TERMS AND CONDITIONS FOR LOVETEFL INTERNSHIP PROGRAMMES These Terms and Conditions apply to teachers who accept a place on a LoveTEFL internship programme. They are an agreement between you (the applicant), LoveTEFL and its in-country partners. They apply in conjunction with the specific programme information with which you will also be provided. This document is provided for your protection as well as ours. It is important that you read and understand the terms to which you are agreeing when you accept a place on a LoveTEFL internship programme. In providing internship programmes overseas, LoveTEFL acts as an Employment Agent for the purposes of The Conduct of Employment Agencies and Employment Businesses Regulations 2003. The service is provided by LoveTEFL Ltd of Woodside House, 261 Low Lane, Leeds, LS18 5NY, UK (Registered Company No 7935847). 1. Confirmation that you are eligible to enter into these terms with LoveTEFL By signing this document, you confirm that you: Are 18 years of age or older at time of travel Are a native English speaker Will have completed an accredited 120-hour TEFL qualification through LoveTEFL (or another recognized provider) before you arrive in your destination country Hold a valid police check from your home country, or are willing to apply for one Will obtain appropriate travel insurance for the duration of your stay. This must include cover for all relevant travel and medical issues (including repatriation to your home country) and working overseas Are committed to teach English, or other required subjects, in the specified country for a period of not less than the initial term of your agreed internship Will comply with LoveTEFL s Code of Conduct for teachers and interns working overseas Are sufficiently fit and healthy to undertake and complete the programme Meet all the specific requirements for the programme and country to which you have been accepted, as laid out in this document and the programme information. 2. Responsibilities of each party (i) LoveTEFL LoveTEFL acts as an agent to recruit and train (where necessary) interns to teach English in your specified country. The LoveTEFL UK team provides: Information about your chosen programme Initial screening of all applications A telephone discussion with all applicants (if required) A 120-hour TEFL course (where relevant) Liaison with the in-country team and our partner schools to facilitate the application process Information and advice on applying for the correct visa General advice and guidance to help you prepare for your programme. The in-country team (including LoveTEFL s in-country partners) provides: Liaison with partner schools to gather necessary paperwork to support your visa application (if required) Airport pick-up and transfers on the specified arrival date and location An in-country orientation Support throughout your programme.
(ii) Applicants You, the successful applicant, are responsible for: Completing your application and related requests for information truthfully and accurately Producing all required documentation to LoveTEFL and / or its partners within the timescales specified Successfully completing an accredited 120-hour TEFL course through LoveTEFL or an alternative, recognized provider prior to arrival in your destination country Ensuring that you have a valid passport, that will remain valid for the duration of your stay in your destination country Obtaining the correct visa. Whilst LoveTEFL will provide general advice to support this process, it is your responsibility to gain the correct visa for your programme. You are also responsible for the cost of obtaining any visa(s) Ensuring you bring all necessary documentation to your destination country Obtaining relevant travel insurance for the duration of your stay. It is important that you are covered for all relevant travel and medical issues (including repatriation to your home country) and working overseas. If you are unable to show relevant insurance documents at your orientation, you may not be able to continue in the programme and will not be entitled to any compensation Ensuring that you have taken appropriate medical advice in respect of living and working in your destination country including (but not limited to) receiving all the appropriate inoculations prior to travel. It is also your responsibility to ensure that you have the necessary medication and / or medical equipment for both prevention and treatment of illnesses during your time overseas Obtaining any required medical checks and certificates, prior to arriving in your destination country Booking and paying for your flights, to ensure that you arrive at the specified airport / meeting point on the official programme arrival date. We suggest that you only book your flights once you have been fully accepted onto the programme and have applied for and received your visa (if required). We also strongly recommend that you purchase a flexible flight ticket Reading all pre-departure information sent by LoveTEFL and attending the in-country orientation to help ensure you are prepared for your internship. Delays or inability to produce evidence of any of the above points may result in your internship application being void with no refund possible. 3. Costs You, the successful applicant, are responsible for the following costs: Internship placement fee All fees for obtaining your visa. This includes any costs required for obtaining the necessary paperwork in-country Costs of obtaining a police-check certificate (if required) Return flights to the specified airport for your programme Travel insurance All spending money during your time on the programme Any costs for optional excursions Any specific programme costs as set out in the programme information. 4. Placement Our in-country partners are responsible for providing your placement. Whilst LoveTEFL and our in-country partners will consider any specific requests regarding placement location, this cannot be guaranteed. LoveTEFL expects its in-country partners and schools to comply with all relevant laws for the country. Neither the partner schools nor LoveTEFL will accept any liability to you arising from discrimination laws, health and safety practice or other matters which vary between your destination and home countries. 5. Teaching contract You may be required to enter into an Internship Contract with the school in which you will be based. If this is necessary, details will be included in the programme information.
