FOREWORD One role of the Community Affairs office of the Buffalo Branch, Federal Reserve Bank of New York, is to encourage and support community partnerships that identify and address concerns impacting the well-being of residents and communities throughout western and central New York. As part of an on-going commitment to assist with housing issues, the Buffalo Branch, in cooperation with several housing agencies, is pleased to release Phase One of a comprehensive housing resource directory. The directory catalogs non-profit housing agencies and services available throughout Erie and Niagara Counties. Phase Two, scheduled for completion at the end of 2003, will incorporate agencies and services available in the Monroe County area. The Fed and its partners are pleased to support the community s access to housing agencies and services by supplying a vehicle which will help make the process of finding housing support agencies and services easier. FREQUENTLY ASKED QUESTIONS The agencies listed in this directory perform a wide variety of housing services for the community. According to an informal survey taken by the Belmont Shelter Corporation, the most frequently asked questions presented to their staff are as follows: Where can I get emergency housing? RENTER S GUIDE 1 The following tips for renters were supplied by the Independent Living Center. You will find this comprehensive list to be very useful in helping you find the apartment that suits your individual needs. Before you begin your search, ask yourself these questions: How much can I afford for rent and utilities, and still have money for food and necessities? A government guideline is 25% to 40% of net income toward rent. Do I want to live alone, or with someone? Who? Do I want to live in an apartment building, complex, duplex, or individual house? How many rooms, bedrooms, bathrooms do I need? Do I have many belongings? Begin your search by looking in all available resources. Most of the agencies in this directory can help you locate safe, affordable housing. In addition, you may check the following resources: Buffalo News Metro Community News Apartment Spotlight or Renters Guides available in area supermarkets, in the free paper section. Walk or drive through the area, looking for FOR RENT signs. Check area Community Centers, Houses of Worship, Senior Centers and places of gathering. Ask the leader or staff if they know of any apartments. Ask if they have a newsletter or pamphlet you may have. Ask if you can put an advertisement in the newsletter or on the bulletin board. If yes, do it. Check bulletin boards. Stores, restaurants and laundromats often have bulletin boards; check those. Ask the manager if you can post a notice that you are looking for an apartment. If yes, do it. Ask friends, relatives, and co-workers if they know of any apartments in the area. Even if they don t live there, they might have friends or relatives who do, or know of vacancies. When you find an apartment: Call for availability, if it s been rented, or if there is a waiting list. If it s available, make an appointment to see it. KEEP the appointment. How much is the rent? Does it include utilities? When is rent due? Are rental subsidies available? What are the qualifications? How do you apply? Is there a waiting list? If you pay utilities, ask for a billing history. You have the right to see a billing history. Is a security deposit required? If so, how much? Is it to be paid with the first month s rent or can it be paid in installments? What are the conditions for the security deposit? 40
What are the conditions for return of the security deposit? How long will it take? Did the previous tenant(s) get the security deposit back? If not, why not? Is a lease required? Do I know anybody who lives in this complex or has this landlord? If so, ask them about the landlord. Are repairs completed in a timely fashion? Is yard work attended to? Is the landlord or a representative available when needed? Is there anything else they can tell you to help you make a more informed decision? Before you leave for the appointment: Things to take with you Name, address, phone number, time and date of meeting, and directions. Paper and pen for taking notes. Flashlight to look into cupboards, under sinks, and into storage areas, and other dimly-lit spaces. Hair dryer, lamp or other small appliance to make sure electrical outlets work. A friend for a second opinion. Especially helpful if your friend is apartment savvy. Just to be safe, always leave information on where you are going with another friend or relative. When you get there: Check if stairs (outer & inner) are well lit and in good condition? Do all have railings? Is the building secure? Are there dead bolt locks on common doors? Do locks work properly? Is the apartment secure? Are dead bolts installed on apartment doors? Do they function properly? Are locks changed between tenants? Do windows have guards? They are required on all common windows above the 1 st floor and in all apartments with children under 10. This also restricts unlawful entry. Are there smoke detectors? Are they outside all bedrooms? Are they on every floor of a multi-level house? The landlord is responsible to provide them. Is there a fire exit? Is there a second floor fire exit? How are emergencies and maintenance handled? Should you contact the landlord, the maintenance person or someone else? Are there signs of bugs? Are there signs of mice or rats? Use your flashlight to look under sinks, in closets, in basement, attic and storage areas. What is the heating system? (gas, electric, radiators, oil or fireplace) Is it in good working order? Turn it on, even if it is out of season, to see if it works. Are there circuit breakers or fuses? Where are they located? Ask to see them. Are there separate meters for each apartment? Ask to see all meters. Who controls the thermostat? Where is it located? Does it work? Turn it on to see if it works. Is the temperature in the apartment comfortable today? If not, ask why. 41
Is there an air conditioner or central air? Is it in good working order? Turn it on, even if it is out of season, to see if it works. Does the landlord arrange for cleaning of outside windows? This is important on upper floors. Is a good bus route conveniently located? Walk to it. Can you walk there every day? Can you carry groceries that distance, every week? Is there a place to park your car? Is there a garage? Off street parking? How many parking spots are there? Are they assigned, or on a first-come basis? Is there a spot for you to park today? Can you carry groceries that distance, every week? Do you have use of the yard? This is important if moving into multi-unit houses, (duplex or similar) especially if landlord lives on-site. Are pets allowed in apartment? Are pets allowed in the yard? Are waterbeds allowed? This is important if you have one. Is smoking allowed? Where is trash pick-up? Is trash pickup free, or is there a charge? If so, what is the fee? Is there on-site laundry? Is it free or coin-operated? Are there laundry hookups? Ask to see them. Who is responsible for grounds maintenance? (mowing, raking, shoveling, and ice/snow removal) Am I close to the places important to me: Stores Clinic School Family Job Doctor Pharmacy Friends Restaurant Laundromat Recreation Day treatment Church Volunteer work Check each room separately: Are windows cracked or broken? Are they clean? Are storms and screens provided for all windows? Is there a storm door? Can windows be opened and closed easily? Try them all. Are there drafts around any window or door frames? Is the floor or carpet clean and well maintained? Is it stained, marred or gouged? Check floor, ceiling and wall tiles. Are they loose or missing? Are floor, ceiling, and walls clean? Is any paint or plaster cracked or peeling? Check walls and ceiling. Are walls and ceiling clean? Are there any water stains indicating previous water damage on floor, walls or ceiling? Are there enough electrical outlets in every room--at least two or three per room? Are they conveniently located? Are there any burn marks or discolorations near outlets? This may indicate past fire damage. Do all switches and outlets work? Check each one. Bring a small appliance to check outlets, both top and bottom plugs. A hairdryer is a good choice. Is there overhead lighting? Turn on every switch. If you can t see what it controls, ask. Is there enough room for all your furniture and other belongings? Are telephone jacks installed? Are they in good locations? The landlord is NOT responsible for this. 42
Is there cable hookup? If so, is it in all the rooms you want? If not, will the landlord let you have cable hookups installed? The landlord is NOT required to let you have cable installed. Things to check in different rooms: Bedroom: Will your bed and dresser fit comfortably in this room? Will all other furniture you currently have in the bedroom fit? Include nightstands, desk, chair, exercise equipment, chest, and all other items. Is there enough closet space? Living areas: Will everything you currently have in your living room fit in the new place? Is there a dining room? Will your furniture fit? Kitchen: Will your kitchen table fit? Are there enough cupboards? Will your appliances and dishes fit? What appliances are provided? Are they in good working order? Are they included in the rent quoted, or is that an extra charge? If so, how much? If there is a stove, light each burner and light the oven. Do all work? If there is a refrigerator, open it. Is it cold? Does it smell? Is there ice buildup in the freezer? Who is responsible for repair and maintenance on appliances? Turn on the cold water. Turn on the hot water. Are both running clean and clear? Is the water pressure good? How long does it take for the water to get hot? Does it drain properly? Where are the water and gas shut-offs? In kitchen or basement? Ask to see them. Bathroom: Is the toilet clean? Does it leak? Does it flush properly? Flush it. Turn water on in sink and tub (or shower)--first cold, then hot. Are all running clean and clear? Is the water pressure good? Is pressure still good when you turn on more than one faucet? Is pressure good when you flush? How long does it take for water to get hot? Does the water drain properly? Where are water shut-offs? Ask to see them. Is there water leakage, either plumbing or rainwater? 43
