Request for Proposals: Entryway Monuments Overview The City of Meridian seeks proposals for a City of Meridian Entry Monument design. The winning design may be used to create entry monuments to be placed along prominent corridors entering Meridian city limits. Such entry monuments will welcome visitors and residents into the City and reflect the positive values of the Meridian community. Deadline All proposals must be received by The City of Meridian Clerk s Office no later than 5:00 p.m. on Friday, July 15, 2011. Proposals will not be accepted after this time. Proposals should be handdelivered or mailed, postage paid, to the following address. Eligibility and Design Specifications To be eligible for consideration, proposals must comply with all requirements of this RFP. The Entryway Monument design should embody and/or reflect the motto of the City of Meridian: Built for business designed for living. The City of Meridian logo shall be incorporated prominently into the proposed Entry Monument design; the logo may consist of the full text logo or the star swooshes, and may include the City s motto. See Attachment 1 for examples. The City of Meridian logo must comply with the City of Meridian Graphics Standard Manual, except that the color may be of, or made to look like, a durable construction material (e.g.: metal, stone, etc). The logo must be easily visible to passing vehicles and be distinguished from surrounding monument features. The proposed Entry Monument shall be largely composed of readily available materials that require little modification and may be assembled by cost-effective methods. Accessories, ornaments, and the logo may be crafted from custom materials. The design should use durable and low maintenance materials; anti-graffiti and anti-theft components are encouraged. Entry Monuments may be constructed in a variety of property conditions, so the design should be appropriate for a wide spectrum of property types and constrained locations which may or may not have access to utility services. However, designs with support for non-intrusive accent lighting, specifically of the logo, through internal power generation or where utilities services are available, are desirable.

The design shall not impede traffic or pedestrian lines of sight or create unsafe driving conditions in any way. The maximum size for an Entry Monument is eight feet (8 ) wide by eight feet (8 ) deep by ten feet (10 ) tall. The monument may need to fit within a two-foot (2 ) wide Ada County Highway District (ACHD) right-of-way, so proposals are preferred which include a scalable design such that a smaller variation could fit such constraints, or include a secondary monument design which is complimentary to the larger and fits within ACHD right-of-way. Limited exceptions may be made for aesthetic elements extending outside the bulk of the monument. The size, proportions, and use of logo may deviate between monument design variations, but monument variations should be complimentary in forms, colors, materials, and reflect a consistent design feel. All proposed monuments regardless of size should conform to all requirements outlined in this RFP. Proposal Requirements Proposals shall be submitted on 8 ½-by-11 inch paper. Proposals shall include: a clear and concise one-page typed narrative describing the intent and features of the proposed Entry Monument (narrative should include artist, team, or organization name; description of forms; description of materials; description of construction methods); and illustration(s) clearly featuring all visible edges of the proposed Entry Monument. Illustrations may be hand drawn or printed from digital renderings, but must be proportional and detailed to clearly convey intent; shall include approximate dimensions and/or reference elements to clearly illustrate comparative size, such as adjacent pedestrians or vehicles; and may be hand drawn or printed, but shall be provided in a permanent, non-smearing medium. Evaluation Process Eligible proposals shall be considered by a selection panel which may choose up to three (3) semifinalist designs, subject to the right of the City to reject all Proposals, as it may deem appropriate in its absolute discretion. Semi-finalists shall be chosen based upon adherence to proposal requirements, construction feasibility, embodiment of the City s motto, presentation of the City s logo, and presentation of aesthetically desirable design elements. Each semi-finalist chosen by the selection panel will be provided a stipend of $250.00 and shall, pursuant to a negotiated written agreement with City, provide a digital 3D model of the proposed design(s) using Google SketchUp. Semi-finalist proposals shall be adequately detailed to reflect use of proposed materials in a built Entry Monument. Public input will be collected on the semi-finalist proposals. The selection panel may choose one winning proposal from the semi-finalists, subject to the right of the City to reject all semi-finalist proposals, as it may deem appropriate in its absolute discretion. In evaluating the semi-finalists, the panel will consider public input, as well as embodiment of the City s motto, presentation of the City s logo, and presentation of aesthetically desirable design elements. The winning proposal will be awarded $1,000 for the proposal s designs and likenesses, and will be required to enter into a written agreement with the City similar to the attached sample agreement.

