Contract Terms for the Master s Programme SpaceTech (MEng) at Graz University of Technology (TU Graz) Current version as of 30 01 2015 The Contract Terms in their currently valid version apply for admission to and participation in the master s programme SpaceTech (MEng) at Graz University of Technology (TU Graz). The rights and obligations of the parties of the contract regarding the individual educational programmes and events are defined in more detail by the content of the specific curriculum, as well as any programme or event information and other newsletters of the university. 1. Application and registration requirements: The application must be submitted in writing, and the signed application form constitutes a legally binding registration. The programme direction decides without exception on admission or rejection of applicants. Since only a limited number of students are admitted to the programme, the programme direction reserves the right to select applicants according to didactically appropriate criteria and a ranking system. Participants will be notified in writing of their admission. By submitting an application, each applicant expressly consents to computer-assisted handling and processing of his/her personal data for the purpose of the master s programme and exams, and each applicant confirms that he/she may be sent future information concerning professional education. In addition, upon being granted a study place the applicant expressly consents that his/her name and address will be passed on to fellow students, lecturers and persons in charge of the organisation of the programme in order to facilitate internal communication. The applicant approves that his/her name - and if necessary his/her picture may be used for marketing and similar activities of Graz University of Technology. For the duration of the master s programme, participants agree to maintain an e-mail account in order to receive information, materials etc., and to download information from internet addresses indicated by Graz University of Technology. 2. Programme fee and payments The programme fee set for the SpaceTech (MEng) master s programme covers the costs for the courses as well as the programme materials. All other costs such as participation in excursions, research as part of the master s thesis, travel expenses and room and board have to be covered by the participants themselves. At the moment, programme fees are exempt from value-added tax. The programme fee ( 34,000.00, no VAT) must be paid in advance and is due without deduction within seven days starting from the date of the invoice. In case of delayed payment, the participant will be charged 4% default interest per annum plus dunning charges. The programme fee has to be paid by bank transfer to Bank Austria (BA) Graz, Bank Identifier Coder (BIC): BKAUATWW, International Bank Account Number (IBAN): AT88 1200 0516 5610 1848, Graz University of Technology - Life Long Learning using the appropriate payment form, on which the name of the master s programme must be stated. 2015 Application Form Page 6/8
Any and all bank charges arising from the transfer must be covered by the participants themselves. Special payment conditions may be arranged on demand. 3. Terms of cancellation The master s programme SpaceTech (MEng) is a complete education and training system. By registering, you are booked for the entire programme. Participants can only terminate the contract (cancellation of registration) in writing, no later than 30 days prior to the beginning of the master s programme. This cancellation of contract is valid only if it is made in writing, if it is sent as a registered letter and if the programme direction of the master s programme receives the termination with at least 30 days notice. Provided that the termination was submitted in time (i.e. no later than 30 days before start of the master s programme), the programme fees that have already been paid will be reimbursed to the participant less a 20% deduction for administrative fees. If the termination is late or if the participant drops out of the master s programme for any reason whatsoever, the programme fee will not be reimbursed. However, the participant is free to name a suitable alternative participant. 4. Change of services The services of the master s programme are planned on a long-term basis and are subject to constant quality control. Quality assurance requires continuous adjustments. For this reason, Graz University of Technology reserves the right to further develop the curriculum and make changes to the content, days, locations and dates as well as lecturers of courses. These kinds of adjustments, as well as possible changes at short notice, do not entitle participants to withdraw from the master s programme, to a reduction of programme fees or to claims for compensation. Any necessary changes, especially of time, location, content or lecturers of individual courses or of the number of participants are the sole responsibility of the programme direction of the master s programme and do not affect the validity of the remainder of the further education contract with the participant. Graz University of Technology reserves the right to cancel or postpone a course prior to its start. Graz University of Technology may postpone or cancel the entire master s programme if there are not enough participants. In the case of a cancellation of an entire programme, 100% of the fees already paid will be reimbursed to the applicants. However, no other claims can be asserted against Graz University of Technology on the grounds of such cancellation or postponement. 5. Copyright protection The course content as well as all programme materials handed out to the participants (such as scripts, electronic data storage media, videos etc.) are the intellectual and sole property of TU Graz. They are approved exclusively and solely for the own personal use of the participants. The reproduction or any other duplication of the programme materials is only permitted with the express permission of the programme direction of the master s programme. 2015 Application Form Page 7/8
All work developed by participants as part of the master s programme remains their own intellectual property. However, participants grant TU Graz permission to utilise their works in any conceivable manner free of charge and regardless of time and location of use. In particular they expressly consent that papers (master s thesis and final papers) selected by Graz University of Technology may be published in part or in full in professional publications (magazines, books and internet) under the name of the author and in the name of Graz University of Technology. The aforesaid does not limit the participant s right of use with respect to his/her work. 6. Liability for objects and house regulations The knowledge acquired and applied within the scope of the master s programme cannot constitute a cause for the assertion of liability claims against Graz University of Technology. Liability for injuries sustained during the master s programme is excluded from the realm of legal possibilities. Liability for slight negligence, compensation for consequential and economic or financial loss, loss of profit and damages resulting from claims of third parties are excluded, too. All participants in the master s programme are responsible for their own decisions and actions. Graz University of Technology assumes no liability for the theft, loss or damage of objects in particular valuables - brought to the master s programme. The house regulations of Graz University of Technology are valid in their current version. A repeated violation of the house regulations or other safety regulations of Graz University of Technology leads to the exclusion of the participant from further participation in the master s programme; in this case, the programme fee will not be reimbursed. 7. Miscellaneous, venue, applicable law and validity These Contract Terms apply exclusively to the master s programme SpaceTech (MEng) offered by Graz University of Technology. No invalidity of unenforceability of individual conditions of this contract shall affect the remaining parts of these terms and conditions. Any subsidiary agreements must be executed in writing and need to be approved by both contract parties in order to be valid. Graz is the exclusive court of jurisdiction with respect to all disputes arising from the contracts concluded between Graz University of Technology and its contractual partners. This contract is subject to Austrian law to the exclusion of the conflict-of-law rules of Austrian international private law.