Other rooms: Is storage space provided? Where? Is it locked and secure? Is it large enough for your belongings? Is it safe from water damage? Water is a major concern in attic, basement, garage, and outside shed. Do you want or need any other storage space? Are there any other things important to you? AVOIDING FORECLOSURE 2 The guidance below (and in the "How to Avoid Foreclosure" pamphlet) is applicable to homeowners with FHA insured loans. While a good deal of this information may apply to all homeowners in danger of losing their homes, not all of the foreclosure avoidance tools mentioned may be available to you if you have a VA or conventional loan. Additionally, HUD/FHA does not have any Loss Mitigation oversight over VA or conventional loans. Please contact your lender or a housing counseling agency. Q: What happens when I miss my mortgage payments? Foreclosure may occur. This is the legal means that your lender can use to repossess (take over) your home. When this happens, you must move out of your house. If your property is worth less than the total amount you owe on your mortgage loan, a deficiency judgment could be pursued. If that happens, you not only lose your home, you also would owe HUD an additional amount. Both foreclosures and deficiency judgments could seriously affect your ability to qualify for credit in the future. So you should avoid foreclosure, if possible. Q: What Should I Do? 1. DO NOT IGNORE THE LETTERS FROM YOUR LENDER. If you are having problems making your payments, call or write to your lender's Loss Mitigation Department without delay. Explain your situation. Be prepared to provide them with financial information, such as your monthly income and expenses. Without this information, they may not be able to help. 2. Stay in your home for now. You may not qualify for assistance if you abandon your property. 3. Contact a HUD-approved housing counseling agency. Call 1-800-569-4287 or TDD 1-800-877-8339 for the housing counseling agency nearest you. These agencies are valuable resources. They frequently have information on services and programs offered by Government agencies as well as private and community organizations that could help. The housing counseling agency may also offer credit counseling. These services are usually free of charge. Q: What Are My Alternatives? You may be considered for the following: Special Forbearance. Your lender may be able to arrange a repayment plan based on your financial situation and may even provide for temporary reduction or suspension of payments. You may qualify for this if you have recently experienced a reduction in income or an increase in living expenses. You must furnish information to your lender to show that you will be able to meet requirements of the new payment plan. 45
Mortgage Modification. You may be able to refinance the debt and/or extend the term of your mortgage loan. This may help you catch up by reducing the monthly payments to a more affordable level. You may qualify if you have recovered from a financial problem and can afford the new payment amount. Partial Claim. Your lender may be able to work with you to obtain a one-time payment from the FHA-Insurance fund to bring your mortgage current. You may qualify if: 1. your loan is at least four months but no more than 12 months delinquent; 2. you are able to begin making full mortgage payments. When your lender files a Partial Claim, the U.S. Department of Housing and Urban Development will pay your lender the amount necessary to bring your mortgage current. You must execute a Promissory Note, and a Lien will be placed on your property until the Promissory Note is paid in full. The Promissory Note is interest-free and is due when you pay off the first mortgage or when you sell the property. Pre-foreclosure sale. This will allow you to avoid foreclosure by selling your property for an amount less than the amount necessary to pay off your mortgage loan. You may qualify if: 1. the loan is at least two months delinquent; 2. you are able to sell your house within three to five months; and 3. a new appraisal (that your lender will obtain) shows that the value of your home meets HUD program guidelines. Deed-in-lieu of foreclosure. As a last resort, you may be able to voluntarily "give back" your property to the lender. This won't save your house, but it is not as damaging to your credit rating as a foreclosure. You can qualify if: 1. you are in default and do not qualify for any other options; 2. your attempts at selling the house before foreclosure were unsuccessful; and 3. you don't have another FHA mortgage in default. Q: How Do I Know if I Qualify for Any of These Alternatives? Your lender will determine if you qualify for the alternatives. A housing counseling agency can also help assist in determining which, if any, of these options will meet your needs and also assist you in interacting with your lender. Call 1-800-569-4287 or TDD 1-800-877-8339. 46
Q: Should I Be Aware of Anything Else? Yes. Beware of scams! Solutions that sound too simple or too good to be true usually are. If you're selling your home without professional guidance, beware of buyers who try to rush you through the process. Unfortunately, there are people who may try to take advantage of your financial difficulty. Be especially alert to the following: Equity skimming. In this type of scam, a "buyer" approaches you, offering to get you out of financial trouble by promising to pay off your mortgage or give you a sum of money when the property is sold. The "buyer" may suggest that you move out quickly and deed the property to him or her. The "buyer" then collects rent for a time, does not make any mortgage payments, and allows the lender to foreclose. Remember, signing over your deed to someone else does not necessarily relieve you of your obligation on your loan. Phony counseling agencies. Some groups calling themselves "counseling agencies" may approach you and offer to perform certain services for a fee. These could well be services you could do for yourself, such as negotiating a new payment plan with your lender, or pursuing a pre-foreclosure sale. If you have any doubt about paying for such services, call a HUD-approved housing counseling agency at 1-800-569-4287 or TDD 1-800-877-8339. Do this before you pay anyone or sign anything. Q: Are There Precautions I Can Take? Following are several precautions that should help avoid being "taken" by a scam artist: 1. Do not sign any papers you do not fully understand. 2. Make sure you get all "promises" in writing. 3. Beware of any contract of sale or loan assumption where you are not formally released from liability for your mortgage debt. 4. Check with a lawyer or your mortgage company before entering into any deal involving your home. 5. If you are selling the house yourself to avoid foreclosure, check to see if there are any complaints against the prospective buyer. You can contact your state's Attorney General, the State Real Estate Commission, or the local District Attorney's Consumer Fraud Unit for this information. Q: What Are the Main Points I Should Remember? 1. Do not lose your home and damage your credit history. 2. Call or write your mortgage lender immediately and be honest about your financial situation. 3. Stay in your home to make sure you qualify for assistance. 4. Arrange an appointment with a HUD-approved housing counselor to explore your options at 1-800-569-4287 or TDD 1-800-877-8339. 5. Cooperate with the counselor or lender trying to help you. 6. Explore every alternative to keep your home. 47

Buffalo City Mission's Men's Shelter is a Christianbased emergency shelter offering emergency shelter for up to 156 males (over 18 years of age). The Mission acts as a safety net to ensure that no one is left on the street. Individuals receive three meals a day, clothing, and referrals in a safe location. Medical attention and a long-term treatment program are also available on site. Buffalo City Mission's Cornerstone Manor is a faith-based emergency shelter offering housing for up to 60 women and children. Families receive three meals a day, clothing, and assistance/referrals. Medical attention is also available as well as a school program for children and parenting classes. It is also a safe house for individuals experiencing family violence. Four beds are marked for a residential treatment program. Community Action Organization provides emergency housing for the homeless. The emergency shelter is located in Lackawanna and has five rooms. The shelter can accommodate unaccompanied males and females as well as females with one child. Community Services for the Developmentally Disabled's mission is to provide or obtain services for people who are developmentally disabled and their families. The program helps individuals to achieve their highest level of independent living. A not-for-profit safe shelter and services for runaway and homeless youth (aged 12-17 years), in an atmosphere that supports the dignity, respect, and self-sufficiency of each youth. 54

Haven House provides shelter for married and unmarried women over 18 (or women age 16 with children) coming from a situation of abuse and children who are abused physically or sexually accompanied by non-abusing adult. Women who are still being abused by an ex-spouse or partner can also seek shelter. There are a total of 36 spaces available: 11 rooms usually 3 beds to a room. The Network provides a way for homeless families to receive temporary shelter, meals, and assistance while seeking their own independence. Also, provides support after the family moves home. Volunteer-based ministry committed to providing shelter and three meals a day to 26 homeless individuals (18 men/8 women). Referrals are made by police, mental health agencies, substance abuse treatment/rehabilitation centers, and hospitals. Shelter is aimed at trying to prevent the reoccurrence of homelessness by focusing on issues related to homelessness. Provides shelter, bed, food, and referrals to locate service providers to families and single females. Catholic Christian Community gathered together to live the gospel of mercy through works of mercy. Not-for-profit mission that provides shelter to those in need. The Emergency Housing Service provides temporary housing for homeless psychiatric disabled persons.. Priority is given to individuals who have the potential to live independently. Individuals must be 18 years or older and have a psychiatric diagnosis. Length of stay must not exceed 28 days. 55

