Legal Expenses Insurance Document For legal policies effective on or before the 3rd January 2011 Definitions We, Us, Our The Underwriters of this insurance and/or their authorised Claims Agents and Sales Agents acting on behalf of the Underwriters. Insured, You, Your The person to whom this insurance has been issued and who has paid or promised to pay the premium. Insured Person The Insured and any authorised driver of or passenger carried in the Insured Vehicle. Insured Vehicle The motorcar, motorcycle or commercial vehicle specified in the underlying policy of motor insurance taken out by the Insured. Claims Agent ACM ULR. Sales Agent Any Intermediary to whom this facility has been granted. Underwriters Equity Red Star, Library House, New Road, Brentwood, Essex, CM14 4GD. Professional Representative An accountant, Solicitor or other suitably qualified person appointed by us to represent Your interests. Solicitor The appropriately qualified lawyer, legal representative or specialist consultant appointed by Us to act on behalf of the Insured. Vetting Solicitor Appointed by Us to review the prospects of success. Limit of Indemnity Is the maximum sum that the Underwriters will pay in aggregate in respect of all Legal Costs and Expenses incurred by the Solicitor or the Defendant in relation to the prosecution of a claim, which is covered by this insurance subject always to the maximum indemnity of 50,000. Legal Costs and Expenses The reasonable and irrecoverable costs incurred by the Solicitor on a standard basis which an Insured Person is ordered to pay by a Civil Court or which are agreed by negotiated settlement with Our agreement. Defendant The person, company or partnership that the Insured alleges is responsible for the Insured Incident. Insured Incident Any road traffic accident (excluding claims for theft or fire) which results in damage to the Insured Vehicle or damage to any personal property owned by an Insured Person whilst in or on the Insured Vehicle or any injury to or death of an Insured Person whilst in, on or mounting or dismounting from the Insured Vehicle. Period of Insurance The period commencing from when the Insured pays or promises to pay the premium to the Sales Agent to the expiry date of the underlying policy of motor insurance in force in respect of the Insured Vehicle which in no circumstances will exceed 12 months. Reasonable Prospects of Success Better than 50/50 in the opinion of the Vetting Solicitor, in the event of a dispute Condition 12 applies. Standard Terms and Conditions for Solicitors and Professional Representatives In order to maintain quality standards We require all Professional Representatives to agree to Our standard terms and conditions which, among other things will set out service standards, hourly charging rates, fees and expenses and give Us the right to audit Your file. These terms and conditions are regularly updated and a copy will be supplied to You on request. In the event of any dispute as to the reasonableness or otherwise of these terms and conditions then, condition 12 will apply. Territorial Limits (a) Great Britain, Northern Ireland, The Isle of Man and the Channel Islands - All Motor Vehicles 2

(b) Andorra, Austria, Belgium, Croatia, Czech Republic, Denmark, Eire, Finland, France, Germany, Greece, Hungary, Iceland, Italy (including Sardinia), Luxembourg, Netherlands, Norway, Portugal, Slovak Republic, Slovenia, Spain, Sweden, Switzerland, (including Liechtenstein) - Private cars, Motorcycles and Commercial vehicles up to 35cwt only. Cover The Underwriters will indemnify the Insured Person against Legal Costs and Expenses incurred in the pursuit of a civil claim against a Defendant arising from an Insured Incident subject to: - a) The Insured having paid or promised to pay the premium. b) The Insured Incident taking place within the Territorial Limits and within the Period of Insurance. c) The claim having Reasonable Prospects of Success. d) The maximum sum We pay not exceeding the Limit of Indemnity. e) The terms and conditions of this policy. Conditions 1. We can attempt to settle the claim prior to the appointment of Solicitors or the issue of legal proceedings. 2. We can take over conduct of any claim at any time in the name of the Insured Person. 3. We can issue proceedings for Our benefit in the name of the Insured Person to recover any payments We have made under this insurance. 4. Upon notification of Your claim, we will appoint a Professional Representative under our Standard Terms and Conditions for Solicitors and Professional Representatives to investigate and advise You, and, if appropriate, to undertake negotiations on Your behalf, with a view to settlement. 