Transportation Services Contract 2016-2017 School Year 1. Services to be Performed Oakcrest agrees to provide the following transportation services during the School Year for the above Student(s): Bus transportation to and/or from School each school day from a designated pickup and delivery point and at times to be designated by School or any Third Party Provider (herein defined). Parent/Guardian acknowledges and agrees that School may arrange for a third party to provide any or all of the bus transportation services contemplated herein (each, a Third Party Provider ). 3. Time for Performance School or Third Party Provider will perform the services on each school day according to the School calendar beginning the first day of school and ending with the last day of school. 4. Oakcrest reserves the right to revise Bus Stops during the school year to accommodate the needs of the School or to comply with requests received from private property owners whose locations will be used as bus stops.
5. Terms of Payment Parents have the option of paying the Total Amount Due in full by August 5, 2016 or adding this amount to their FACTS Tuition Payment Plan for the School Year, to be paid over the same time period as their student s tuition. Please check the appropriate option below: Full Payment - Total Amount Due to be paid to Oakcrest by August 5, 2016. Payment Plan - Total Amount Due to be added to FACTS Tuition Payment Plan Please note that partial refunds will not be paid if a student withdraws from Transportation Services during the School Year. 6. Weather and Other Hazards. Oakcrest maintains the right to suspend operations without refund due to road conditions or circumstances beyond its control. In the event of inclement weather or emergency, Oakcrest follows Fairfax County Public Schools as announced on local radio (WTOP). Only in cases of an independent decision or timing of a decision will Oakcrest make its own announcement. Announcements will also appear on the Oakcrest website (Oakcrest.org) homepage in the News column. In addition, Bus families will receive a separate e-mail from the Transportation Department with specific information regarding schedule changes, cancellations, etc. 7. Damages. Parent/Guardian agrees to pay for any damages to transportation equipment willfully caused by Student. 8. Terminating the Agreement This agreement will become effective when signed by both parties. This agreement once executed may not be terminated by Parent/Guardian unless agreed to by School in School s sole discretion. Oakcrest may cancel this agreement at any time before the beginning of the School Year, in which event a refund will be paid by the School for the amount of any fee that has been paid by Parent/Guardian under this agreement. 9. Transportation Policies Parents will be responsible for the Student s compliance with the School s Transportation Policy (which addresses, among other things, parental oversight of students at bus stops and proper student conduct while riding the bus) as well as Student s compliance with the policies of any Third Party Provider with respect to bus transportation services. Any student who does not adhere to the Transportation Policy or the policies of any Third Party Provider will be subject to disciplinary action and possible dismissal from the bus, without refund. a. Oakcrest s atmosphere is one of mutual respect, trust and friendliness. Any conduct contrary to this atmosphere is not acceptable, and may be subject to disciplinary measures. Please see the Oakcrest Student Handbook section on Conduct. The Oakcrest bus driver has authority and responsibility for the students on the bus. Expectations and disciplinary measures as noted in the Oakcrest Student Handbook section on Conduct will be enforced. b. Oakcrest parents have the responsibility to coordinate a system whereby all students are accounted for and have a car in which to wait until the Oakcrest bus arrives in the morning and their rides come to get them in the afternoon. c. In order to ensure student safety and maintain good relations with the owners of the pick-up/drop-off sites, Oakcrest parents will be responsible for monitoring their children at these locations. d. The bus will leave each stop at the appointed time noted on the published schedule, unless the bus is delayed due to unforeseen traffic or another emergency. This will help ensure students arrive at School before classes begin. Parents please plan ahead to ensure your student arrives at the stop on-time. e. Food and drinks are not permitted on the bus. f. All students must remain seated for the duration of the trip. g. Nothing may be thrown out of the windows, nor may students stick hands, arms or heads outside the windows.