GLOSSARY This glossary contains commonly used terms related to apartment rental, housing and financing. 203(b) - FHA program which provides mortgage insurance to protect lenders from default; used to finance the purchase of new or existing one-to-four family housing; characterized by low down payment, flexible qualifying guidelines, limited fees, and a limit on maximum loan amount. 203(k) - this FHA mortgage insurance program enables homebuyers to finance the purchase of a house and the cost of its rehabilitation through a single mortgage loan. Abatement - A reduction or decrease. Usually applies to a government-granted decrease in property taxes, but can also refer to the reduction or termination of other debt. Abstract - A short legal history of a piece of property, tracing its ownership (title) through the years. An attorney or title insurance company reviews the abstract to make sure the title comes to a buyer free from any defects (problems). Abutting - Having property or district lines in common. Acquisition Financing - Funds obtained for the purpose of purchasing vacant land or properties (exclusive of any funds needed for property improvements or rehabilitation). Acquire, Rehab and Sale - A strategy of purchasing and rehabbing substandard homes, then selling them with affordable financing to low- or moderate-income buyers. Adjustable Rate Mortgage (ARM) - A mortgage in which the interest rate is adjusted periodically based on an index. Also called a variable rate mortgage. Adjustment Interval - For an adjustable rate mortgage, the time between changes in the interest rate charged. The most common adjustment intervals are one, three or five years. Affordable Housing - (also called public housing and assisted housing) - HUD's affordable housing program was established to provide decent and safe rental housing for eligible low-income families, the elderly, and persons with disabilities. Because public housing is limited to low-income families and individuals, local Public Housing Authorities determine each individual's eligibility based upon the following criteria: (1) annual gross income; (2) whether a person qualifies as elderly, a person with a disability, or as a family; and (3) U.S. citizenship or eligible immigration status. Public Housing Authorities use income limits, which are set by HUD; these income limits vary from area to area. All affordable housing facilities comply with federal fair housing regulations, accepting income-qualified residents without regard to race, color, religion, sex, handicap, familial status, or national origin. 73
Affordable Rental Investment Fund - A program through the Minnesota Housing Finance Agency that provides zero percent interest-deferred loans to help cover costs of providing permanent affordable rental housing. Affordable Senior Housing - The Department of Housing and Urban Development (HUD) 202 Program offers rental assistance for seniors who meet the requirements of the federal program. Rents are based on a resident's adjusted gross income, which is calculated by subtracting approved medical expenses from their income. The resident then pays 30 percent of the adjusted gross income for rent and utilities. Residency requirements have been determined by the United States Department of Housing and Urban Development (HUD). To be eligible for an apartment under the HUD 202 program, individuals or their spouse must be at least 62 years of age; individuals must have an annual income consistent with HUD guidelines for income maximums; individuals must be able to meet the posted residency criteria. All affordable senior housing facilities comply with federal fair housing regulations, accepting age- and income-qualified residents without regard to race, color, religion, sex, handicap, familial status, or national origin. Amenity - A feature of the home or property that serves as a benefit to the buyer but that is not necessary to its use; may be natural (like location, woods, water) or man-made (like a swimming pool or garden). American Association of Homes and Services for the Aging (AAHSA) - This national organization represents not-for-profit organizations that are dedicated to providing highquality health care, housing, and services to the nation's elderly. Its membership consists of over 5,000 not-for-profit nursing homes, continuing care retirement communities, senior housing facilities, assisted living, and community services. AAHSA organizations serve more than one million seniors of all income levels, creeds, and races. Americans with Disabilities Act (ADA) - The purpose of the ADA is to: (1) provide a clear and comprehensive national mandate for the elimination of discrimination against individuals with disabilities; (2) provide a clear, strong, consistent, enforceable standard addressing discrimination against individuals with disabilities; (3) ensure that the Federal Government plays a central role in enforcing the standards established in this chapter on behalf of individuals with disabilities; and (4) invoke the sweep of congressional authority, including the power to enforce the fourteenth amendment and to regulate commerce, in order to address the major areas of discrimination faced day-to-day by people with disabilities. The Act has subchapters or titles: Title I covers employment; Title II covers public services; Title III covers privately operated public accommodations and transportation services; Title IV covers telecommunications relay services; and Title V covers miscellaneous provisions. Title III of the ADA requires that public buildings meet minimum standards and make reasonable accommodations for disabled persons. Multifamily dwellings may require an ADA review prior to rehabilitation design. Amortization - Repayment of a mortgage loan through monthly installments of principal and interest; the monthly payment amount is based on a schedule that will allow you to own your home at the end of a specific time period (for example, 15 or 30 years). 74
Annual Percentage Rate (APR) - Calculated by using a standard formula, the APR shows the cost of a loan; expressed as a yearly interest rate, it includes interest, points, mortgage insurance, and other fees associated with the loan. Application - The first step in the official loan approval process. This form is used to record important information about the potential borrower necessary to the underwriting process. Application Fee - The fee charged by the lender to the borrower for loan application. Payment of this fee does not guarantee that a loan will be approved. Some lenders may apply the application fee to certain closing costs. Appraisal - A document that gives an estimate of a property s fair market value; an appraisal is generally required by a lender before loan approval to ensure that the mortgage loan amount is not more than the value of the property. Appraiser - A qualified individual who uses his or her experience and knowledge to prepare the appraisal estimate. Appreciation - The increase in the value of a property. Appropriation - A form of federal or state budget authority that permits obligations to be incurred and payments to be made. Assessment - A tax levied on a property or a value placed on the worth of property by a taxing authority. Assessment Rolls - The public record of all taxable property within a jurisdiction. Assessor - A government official who is responsible for determining the value of a property for the purpose of taxation. Assumable mortgage - A mortgage that can be transferred from a seller to a buyer; once the loan is assumed by the buyer, the seller is no longer responsible for repaying it; there may be a fee and/or a credit package involved in the transfer of an assumable mortgage. Balance Sheet An accounting statement of the financial position of a company showing all assets, liabilities and net worth as of a specific date. Balloon Mortgage Similar to a fixed-rate mortgage for a set number of years (usually five or seven) and then must be paid off in full in a single balloon payment. Balloon loans are popular with those expecting to sell or refinance their property within a definite period of time. Bankruptcy A federal law whereby a person s assets are turned over to a trustee and used to pay off outstanding debts; this usually occurs when someone owes more than they have the ability to repay. Basic Rent - The rent charged in a subsidized housing project and computed on the basis of a maximum subsidy. Below Market Interest Rate Program (BMIR) - This program was created in 1988 when approximately 301 of HUD's below-market interest rate (BMIR) multifamily 75