5. If We consider that it is appropriate to issue legal proceedings We shall nominate a Solicitor to act on behalf of the Insured Person. The Insured Person may nominate a Solicitor of their own choice however such Solicitor must submit full details of their experience and expertise and must agree to work to Our standard terms and conditions for Solicitors and Professional Representatives. In the event that We cannot agree such nomination the Insured Person will have the right to arbitration as set out in the conditions of this insurance. 6. If Your Professional Representative refuses to continue acting for You or You discontinue his instructions then Our liability will stop at once unless We agree to the appointment of another Professional Representative. In order to ensure that We are fully informed of progress, We will be entitled to get any information We need from the Professional Representative. 7. We have the right to withdraw indemnity under this insurance if the Insured Person is declared bankrupt, goes into liquidation (voluntary or otherwise), appoints a receiver or has a receiver appointed. 8. We may cancel this insurance by giving the Insured 7 days notice in writing by recorded delivery to the Insured s last known address. 9. We may at Our discretion discharge all Our liabilities to the Insured Person by paying a sum equal to that claimed subject always to such sum not exceeding the Limit of Indemnity. 10. You and / or the Insured Person must: a) Report all claims to Us without delay b) Take all reasonable steps to minimise any amount claimed from the Defendant c) Co-operate with Us at all times and forward any communications received in connection with an Insured Incident to Us without delay and supply Us with any information We require. d) Co-operate with the appointed Solicitor including giving such instructions as We require and keep the Solicitor and Us fully informed of any developments or material changes in circumstances that may affect the progress or settlement of the claim. e) Advise Us immediately of any offers of payments to settle the claim. f) Not accept any offer of payment or enter into settlement negotiations without Our express agreement. g) Instruct the Solicitor to have the Legal Costs and Expenses assessed taxed or audited if We request such action. h) Co-operate fully with Us to assist Us to recover any Legal Costs and Expenses We have had to pay on Your behalf that have been reasonably incurred in connection with the pursuit of the claim. i) Adhere to the terms and conditions of this insurance at all times 11. If the Insured Person makes any claim under this policy which is fraudulent or false or where there is collusion between the Insured Person and the Defendant this policy shall be declared void. 3

12. In the event of a dispute arising between You and Us, You may ask for the dispute to be referred to an independent arbitrator who is acceptable to both parties. In the event that such an arbitrator cannot be agreed upon an arbitrator will be nominated by the President of the Bar Council and the decision will be binding upon both parties and the cost of the arbitration will be borne by the losing party. 13. Co-operate fully with Us and the Solicitor in any action or issue of legal proceedings that may be necessary to enforce any rights or remedies that We become or may become entitled to under subrogation upon Us paying or becoming liable to pay any losses under this policy. 14. English Law will at all times govern the contract of insurance evidenced by this certificate. 15. No legal proceedings to be commenced without Our consent. Such consent not to be unreasonably withheld. 16. If You unreasonably reject an offer of settlement and fail to recover a greater sum, We will not pay Your legal costs and expenses after such offer was rejected. 17. This insurance is written in English and all communications about it will be in English. Exclusions 1 Any Legal Costs and Expenses incurred prior to Our confirmation of indemnity being granted to You under this policy. 2. Any Legal Costs and Expenses or fees where Your Solicitor or Professional Representative fails to comply or refuses to comply with our Standard Terms and Conditions for Solicitors and Professional Representatives. 3. Any claims arising out of any deliberate criminal act or omission or fines and penalties imposed by a criminal court. 4. Any claims where the Defendant cannot be traced. 5. Any claims occurring from use of the Insured Vehicle for motor racing, rallies, speed trials or competitions of any kind. 6. The legal expenses of an Insured Person with whom you take legal proceedings. 