Orange County Bail Schedule Holders Pursuant to the 2002 Uniform Bail Procedures Committee meeting, this bail schedule was approved by the judges of the Superior Court of California, County of Orange, and effective September 1, 2002. 2. Law Enforcement Agencies Prevailing legislation places the burden on law enforcement agencies to notify the magistrate if the scheduled bail is not adequate for the crime. It is recommended that each agency make their personnel cognizant of 1270.1 Penal Code as certain provisions may apply if bail modification occurs. Also, paraphrased below is Penal Code section 1269c: 1269c PC. Orders setting bail in excess of, or less than, schedule amount. If a defendant is arrested without a warrant for a bailable felony offense or for the misdemeanor offense of violating a domestic violence restraining order, and a peace officer has reasonable cause to believe that the amount of bail set forth in the schedule is insufficient to assure the defendant s appearance or to assure the protection of a victim, or family member of a victim, of domestic violence, the peace officer shall prepare a declaration under penalty of perjury setting forth the facts and circumstances in support [of a higher bail]. 3. A. Rules of Application FELONY BAIL SCHEDULE 1. Rule #1 The Felony Bail Schedule shall be applicable throughout Orange County and is applicable to all arrests without a warrant for bailable felony offenses. 2. Rule #2 For any felony offense not specifically listed herein, bail shall be $10,000.00. 3. Rule #3 The following felony offenses will have a bail amount equal to the substantive offense which was the object of the conspiracy, solicitation, or attempt, when the arrest is for being a principal or accessory: Section 31 PC Section 32 PC Section 182 PC Section 653f PC Section 664 PC (Example of Rule #3: Booking of 182 PC and 207 PC will have a bail amount of $50,000.00 that is equal to 207 PC) 4. Rule #4* Persons not entitled to be released on bail are those charged with: a. Capital crimes (i.e., punishable by death) when the facts are evident or the presumption great) Principal capital offenses are first degree murder under the following special circumstances: 1) Murder for financial gain 2) Murder by a convicted murderer 3) Murder of multiple victims 4) Murder by destructive device, bomb, or explosive 5) Murder to prevent lawful arrest or to escape from lawful custody 6) Murder of a law enforcement officer, fireman, prosecutor, juror, judge, or other elected or appointed public official arising out of his official duties 7) Murder of a witness in retaliation for his/her testimony or to prevent his/her testimony concerning a prior crime 8) Murder by lying in wait, poison or torture 9) Murder while committing or attempting, or fleeing from, a robbery, kidnapping, rape, sodomy, oral copulation, molestation of a child under 14, burglary, arson or trainwrecking, mayhem, carjacking 10) Murder because of the victim s race, color, religion, nationality, or country of origin 1

11) Intentionally aiding and abetting or soliciting the actual killer in any of the foregoing special circumstances 12) Train wrecking; set fire to railroad bridge with death 13) Murder by discharging firearm from a vehicle b. Felony offenses involving acts of violence on another person when the facts are evident or the presumption great and the court finds based upon clear and convincing evidence that there is a substantial likelihood the person s release would result in great bodily harm to others; or c. Felony offenses when the facts are evident or the presumption great and the court finds based upon clear and convincing evidence that the person has threatened another with great bodily harm and that there is a substantial likelihood that the person would carry out the threat if released. (See California Constitution, Article 1, Section 12.) *NOTE: THE PRIMARY RESPONSIBILITY FOR RECOGNIZING THE EXISTENCE OF A CASE WHICH MAY POTENTIALLY FALL INTO ONE OF THE ABOVE CATEGORIES BEFORE THE FIRST COURT APPEARANCE IS ON THE ARRESTING AGENCY. In this type of case, a magistrate should be contacted before accepting bail prior to the first court appearance. This contact may be made after normal court hours through the Detention Release Officer. In noncapital murder cases the bail shall be $250,000.00 unless otherwise fixed by the magistrate. 5. Rule #5 Bail for 11350, 11358 and 11377 H&S not less than $25,000 when Penal Code felony firearms violation is also present. B. Bail Limit for Multiple Offenses A bail limit for a case with multiple charges will be established as follows: 1. Felony only The highest bail amount for any one felony offense will apply 2. Felony with misdemeanor or infraction violations. The highest bail amount for any one felony offense will apply. Misdemeanor and infraction bails will not be considered. C. Holds for Out-of-County Charges The Felony Bail Schedule will apply to holds placed for out-of-county charges when no amount has been previously established or shown on a warrant. D. VIOLATION OF PROBATION 1. Arrest without a warrant shall have NO BAIL if VIOLATION is for FELONY PROBATION 2. BAIL will be set at $15,000.00 if violation is a MISDEMEANOR PROBATION. E. All references to a code section shall include all subsections thereof unless a specific bail is set forth for a particular subsection. 2