h. Students may not speak with the bus driver while the bus is in motion, except in the case of an emergency. i. On scheduled half-days, afternoon bus service will depart Oakcrest at 12:30 pm. On Special Schedule days, parents will be informed in advance of changes to departure times. j. For the afternoon/evening drop-offs, if there is no parent waiting for the student and the student is unable to contact her parent, the bus driver will wait up to 10 minutes. After that, the student will be required to ride the bus back to the School, where we will contact the parents to arrange for pick-up. Helpful Hint: Parents may wish to consider arranging car pools for drop-off and pick-up. k. In the event bus service is unavailable due to the illness of the bus driver or mechanical breakdown of the vehicle, we will notify families as soon as possible via e-mail (preferred family e-mail). Helpful Hint: Parents may wish to establish a phone tree to communicate. Entire Agreement This is the entire agreement between the parties with respect to the subject matter hereof. It replaces and supersedes any and all oral agreements between the parties, as well as any prior writings. 11. Successors and Assignees This agreement binds and benefits the heirs, successors and assignees of the parties. 12. Notices All notices required under this agreement must be in writing. A notice may be delivered to a party at the address that follows a party's signature or to a new address that a party designates in writing. 13. Governing Law This agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia. 14. Modification This agreement may be modified only by a written agreement signed by both parties. 15. Waiver If one party waives any term or provision of this agreement at any time, that waiver will be effective only for the specific instance and specific purpose for which the waiver was given. If either party fails to exercise or delays exercising any of its rights or remedies under this agreement, that party retains the right to enforce that term or provision at a later time. 16. RELEASE and INDEMNIFICATION PARENT OR GUARDIAN ON BEHALF OF MYSELF, MY SPOUSE, MY STUDENT(s) AND EACH OF THEIR HEIRS, AGENTS, EXECUTORS AND ASSIGNS RELEASE AND FOREVER DISCHARGE OAKCREST AND EACH OF ITS TRUSTEES, BOARD MEMBERS, OFFICERS, AGENTS AND EMPLOYEES (OAKREST AND SUCH OTHER PERSONS BEING REFERRED TO HEREIN AS RELEASEES ) FROM ALL LIABILITY, WHETHER IN CONTRACT OR IN TORT (OR ANY OTHER LEGAL BASIS), DEMANDS, CLAIMS, DAMAGES, ACTIONS AND CAUSES OF ACTION, ATTORNEY S FEES AND COSTS, PERTAINING TO OR RELATING IN ANY WAY TO THIS CONTRACT, THE SERVICES CONTEMPLATED HEREUNDER AND/OR MY
STUDENT(s) S PARTICIPATION IN THE TRANSPORTATION SERVICE. SUCH LIABILITY INCLUDES BUT IS NOT LIMITED TO CLAIMS FOR NEGLIGENCE, DEATH, PERSONAL INJURY, ILLNESS, DESTRUCTION OR DAMAGE TO PERSONAL PROPERTY, INVASION OF PRIVACY, BREACH OF CONTRACT OR BREACH OF WARRANTY EXCEPT WHERE ANY OF THE SAME IS DIRECTLY CAUSED BY THE GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF ANY OF THE RELEASEES. PARENT OR GUARDIAN UNDERSTANDS AND ACKNOWLEDGES THAT AS A RESULT OF MY EXECUTING THIS RELEASE, I AND THE PARTIES LISTED ABOVE, WILL BE FOREVER BARRED FROM BRINGING A CLAIM AGAINST ANY OF THE RELEASEES. FURTHER, PARENT OR GUARDIAN AGREES TO INDEMNIFY OAKCREST, AND EACH OF ITS TRUSTEES, BOARD MEMBERS, OFFICERS, AGENTS AND EMPLOYEES (OAKREST AND SUCH OTHER PERSONS BEING HEREIN REFERRED TO IN THIS PARAGRAPH AS INDEMNITEES ) AGAINST, AND TO HOLD EACH OF THE INDEMNITEES HARMLESS FROM, ANY LIABILITY, LOSS (INCLUDING BODILY INJURY OR DEATH), COST, DAMAGE OR EXPENSE (INCLUDING REASONABLE LEGAL FEES) THAT ANY OF THE INDEMNITEES MAY SUFFER AS A RESULT OF CLAIMS, DEMANDS, COSTS OR JUDGMENTS AGAINST ANY OF THEM PERTAINING TO OR RELATING IN ANY WAY TO THIS CONTRACT, THE SERVICES CONTEMPLATED HEREUNDER AND/OR MY STUDENT(s) S; PARTICIPATION IN THE TRANSPORTATION SERVICE, PROVIDED, HOWEVER, THAT ANY SUCH LIABILITY, LOSS, COST, DAMAGE OR EXPENSE THAT DIRECTLY RESULTS FROM THE GROSS NEGLIGENCE OR WILLFUL MISCONDUCT OF ANY INDEMNITEE IN CARRYING OUT ASSIGNED DUTIES PURSUANT TO THE CONTRACT, IS EXCLUDED FROM THIS AGREEMENT TO INDEMNIFY AND HOLD HARMLESS. 17. Severability If any court determines that any provision of this agreement is invalid or unenforceable, any invalidity or unenforceability will affect only that provision and will not make any other provision of this agreement invalid or unenforceable and such provision shall be modified, amended or limited only to the extent necessary to render it valid and enforceable.
