3 CHAPTER The Vehicles Act, 1983 PART I Title and Interpretation Title 1 These regulations may be cited as The Seat Belt Regulations. Interpretation 2 In these regulations, Act means The Vehicles Act, 1983. 21 Oct 83 cv-3.1 Reg 11 s2. PART II Child Seating and Restraint Systems Interpretation 3 In this Part: (a) child means a child born after June 30, 1980; (b) restraint system means a Type I restraint system, a Type II restraint system, a Type III restraint system or a Type IV restraint system; (c) Type I restraint system means an infant seating and restraint system that meets the standards set pursuant to the Motor Vehicle Safety Regulations (Canada) or any other restraint system that is approved by the board; (d) Type II restraint system means any child car seat which is designed for the transportation of a child whose weight is less than nine kilograms in a rear-facing position, and that complies with the Children s Car Seats and Harnesses Regulations (Canada) or any other restraint system that is approved by the board; (e) Type III restraint system means any child car seat which is designed for the transportation of a child whose weight is nine kilograms or more but less than 18 kilograms in a forward-facing position, and that complies with the Children s Car Seats and Harnesses Regulations (Canada); (f) Type IV restraint system means the pelvic restraint of a seat belt assembly. 21 Oct 83 cv-3.1 Reg 11 s3.

Non-application 5(1) This Part does not apply to the operator of a vehicle registered outside Saskatchewan. (2) Section 6 does not apply to: (a) the operator of a vehicle registered as Class PT; (b) the operator of a vehicle registered to a person to whom section 73 of The Vehicles Act, 1983 applies; or (c) a child who is not a resident of Saskatchewan. 21 Oct 83 cv-3.1 Reg 11 s5. Child under nine kilograms 6 No person shall operate a vehicle on a highway in which there is carried a child whose weight is less than nine kilograms and in which a seating position fitted with a seat belt assembly is available unless: (a) the child is secured in a Type I or Type II restraint system; and (b) the restraint system is secured by the pelvic restraint of a seat belt assembly in the manner prescribed by the manufacturer of the restraint system, and all harnesses, straps and buckles designed to secure the child in the restraint system are properly adjusted and securely fastened. 21 Oct 83 cv-3.1 Reg 11 s6. Child between nine and 18 kilograms 7(1) No person shall operate a vehicle on a highway in which there is carried a child whose weight is nine kilograms or more but less than 18 kilograms and in which a seating position fitted with a seat belt assembly is available unless the child is secured in: (a) a Type III restraint system that is secured by the pelvic restraint of a seat belt assembly and, where practicable, by all other anchorage straps and devices in the manner prescribed by the manufacturer of the restraint system, and all harnesses, straps and buckles designed to secure the child in the restraint system are properly adjusted and securely fastened; or (b) in the case of a vehicle registered in the name of a person other than the parent or legal guardian of the child, the child is secured in a restraint system described in clause (a) or in a Type IV restraint system. 21 Oct 83 cv-3.1 Reg 11 s7.

5 PART III Seat Belt Exemptions Exemption from section 121 8 Section 121 of the Act does not apply to: (a) a person operating a public service vehicle registered in Class PT, while transporting passengers for compensation; or (b) a police officer or police constable while transporting prisoners or other persons who in the opinion of the police officer or police constable represent a danger to the personal safety of a police officer or police constable, except where provision has been made for the protection of the police officer or police constable. 21 Oct 83 cv-3.1 Reg 11 s8.
