SUPERINTENDENT S MESSAGE The year 2011 provided the insurance industry in Alberta with many opportunities to demonstrate their agility, perseverance and resilience. Insurers operating in Alberta continued to face the increasing frequency and severity of weather related storms, financial market volatility, and historically low interest rates. They also dealt with the May 2011 wildfire that burned through the Town of Slave Lake causing the evacuation of 7,000 residents and more than $700 million in damages, making it the second costliest insured disaster in Canadian history. These factors combined to highlight the strengths of the insurance industry. The office of the Superintendent of Insurance provides policy and regulatory oversight for the insurance sector in Alberta. In 2011, we closely monitored existing and emerging risks to the solvency of the provincial insurance companies and reciprocal insurance exchanges that we oversee. We continued our efforts to monitor the industry to make sure that insurers were conducting business in a manner that ensures customers are being treated fairly and in compliance with the Insurance Act. As Superintendent of Insurance, I would like to express gratitude to: Mr. Dennis Gartner, Superintendent of Insurance and Mr. Arthur Hagan, Deputy Superintendent of Insurance who retired from the Alberta Public Service in 2011. SUMMARY OF INSURANCE BUSINESS IN ALBERTA The mission of the office of the Superintendent of Insurance is to provide policy and regulatory oversight for the insurance sector that is effective, fair and in the interests of Albertans. We achieve this by taking appropriate, fair and balanced regulatory actions and effectively consulting with Albertans and the insurance industry. The office regulates 259 insurance companies, reciprocal insurance exchanges and fraternal benefit societies that are licensed to operate in Alberta as follows: Fraternal Benefit Societies 10 Reciprocal Insurance Exchanges 22 Life Insurers 72 Property and Casualty Insurers 155 Total Insurers Licensed in Alberta 259 The office recovers all the costs of regulation and policy development from industry on an annual basis. PREMIUM STATISTICS Insurance is an $11.3 billion business in Alberta. In 2011, of the total premium dollars paid, 63 per cent went to property and casualty insurers and the remaining 37 per cent went to the life insurance industry: 37% 63% Property and Casualty Insurers Life Insurers Property and casualty insurers received $7.1 billion in premiums in 2011. ENFORCEMENT ACTIVITIES In 2011 the Superintendent of Insurance issued eight administrative penalties, pursuant to section 789 of the Insurance Act and the Enforcement and Administrative Regulation. The total amount of administrative penalties levied and collected was $461,000 from the following insurance companies. CERTIFIED EXAMINATIONS AND APPEAL BOARDS Certified Examiner Selection The Superintendent of Insurance appoints a certified examiner in the event of a disagreement between the claimant and the insurance company as to whether an injury arising from a motor vehicle accident is or is not a minor injury. The process is further described in the Minor Injury Regulation and the Insurance Act. The appointment of certified examiners began in 2005 as a result of the automobile insurance reforms in 2004. The number of certified examination applications processed by the Superintendent of Insurance office each year since 2005 is illustrated below. Appeal Boards During 2011, four appeal board panels were established by the Superintendent of Insurance. UNLICENSED INSURANCE Special Brokers The Superintendent of Insurance licenses special brokers. Special brokers are individuals who are permitted to negotiate insurance with unlicensed insurers in respect of any person or property in Alberta that is unavailable in the current regulated insurance market. In 2011 Alberta licensed 51 special brokers. Special brokers are required to pay taxes on premiums that would be payable if the premiums had been received by a licensed insurer. In 2011, special brokers reported and paid $8 million in taxes on $266.6 million in premiums. The tax collected for the period 2008 2011 is shown below. Unlicensed Insurance The Superintendent of Insurance also collects a charge from individuals and companies who choose to purchase their insurance from an unlicensed insurer without utilizing a special broker. The charge for unlicensed insurance is 50 per cent of the premium paid. Alberta collected $1.9 million in charges on unlicensed insurance in 2011. comparison of the amounts collected from 2008 2011 is shown below.
