CAHILL, Respondent <-... -.., - MAR - 6 20t7-3,J I CONDITIONAL ADMISSION AND AGREEMENT AS TO DISPOSITION Pursuant to Practice Book 5 2-82, the undersigned Respondent, Gary P. Cahill, and Disciplinary Counsel stipulate and agree as follows: I. This matter was instituted by grievance complaint filed by the Complainant, Dr. Timothy Leffert, on September 29,2006. On January 12, 2007, the Ansonia/Milford Judicial District Grievance Panel found probable cause that the Respondent violated Rules?.f5 (Safekeeping of Property) and 8.4(4) (Engaging in Conduct that is Prejudicial to the Administration of Justice) of the Rules of Professional Conduct in connection with the letter of protection dated July 22, 1998, which Attomey Cahill provided to Dr. Leffert on behalf of Attorney Cahill's client, Jeffrey Couture. Attomey Cahill has tendered a conditional admission of fact in accordance with his affidavit attached hereto, admitting that he violated Rule 1.15 of the Rules of Professional Conduct. I 4. Attomey Cahill acknowledges that he represented Jeffrey Couture in a personal injury lawsuit that arose out of a car accident on June 9, 1998. Mr. Couture visited chiropractor Dr. Leffert for injuries resulting from this accident. Upon request by Dr. Leffert, Attorney Cahill issued a letter of protection on July 22, 1998-5. Attomey Cahill acknowledges that Mr. Couture's personal injury lawsuit settled for $5,500.00 on or about April 7, 2004. Attorney Cahill deducted his fees and litigation costs from the settlement proceeds and distributed the remaining $3,710.00 of the settlernent to Mr. Couture. Dr. Leffert contacted Attorney Cahill on numerous occasions to discuss the sefflement, but Attorney Cahill never responded to those inquiries. 7. Attorney Cahill and Discipjinary Counsel agree that Disciplinary Counsel woum be able to present'evidence that Attomey Cahill did not not'@ Dr. Leffert that Mr. Couture's lawsuit had settled, and did not protect Dr. Leffert's interest in the settlement under the Letter of Protection. Further, Attorney Cahill did not account for the settlement proceeds in response to Dr. Leffert's inquiries regarding the settlement. ~ttome~ Cahiil's conduct violated Rule 1.15. 8. Disciplinary Counsel has agreed to recommend that Attorney Cahill be reprimanded and be ordered by the Statewide Grievance Committee to pay immediate restitution to Dr. Leffert in the amount of $1,500.00. Attorney Cahill agrees to pay Dr. Leffert within fourteen (14) days of receiving notice that the Statewide Grievance Committee has approved this agreement. Attorney Cahill will confirm with Disciplinary Counsel his timely payment to Dr. Leffert. 9. Complainant Dr. Leffert h& been advised of this Conditionai Admission and Affidavit, fully supports the proposed disposition, and has been informed of his opporzunity to be heard on the issue of discipline before the Committee. Pursuant to Practice Book 52-82,! make the following affidavit: 1; The Conditional Admission and Agreement as to Disposition attached hereto and made a part hereof are voluntarily submitted. 2. 1 herein consent to the submission of this matter to the Statewide Grievance Committee for disposition pursuant to Connecticut Practice Book 52-82(a). 3. 1 am aware that I have a right to a full hearing on this matter with the assistance of an attorney and I waive that right by entering into this agreement. 4. 1 have been neither subject to coercion nor duress and I am fully aware of the implications of this Affidavit and Conditional Admission and Agreement as to Disposition. 5. 1 am aware of the current proceeding regarding my alleged violation of Rules 1.15 (Safekeeping of Property) and 8.4(4) (Engaging in Conduct that is Prejudicial to the Administration of Justice), as they specifically relate to my dealings with Dr. Leffert. 6. 1 represented Jeffrey Couture in a personal injury lawsuit arising out of a motor vehicle accident on June 9, 1998. When Mr. Couture sought treatment from Dr. Leffert, Dr. Leffert requested a letter of protection for his fees. 1 provided Dr. Leffert with a letter of protection on July 22, 1998. 7. On April 7,2004, Jeffrey Couture's personal injury lawsuit settled'for $5,500. I subtracted my fees and litigation costs, and distributed the remaining $3,710 to Mr. Couture. 8. 1 agree that I violated Rule 1.15 (Safekeeping of Property) in that I failed to notify Dr. Leffert of the settlement agreement, to protect his.medical fees, and to return his phone calls or otherwise keep him informed of the status of the settlement agreement.