7. Any claim (excluding claims made by any authorised driver or passenger) where the Insured Vehicle is found to be in an unroadworthy condition or does not have a valid MOT certificate at the time of the Insured Incident. 8. Any claim not reported to Us within 90 days of the occurrence of the Insured Incident. 9. Any claims that You are indemnified for under any other policy of insurance. 10. Any claims or counter claims made against You by the Defendant. 11. Any claim arising from ionizing radiation or contamination from irradiated nuclear fuel or from any nuclear waste. 12. Any claim arising from riot civil commotion war invasion acts of hostility by foreign powers confiscation nationalization requisition or damage to property by or under the order of any government. Complaints Procedure We always aim to provide a first class standard of service. However if You have any complaint about Your Legal Expenses Insurance or Our service You should in the first instance write with full details of Your complaint to: Customer Relations Administration Team ACM ULR, Pegasus House, Bakewell Road, Orton Southgate, Peterborough PE2 6YS Who will respond fully to Your complaint within 10 working days. If You are still not satisfied You should contact the Chief Executive of the Underwriters of this policy who will attempt to resolve Your problem: Equity Red Star Library House, New Road, Brentwood, Essex CM14 4GD If You are still not satisfied You can contact: Financial Ombudsman Service South Quay Plaza, 183 Marsh Wall, London E14 9SR This complaints procedure does not affect any legal right You may have to take action against Us. Financial Services Compensation Scheme (FSCS) If We are not able to pay all valid claims under this insurance, You may be entitled to compensation under the Financial Services Compensation Scheme. The scheme will pay 90% of a claim without any upper limit. For types of insurance You must have by law (such as third party insurance under a motor policy), the scheme will pay the whole claim. You can get more information from the Financial Services Compensation Scheme, or by visiting the website at www.fscs.org.uk. 4

You will need to confirm the following: Policyholder s name and address Policy number Legal Expenses Insurance Legal Expenses Insurance (the Product ) is a supplementary Product available to holders of certain motor insurance policies. Purchasers of the Product are entitled to legal expenses insurance. The Product is administered by ACM ULR Limited. Details of the legal expenses insurance are set out in Section 2 of this document. The Product is underwritten by AmTrust Europe Limited. Details of the services available, and the terms and conditions subject to which they are provided, are set out in Section 2. Section 1 Definitions Each of the words or phrases listed below will have the same meanings wherever they appear in bold in this Product. ACM ACM ULR Limited. ACM s role is to administer the insurance and service elements of the Product. The insurance element is underwritten by AmTrust Europe Limited and the services which are the subject of the service element are provided by a panel of suppliers carefully selected within their areas of expertise. Appointed Legal Representative Any lawyer or other suitably qualified or experienced person appointed to act for an Insured Person. Claim A civil claim for damages for any Uninsured Loss arising out of an Insured Event. Insured Event An accident arising from the negligence of a Third Party which results in the Insured Person incurring Legal Expenses in bringing a Claim relating to: (i) loss of or damage to the Insured Vehicle; (ii) damage to any personal property owned by the Insured Person or for which the Insured Person is legally responsible while such property is in or on the Insured Vehicle; or, (iii) death or personal injury to the Insured Person while travelling in or getting into or out of the Insured Vehicle occurring during the Period of Insurance and within the Territorial Limits of this Product. Insured Person (i) the Policyholder (ii) any person authorised to drive the Insured Vehicle under the Motor Vehicle Insurance Policy and (iii) any passenger in the Insured Vehicle with Your permission, or their legal representatives in the event of death. Insured Vehicle Means the motor car, motorcycle or commercial vehicle insured by the underlying Motor Vehicle Insurance Policy, including any caravan, sidecar or trailer properly constructed to be towed by such a vehicle and attached to it by normal means. Legal Expenses Any legal fees, costs and disbursements reasonably and properly incurred in connection with any Legal Proceedings issued in the United Kingdom: (i) by the Appointed Legal Representative, including fees of Counsel instructed by him when acting on behalf of the Insured Person in bringing a Claim; such costs shall be limited to those that would be payable on a standard basis; and/or (ii) by any other party to the Claim which the Insured Person is liable to pay as a result of an order or award of the court or other tribunal or a negotiated settlement but only where such settlement was made with Our agreement in accordance with paragraph 6.4 of Section 2 of this Product. 5

