WILFUL AND WANTON NEGLIGENCE UNDER C.P.R.C. 74.153

CPRC 74.153 STANDARD OF PROOF IN CASES INVOLVING EMERGENCY MEDICAL CARE In a suit involving a health care liability claim against a physician or health care provider for injury or death of a patient arising out of the provision of emergency medical care in a hospital emergency department or obstetrical unit or in a surgical suite immediately following the evaluation or treatment of a patient in a hospital emergency department, the claimant [must] show by a preponderance of the evidence that the physician or health care provider, with wilful and wanton negligence,, deviated from the degree of care and skill that is reasonably expected of an ordinarily prudent physician or health care provider in the same or similar circumstances.

Turner v. Franklin, 325 S.W. 3d 771 (Tex.App.-Dallas 2010, pet. denied) [T]he legislature intended wilful and wanton negligence, as used in Section 74.153 of the Civil Practice and Remedies Code, to mean gross negligence.

PUNITIVE DAMAGE EXCLUSION Example of PL policy provision provides: VII. EXCLUSIONS This policy does not cover You for: Punitive or exemplary damages unless that coverage is required by the state where You practice.

TEXAS LAW EXEMPLARY DAMAGES EXCLUSION (a) Except as provided by Subsection (b), a medical professional liability insurance policy issued to or renewed for a physician or health care provider in this state may not include coverage for exemplary damages that may be assessed against the physician or health care provider. (b) The commissioner may approve an endorsement form that provides for coverage for exemplary damages for use on a medical professional liability insurance policy issued to: (1) a hospital; or (2) a for-profit or not-for for-profit nursing home or assisted living facility

Any such payment, obligation or expense, will not be reimbursed by INSURER,, even if it is a cost that would otherwise be covered under the policy.