In all cases, please note: Precise working conditions as well as holiday / term dates may vary between different schools and regions You will be expected to dress and behave appropriately for work in accordance with the cultural norms in your destination country. These may be very different from those in your home country. LoveTEFL will not be able to help you if your internship is terminated because you refuse to comply with your school s expectations in relation to style of dress, hair or personal adornment (eg piercings and tattoos) You will be expected to take care of, and be responsible for, any materials provided for your use by your school. You may be held financially responsible for any damage or loss caused to such materials You will be subject to your destination country s laws during your internship, and it is imperative that you comply with these. LoveTEFL accepts no liability should you choose to violate any laws during your internship and / or if your internship is terminated as a result of you violating such laws Your school reserves the right to terminate your internship should you violate any of the work rules and regulations set by the school. In this case neither the school, nor LoveTEFL will have any responsibility for any costs incurred You will be held financially responsible for any damage to accommodation provided through your internship, whether caused by you or by somebody who is in your accommodation with your permission. 6. Correct paperwork All offers of acceptance onto LoveTEFL s programmes are reliant on you being able to produce the correct paperwork prior to travelling to your destination country. This includes, but is not limited to: CV / resume Original certificates for all required qualifications, including a degree (if relevant) Valid passport Original certificate for 120-hour TEFL course (minimum) from a recognized, accredited provider Original medical check report (if required) Police clearance certificate (if required) Evidence that you are fit and healthy to travel, if requested (ie doctors note / certificate) Any specific requirements for your programme, as set out in the programme information. Failure to provide the correct documentation within the timescales specified by LoveTEFL may mean that you cannot take part in the programme. Neither LoveTEFL not its partner schools will be responsible for any costs you may incur through delayed or non-production of the relevant certificates or documentation. 7. Date changes You are permitted to change the date of your internship up to sixty days before your programme s arrival date, assuming that a place is still available on your new preferred programme. The cost of each date change is 40. Payment is required before the date change can be made. These terms and conditions apply to the departure date of the original booking or new preferred programme (whichever date is earliest). 8. Cancellation (i) Refunds If for any reason you are not satisfied with the LoveTEFL internship you have purchased, you are entitled to a full refund of the internship placement fee within fourteen calendar days of booking (the cooling off period ). After the cooling off period has passed and you have paid the full balance payment of your trip the following cancellation charges apply: More than sixty days before the specified arrival date = 50% of the trip cost will be refunded Sixty days or less before the specified arrival date = 100% cancellation charges apply. (ii) Rejection of visa or application to an internship programme If our in-country partners or the partner schools reject your application to the internship programme then you will be entitled to a full refund. In the unlikely event that your visa application is refused by the relevant Embassy then the general cancellation conditions will apply, as set out in point 9(i) above.