Legal Proceedings All legal work undertaken with the approval of the Underwriters in connection with a Claim which is subject to the jurisdiction of courts within the Territorial Limits. Limit of Cover A maximum of 100,000 for all Legal Expenses of the Insured Person and including the costs of any other party to the Claim where awarded arising out of any one Insured Event, such limit to include the costs of any appeal approved by Us in accordance with clause 10.19. Motor Vehicle Insurance Policy The vehicle insurance policy issued to You in compliance with the Road Traffic Act. Period of Insurance The period during which the Motor Vehicle Insurance Policy is in force. Territorial Limits Great Britain, Northern Ireland, Isle of Man, Channel Islands, Andorra, Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Federal Republic of Germany, Greece, Hungary, Republic of Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden and Switzerland inc Liechtenstein. Third Party The other person(s) and/or party(ies) responsible for the Insured Event, excluding the Insured Person. Underwriters AmTrust Europe Limited. Uninsured Loss Any loss, including death, personal injury, damage or resultant loss sustained by the Insured Person arising out of an Insured Event where such loss is recoverable from the insurers of a Third Party and is not covered by the Insured Person s underlying Motor Vehicle Insurance Policy. We, Us, Our ACM and/or the Underwriters. You, Your, Policyholder The person, firm or company who has taken out this Product. Section 2 Legal Expenses Insurance Cover ACM will, provided that all payments which have at the time fallen due in respect of this Product and the underlying Motor Vehicle Insurance Policy have been made and all other obligations of the Policyholder under this Product and the underlying Motor Vehicle Insurance Policy have been complied with, make arrangements for the provision of the following insurance cover to the Insured Person: 1. Scope of Cover Provided that the Policyholder and all Insured Persons comply with all their obligations under the applicable Motor Vehicle Insurance Policy and this Product, the Underwriters agree to provide cover for the Insured Person against Legal Expenses in respect of an Insured Event occurring within the Territorial Limits during the Period of Insurance, subject to the terms of this Product and to the exclusions and conditions which it contains. However the total amount payable under this Section 2 shall not exceed the Limit of Cover. 2. Compliance and Precautions The Policyholder and all Insured Persons must comply with all the terms and conditions of this Product and take all reasonable precautions to minimise the cost of Claims or Legal Proceedings and attempt to prevent any event which may cause a Claim. 3. Reporting a Claim The Insured Person must immediately report to Us or our nominated agents any accident which may give rise to a Claim under this Section 2 and must complete any forms requested. The Insured Person must supply, without delay, all information required by Us or the Appointed Legal Representative. All information and forms must be sent to Us at the address shown on the claim form. The Insured Person must not do anything which may prejudice their case. 4. Acceptance of a Claim Where We accept a Claim, We will notify the Insured Person in writing as soon as practicable. 5. Representation 5.1 The Underwriters and We on their behalf reserve the right to make Our own investigations into the case. 5.2 We also have the right to negotiate and settle the Claim, in the Insured Person s name, before an Appointed Legal Representative is instructed. In 6

