CONSULTATION QUESTIONNAIRE Mandatory categories of FAIs Question 1: Do you think that the current mandatory provision for work-related deaths is sufficient? Question 2: Do you agree that a death which occurs when a person is arrested or detained by police should be subject to a mandatory FAI? We agree that the mandatory category of deaths of person in "lawful custody" should be extended beyond the current provision set out in section 1(4) (where a person is detained in a police station, police cell or other similar place...). This definition leaves gaps and the definition should be expanded as proposed to cover all situations in which the deceased has been arrested or detained by a police officer. Question 3: Should the death of a child in secure care be subject to a mandatory FAI?, as this would cover those children required to live away from home. Question 4: Do you agree that any other categories of residential childcare, which are not defined as secure care, should not result in a mandatory FAI? X Mandatory FAIs should also include those children, not in secure care who are otherwise required to live away from home. This would include children subject to a child protection order or supervision requirement, or any other order or requirement that the child be kept in, or taken to a place of safety or residential establishment. In relation to deaths of children who are not in secure care nor otherwise required to live away from home, the Lord Advocate would retain a discretion to decide that a FAI should be held, if it appears that it would be

in the public interest that an inquiry be held into the circumstances of a death of a child which is sudden, suspicious or unexplained or has occurred in circumstances which give rise to serious public concern. Question 5a: Do you think the aim of an independent investigation into the death of a person subject to compulsory detention by a public authority, that retains the traditional role of the Lord Advocate, should be met by an investigation by the procurator fiscal and exercise of the Lord Advocate s discretion on completion of that investigation? X The proposals in Question 5b are preferred for the reasons set out in our response to that Question. Or Question 5b: Alternatively, do you think the option of a case review by a public authority such as the Mental Welfare Commission could be combined with a discretionary power to hold an FAI? x We have assumed that this alternative is, like Question 5a, to meet the aim of an independent investigation into the death of a person subject to compulsory detention by a public authority. This option would appear to offer an appropriate and suitably flexible approach, subject to the comments made in response to this question. We would welcome the requirement that investigation is made of all deaths where the person has been subject to detention by a public authority, as defined by section 6 of the Human Rights Act. We have a particular concern in relation to the death of psychiatric patients. At present deaths of psychiatric patients subject to compulsory measures of care are not included in the category of mandatory grounds for FAIs. That contrasts with deaths of prisoners, who are similarly under the care and custody of the state, but in respect of whom FAIs are currently mandatory. The definition of compulsory detention by a public authority, should in our view include those people: in hospital under compulsory detention under the Mental Health (Care and Treatment) (Scotland) Act 2003; living in the community who are subject to compulsory orders under the Act or other mental health legislation; subject to detention under the use of legal guardianship or other powers under the Adults with Incapacity (Scotland) Act 2000 (for

example with a requirement to attend day care or take certain medication). Any review would need to meet requirements necessary to comply with article 2 of the European Convention on Human Rights In the Commission s view the following are required for a review to be compliant with Article 2: 1. By initiating that investigation itself 2. It must be carried out promptly and as quickly as is reasonable 3. All reasonable steps to secure the relevant evidence relating to the death must be taken 4. All reasonable steps to uncover any discriminatory motive behind the death must be taken 5. It must be carried out by someone who is independent of those implicated in the events 6. The investigation and its results must be open to public scrutiny 7. The next of kin must be involved to ensure their interests are protected 8. Anyone found to be at fault as a result of the investigation must be held to account 9. Lessons learned from the result of the investigation must be put into practice to ensure, so far as possible, that the risk of similar deaths in the future is minimised. After carrying out its investigations, the Mental Welfare Commission (MWC) could report to the Lord Advocate as to whether the MWC considered that a judicial inquiry was in the public interest and did not require a judicial inquiry. Where the MWC does not consider a FAI is necessary, there could be power for the MWC to make recommendations as regards measures which might be taken in future to avoid deaths in similar circumstances. Concerns were raised by the MWC in its response to the Cullen Review, that since many psychiatric patients die from natural causes, an FAI may in certain circumstances be unnecessary and cause further distress to the relatives. Lord Cullen recommended that it was in the public interest that an FAI should be held into the deaths of those detained by the state, especially those who are most vulnerable. He felt that even investigations into deaths by natural causes may reveal unsafe conditions. This alternative proposal would address the MWC's concerns as it would allow the MWC to exercise its discretion, to make an appropriate recommendation to the Lord Advocate for a FAI, if such a case raised questions about unsafe conditions or other wider systemic concerns.

