General Terms and Conditions for Use of Web Services and Widgets Web Services Applicable from 01-11-2011 1. Web Services Posten Logistik AB, reg. number 556711-5380, (hereinafter referred to as Posten Logistik ), will provide web services and widgets (hereinafter referred to as Web Services ), which will enable the integration into the user s own website of services available from the website www.postdanmark.dk of Post Danmark Logistik A/S. Like Post Danmark Logistik A/S, Posten Logistik is part of the PostNord Group (PostNord AB). Web Services are owned and controlled by Posten Logistik. Only business customers are authorised to use Web Services. 2. Terms of Use These terms of use of Web Services are agreed to between Posten Logistik and the Account Owner. The terms of use are published at www.postdanmark.dk and are applicable from time to time. By accepting these terms of use, the Account Owner confirms that he is a business customer. In addition, the person that registers the user account confirms that he is authorised to represent the Account Owner. The Account Owner accepts an obligation to comply with the provisions contained in these terms of use. 3. Obligations of Account Owner Registration of account, authorised user, responsibility Authorised users are users that have registered an account for use of Web Services - in these terms of use referred to as the Account Owner. Upon registration of an account, the Account Owner receives a password for use in the administration of account details as well as a key (consumer ID) for use in the request for Web Services. The Account Owner is responsible for ensuring that unauthorised persons do not gain access to the password. The Account Owner is responsible for all authorised and unauthorised use of the password and shall indemnify
Posten Logistik for all damage caused by any use of the Account Owner s password. Posten Logistik reserves the right to make changes to Web Services. Information about planned changes to Web Services shall to the extent possible be communicated to the Account Owner by e-mail. The Account Owner is responsible for handling any impacts on systems and applications etc. arising from such changes. The Account Owner is responsible for supplying the technical knowledge, equipment, communication, software etc. required for access and ability to use Web Services. All intellectual property rights (e.g. copyrights and rights to service marks) to Web Services (including technical solutions), service marks, trademarks and other material on the website are owned by Posten Logistik, Post Danmark A/S or another company in the PostNord Group (or rights owner that Posten Logistik represents). If trademarks owned by the PostNord Group (that Posten Logistik and Post Danmark Logistik A/S are part of) are shown in connection with any use of Web Services, the Account Owner accepts an obligation to follow PostNord s current instructions for the trademark. New password If there is any reason to assume that another person has gained access to or knowledge of the Account Owner s password, the Account Owner shall without delay create a new password by logging in on the user account. Blocking If there is any reason to assume that another person has gained access to or knowledge of the Account Owner s key (consumer ID), the Account Owner shall without delay close his user account whereby the key will be blocked for continued use. Account details The Account Owner is responsible for ensuring that his account details are correct and undertakes, if these details are changed, to enter updated account details in the user account without delay. The Account Owner is aware that Posten Logistik will only use the e-mail address that has been registered for the communication of any messages to the Account Owner. Information about processing of personal data Account details (such as business name, e-mail address and domain) stated by the Account Owner in connection with the registration of an account will be kept and processed by Posten Logistik.
Posten Logistik will use these account details for identification of Account Owner, for administration of Web Services and relevant account and for communication of information to the Account Owner about planned changes to existing functions/tools, new versions and, to the extent possible, planned interruptions. To the extent that account details include personal data, Posten Logistik s collection and processing of this data will be regulated by the Swedish Personal Data Act (1998:204) and, as the controller of personal data, Posten Logistik is responsible for ensuring that the processing of this data is in compliance with the Swedish Personal Data Act. Personal data will be kept for a period of three (3) years from the latest time of use of the services by the Account Owner. Pursuant to the Swedish Personal Data Act, users are entitled to be provided with information about the personal data registered about them as well as to request that incorrect or incomplete data be rectified. In such cases, Posten Logistik should be contacted at the following address: Posten AB, Personuppgiftsombudet, 105 00 STOCKHOLM, Sweden. 4. Obligations of Posten Logistik Accessibility Under normal circumstances, Web Services are accessible everyday 24 hours a day, except where interruptions occur due to planned maintenance and improvements. Information about planned interruptions shall to the extent possible be communicated to the Account Owner by e- mail. Posten Logistik cannot guarantee that Web Services will be provided free from defects or without interruptions as operations are not monitored at certain points in time and interruptions therefore may occur. Changes to Web Services and current terms of use Posten Logistik reserves the right to make changes to or close Web Services. The Account Owner will be informed about such changes to Web Services via the e-mail address registered on the user account. In other respects, Posten Logistik shall be entitled to make changes to Web Services and these terms of use in order to, for example, make sure that Web Services or these terms of use conform to new technology, new routines for information security or new administrative procedures. The terms of use applicable from time to time are published at www.postdanmark.dk. The Account Owner is responsible for keeping abreast of current terms of use.
Term, termination and blocking Upon acceptance of these terms of use, access to Web Services shall be provided until further notice after the registration of a user account. The Account Owner may with immediate effect close the account by logging on in the user account. Posten Logistik shall, for any reason whatsoever, be entitled to close the Account Owner s user account one (1) month after a message to that effect has been communicated to the e-mail address registered by the Account Owner. Posten Logistik shall furthermore be entitled to close the Account Owner s user account with immediate effect and consequently block the user account and key (consumer ID) for use if: - the Account Owner uses Web Services that are contrary to these terms of use or the objective of Web Services, or - there is a fair reason to assume that the Account Owner may fail to fulfil his obligations in relation to Posten Logistik, or - such information has been disclosed about technical or administrative routines for information security that there is a fair reason to assume that Web Services may be abused, or - such information has been disclosed that there is a fair reason to assume that the Account Owner may fail to comply with laws, executive orders and official rules and regulations, or use Web Services in contexts that are offensive, cause indignation or may cause injury or other nuisance to Posten Logistik or any third-party. Liability Access to Web Services shall be provided in the present form and, until further notice, at no charge to the Account Owner. No warranty shall be accepted. Consequently, Web Services used by the Account Owner do not provide warranties. Posten Logistik shall not be liable for direct or indirect loss or damage, consequential loss or damage, lost earnings etc., such as, but not limited to, loss or damage which arises due to: - inaccessible, inoperative or defective Web Services, - blocked access to Web Services, - incorrect information provided in Web Services. Dispute resolution and governing law The parties shall endeavour to amicably resolve any disputes arising in connection with Web Services and/or in connection with these terms of use. In the event that a dispute cannot be resolved amicably, the matter shall be resolved by the courts of general jurisdiction in Sweden with Stockholms tingsrätt as the court of first instance. Swedish substantive law shall apply to the matter of the dispute between the parties.
5. Customer Service If the functionality of Web Services is inconsistent with the functional description, the Account Owner may communicate information about this lack of consistency to the Customer Service of Post Danmark Logistik by e-mail sent to dpd@dpd.dk. The remedy of defects may be carried out by Posten Logistik at its own discretion and at the speed that Posten Logistik considers to be reasonable in proportion to the scope of a defective service. Posten Logistik s liability for defective Web Services shall be limited to the liability stated under Liability in paragraph 4.
