FRENCH QUARTER ECONOMIC DEVELOPMENT DISTRICT RESOLUTION NO. R-2015-1 CITY HALL: May 7, 2015 BY: DISTRICT MEMBER RAMSEY (BY REQUEST) SECONDED BY: A RESOLUTION authorizing the publication of a notice describing the intention of the Governing Authority of the French Quarter Economic Development District to levy an increase of.2495% in sales tax within the boundaries of the District, and providing for other matters in connection therewith. WHEREAS, Part II, Chapter 27, Title 33 of the Louisiana Revised Statutes of 1950, as amended (La. R.S. 33:9038.31, et seq.) (the EDD Act ) authorizes municipalities, parishes and certain other local governmental subdivisions to create economic development districts to carry out the purposes of the Act, which economic development districts are political subdivisions of the State of Louisiana and possess such power and authority and have such duties as provided by the EDD Act and other law; and WHEREAS, at its April 23, 2014 meeting, the New Orleans City Council adopted Ordinance No. 26,374 M.C.S. creating the French Quarter Economic Development District ( FQ EDD ) and establishing the City Council as the Governing Authority of the FQ EDD, in accordance with La. R.S. 33:9038.32; and WHEREAS, La. R.S. 33:9038.39 grants the Governing Authority of the FQ EDD the power to levy an increase in sales taxes of up to two percent within the boundaries of the District, for the furtherance of economic development projects; and WHEREAS, in accordance with La. R.S. 33:9038.39, the Governing Authority of the FQ EDD now desires to give notice of its intention to levy an increase in sales tax of.2495% within the boundaries of the District and to hold a public hearing relative to the proposed increase, which notice shall be published in the City s official journal two times prior to the public hearing, one week apart, the first publication to appear at least fourteen days before the date of the public hearing;

NOW THEREFORE, BE IT RESOLVED BY THE GOVERNING AUTHORITY OF THE FRENCH QUARTER ECONOMIC DEVELOPMENT DISTRICT (FQ EDD): SECTION 1. Intent to Levy Increase in Sales Tax. In accordance with La. R.S. 33:9038.39, the Governing Authority of the FQ EDD does hereby give notice of its intention to levy an increase of.2495% in the sales tax within the boundaries of the District for the purpose of funding enhanced and supplemental public safety services to facilitate economic development projects within the District. The boundaries of the District are as follows: the area bounded by the Mississippi River, the center line of Canal Street, the rear property line of the properties fronting on the lake side of North Rampart Street, and the rear property line of the properties fronting on the downriver side of Esplanade Avenue to the Mississippi River, as set forth in Exhibit A, attached. SECTION 2. Publication of Notice of Intention. The City Clerk is authorized and directed to publish a notice of intention, in the following form and substance, which notice shall be published in the City s official journal two times prior to the public hearing, one week apart, the first publication to appear at least fourteen days before the date of public hearing: ***** NOTICE OF INTENTION TO LEVY AN INCREASE IN SALES TAX WITHIN THE BOUNDARIES OF THE FRENCH QUARTER ECONOMIC DEVELOPMENT DISTRICT NOTICE IS HEREBY GIVEN that the Governing Authority of the French Quarter Economic Development District ( FQ EDD ) intends to levy an increase of.2495% in the sales tax within the boundaries of the District, subject to a vote of the electors residing in the FQ EDD, for the purpose of funding enhanced and supplemental public safety services to facilitate economic development projects within the District. NOTICE IS HEREBY FURTHER GIVEN that the Governing Authority, acting on behalf of the FQ EDD, will meet in open and public session on June 4, 2015 at 10:00 a.m., in City Council chamber, City 2

Hall, 1300 Perdido Street, New Orleans, Louisiana 70112, to hear any objections to the levy of an increase of.2495% in the sales tax within the boundaries of the District. A description of the boundaries of the District and a map of the District, are attached to this Notice. [LEGAL DESCRIPTION AND MAP TO BE ATTACHED IN PUBLICATION] ***** SECTION 3. Public Hearing. At the date, time and place specified in the foregoing Notice of Intention, or at such other date, time and place as may be determined by the Governing Authority and included in the published notice, the Governing Authority will meet in open and public session, to hear any objections to the proposed levy of an increase of.2495% in the sales tax within the boundaries of the District for the purpose of furthering economic development projects within the District. SECTION 4. Authorization of Officers. The Mayor, authorized representatives of the FQ EDD, the Clerk of Council, and any other necessary officials or officers be and are hereby authorized, empowered and directed to do any and all things necessary and incidental to carry out the provisions of this Resolution. THE FOREGOING WAS READ IN FULL, THE ROLL WAS CALLED ON THE ADOPTION OF THEREOF AND RESULTED AS FOLLOWS: YEAS: NAYS: ABSENT: AND THE RESOLUTION WAS ADOPTED. 3