housing mortgage loans were purchased by the Arkansas Development Finance Authority (ADFA) in order to preserve thousands of low-income housing units. The loans were purchased through the sale of $215,625,000 in Government National Mortgage Association (GNMA) Guaranteed Bonds. This innovative financing by ADFA was accomplished in order to provide assurances to low-income housing advocates regarding preservation of the low-income rental housing projects, which secure the BMIR loans. The 3 to 3-1/2 percent interest rate BMIR loans offered through ADFA include lowincome rental requirements that must be met. The BMIR loans also prohibit prepayments for 20 years. Binder - A receipt for a deposit paid to secure the right to purchase a home at terms agreed upon by the buyer and seller. BOCA (Building Officials and Code Administrators) - Refers to the basic building code manual, used nationally as a standard, and locally with certain adaptations. Borrower - A person who has been approved to receive a loan and is then obligated to repay it and any additional fees according to the loan terms. Bridges - A rent subsidy program that links housing with social services for persons with severe and persistent mental illness. Bridges is operated by a local housing agency, which provides housing services, and a local mental health authority, which provides other support services while persons are on waiting lists for federal or other permanent housing subsidies. Broker - An individual in the business of assisting in arranging funding or negotiating contracts for a client but who does not lend the money himself. Brokers usually charge a fee or receive a commission for their services. Budget - A detailed record of all income earned and spent during a specific period of time. Buffer Zone - A strip of land, identified in the zoning ordinance, established to protect one type of land use from another with which it is incompatible. Buffer zones may either be shown on the zoning map or described in the ordinance with reference to neighboring districts. Building Code - Local or state regulations that control design, construction, alteration, use, occupancy, etc. of any structure. Buydown - A subsidy (usually paid by a builder or developer) to reduce the monthly payments on a mortgage loan. Cap - A limit to the amount an interest rate or a monthly payment can increase for an adjustable rate loan either during an adjustment period or over the life of the loan. Capital - Money invested either in a business or property to create income. Capital Asset - An asset of a permanent or fixed nature, or one used in carrying on a business or trade. 76
Capital Expenditures - The cost of an improvement made to extend the useful life of a property or to add to its value. Capital Gain or Capital Loss - The gain or loss incurred from the sale or disposition of a capital asset (such as a property). Capital Improvements - Improvements on a property that increase its value; also, improvement of public facilities such as streets, sewers, etc. Cash Flow - In investment property, the actual cash the investor will receive after deduction of operating expenses and debt service (loan payment) from gross income. Cash Reserves - A cash amount sometimes required to be held in reserve in addition to the down payment and closing costs; the amount is determined by the lender. Census Tract - A census tract is a small statistical subdivision of a county. Census tract data identifies population and housing statistics about a specific part of an urban area. This is particularly important when you want information about a particular part of a large city. A single community may be composed of several census tracts. Certificate of Compliance - Commonly used synonymously with zoning permit in which an official certifies that the plans for a proposed use conform with the zoning ordinance. Certificate of Occupancy - A document from an official agency stating that the property meets the requirements of local codes, ordinances, and regulations. Certificate of Title - A document provided by a qualified source (such as a title company) that shows the property legally belongs to the current owner. Before the title is transferred at closing, it should be clear and free of all liens or other claims. Certified Property Manager (CPM) - A professional certification in property management. Civil Rights Act of 1968 Title VIII, also known as the Federal Fair Housing Law, made illegal any discrimination in the sale, lease, rental, advertising, or inspection of real property based on race, color, religion, sex or national origin. Closing - Also known as settlement, this is the time at which the property is formally sold and transferred from the seller to the buyer; it is at this time that the borrower takes on the loan obligation, pays all closing costs, and receives title from the seller. Closing Costs - Customary costs above and beyond the sale price of the property that must be paid to cover the transfer of ownership at closing; these costs generally vary by geographic location and are typically detailed to the borrower after submission of a loan application. Code Compliance - To be in accordance with required building codes (local, state, BOCA). Code Inspection - The assessment of the design, construction, and material used in buildings in meeting required building codes. 77
Collateral - Property pledged as security for a debt, for example, mortgaged real estate. Comments - Lenders may provide a brief description of some of their programs or special features on the caller.com Mortgage Center Tables. Many lenders offer discounts to any borrower who mentions caller.com. It is always recommended that you tell your lender that you found him on the caller.com Mortgage Tables, because some lenders offer these discounts even if they do not explicitly say so in their comments. Commission - An amount, usually a percentage of the property sales price, that is collected by a real estate professional as a fee for negotiating the transaction. Commitment - A written letter of agreement detailing the terms and conditions by which the lender will lend and the borrower will borrow funds to finance a home. Community Development Block Grants (CDBG) - A federal program administered by HUD which provides grant funds to local and state governments to develop viable urban communities by providing decent housing and expanding economic opportunities for low- and moderate-income residents. Community Development Financial Institutions - An array of diverse institutions that lend to low-income and, increasingly, middle-income persons, American Indian reservations and community development projects, complementing the work of conventional lenders. Included are community development banks, community development credit unions, community development loan funds and micro-loan funds. Community Investment Program - A federal program established by the Financial Institutions Reform, Recovery, and Enforcement Act through which Federal Home Loan Banks provide low-cost advances and direct subsidies to member banks for purchasing or renovating owner-occupied or rental housing for families with incomes up to 115 percent of the area median, for low- or moderate-income commercial or economic development, and for mixed-use projects combining housing and commercial or economic development activities. Community Land Trust - A means of restricting use of land and housing through notfor-profit ownership of land with leases to the land users. It is often used to protect lowincome housing from speculation. Community Reinvestment Act (CRA) - A 1977 federal law that requires banks and savings and loan associations to help meet the credit needs of their local communities, including low-income communities. Conditions, Covenants, and Restrictions (CC and Rs) - The standards that define how a property may be used and the protections the developer has made for the benefit of all owners in a subdivision. Condominium - A home in a multi-unit complex; each purchaser owns an individual unit, and all the purchasers jointly own the common areas, such as the surrounding land, hallways, etc. Conforming Loan - A mortgage loan for up to $300,700 in the continental United States (Alaska and Hawaii limits are higher). 78
Consolidated Plan - A document written by a state or local government describing the housing needs of the low- and moderate-income residents and outlining strategies to meet those needs. The consolidated plan is required by HUD in order to receive Community Planning and Development funds. Construction Loan - A short-term loan for funding the cost of construction. The lender advances funds to the builder as the work progresses. Conventional Loan - A mortgage neither insured by the FHA nor guaranteed by the VA. Conversion - The right of a borrower to convert an adjustable or balloon loan into a fixed loan. Conventional Loan - A private sector loan, one that is not guaranteed or insured by the U.S. government. Cooperative (Co-op) - A form of ownership in a multi-unit complex; the purchasers own shares of the entire complex rather than owning individual units. Credit Bureau Score - a number representing the possibility a borrower may default; it is based upon credit history and is used to determine ability to qualify for a mortgage loan. Credit History - History of an individual s debt payment; lenders use this information to gauge a potential borrower s ability to repay a loan. Credit Rating - A report ordered by a lender from a credit bureau to determine if the borrower is a good credit risk. Credit Report - A record that lists all past and present debts and the timeliness of their repayment; it documents an individual s credit history. Debt-to-income Ratio - A comparison of gross income to housing and non-housing expenses. With the FHA, the monthly mortgage payment should not exceed more than 29% of monthly gross income (before taxes) and the mortgage payment combined with non-housing debts should not exceed 41% of income. Deed - The document that transfers ownership of a property from the seller to the buyer. Deed-in-lieu - To avoid foreclosure ( in lieu of foreclosure), a deed is given to the lender to fulfill the obligation to repay the debt; this process doesn t allow the borrower to remain in the house but helps avoid the costs, time, and effort associated with foreclosure. Deed Restrictions - Clauses in a deed limiting the future uses of the property. Deed restrictions can take many forms - They may limit the density of buildings, dictate the types of structures that can be erected, prevent buildings from being used for specific purposes or used at all, and limit the resale price, etc. Default - The failure to make payments on a loan. Delinquency - Failure of a borrower to make timely mortgage payments under a loan agreement. 79