the event of any dispute between the Insured Person and Us as to the appropriate level of such settlement the matter may be referred to arbitration in accordance with paragraph 5 of Section 3. 5.3 Where appropriate We will pass the matter to an Appointed Legal Representative to handle and conduct the Claim who will be instructed in the name of the Insured Person and who may negotiate and settle the Claim on their behalf. 5.4. Where Legal Proceedings are necessary or where the Claim includes a claim for personal injury or death or where it is otherwise required, such Appointed Legal Representative shall be a solicitor nominated by Us subject to paragraph 5.5 below. 5.5 Pursuant to Regulation 6 of the Insurance Companies (Legal Expenses Insurance) Regulations 1990 You nonetheless shall be free to choose as Appointed Legal Representative a solicitor having suitable qualifications as necessary to represent You in any proceedings and/or to serve Your interests in the event that any conflict of interest arises. 5.6. Where Legal Proceedings are to be commenced with respect to an Insured Event occurring within the Territorial Limits and outside the United Kingdom, the Appointed Legal Representative shall be a solicitor who will initiate proceedings in the courts of the United Kingdom against the Third Party s insurer and/or its appointed claims representative as defined by the Motor Vehicles (Compulsory Insurance) (Information Centre and Compensation Body) Regulations 2003. 6. Control of the Claim 6.1 The Insured Person must co-operate fully with Us and the Appointed Legal Representative and in particular We and the Appointed Legal Representative must be kept continually and promptly informed of all developments relating to the Claim of which the Insured Person is aware and must be provided immediately with all information, evidence and documents relating to the Claim in his possession. 6.2 We shall have direct access to the Appointed Legal Representative in relation to any Claim at all times. 6.3 The Insured Person must instruct the Appointed Legal Representative to produce to Us immediately any documents, information or advice in his possession. The Insured Person must also give the Appointed Legal Representative such prompt, proper and reasonable instructions in relation to the Claim and the Legal Proceedings as We or the Underwriters require. 6.4 The Insured Person should advise Us directly or through his Appointed Legal Representative immediately of all offers to settle or payments into Court in respect of the Claim. No offer of settlement or negotiation can be made without Our agreement. 6.5 If the Insured Person does not accept any offer or payment into Court and We consider that the outcome of the case will not be bettered, We reserve the right to withdraw cover and will not be responsible for any further Legal Expenses after the last date on which the offer or payment into Court could be accepted without the permission of the Court or the Third Party. 6.6 We may discharge Our liabilities to the Insured Person under this Section 2 at any time by paying an amount equal to that claimed in the Claim. 6.7 The Insured Person shall take all reasonable steps to mitigate the costs of the Claim or any Legal Proceedings relating thereto. 6.8 The Insured Person must send to Us directly or authorise the Appointed Legal Representative to send to Us all bills for Legal Expenses, orders or awards for costs immediately on receiving them and We have the right to have these submitted for assessment by the courts or certification by the Law Society. 6.9 The Insured Person must authorise any Appointed Legal Representative to receive any sums by way of legal costs recovered from the Third Party and to pay the same to Us to the extent of the sums covered under this Section 2. Any sums received directly by the Insured Person should similarly be paid over to Us to the extent of the sums covered under this Section 2. 6.10 The Insured Person must take all action possible to recover any costs, charges or fees We or the Underwriters may have paid or be liable to pay under this Section 2 and pay any such amounts recovered to Us. In any event, upon payment of all sums due for Legal Expenses under this Section 2 We can take over, and if necessary conduct, proceedings in the name of the Insured Person to recover such Legal Expenses which the Insured Person is entitled to receive from the Third Party. 7

7. Withdrawal If the Insured Person withdraws from a Claim or discontinues instructions to an Appointed Legal Representative expressly or by omission without the agreement of the Underwriters or ACM all Legal Expenses will become the responsibility of the Insured Person. The Underwriters and ACM will be entitled to be reimbursed by the Insured Person for Legal Expenses paid or incurred during the course of the Claim. 8. Dual Insurance If at the time of any Insured Event there is any other insurance, which provides cover for any of the loss claimed in the Claim We will only be responsible for the payment of Legal Expenses in relation to the amount not recoverable under that insurance. 