DALLAS COUNTY, TEXAS LORENZO BROWN JUDICIAL DISTRICT DISCIPLINARY PETITION TO THE HONORABLE JUDGE OF SAID COURT: COMES NOW Petitioner, the Commission for Lawyer Discipline, a committee of the State Bar of Texas (hereinafter called "Petitioner"), complaining of Respondent, Lorenzo Brown, (hereinafter called "Respondent"), showing the Court: I. Discovery Control Plan Pursuant to Rules 190.1 and 190.2, TEXAS RULES OF CIVIL PROCEDURE (TRCP), Petitioner intends discovery in this case to be conducted under the Level II Discovery Control Plan. II. Petitioner brings this disciplinary action pursuant to the State Bar Act, Tex. Gov't. Code Ann. 81.001, et sea. (Vernon 1988), the Texas Disciplinary Rules of Professional Conduct and the Texas Rules of Disciplinary Procedure. The complaint which forms the basis of the Disciplinary Petition was filed on or after May 1, 1992. III. Respondent is an attorney licensed to practice law in Texas and is a member of the State Bar of Texas. Respondent is a resident of and has his principal place of practice in Dallas County, Texas. An officer may serve citation on Respondent at 1015 NationsBank, Oak Cliff Tower, 400 S. Zang Blvd., Dallas, Texas 75208-6641. IV. On or about August 21, 1997, Complainant, Bobby Burley ("Burley") employed Respondent to represent him in a personal injury claim. During the course of the representation, Burley called several times to speak with Respondent regarding his case. Burley was unable to speak directly with Brown, but instead spoke with Respondent's paralegal, who was unable to keep Burley reasonably informed about the status of his case. V. Not until Burley dropped by Respondent's office unannounced on June 11, 1998, did Burley get to speak to Respondent regarding his case. Burley had already given Respondent signed medical authorizations on or about August 15, 1997. Brown failed to tell Burley (until Burley came to Respondent's office) that additional medical authorizations were needed to pursue his case. VI. On or about June 15, 1999, Respondent withdrew from representing Burley. Respondent asserted a lien of thirty-three and one-third percent on any settlement proceeds despite the provision in the parties written contract that upon withdrawal by the attorney "the attorney shall be entitled to reimbursement of any expenses, charges or costs the attorney may have advanced or incurred during the course of the representation." VII. Such acts and/or omissions on the part of Respondent as are described in Paragraphs IV, V, VI, hereinabove, which occurred on or after January 1, 1990, constitute conduct which violates Rules 1.03(a)(b), and 1.15(d) of the Texas Disciplinary Rules of Professional Conduct. VIII. The complaint which forms the basis of the Cause of Action hereinabove set forth was brought to the attention of the Office of General Counsel of the State Bar of Texas by Bobby Burley filing a complaint on or about June 18, 1999. PRAYER WHEREFORE, PREMISES CONSIDERED, Petitioner prays for judgment that Respondent be disciplined as the facts shall warrant; and that Petitioner have such other relief to which entitled, including costs of Court and attorney's fees.