Density - The number of homes built on a particular acre of land. Allowable densities are usually determined by local jurisdictions. Department of Housing and Urban Development (HUD) - A federal government agency responsible for national policy and programs that address the nation s need for fair and affordable housing for low- and moderate-income people. HUD administers several programs, including Community Development Block Grants, Section 8 certificates and vouchers, subsidized public housing, homeless assistance, and fair housing education and enforcement. Depreciation - A sum representing presumed loss (from physical wear and economic obsolescence) in the value of a building or other real-estate improvement and deducted annually from net income to arrive at taxable income. Discount Point - Normally paid at closing and generally calculated to be equivalent to 1% of the total loan amount, discount points are paid to reduce the interest rate on a loan. Down Payment - Money paid by a buyer from his own funds, as opposed to that portion of the purchase price which is financed. The down payment is usually paid at closing. Due-on-Sale - A clause in a mortgage contract requiring the borrower to pay the entire outstanding balance upon sale or transfer of the property. A mortgage with a due-on-sale clause is not assumable. Earnest money - Money put down by a potential buyer to show that he or she is serious about purchasing the home; it becomes part of the down payment if the offer is accepted, is returned if the offer is rejected, or is forfeited if the buyer pulls out of the deal. Easement - Right-of-way granted to a person or company authorizing access to the owner s land; for example, a utility company may be granted an easement to install pipes or wires. An owner may voluntarily grant an easement, or in some cases, be compelled to grant one by a local jurisdiction. Economic Development Administration (EDA) - An agency of the Department of Commerce that provides planning, technical assistance and financial resources to qualifying programs. Eminent Domain - The right of governmental bodies, public utilities and public service corporations to take private property for public use (e.g., schools, roads, sewer, power line towers) on payment of its fair market value. Empowerment Zone/Enterprise Community (EZ/EC) - This is an initiative sponsored through HUD's Community Planning and Development Office. The goal of the EZ/EC initiative is to create self-sustaining, long-term economic development in under-served areas. The initiative accomplishes this by using innovative and comprehensive strategic plans developed and implemented through partnerships among private, public, and nonprofit entities in each community. The EZ/EC framework is represented in four key principles: strategic vision for change, economic opportunity, sustainable community development, and community-based partnerships. Eligible applicants include local governments and states in which a nominated area is located. 80
Encumbrance - An outstanding claim or lien on a property. A property with a mortgage is said to be encumbered by that mortgage. Energy Audit - A building evaluation to assess the condition and efficiency of heating units and to identify locations of heat loss. Energy Efficient Mortgage (EEM) - An FHA program that helps homebuyers save money on utility bills by enabling them to finance the cost of adding energy efficiency features to a new or existing home as part of the home purchase. Escrow Account - A separate account into which the lender puts a portion of each monthly mortgage payment; an escrow account provides the funds needed for such expenses as property taxes, homeowners insurance, mortgage insurance, etc. Escrow Fee - These costs cover the preparation and transmission of all home purchaserelated documents and funds. Escrow fees range from several hundred to over a thousand dollars, based on the purchase price of the home. Not all states require placement of into escrow accounts for closing. Equity - The difference between the value of a home and what is owed on it. Equity Capital - Money invested by owners or others who share in profits or tax breaks. Fair Housing Act - A law that prohibits discrimination in all facets of the home buying process on the basis of race, color, national origin, religion, sex, familial status, or disability. (See also Civil Rights Act of 1968). Fair Housing Amendments Act of 1988 The amended Fair Housing Act strengthened the law of 1968 by covering discrimination based on disability and familial status. (See also Civil Rights Act of 1968). Fair Market Rent (FMR) - Rent guidelines determined by HUD to be the cost of modest, non-luxury rental units in a specific market area for various size units (1- bedroom, 2-bedroom, etc.). With certain exceptions, it is the highest rent chargeable for that market under the Section 8 program. FMRs are revised annually and are different for each community. Fair Market Value - The price at which property is transferred between a willing buyer and a willing seller, based on accurate appraisals. Neither party is under compulsion to buy or sell. Family Homeless Prevention and Assistance Program - A program that provides grants to encourage and support innovations at the county, regional, or local level in redesigning the existing homelessness support system or in establishing a comprehensive system. Funds are used for a broad range of purposes aimed at preventing homelessness, shortening the length of stay in emergency shelters, and/or assisting families with securing transitional or permanent affordable housing. Fannie Mae Federal National Mortgage Association (FNMA) - A federallychartered enterprise owned by private stockholders that purchases residential mortgages and converts them into securities for sale to investors. By purchasing mortgages, Fannie Mae supplies funds that lenders may loan to potential homebuyers. 81
Federal Environmental Assessments - A Phase I Environmental Site Assessment is a visual and record search of a site in order to determine environmental hazards. There are several Phase I Environmental Site Assessment (ESA) protocols that have been developed. A Phase II Environmental Site Assessment is a site assessment that identifies the characteristics and extent of suspected contamination. Phase II site assessments involve taking samples for analysis and often require several testing cycles before completion. Federal Housing Administration (FHA) - A federal agency which insures mortgages that have lower down payment requirements than conventional loans. Finance Charge - The total dollar amount your loan will cost you. It includes all interest payments for the life of the loan, any interest paid at closing, your origination fee and any other charges paid to the lender and/or broker. Appraisal, credit report, and title search fees are not included in the finance charge calculation. Fixed-Rate Mortgage - A mortgage in which the interest rate does not change for the life of the loan. Fixed Schedule Mortgage - A mortgage whose payment schedule for the life of the loan is established at closing. The payments and interest rate are not necessarily level. Float - Between the time of application and closing, a borrower may choose to bet on interest rates decreasing by electing to float. Floating is essentially choosing not to lock the interest rate. Since it is the borrower s responsibility to lock his or her rate before (or at) closing, choosing to float is considered risky and may result in a higher interest rate. Request information from your lender regarding lock procedures. Flood Insurance - Insurance that protects homeowners against losses from a flood; if a home is located in a flood plain, the lender will require flood insurance before approving a loan. Foreclosure - A legal process in which mortgaged property is sold to pay the loan of the defaulting borrower. Freddie Mac - Federal Home Loan Mortgage Corporation (FHLM) A federallychartered corporation that purchases residential mortgages, securitizes them, and sells them to investors; this provides lenders with funds for new homebuyers. Front-End Money (Front Money) - Funds required to start a project and generally advanced by the developer or equity owner as a capital contribution to the project, also called seed money. Ginnie Mae - Government National Mortgage Association (GNMA) A governmentowned corporation overseen by the U.S. Department of Housing and Urban Development, Ginnie Mae pools FHA-insured and VA-guaranteed loans to back securities for private investment; as with Fannie Mae and Freddie Mac, the investment income provides funding that may then be lent to eligible borrowers by lenders. Good Faith Estimate - An estimate of charges which a borrower is likely to incur in connection with a loan closing. 82
Graduated Payment Mortgage (GPM) - A fixed-rate, fixed-schedule loan which starts with lower payments than a level payment loan; the payments rise annually over the first 5 to 10 years and then remain constant for the remainder of the loan. GPMs involve negative amortization. Grandfathered - Zoning use that, once allowed, may be continued even though other zoning is changed, e.g., a prior commercial use on a lot may be continued even after residential zoning has been instituted on surrounding property. Gross Monthly Income - The total amount the borrower earns per month, not counting any taxes or expenses. Often used in calculations to determine whether a borrower qualifies for a particular loan. Growing Equity Mortgage (Rapid Payoff Mortgage) - A fixed-rate, fixed-schedule loan which starts with the same payments as a level payment loan; payments rise annually, with the entire increase used to reduce the outstanding balance. No negative amortization occurs, and the increase in payments may enable the borrower to pay off a 30-year loan in 15 to 20 years, or less. Hard Cost - The cost of land acquisition and improvement. Hazard Insurance - Protection against damage caused by fire, windstorm, or other common hazards. Many lenders require borrowers to carry it in an amount at least equal to the mortgage. Heating, Ventilation and Air Conditioning (HVAC) - A home s heating and cooling system. Homebuyer Education Learning Program (HELP) An educational program from the FHA that counsels people about the home buying process; HELP covers topics like budgeting, finding a home, getting a loan, and home maintenance; in most cases, completion of the program may entitle the homebuyer to a reduced initial FHA mortgage insurance premium-from 2.25% to 1.75% of the home purchase price. Home Energy Assistance Program (HEAP) Federally funded grant program that provides assistance to eligible households to pay their home heating bills. Eligibility is based on income guidelines, and applicants must provide documentation to prove eligibility. HEAP grants are administered by the Department of Social Services and the Department of Senior Services. Home Inspection - An examination of the structure and mechanical systems to determine a home s safety--makes the potential homebuyer aware of any needed repairs. HOME Investment Partnerships Program This program is operated by HUD and is a federal housing block grant program that allows states and local governments the flexibility to fund a wide range of low-income housing activities, including moderate and substantial rehabilitation, new construction, tenant-based rental assistance and other housing-related activities. 83
