WARREN COUNTY INSTRUCTIONS FOR FILING A MODIFICATION PETITION If you have been in Court in Warren County at any time in the past with regard to Custody (not support) of the children and are filing a modification petition, follow the instructions below. If you have never been to Court in Warren County for custody however, you must file a new Complaint. You may obtain forms to do this from the Family Hearing Office in the Warren County Courthouse. You may also consult with an attorney. You will need to attach a copy of the latest Court Order to your Petition. If you do not have a copy of your Order you may obtain one from the Prothonotary's Office in the Warren County Courthouse (814) 728-3440. Fill in the caption on the Petition for Modification as it appears on your Court Order. The Plaintiff and the Defendant will always remain the same regardless of who files the Petition. You should fill in the docket (A.D.) number and year as it appears on your Court Order as well. Complete each numbered paragraph following the instructions below: 1. The person filing the Petition is the Petitioner. List your name, place of residence, and telephone number in full. 2. All other parties to the action are the Respondents. List each name, place of residence, and telephone number in full. 3. List the date of the most recent Court Order. Indicate whether the most recent order addressed shared legal custody, sole legal custody, partial physical custody, primary physical custody shared physical custody, sole physical custody, and/or supervised physical custody (check all that apply). You must attach a copy of the most recent Court Order to your Petition. 4. Concisely state your reasons for making the request. Do not write on the back of the forms. If it is absolutely necessary, you may attach additional pages. Sign both the Petition and the statement verifying that the Petition is true and correct. Complete the Criminal Record / Abuse History Verification form. Be sure to check either "yes" or "no" for every item listed. Forward the completed forms to the address listed below for scheduling of a date, time and location for a conference. Definitions of Custody Terms in 23 Pa.C.S. 5322(a) Legal custody: The right to make major decisions on behalf of the child, including, but not limited to, medical, religious and educational decisions. Shared legal custody: The right of more than one individual to legal custody of the child. Sole legal custody: The right of one individual to exclusive legal custody of the child. Physical custody: The actual physical possession and control of a child. Partial physical custody: The right to assume physical custody of the child for less than a majority of the time. Primary physical custody: The right to assume physical custody of the child for the majority of time. Shared physical custody: The right of more than one individual to assume physical custody of the child, each having significant periods of physical custodial time with the child. Sole physical custody: The right of one individual to exclusive physical custody of the child. Supervised physical custody: Custodial time during which an agency or an adult designated by the court or agreed upon by the parties monitors the interaction between the child and the individual with those rights. Relocation: A change in a residence of the child which significantly impairs the ability of a nonrelocating party to exercise custodial rights.