(ii) 120-hour TEFL course Where LoveTEFL s 120-hour TEFL course is included in your package, access to the course will be suspended if you are entitled to a refund. You will have the choice to have the price of the course deducted from your refund, if you would prefer to continue with the course. (iv) Minimum numbers Some of our programmes are organised on the basis of a minimum number of clients (please see your programme handbook). In the unlikely event that the programme you have booked has to be cancelled because of insufficient numbers, you will be informed at least 30 days prior to departure. (v) General conditions In all cases, neither LoveTEFL nor its partner schools will pay any compensation in the event that your programme is cancelled, curtailed or delayed or in any way changed as a result of circumstances that any party could not, even with all due care, foresee or avoid. Such circumstances include, but are not limited to, war or threat of war, terrorist activity or threats of such activity, riots or civil disturbance and adverse weather conditions. You are responsible for arranging adequate insurance to cover for any such eventualities. 9. Accuracy of marketing materials Every reasonable effort has been made to describe our internship programmes correctly in our marketing materials and on our website. All statements are correct to the best of our knowledge at the time they are made. LoveTEFL cannot be held responsible for any changes that become known or happen after the printing of any written materials, nor can we accept liability for events outside our reasonable control. We will undertake to advise you of any material changes known to us prior to your departure, providing there is sufficient time to do so and we can contact you. 10. Use of photos and comments By agreeing to these Terms and Conditions you agree that we may use any photo(s) / image(s) that we or someone on our behalf takes of you or any comments (written or verbal) you make during or in connection with your participation on the programme for our promotional / marketing purposes without obtaining your further specific permission or making any payment to you. Such use may include mentioning your name, age and area of residence. 11. Personal data For the purposes of the Data Protection Act, LoveTEFL is a data controller. We will store the personal data that you give us, and will use it for the purpose of processing your application and the provision of the services in this agreement. We will disclose your personal data to our partners in the country in which you will be working in order to process your application and deliver our services. However, it is your responsibility to ensure that LoveTEFL, its in-country partners and your school have all the necessary information required to protect your interests, such as medical information needed for the provision of medical treatment should you become ill or suffer an accident during your time overseas. As your internship may involve work with children or vulnerable people, it may be necessary for you to produce a police clearance certificate (or similar background check). This may affect whether or not your application is accepted by our incountry partners and what records we keep about you. Our in-country partners are expected to store and use your data appropriately, in line with requirements set out in the UK. However, please note that the countries we need to transfer your personal data to may not afford the same level of protection to your personal data as your home country. We may also contact you from time to time with information about other LoveTEFL products and services that may be of interest to you. If you would like to opt out of this service at any time, please email support@lovetefl.com or write to us at the address given at the top of this document. All data is kept in accordance with the Data Protection Act 1998. You have a right to ask for a copy of your information and correct any inaccuracies in your data. If you believe that any of your personal details that we process are inaccurate or incorrect, please contact us immediately by writing to LoveTEFL, Woodside House, 261 Low Lane, Leeds, LS18 5NY, UK. By agreeing to these Terms and Conditions, you acknowledge and agree that we may transfer, store and process your personal data and sensitive personal data as set out above. Please note, our Data Protection Policy may change periodically to reflect developments in the law. You can request a copy of our current policy at any time to understand how we gather, use and store data.
12. The law and your protection When agreeing to these Terms and Conditions, both parties recognise that you are not an employee of LoveTEFL. LoveTEFL will use all reasonable skill and care in providing our services to you in accordance with these terms. However, LoveTEFL does not accept any liability: For any aspect of your internship teaching contract with your school (if relevant) That we might otherwise have if any part of this contract is improperly performed due to your error or omissions in the information and personal details that you provided to us Arising from a difference in regulation of employee protection, discrimination laws, health and safety practice or other matters between the destination country and your home country For what partners do, or do not do or for any loss, damage, expense or other claim of any description that you suffer in connection with your internship. Our in-country partners are not employees of LoveTEFL and as such we cannot ultimately exercise direct control over them or be responsible for their actions For any indirect, economic or consequential loss that you suffer as a result of this internship. Nothing in these conditions is intended to exclude or limit our liability to you for fraud or for death or personal injury caused by any act or omission by LoveTEFL or its employees acting in the course of their employment for the duration of your internship. 13. Interpretation in a dispute If any wording in this agreement for any reason is held by a Court to be unfair, illegal or unreasonable, it will not bind you. The Court can remove that wording from the agreement, and the rest of the agreement will still continue to bind us and you. This agreement and any claim or dispute arising from or related to this agreement, will be governed by, and shall be construed in accordance with, English law and the Courts of England and Wales shall have exclusive jurisdiction over any claim arising out of it. 14. Complaints If for any reason you are not satisfied with our service, in the first instance you should set out the issue in writing and send it to: The UK LoveTEFL support team, if you have not left for your destination country by emailing: support@lovetefl.com The in-country support team, if you are already in your destination country. If the in-country team is unable to resolve your issue please email support@lovetefl.com informing us of the problem. We will acknowledge your complaint within five working days and will aim to resolve the complaint within a maximum of twenty-eight days. ACCEPTANCE OF TERMS AND CONDITIONS It is understood that you have read, understood and agree to the Terms and Conditions covering the internship programme as set out in this document and the accompanying programme information. If you do not agree then you should contact us within fourteen calendar days to exercise your rights within the cooling off period. Last updated: August 2015