Consideration should also be given to extending the proposed approach of MWC inquiry, to the death of patients who have recently been discharged from detention and to voluntary patients in psychiatric hospital, as otherwise such deaths may not be the subject of any inquiry even where they might raise questions of wider public interest. In relation to the investigation of deaths outwith a psychiatric setting, a key question is obviously the identification of the appropriate public authority to carry out the inquiry. We would not consider that, for example, the suggestion within the consultation paper of investigation by one health board of a different health board is sufficiently independent to comply with the requirements of article 2. The Equality and Human Rights Commission is currently gathering evidence on non-natural death of adults who die while being detained by the state. In Scotland, evidence is being gathered on deaths which fall into one of the following categories: self-inflicted/suicide, deaths caused by another person including homicide, deaths the cause of which is unknown and accidental deaths of people held in detention in psychiatric hospitals, prison and police custody. As part of this work, the concern has been raised with the Commission that having mandatory FAIs for all prisoner deaths may not be appropriate or necessary. In certain cases, the death of a prisoner may be clearly due to natural causes, in circumstances where there would be no wider public interest in holding a FAI. This is anticipated to be an issue of growing concern, given an aging prison population. Accordingly, we would suggest that consideration is given to extending the approach proposed in this question, to the death of prisoners, instead of the current mandatory FAIs for such deaths. A suitable public body to investigate death of prisoners might be Healthcare Improvement Scotland, being sufficiently independent and having the necessary and appropriate investigative expertise and experience. Question 6: What impact do you think that the proposals in relation to the mandatory categories of FAIs will have on you, your organisation or community? Please see response to Question 5b. Deaths abroad Question 7: Should the Lord Advocate have discretion to hold an FAI into the death of a person domiciled in Scotland who dies abroad where the body is repatriated to Scotland?

Question 7a: If you answered yes to question 7, should the criteria to consider include: (i) Whether there had been circumstances which called for investigation (ii) Whether there had been a satisfactory investigation (in the country where the death took place) (iii) Whether there was a prospect of an FAI yielding significant findings Question 7b: If you answered no to any of the criteria in question 7a, please provide reasons for your answer Comments Question 8: What impact do you think this proposal will have on your, your organisation or community? Delays Question 9: Do you agree with Lord Cullen s view that it is plainly not practical or realistic to make it mandatory that an FAI must open within a certain period of the date of the death of the deceased because of the diversity and potential complexity of the cases which may mean that an incident is not properly investigated? Question 10: Do you agree that preliminary hearings should be held to help speed up the process of FAIs?

Question 11: Will having pre-hearing meetings of experts speed up FAIs? Question 12: Will hearing some business in sheriffs chambers help speed up FAIs? Fatal Accident Inquiry accommodation Question 16: Do you agree with the proposal that the majority of FAIs should be dealt with in ad hoc locations, but FAIs which relate to deaths in rural or remote areas should still be dealt with in local sheriff courts?

Consideration of the consultation proposals will no doubt take into account the potential equality impact of the proposals eg with regard to the accessibility of the relevant premises for disabled people. Question 17: Do you think that all FAIs in Scotland should be held in three bespoke, dedicated centres? Please see response to Question 16. Do you agree that parties to whom sheriffs recommendations are addressed should be obliged to respond to the sheriff who presided over the FAI indicating what action had been taken? This would be on the basis that those parties would not be obliged to comply with the sheriff s recommendations, but if they have not complied they would be obliged to explain why not.