Home Warranty - Offers protection for mechanical systems and attached appliances against unexpected repairs not covered by homeowner s insurance; coverage extends over a specific time period and does not cover the home s structure. Homeowner s Insurance - An insurance policy that combines protection against damage to a dwelling and its contents with protection against claims of negligence or inappropriate action that result in someone s injury or property damage. Housing Authority - An agency charged with providing housing for low-income citizens; it often owns and/or operates public housing units. Housing Choice - The housing choice voucher program is a federal program for assisting very low-income families, the elderly, and the disabled to afford decent, safe, and sanitary housing in the private market. Since housing assistance is provided on behalf of the family or individual, participants are able to find their own housing, including singlefamily homes, townhouses and apartments. The participant is free to choose any housing that meets the program s requirements and is not limited to units located in subsidized housing projects. Housing Development Corporation - A private, multifamily housing corporation established to serve a specific geographic area (neighborhood, city, state, and region). Provides technical assistance, lends seed money, and directly sponsors housing developments. Generally, community residents, local business people and government officials have representation on its board of directors. Housing Finance Agency - A state agency which offers a limited amount of belowmarket-rate home financing for low- and moderate-income households. Housing Ratio - The ratio of the monthly housing payment to total gross monthly income. Also called Payment-to-Income Ratio or Front-End Ratio. Housing Trust Fund - Provides deferred loans without interest for the development, construction, acquisition, preservation and rehabilitation of low-income rental housing, limited equity cooperative housing and homes for ownership through community housing organizations. HUD - The U.S. Department of Housing and Urban Development; established in 1965, HUD works to create a decent home and suitable living environment for all Americans; it does this by addressing housing needs, improving and developing American communities, and enforcing fair housing laws. HUD Income Guidelines - Income levels used for determining eligibility for HUD assistance programs, typically expressed as a percentage of the area median income. Very Low Income - Households whose income does not exceed 50% of the area median income. 84
Low Income - Generally, a household whose income does not exceed 80% of the area median income. Moderate Income - Generally, households whose income ranges between 81% and 95% of the area median income. HUD1 Statement - Also known as the settlement sheet, it itemizes all closing costs; must be given to the borrower at or before closing. Income Qualifiers - "Very low-income" is defined as 50 percent of the median family income for the area, subject to specified adjustments for areas with unusually high or low incomes. "Low-income" is defined as 80 percent of the median family income for the area, subject to adjustments for areas with unusually high or low incomes or housing costs. Index - A published interest rate not controlled by the lender to which the interest rate on an Adjustable Rate Mortgage (ARM) is tied. The index and the interest rate linked to it may increase or decrease. Inflation - The number of dollars in circulation exceeds the amount of goods and services available for purchase; inflation results in a decrease in the dollar s value. Infrastructure - The public facilities and services needed to support residential development, including highways, bridges, schools, and sewer and water systems. Insurance - Protection against a specific loss over a period of time that is secured by the payment of a regularly scheduled premium. Interest - The cost paid to a lender for the use of borrowed money. Interest Rate - The percentage of an amount of money which is paid for its use for a specified time. Joint Tenancy - A form of ownership by which the tenants own a property equally. If one dies, the other would automatically inherit the entire property. Joint Venture - An agreement between two or more parties to invest in a business or property. Judgment - A legal decision; when requiring debt repayment, a judgment may include a property lien that secures the creditor s claim by providing a collateral source. Jumbo Loan - A loan for $300,700 or more in the continental United States (Alaska and Hawaii limits are higher). These limits are set by the Federal National Mortgage Association and the Federal Home Loan Mortgage Corporation. Because jumbo loans cannot be funded by these two agencies, they usually carry a higher interest rate. Land Contract - An agreement to transfer title to a property once the conditions of the contract have been fulfilled. Usually the buyer does not receive title to the property until the final payment is made. Land Loan - A loan for the purchase of property, which is held pending zoning or financial approval. 85
Land Trusts or Leases - A technique popular in England and recently popular with affordable housing groups in the United States in which a trust or other nonprofit developer sells a building to the residents but retains ownership of the land on which it is located and provides a long-term lease. This technique reduces the cost of acquisition (since the buyer need not purchase the land) and helps the nonprofit to retain future control over disposition of homestead property. Land Use Plan - Policy for the use of land that is intended to serve the general welfare. Lead-Safe Housing - A new standard for cleaning up lead-contaminated housing that recognizes that intact lead paint is not hazardous to children while lead paint that is deteriorating can cause a child to become lead poisoned. Under this standard, education about lead hazards and safe cleanup are seen as critical to preventing children from becoming lead poisoned. Lead-safe cleanup is much less costly, much more practical, and more child-protective than lead-free (also called abatement) cleanup. Lease Purchase - Assists low- to moderate-income homebuyers in purchasing a home by allowing them to lease a home with an option to buy; the rent payment is made up of the monthly rental payment plus an additional amount that is credited to an account for use as a down payment. Lender - The bank, mortgage company, or mortgage broker offering the loan. Many institutions only originate loans and then resell the obligation to third parties. Lessee - The tenant. Lessor - The landlord. Level Payment Mortgage - A mortgage whose payments are identical for each month over the life of the loan. LIBOR - The London Interbank Offered Rate Index (LIBOR) is an average of the interest rates that major international banks charge each other to borrow U.S. dollars in the London money market. Like the U.S. Treasury and the CD indexes, LIBOR tends to move and adjust quite rapidly to changes in interest rates. Lien - A legal claim against a property that must be satisfied when the property is sold. Limited Partnership - A partnership consisting of one or more general partners and limited partners. The general partner manages the business, while the limited partner(s) contribute(s) cash. The limited partner s liability is limited to the amount he or she has invested. Life of Loan Cap - The maximum interest rate that can be charged during the life of the loan. Also called Lifetime Cap. Loan - Money borrowed that is usually repaid with interest. Loan Fraud - Purposely giving incorrect information on a loan application in order to better qualify for a loan; may result in civil liability or criminal penalties. 86
Loan-to-value (LTV) Ratio - A percentage calculated by dividing the amount borrowed by the price or appraised value of the home to be purchased; the higher the LTV, the less cash a borrower is required to pay as down payment. Lock-in - Since interest rates can change frequently, many lenders offer an interest rate lock-in that guarantees a specific interest rate if the loan is closed within a specific time. Loss Mitigation - A process to avoid foreclosure; the lender tries to help a borrower who has been unable to make loan payments and is in danger of defaulting on his or her loan. Low Income Housing Preservation and Resident Homeownership Act (LIHPRHA) - This Act, which was passed in 1991, provides incentives to owners to extend affordability terms on Section 236 and 221(d)(3) housing where subsidy contracts have expired or where owners have reached an "opt out" point. During the last five years, thousands of units have been "preserved" under LIHPRHA provisions. The term "preservation" relates to the federal assistance program that helps owners keep their properties affordable to low-income individuals. Under this program, federal assistance pays the difference between 30 percent of a tenant's income and market rents. Low Income Housing Tax Credit - A tax credit allowed for investors as an incentive for the development and preservation of multifamily rental housing affordable to low- and very-low-income households, sometimes referred to as Section 42. Low Income Residential Assistance (LIRA) National Fuel program designed to assist payment-troubled customers with high gas use and low incomes. Customers who are selected to participate in the program receive a lower monthly gas rate and debt forgiveness. Further reductions are offered for using less gas. Used with gross income to determine affordability. Mortgage - A lien on the property that secures the promise to repay a loan. Mortgage Banker - A company that originates loans and resells them to secondary mortgage lenders like Fannie Mae or Freddie Mac. Mortgage Broker - A firm that originates and processes loans for a number of lenders. 87
