Certification and General Installation Certification All Ductile Iron Spooling manufactured by is made in accordance with current ANSI/AWWA- C115/A21.15 For submittals on spooling, linings and coatings, please refer to our website at www.uspipefab.com General Installation Due to the unique sealing capabilities of the FULL FACE FLANGE-TYTE GASKET recommends their use in flanged connections with Ductile Iron spools. *Please consult job specifications for gasket compound selection. Compounds other than SBR are available POA. Flanged piping should be supported during installation and never lifted after assembly to fittings, valves, pumps, or other equipment. Flanges should be torqued in accordance with manufacturer's recommendations in an alternating pattern. Improper installation of flanged ductile iron pipe will void all warranties, written or implied. CERTIFICATE OF COMPLIANCE TO STANDARDS 's pipe and fittings are manufactured to the following standards: The flanged pipe is manufactured with class 53 pipe in accordance with ANSI A21.15/AWWA C151 and drilled to meet ANSI B 16.1 Standard. Heavier classes are available. The pipe is manufactured in accordance with all applicable requirements of ANSI A12.51 and AWWA C151 Standards. The pipe groove depth dimension is manufactured in accordance with all applicable requirements of ANSI/AWWA C606. Rigid groove is standard. Flex groove is available. The exterior of the underground pipe will be coated with asphalt tar in accordance with ANSI A21.51/AWWA C151. All coating and lining for exterior piping, and all lining for interior piping, is certified to be in compliance with NSF 61 for potable water. Conforms to ANSI A21.4/AWWA C104. All flange fittings are manufactured in accordance with ANSI A21.10/AWWA C110 and are drilled to meet ANSI B16.1 Standard. All flanged fittings and flanged pipe will be coated with a primer if required, compatible with the top coat specified in the contract documents conforms to ANSI A21.4/AWWA C104. Terms of payment are net 30 days from the date of invoice, subject to approval by Seller s credit department. Prices do not include a present or future federal, state or local taxes based upon or measured by the sale, use, manufacture or shipment of the products covered hereby. All such taxes shall be for the buyer s account. Minimum on any order is $50.00. Specifications and instructions on the face hereof, to the best of our knowledge, are in accordance with directions of Buyer and full responsibility for their correctness is assumed by the Buyer. ALL GOODS SOLD BY, LLC ARE WARRANTED TO BE FREE FROM DEFECTS IN MATERIAL AND WORKMANSHIP. THE FOREGOING WARRANT IS IN LIEU OF AND EXCLUDES ALL OTHER WARRANTIES NOT EXPRESSLY SET FORTH HEREIN, WHETHER EXPRESS OR IMPLIED BY OPERATION OF LAW OR OTHERWISE, INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS., LLC WARRANTIES SHALL NOT APPLY TO ANY PRODUCT SOLD HEREUNDER IF ALTERATION, REPAIR OR WORK IS DONE ON THE PRODUCT WITHOUT SELLER S EXPRESS PRIOR APPROVAL IN WRITING., LLC shall not be liable for incidental or consequential losses, damages or expenses directly or indirectly arising from the sale, handling or use of the goods, or from any other cause relating to thereto, and, LLC liability hereunder in any case is expressly limited to the replacement (in the form originally shipped) of goods not complying with this agreement, or, LLC election to the prepayment of, or crediting Buyer with, an amount equal to the purchase price of goods, whether such claims are for breach of warranty or negligence. Any claim by Buyer with reference to the goods sold hereunder for any cause shall be deemed waived by the Buyer unless submitted to, LLC in writing within thirty (30) days from the date Buyer discovered, or should have discovered, any claimed breach. All goods not manufactured by the seller are warranted and guaranteed only to the extent and in the manner warranted and guaranteed to us by the manufacturer of such goods and then only to the extent the seller is able to enforce such warranty or guarantee. Fabricated pipe is made to order, therefore, it is not cancelable while under production and is not returnable without the prior written consent of the Seller. Shipment of products cannot be extended beyond the original shipping date specified without Seller s consent. On authorized returns, Buyer s account shall be credited for materials that are accepted for return less a handling charge of 25%, applicable reconditioning, and the outgoing and incoming freight. No credit shall be allowed for materials which are found not to be in resalable condition after testing, counting, and inspection. All authorized return goods must be identified by invoice numbers covering original sale. DELIVERY: Quoted deliveries are based on estimates at the time of quotation., LLC will devote it s best efforts to meeting delivery schedules but assumes no liability for additional costs or damages resulting from later deliveries. Buyer may not assign this agreement without Seller s prior written consent. Waiver of any breach of this contract shall not be construed as a waiver of any other breach. In the event of a conflict between any of the printed provisions hereof and any written or typed provisions hereof, the written or typed provisions shall govern. A service charge of 1½ % per month will be added for invoices not paid by the due date. Should the financial responsibility of Buyer at any time become unsatisfactory to Seller, Seller shall have the right to require payment for any shipment hereunder in advance or satisfactory security. If the Buyer fails to make payment in accordance with the terms of this agreement or fails to comply with any provisions thereof, the Seller may at it s option, in addition to other remedies, cancel any unshipped portion of this order. Buyer to remain liable for all unpaid accounts. Buyer agrees to pay all collection costs and expenses, including reasonable attorney fees, incurred by Seller in collecting or attempting to collect such account. FORCE MAJEURE:, LLC shall not be liable for any delays or failures in making delivery where occasioned by strikes or differences with workmen or any causes beyond the control of, LLC such as, but not limited to, fires, floods, accidents, action of any governmental authority, or shortages of labor, raw materials, production facilities or transportation. Acceptance by Buyer of any goods shall constitute a waiver by the Buyer of any claim for damages on account of any delay in delivery of such goods. BACKCHARGES: Claims for shortages or defective materials or non-conformity to specifications, which would be revealed by prompt inspection, must be made in writing to us immediately and in any event, within 5 days after you receive the materials so that any such materials can be investigated promptly. Claims of defective materials or non-conformity to specifications, not discernible by you from prompt inspection upon delivery, first discoverable by you upon installation of products, or first discoverable upon failure of a portion of the pipeline to pass certain specified field tests, will be investigated promptly provided you give us notice in writing within 15 days after completion of the installation or testing. If upon such investigation satisfactory evidence is received establishing the defect or non-conformity and that any failure was the result of the quality of the product as delivered, your claim will be allowed in writing subject to the limitations of this agreement. No claim will be allowed except as provided above. Failure to provide us written notice of defects in accordance with the above constitutes acceptance of the material delivered as fully complying with the terms of this order. Since you are in exclusive control of the installation means and methods, the materials furnished hereunder shall be conclusively presumed to have conformed to all applicable specifications in the event they have been inspected by governmental authorities and not rejected prior to inspection. Prices do not include the cost of any outside independent laboratory inspection if such should be required.
