Judge DICK AMBROSE ANTHONY SOWELL SUPPLEMENTAL ORDER REGARDING PRE-TRIAL PUBLICITY, MEDIA COVERAGE AND COURTROOM CONDUCT June 21, 2011 The Court hereby supplements its prior Order of June 2, 2011 regarding Pre-Trial Publicity, Media Coverage and Courtroom Conduct as follows: During General Voir Dire of the Jury, expected to begin on June 22, 2011, The Court will permit one "pooled" video camera to be present in the Courtroom that may record the opening statements of the Court and counsel to the jury. However, The camera, and any recording device connected to the camera, must be turned off for any questioning of jurors by the Court or by counsel. This is to avoid the possibility of recording the images or voices of jurors during the voir dire process. The Court will direct the camera operator when the camera is to be turned off and when it can be turned on.
Seating for media personnel within the Courtroom will be arranged through the Court Administrator. No electronic devices are permitted in the courtroom at any time and there will be no transmission of video or radio signals from the courtroom at any time during Voir Dire. Also, members of the Media present in the courtroom are prohibited from publishing or otherwise distributing or making available anything that could be used to personally identify a juror or potential juror. Therefore, directly quoting a juror's response to a question posed by the Court or counsel is prohibited, as well as any publication of a juror's jury number, their first or last name, or information concerning their place of employment, occupation, residence address or community where they reside. The Court will permit one "pooled" still photographer in the courtroom during Voir Dire. The still photographer shall be subject to the same limitations as the pooled video photographer permitted in the courtroom. There are no "in-and-out" privileges during court sessions. If a person leaves the courtroom for any reason during a session, that person will not be permitted to re-enter the courtroom while the court is in session. That person may re-enter the courtroom and retake his/her seat, prior to the resumption of proceedings, as outlined above. 2
This Order supplements and does not modify, in any way, the Court's prior Order of June 2, 2011 regarding Media Coverage. All penalties and sanctions that can or may be imposed under that prior Order may be imposed under this Supplemental Order. IT IS SO ORDERED! Date: JUDGE DICK AMBROSE 3
