes. When inter-city bus routes are consolidated and the above route overlap conditions are met, the operation of one vehicle on the District of Tofino City of Nanaimo corridor is deemed, with respect to route frequency determinations, to be a vehicle operating on both routes. PAGE 6 Alternate Routing: The route points set out above do not preclude the licence holder from, on any portion of Highways 1, 4, 4A, 19 and 19A that is situated between the terminating points, making scheduled time stops or unscheduled drop-offs or conveying passengers who hail or flag the motor vehicle from the street.
