GENERAL INFORMATION: The City of Sunnyside Municipal Code allows the consideration of variances by the Staff Review Committee as specified in Section 2.46.030(A) of the Sunnyside Municipal Code. It shall be the responsibility of the Applicant to provide all necessary and supportive documentation. An incomplete application will result in the application being returned to the Applicant and could delay scheduling of the public hearing on the application. If an inspection is required, you will be contacted by the Fire Marshall and the Code Enforcement Officer for an inspection of the premises. These inspections must be done prior to the hearing before the Staff Review Committee. The officers will attempt to schedule both inspections at the same time, if possible, so that it may be more convenient for the Applicant. Staff Review Committee meets as necessary in the Council Chambers. You will be notified when your application has been set before the Staff Review Committee for public hearing. Any decision of the Staff Review Committee may be appealed in writing within ten (10) days to the City Council. (SMC 2.46.060.) It is recommended that the Applicant contact his/her neighbors to explain the nature of the project for which the Variance is sought, and be prepared to address concerns neighbors may have regarding the public hearing. It is also recommended that the Applicant or a representative familiar with the project be present at the Staff Review Committee meeting to answer any questions posed by the public and/or members of the Staff Review Committee. The Staff Review Committee may continue a public hearing or deny the application if there is no one present to answer any such questions or concerns brought before the Staff Review Committee. Applications for variances from the terms of the zoning ordinance, the official map ordinance, or other land use regulatory ordinances under the procedures and conditions prescribed by the city ordinance, which among other things shall provide that no application for a variance be granted unless the Staff Review Committee finds: 1. The variance shall not constitute a grant of special privilege inconsistent with the limitation upon uses of other properties in the vicinity and zoning of the property on behalf of which the application was filed is located; and, 2. That such variance is necessary, because of special circumstances relating to the size, shape, topography, location or surroundings of the subject property, to provide it with use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located; and, 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and zoning in which the subject property is situated.

Be as complete as possible. 3. Submit the application form with a site plan drawn to scale showing dimensions. (See Attached Sample) (a) Location of the Applicant s property; (b) Location of property adjacent to Applicant s property; (c) For a set back variance, the location of the proposed building/expansion in relation to the property lines.