SAMPLE FOR ILLUSTRATIVE PURPOSES ONLY AGREEMENT FOR PURCHASE OF CITY ENTRY MONUMENT DESIGN This AGREEMENT FOR PURCHASE OF CITY ENTRY MONUMENT DESIGN ( Agreement ) is made this day of, 2011 ( Effective Date ), by and between the City of Meridian, a municipal corporation organized under the laws of the State of Idaho ( City ), and [Name] ( Contractor ). (City and Contractor may hereinafter be collectively referred to as Parties. ) I. SCOPE OF SERVICES. Contractor shall provide to City a [digitally rendered/hand-drawn], detailed, to-scale design of the entryway monuments, as described and depicted in Exhibit B, and all rights and interest to such Design and any and all components and derivatives thereof (collectively and separately referenced hereinafter as Design ). II. COMPENSATION. The total payment to Contractor for such design shall be $1,000.00. This amount shall constitute full compensation for any and all services, materials, and costs to be performed or furnished by Contractor. By 5:00 p.m. on August 26, 2011, Contractor shall provide City with a completed W-9 form and an invoice for design services, which City shall pay within thirty (30) days of receipt. City shall not withhold any federal or state income taxes or Social Security tax from any payment made by City to Contractor under the terms and conditions of this Agreement. Payment of all taxes and other assessments on such sums shall be the sole responsibility of Contractor. III. CREATION, INTEGRITY, AND OWNERSHIP OF DESIGN. A. Waiver and relinquishment of rights. Contractor shall, and hereby does, expressly waive any and all right, title, or interest in the Design. Contractor understands that this waiver includes waivers of the exclusive rights of reproduction, adaptation, publication, and display. Contractor agrees to relinquish any and all rights, title, and interest to the Design developed in connection with this Agreement, and hereby expressly waives any rights Contractor has to the Design, including, but not limited to, the rights afforded Contractors under the Copyright Act of 1976 and the Visual Arts Rights Act of 1990, Title 17 U.S.C. 101 et seq. Contractor understands and agrees that the right of attribution and integrity, as specifically set forth in 17 U.S.C. 106A, are hereby expressly waived except as otherwise provided herein. To the extent that the provisions of this Agreement differ with the Copyright Act of 1976 and Visual Arts Rights Act of 1990, the provisions of this Agreement will govern and any such differences in the rights and duties created thereunder are expressly waived. B. Limited edition. The Design shall each be a limited edition of one (1). Contractor warrants and represents that the Design purchased by City pursuant to this Agreement has never heretofore been designed, fabricated, installed, created, published, or copied and that Contractor is the sole creator and owner of all rights in the Design and the design thereof. C. Ownership. Upon the Effective Date of this Agreement, the Design shall be owned by City. D. No copyright. Contractor shall not make any claim to the copyright of the Design.

SAMPLE FOR ILLUSTRATIVE PURPOSES ONLY E. Alteration of Design. If any alteration occurs to the Design after installation, whether intentional or accidental and whether caused by City or others, upon written request of Contractor, such Design shall no longer be represented to be the work of Contractor. Other than as specified herein, Contractor specifically waives the right to claim any other remedy concerning the alteration of the Design as provided for under Idaho or federal law, whether by statute or otherwise. F. Removal from display. City shall have the right to remove monuments created using the Design from public display. IV. GENERAL PROVISIONS. A. Relationship of Parties. It is the express intention of Parties that Contractor is an independent Contractor and not an employee, agent, joint venturer, or partner of City. B. Compliance with law. Throughout the course of this Agreement, Contractor shall comply with any and all applicable federal, state, and local laws. C. Non-Discrimination. Throughout the course of this Agreement, Contractor shall not discriminate against any person as to race, creed, religion, sex, age, national origin, sexual orientation or any physical, mental, or sensory handicap. D. Agreement governed by Idaho law. The laws of the State of Idaho shall govern the validity, interpretation, performance and enforcement of this Agreement. Venue shall be in the courts of Ada County, Idaho. E. Severability. If any provision of this Agreement is found by a court of competent jurisdiction to be illegal, invalid, or unenforceable, the remainder of this Agreement shall not be affected. F. Notice. Any and all notice required to be provided by either of the Parties hereto, unless otherwise stated in this Agreement, shall be in writing and shall be deemed communicated upon mailing by United States Mail, addressed as follows: [ ] Either party may change its address for the purpose of this paragraph by giving written notice of such change in the manner herein provided. G. City Council approval required. The validity of this Agreement shall be expressly conditioned upon City Council action approving the Agreement. Execution of this Agreement by the persons referenced below prior to such ratification or approval shall not be construed as proof of validity in the absence of Meridian City Council approval.