9. Prospects of Success Cover will only be provided if We and, where applicable, the Appointed Legal Representative, are of the opinion that there are reasonable prospects of recovery from the Third Party and when the Insured Person s Claim outweighs the Legal Expenses of pursuing the Claim. We can give written notice to the Insured Person and the Appointed Legal Representative to discontinue cover if during the course of a Claim We consider reasonable prospects of success no longer exist. In the event of any dispute as to the prospects of success of a Claim between the Insured Person and Us the matter may be referred to arbitration in accordance with paragraph 5 of Section 3. 10. Exclusions The Underwriters will not cover the Insured Person in respect of: 10.1 any Insured Event which took place prior to the Period of Insurance. 10.2 any Claim reported to Us more than 180 days after the Insured Event. 10.3 any Legal Expenses for any period subsequent to a refusal by the Appointed Legal Representative to act further for the Insured Person for a reason which We consider is justified unless We agree to another Appointed Legal Representative being instructed. 10.4 any case where the Insured Person has misled Us or the Appointed Legal Representative as to the circumstances of the Insured Event. 10.5 any case where the Insured Person fails at the time of making the Claim, or at any stage, to disclose to Us and/or the Appointed Legal Representative material facts relevant to the Claim. 10.6 compensation, costs, damages, fines or penalties or any kind awarded by a court of criminal jurisdiction. 10.7 claims for damage to any property or any related loss, expense or resultant loss. 10.8 any Claim arising out of a deliberate or criminal act or omission or which is found to Our satisfaction to be of a fraudulent nature. 10.9 any Claim arising from the theft or attempted theft of the Insured Vehicle. 10.10 any case where the Policyholder does not possess a valid Motor Vehicle Insurance Policy, valid road fund licence or MOT for the Insured Vehicle or a valid driving licence. 10.11 any case where the Insured Vehicle is not in a roadworthy condition at the time of the Insured Event. 10.12 any Claim where the Policyholder s motor insurers are entitled to repudiate the Motor Vehicle Insurance Policy or refuse cover. 10.13 any Insured Event arising out of the use of an Insured Vehicle by the Insured Person in connection with racing, rallies, trials or competitions of any kind. 10.14 any Claim where the Third Party cannot be traced or identified. 10.15 any Claims arising from: (i) ionising, radiation or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel. (ii) the radioactive, toxic, explosive or other hazardous properties of any nuclear assembly or component of it. (iii) riot, civil commotion, war, invasion, acts of foreign enemies, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, nationalisation, requisition, destruction or damage to property by or under the order of any government or public or local authority. (iv) pressure waves caused by aircraft or any other airborne devices travelling at sonic or supersonic speeds. (v) the failure of any device to recognise, interpret or process any date as its true calendar date. 8

10.16 Legal Expenses incurred prior to notification of the Insured Event to Us. 10.17 Any Legal Proceedings dealt with by a Court or other body, outside the United Kingdom and/or to which We have not agreed. 10.18 Legal Expenses relating to representation at any arbitration (but Legal Expenses relating to advice and assistance in connection with arbitration are covered) or at any interim hearing except in so far as such interim hearing occurs in the ordinary progression of the Claim in accordance with the Civil Procedure Rules. 10.19 Legal Expenses incurred in connection with any appeal from the judgement of any Court unless We are notified of any proposed appeal at least five working days before the expiry of the deadline for giving notice of appeal and We consider the appeal to have reasonable prospects of success. 10.20 Legal Expenses incurred in connection with small Claims in the Sheriff Courts in Scotland. 10.21 any undertakings the Insured Person gives to the Appointed Legal Representative, or which the Insured Person or the Appointed Legal Representative gives to any person about payment of fees or expenses, unless We have given prior written authority. 10.22 Legal Expenses incurred when the amount of the Claim is outweighed by the Legal Expenses. Section 3 General terms applicable to all elements of the Product 1. Compliance and Avoidance We and/or the Underwriters have the right to cancel this Product and declare the same null and void if: 1.1 the Policyholder does not hold a valid Motor Vehicle Insurance Policy, at the time of the Insured Event for the vehicle involved. 1.2 the Policyholder s motor insurers are entitled to avoid, or to refuse to provide cover under, the Motor Vehicle Insurance Policy. 