Mortgage Commitment - A formal written communication by a lender, agreeing to make a mortgage loan on a specific property, specifying the loan amount, length of time, and conditions. Mortgage Company (Mortgage Banker) - A company that borrows money from a bank, lends it to consumers who want to buy homes, then sells the loans to investors. Mortgagee - The lender who makes a mortgage loan. Mortgage Insurance - A policy that protects lenders against some or most of the losses that can occur when a borrower defaults on a mortgage loan; mortgage insurance is required primarily for borrowers with a down payment of less than 20% of the home s purchase price. Mortgage Insurance Premium (MIP) - A monthly payment (usually part of the mortgage payment) paid by a borrower for mortgage insurance. Mortgage Loan - A contract in which the borrower s property is pledged as collateral and which can be repaid in installments over a long period. The mortgagor (buyer) promises to repay principal and interest, keep the home insured, pay all taxes, and keep the property in good condition. Mortgage Modification - a loss mitigation option that allows a borrower to refinance and/or extend the term of the mortgage loan and thus reduce the monthly payments. Mortgage Origination Fee - A charge by a lender for the work involved in preparing and servicing a mortgage application (usually 1 percent of the loan amount). Negative Amortization - An increase in the outstanding balance of a loan when a monthly payment is not large enough to cover all interest due. Net Operating Income (NOI) - In rental properties, this is the gross income from rents and other sources minus the vacancy allowance and operating expenses. The net operating income is the amount available for making loan payments (debt service) and paying investors (cash flow). New York State Human Rights Law 296 Landlords may not refuse to lease or renew accommodations to, or otherwise discriminate against any person or group of persons because of race, creed, color, national origin, sex, disability, age or marital status. New York State Real Property Law 236 Landlords may not refuse to lease an apartment or discriminate against any person in the terms and conditions of a rental property because a person has children living with them. New York State Real Property Law 237 A lease may not require that tenants agree to remain childless during their tenancy. 88
Note - A formal document showing the existence of a debt and stating the terms of repayment. Occupancy Regulations - Regulations limiting the number of people who are allowed to live in a housing unit and the kinds of activity permitted on the premises. The most prevalent form of occupancy regulation is the requirement that each housing unit be occupied by only one family. Offer - Indication by a potential buyer of a willingness to purchase a home at a specific price; generally put forth in writing. Origination - The process of preparing, submitting, and evaluating a loan application; generally includes a credit check, verification of employment, and property appraisal. Origination Fee - The fee imposed by a lender to cover certain processing expenses in connection with making a loan; usually a percentage of the amount loaned and paid at closing. Partial Claim - A loss mitigation option offered by the FHA that allows a borrower, with help from a lender, to get an interest-free loan from HUD to bring mortgage payments up to date. PITI - Stands for principal, interest, taxes and insurance the components of a monthly mortgage payment. PITI Ratio - The principal, interest, tax and insurance payment-to-income ratio that is used in mortgage-lending decisions. Planning Commission - A local or regional organization, normally a government agency, responsible for preparing and adopting comprehensive, long-term general plans for the physical development of property within its jurisdiction. Points - Interest charges paid up-front when a borrower closes a loan. A point is equal to 1 percent of the loan amount (e.g. 1.5 points on a $100,000 mortgage would cost the borrower $1,500). Generally, by paying more points at closing, the borrower reduces the interest rate of his loan and thus future monthly payments. Pre-approve - Lender commits to lend to a potential borrower; commitment remains as long as the borrower still meets the qualification requirements at the time of purchase. Pre-foreclosure Sale - Allows a defaulting borrower to sell the mortgaged property to satisfy the loan and avoid foreclosure. Premium - An amount paid on a regular schedule by a policyholder that maintains insurance coverage. Prepaids - Expenses such as taxes, insurance and assessments which are paid in advance of the due date and which must be paid by the buyer on a prorated basis at time of closing. Prepayment - Payment of all or part of a debt prior to maturity. 89
Prepayment Penalty - Lenders who impose prepayment penalties will charge borrowers a fee if they wish to repay part or all of their loan in advance of the regular schedule. Pre-qualify - A lender informally determines the maximum amount an individual is eligible to borrow. Principal - The amount borrowed from a lender; doesn t include interest or additional fees. Private Mortgage Insurance (PMI) - Paid by a borrower to protect the lender in case of default. PMI is typically charged to the borrower when the Loan-to-Value Ratio is greater than 80%. Pro Forma - A statement showing the projected annual income and operating expenses of a project. Project Rental Assistance Contract (PRAC) - Project Rental Assistance Contract (PRAC) funds are used to cover differences between what affordable housing residents pay for rent and the HUD-approved expense to operate the project. Project Rental Assistance Contract funds may also be used to provide supportive services and to hire a service coordinator in those projects serving frail elderly residents. The supportive services must be appropriate to the category or categories of frail elderly residents to be served. Property Survey - A survey to determine the boundaries of your property. The cost will depend on the complexity of the survey. Public Housing Authority (PHA) - A public agency created by a state or local government to finance or operate low-income housing. Qualifying Ratio - The ratio of the borrower s fixed monthly expenses to his gross monthly income. Radon - A radioactive gas found in some homes that, if occurring in strong-enough concentrations, can cause health problems. Rapid Payoff Mortgage - (See Growing Equity Mortgage). Real Estate Agent - An individual who is licensed to negotiate and arrange real estate sales; works for a real estate broker. Real Estate Settlement Procedures Act (RESPA) - A federal law requiring lenders to provide home buyers with information about known or estimated settlement costs. The act also regulates other aspects of settlement procedures. Realtor - A real estate agent or broker who is a member of the National Association of Realtors and its local and state associations. Recording Fee - A charge for recording the transfer of property, paid to a city, county, or other appropriate branch of government. Refinancing - Paying off one loan by obtaining another; refinancing is generally done to secure better loan terms (like a lower interest rate). 90
Rehabilitation Mortgage - A mortgage that covers the costs of rehabilitating (repairing or improving) a property. Some rehabilitation mortgages - like the FHA s 203(k) - allow a borrower to roll the costs of rehabilitation and home purchase into one mortgage loan. Rental Assistance for Family Stabilization - Provides rent assistance to families on public assistance who are involved in a self-sufficiency effort. The program is administered jointly by a local housing agency and local self-sufficiency provider. Reserves - Cash or letter of credit held to fund future liabilities. Typical reserves include replacement reserve for major repairs, operating reserve for covering negative cash flow and contingency fund. Reverse mortgage (Also known as Home Equity Conversion) Offered by banks, thrifts, and other financial institutions. Four reverse mortgage products are available to consumers in the U.S. at the present time. The most popular reverse mortgage is the federally-insured reverse mortgage, called the FHA Home Equity Conversion Mortgage Program (HECM). The other major product is the Home Keeper reverse mortgage, which was developed in the mid-1990s by Fannie Mae, a private national mortgage company. A companion product is the Home Keeper for Home Purchase mortgage, which is intended for home purchases. One "jumbo" private reverse mortgage product is offered by Financial Freedom Senior Funding Corp., of Irvine, CA. This is the Cash Account Plan. The HECM and Home Keeper products are available in every state, while Financial Freedom s product is offered in 21 states and the District of Columbia. R-Value - The resistance of insulation material (including windows) to heat passing through it. The higher the number, the greater the insulating value. Sales Contract - A contract between a buyer and seller which should explain, in detail, exactly what the purchase includes, what guarantees there are, when the buyer can move in, closing costs, and what recourse parties may have if the contract is not fulfilled or if the buyer cannot get a mortgage commitment at the agreed-upon terms. Section 8 Certificate - A rent subsidy that allows a tenant to rent a unit priced at or below the fair market rent (FMR) set by HUD. The rental property owner is paid for the difference between 30% of the renter s income and the unit s rent. Section 8 Housing - This type of affordable housing is based on the use of subsidies, the amount of which is geared to the tenant's ability to pay. The subsidy makes up the difference between what the low-income household can afford, and the fair market rent established by HUD for an adequate housing unit. Subsidies are either attached to specific units in a property (project-based), or are portable and move with the tenants that receive them (tenant-based). The Section 8 program was passed by Congress in 1974 as part of a major restructuring of the Department of Housing and Urban Development's (HUD) low-income housing programs. Section 8 was created to permit federal housing assistance to go for construction or rehabilitation of new low-income housing or to subsidize existing housing. Section 8 Project-Based Assistance - This form of assistance is linked to a particular property so that a tenant moving into the building pays 30% of their adjusted gross 91