Determining Bail The most current publication of the Judicial Council Uniform Bail and Penalty Schedule is hereby adopted and incorporated by reference, with the exception of the violations reflected in the misdemeanor portion of this bail schedule: 1. Misdemeanor bail shall be determined by first using the amount set forth in this publication. 2. If the violation is not specifically set forth in this publication, then bail shall be the amount set forth in the most current publication of the Judicial Council Uniform Bail and Penalty Schedule. 3. If bail has not been set by the Judicial Council, the amount of bail shall be determined as set forth under Section D, below. B. Revisions to Schedule The following procedure is established to make changes to the bail schedule without a formal meeting of the bail committee: 1. The staff will present to the chairperson of the bail committee all proposed changes to the approved bail schedule. 2. The chairperson will approve the changes for review by the committee. 3. The staff will distribute the changes for approval. 4. When the changes have been approved, a revised page for the bail schedule will be distributed to all agencies holding authorized copies. C. Additions to Schedule The following procedure is established to add a section to the automated bail schedule with approval from the chairperson of the bail committee: 1. When it is advisable to add a new section number to the automated bail schedule (computer based) because of increased usage, the staff will present the new section to the bail committee chairperson, who will have authority to approve the addition to the automated schedule. 2. Notification of the addition will be given to all members of the committee. 3. The conditions for the section will be the same as the following conditions shown for unlisted violations. 8

Bail Limit for Multiple Offenses Same Degree A bail limit is established for a case that has multiple offenses of the same degree, as follows: 1. Vehicle Code - Misdemeanors/Infractions The total amount of bail is not to exceed $500.00 (not counting assessment and night court). Assessment and night court are then added to the bail amount for applicable code sections. If bail is over $500.00 (not counting assessment and night court), then delete from the calculation the Vehicle Code violations with the least amount of bail until the total bail amount is $500.00 or less, then add the appropriate assessment and night court to the remaining applicable Vehicle Code sections. Bail for the 14601 CVC suspended license violations (see page 13) and the Driving under the influence violations 23152 and 23153 (see page 13) have bail settings of $300.00 or more. If one or more of these violations are part of a multiple vehicle code misdemeanor case then the aggregate bail will be set for the one violation with the highest setting in excess of $500.00. (No penalty assessment or night court is to be added.) 2. Other State and County Codes Misdemeanors (except Vehicle Code) The highest misdemeanor bail involved is to be the accepted bail. 3. All Codes Felony The highest felony bail involved is to be the accepted bail. 9

F. Bail Limit for Multiple Offenses Different Degree A bail limit is established for a case that has multiple offenses of a different degree as follows: 1. Felony with Misdemeanor or Infraction Violations A felony with a misdemeanor or infraction violation will take the highest felony bail. 2. Penal Code or Other State Codes Misdemeanors with Vehicle Code violations A misdemeanor with a Vehicle Code violation will take a total bail for the Vehicle Code violations, not exceeding $500.00 (not counting assessment or night court), plus the highest misdemeanor bail. The entire total is not to exceed $1,000.00, not counting the above Vehicle Code assessment and night court. Assessment and night court are then added to the bail amount for applicable Vehicle Code sections only. If bail for the Vehicle Code violations is over $500.00 (not counting assessment and night court), then delete from the calculation the Vehicle Code violations with the least amount of bail until the total bail amount for Vehicle Codes is $500.00 or less. Then add the appropriate assessment and night court to the remaining applicable Vehicle Code sections. When one or more misdemeanor violations have a $500.00 or more bail setting as may be listed in this bail table use only the bail setting for the one misdemeanor violation with the highest setting when adding to the vehicle code violation(s) for the aggregate bail. When both misdemeanor and vehicle code misdemeanors listed in this bail table have a bail setting of $500.00 or more take the highest misdemeanor violation bail setting and add to the highest vehicle code misdemeanor violation bail setting for the aggregate bail. (Do not add penalty assessment or night court.) G. California Vehicle Code Defective equipment violations exceptions to court appearance. Pursuant to Section 10.5(b) of the Judicial Administration Standards, Appendix to the California Rules of Court, the clerk is authorized to accept offers of proof of correction or compliance in accordance with the Judicial Council Uniform Bail Schedule without necessity of a court appearance. The dollar amount shown in the Judicial Council Bail Schedule involving defective equipment violations is merely a guide for the judge in imposing a fine. H. Bail Set on VC 40508 The Bail Committee has stipulated that all VC 40508 misdemeanor warrants be $86.00 base bail plus penalties. 10