1.3 any claim or request for the provision of any service under this Product, is fraudulent or false in any material respect. 2. Communication All notices and communications from Us, the Underwriters or the Appointed Legal Representative will be considered to have been sent if despatched to the last known address of an Insured Person. 3. Alteration You must notify Us immediately of any change, which affects this Product. 4. Complaints Any enquiry or complaint regarding this Product may be addressed to: the Customer Relations Department, ACM ULR Limited, Fusion House, Bretton Way, Bretton, Peterborough, PE3 8BG. We will contact You within five days of receiving Your complaint to inform You of what action We are taking. We will try to resolve the problem and give You an answer within four weeks. If it will take Us longer than four weeks We will tell You when You can expect an answer. If We have not given You an answer in eight weeks We will tell You how You can take Your complaint to the Financial Ombudsman Service for review. If You are not satisfied with the way the complaint has been dealt with You may be entitled to refer Your complaint to the Financial Ombudsman Service, South Quay Plaza, 183 Marsh Wall, London E14 9SR. Arbitration In the event of any dispute or difference whatsoever arising out of this Product or any Claim made thereunder, the matter shall be referred to an arbitrator, who shall be either a solicitor or a barrister agreed upon by the Insured Person and Us. If the Insured Person is not the Policyholder, by claiming under this Product he agrees to be a party to any Arbitration under this Clause whether jointly with the Policyholder or otherwise and whether as claimant or defendant. If an arbitrator cannot be agreed then the President of the Law Society or the Chairman of the Bar Council or similar legal professional body within the Territorial Limits will choose one. The appointment and subsequent arbitration shall be binding on both parties. 9

Whoever loses the arbitration must pay all the costs involved. If the decision is not clearly made against the Insured Person or Us, the arbitrator will decide how the Insured Person and We will share the costs. 6. Governing Law This Product shall be governed by and construed in accordance with English Law. 7. Whole Agreement This Product contains the entire agreement between the Policyholder and any Insured Person claiming under it and the Underwriters and Us on their behalf relating to the provision of legal expenses insurance and no other representation or warranty by the Insured Person or Us or their authorised representatives or any third party shall have any contractual effect unless agreed by both parties in writing. 8. Procedure in the event of an Accident If You are involved in an accident try to obtain as much information as possible including:- (a) Name and address of the other person and the registration number of the other vehicle. (b) Name and address of the other person s insurance company and the policy number. (c) Names and addresses of any witnesses who may have seen the accident. Then contact the Claims Line immediately on: 0844 809 4953 9. Cancellation You may cancel this Product at any time by contacting Customer Services on the number shown in Your main Motor Vehicle Insurance Policy documentation. However unless it is cancelled within 14 days (known as the withdrawal period), there will be no refund of premium. If You change Your mind and cancel this policy within the first 14 days We will return any premium paid. This Product will automatically be cancelled in the event that the underlying Motor Vehicle Insurance Policy, in connection with which it is arranged, is cancelled or avoided at any time. 10. Automatic Renewal For Your protection, We reserve the right to automatically renew this Product annually in conjunction with the underlying Motor Vehicle Insurance Policy. If We do not receive Your instructions to cancel the Product from the renewal date, We may, at Our option, renew Your Product. You will then be liable for any premiums that fall due. You may opt out of the automatic renewal process at any time by contacting the Customer Services helpline shown in Your main Motor Vehicle Insurance Policy documents. 11. Financial Services Compensation Scheme AmTrust Europe Limited, who underwrite this insurance, is covered by the Financial Services Compensation Scheme. You may be entitled to compensation from the scheme if they cannot meet their obligations. This depends upon the type of insurance and the circumstances of the Claim. Most insurance contracts are covered for 90% of the Claim. Further information is available from the Financial Services Authority of the FSCS.