income in rent and the remainder is subsidized. The tenant receives the rental assistance as long as they live in the building and remain income-eligible. Section 8 Tenant-Based Assistance - This form of assistance is issued to the tenant in the form of a certificate or voucher which the tenant can use to rent from a landlord who participates in the program. Section 8 Voucher - A rent subsidy that allows a tenant to rent a unit that is above the fair market rent (FMR) set by HUD. The rental property owner is paid for the difference between 40% of the renter s income and the FMR. The tenant pays the amount of rent over the FMR. Section 202 Housing - This is a type of affordable housing designed for low-income individuals who are elderly or disabled. The Department of Housing and Urban Development (HUD) 202 Program offers rental assistance for seniors or the disabled who meet the requirements of the federal program. Rent subsidies are based on a resident's adjusted gross income, which is calculated by subtracting approved medical expenses from their gross income. Section 236 Housing - Section 236 of the National Housing Act (1934) provided a rent subsidy, in the form of interest reduction, through which multifamily housing could be produced. Two rent schedules were utilized: market rent, based on a market rate mortgage; and a basic rent, based on a one percent mortgage. Tenants were required to pay the basic rent of 25 percent of their income, whichever was greater, with rent payments never to exceed market rents. Units were restricted to households that met the low- and moderate-income limits established for the program. The subsidized housing moratorium imposed by President Nixon in January 1973 brought an end to additional Section 236 construction. Settlement- (See Closing). Shared Appreciation Mortgage A loan in which partners agree to share specified portions of the down payment, monthly payment, and appreciation. Single-Room Occupancy (SRO) Housing - One of the country s oldest forms of affordable housing for single and elderly low-income people. Typically, an SRO room will have a sink and closet. Bathroom, shower, kitchen, and other rooms are usually shared. Special Forbearance - A loss mitigation option where the lender arranges a revised repayment plan for the borrower that may include temporary reduction or suspension of monthly loan payments. Subordinate - To place in a rank of lesser importance or to make one claim secondary to another. Subsidy - Generally any funds provided from a source (generally a unit of local, state or the federal government) that reduces the amount of financing a borrower needs to obtain from a conventional lender, or that provides support payments, low-interest loans or grants that allow low-income people to afford to live in housing that would otherwise be unaffordable or unavailable. 92
Super Notice of Funding Availability (SuperNOFA) - Each year, the U.S. Department of Housing and Urban Development (HUD) issues a super Notice of Funding Availability (NOFA) for the Department's Housing, Community Development and Empowerment programs. This SuperNOFA announces the availability of HUD program funds covering 32 grant programs, including the Supportive Housing, Shelter Plus Care and Section 8 Moderate Rehabilitation Single Room Occupancy programs; the Housing Opportunities for Homeless Persons with AIDS (HOPWA); Section 202 Supportive Housing for the Elderly; and Section 811 Supportive Housing for Persons with Disabilities. Supportive Housing Program (SHP) - A federal program, authorized by Title VI of the Stewart B. McKinney Homeless Assistance Act of 1987, that provides financial assistance toward the development and operating cost of transitional housing for the homeless and permanent housing for the homeless and disabled. Grants may be used only to provide long-term housing opportunities. Survey - A property diagram that indicates legal boundaries, easements, encroachments, rights of way, improvement locations, etc. Sweat equity - Using labor to build or improve a property as part of the down payment. Syndication - The sale of equity interests (shares) in real-estate projects to investors other than the original developers. The concept extends generally to any group of investors who have contributed funds for the common purpose of carrying out a realestate project requiring concentration of capital. It can take several business forms, but the most common is the limited partnership. Targeted HOME Fund - A flexible fund for rental or single family affordable or supportive housing which meets federal HOME requirements. Tax Classification 4d - A Minnesota State property tax law that gives owners of lowincome rental housing a property tax break if they agree to keep their units affordable for a period of five years. Tax Credit - A dollar-for-dollar reduction against income tax payments that would otherwise be due. Contrasted with tax deductions that reduce taxable income. Tax Increment Financing (TIF) - A public financing tool used to assist economic development projects by capturing projected property tax revenue stream to be created by developing and investing those funds in improvements associated with the project. Tax Lien - A claim against real estate for the amount of its unpaid taxes. Tenancy in Common - A form of ownership in which tenants own separate but equal parts. To inherit the property, a surviving tenant would either have to be mentioned in the will or, in the absence of a will, be eligible through state inheritance laws. Title - A document that gives evidence of an individual s ownership of property. Title Insurance - Title Insurance policies typically insure a homebuyer against any titlesearch errors or mistakes, and against loss due to disputes over property ownership. Title Insurance can additionally offer protection to the lender under similar circumstances. The 93
cost of title insurance is usually a set value per thousand of dollars of the total loan amount. Title Search - A check of public records to be sure that the seller is the recognized owner of the real estate and that there are no unsettled liens or other claims against the property. Total Debt Ratio - Monthly debt and housing payments divided by gross monthly income. Also known as Back-End Ratio. Transfer Taxes - Taxes levied on the transfer of property or on real estate loans by state and/or local jurisdictions. Transitional Housing - Shelter for homeless individuals and families for six months to two years in an environment of security and support designed to help residents progress toward self-sufficiency. A middle point between emergency shelter and permanent housing. Transitional Housing Program - Provides funds for the construction, acquisition, or rehabilitation of residential housing for low-income individuals and families having an immediate need for temporary or transitional housing. Truth-in-Lending - A federal law obligating a lender to give full written disclosure of all fees, terms, and conditions associated with the loan initial period and then adjusting to another rate that lasts for the term of the loan. U-Value - The U-Value number represents the amount of heat lost through one square meter of a material for every degree difference in temperature on either side of the material and is measured in units of Watts per Meter Squared per Degree Kelvin or W/m 2 K. Note that Kelvin is used as the scale of temperature difference, but this is numerically equal to degrees Celsius. Underwriting - The process of analyzing a loan application to determine the amount of risk involved in making the loan; it includes a review of the potential borrower s credit history and a judgment of the property value. Uniform Building Code (UBC) - The minimum standards set for construction. Vacancy Rate - The ratio between the number of vacant units and the total number of units in a multi-tenant building or development. Variance - An approved special change in construction codes, zoning requirements, or other property use restrictions. Veterans Administration (VA) - A federal agency which insures mortgage loans with very liberal down payment requirements for honorably discharged veterans and their surviving spouses. Walk-Through - A final inspection of a home before settlement to search for problems that need correction before changing ownership. Warranty - A promise, either written or implied, that the material and workmanship of a product is defect-free and will meet a specified level of performance over a specified 94
period of time. Written warranties on new homes are either backed by insurance companies or by the builders themselves. Weatherization - Modifying a building to reduce energy loss, e.g., adding insulation or installing storm windows. Working Capital - The excess of current assets over current liabilities. Write-Down - In low-income housing development, it generally means an up-front subsidy provided by a government agency or other owner of property that reduces the asking price of a property to make it affordable to low-income people. Youthbuild Program - A federal program that provides resources to educate, train, and provide stipends for economically disadvantaged young adults to construct and rehabilitate housing for low-income and homeless persons. Zero Lot Line - A system of subdividing that permits building on lot lines, e.g., row houses. Zoning - A division of a city into districts to control land use, i.e., residential, commercial or industrial. Zoning Variance - A deviation from the zoning ordinance that is supposedly granted because strict enforcement would result in undue hardship on a property owner. 95
