The prosecution story in brief is that on 03/04/2015 at 5.30 pm the accused persons has stolen his white colour goat from Khaga Tinikhuti Tinali road near the shop of Bhadra Sonowal and took it away by carrying it on a purple colour nano car. When the informant saw it, he follows the vehicle with a motorcycle and with the help of local people he caught the accused person with the vehicle and goat at the embankment of Kharkati village. 2. On receipt of the ejahar from the informant on 3/4/2015 at Panigaon P.S, police registered the case as Panigaon p.s case No-21/2015 arrested the accused persons and started investigation of the case and after completion of the investigation I.O has submitted the charge-sheet u/s 379/34 IPC. I received the case record from the Hon ble CJM on being transferred for disposal. Necessary copies were furnished to the accused 1
persons by my Ld predecessor. On revealing that a prima facie case is made out u/s 379/34 IPC against the accused persons, my Ld predecessor explained the particulars of the offences to the accused persons which they pleaded not guilty claimed to be tried. The accused person is examined u/s 313 Cr.P.C. Defence has not adduce any evidence. Defence plea is of total denial. 3. POINTS FOR DETERMINATION: Whether the accused persons in furtherance of common intention committed theft of goat from road near to the shop of Bhadra Sonowal and carrying it on a purple colour nano car and punishable u/s 379/34 IPC? 4. DECISION AND REASONS FOR DECISION: 5. Heard the argument of both sides. 6. To prove this case the prosecution side examined five witnesses PW1- Sri Umesh Kakoti, PW2- Sri Tarun Kakoti, PW3-Sri Biju Kakati, PW4-Sri Naba Borah,including the I.O as PW5-Sri Jyoti Borah. 7. Pw1 deposed that on 03/04/2015 some goats were gazing near shop at tinali. He deposed that one purple colour nano car was waiting there since 5.30 am. He deposed that he noticed the nano car from a distance of fifty metre. He saw that some edible items were throwing from the vehicle and when the goats came near the car to have it, his white colour goat lifted inside the vehicle and left. He deposed that he follow the vehicle by riding on his brother s motor cycle and able to catch them with the help of villagers at Kharkati village embankment. In his cross he deposed that the car stopped there at 5.30 am and morning light was there at that time. He stated in his cross that he saw two person in the vehicle. 8. Pw2 in deposition in chief is same as pw1. Pw2 in his cross stated that in the time of incident he was at home. He stated that when his brother came to his house and told the incident then he went with him on his bike. He stated that after fifteen minutes they saw the vehicle and after 2
crossing four five kilometre they were able to catch one but other accused person Nased Ali tried to fled away. 9. Pw3 deposed that that on the day of incident when his brother told him about lifting of their goat from Bhadra Tin Ali. When he reached Kharkati Mathawari the driver tried to drive the vehicle fast but trapped. The driver is able to fled away but other accused person is caught red handed. Policed came and seized the purple colour nano car with black glass. Police also seized the goat Ext 2: Seizure list and Ext 2(1): His signature on it. In his cross he deposed that when he followed the vehicle he saw the vehicle bearing registration No-As-12 M 5434. 10.Pw4 deposed that in the month of April at 6.00 am he saw Babul Ali and other person was followed by some persons. He deposed that the accused persons are in a nano car. The embankment was newly constructed and therefore the vehicle got stucked in the mud and the person with Babul Ali was on the road. He deposed that thereafter he saw that nano car was seized by the police and he put his signature on it Ext2: Seizure list and Ext 2(3): His signature on it. 11.Pw5, the I.O. deposed that after entrustment he went to the place of occurance and found the nano car and the goat was kept by the villagers. He seized the car and also gave zimma of the goat and prepared the rough scratch map of the place of occurance. The I.O has exhibited Ext-2 is the seizer list and Ext-2(2) is his signature. Ext 3 Another seizure list Ext3(1)-His signature on it, Ext4- Rough Stretch Map, Ext 4(1)- His signature on it, Ext 5: charge sheet, Ext 5(1): His signature on it. In his cross he deposed that Umesh Kakoti, Biju Kakoti, Nava Bora are the eye witnesses of the case. He deposed in his cross that at the time of incident it was day time in the month of April. 12.Section 379 IPC stated that whoever intending to take dishonestly any movable property out of the possession of the any person without that persons consent moves that property in order to such taking is said to 3
commit theft. In this case Pw1 deposed that he noticed the nano car from a distance of fifty metre. He saw that some edible items were throwing from the vehicle and when the goats came near the car to have it, his white colour goat lifted inside the vehicle and left.pw2, Pw3, Pw4 were present at the time of seizing the vehicle and able to catch the accused persons red handed with the vehicle bearing registration No As-12 M 5434. Persue the Ext 3 where the number and description of the vehicle is similar as deposed by Pw3 as well as Pw4. The I.O also cited them as eye witness in his deposition as Pw5. As the accused persons put eatable items in front of the goats which were on the road, and when they came near the vehicle to have it they grab it inside the vehicle and fled away. From the depositions of witnesses and finding of the white goat inside the vehicle which proves that the accused persons took away the goat with a intention to take it dishonestly out of the possession of the owner of the goat without his consent. Hence, the prosecution has prove the case against the accused persons u/s 379/34 I.P.C beyond reasonable doubt. Hence the accused persons are convicted under the said provision of the I.P.C. 13.Considering the nature and gravity of offence I am not inclined to provide the convicted accused person benefit of the Probation of Offenders Act. Heard the accused persons on the point of sentence hearing to which they prayed mercy on the ground that they are very poor men and sole bread earner of their family, therefore, this court imposed fine amount of Rs 5000/- each in default 3 months S.I for the offence u/s 379/34 I.P.C. Total amount of fine is Rs 10,000/-. ORDER The Prosecution side has been able to establish the case u/s 379/34 IPC and accordingly the accused persons are convicted under the said section of IPC. Accordingly, this court imposed fine amount of Rs 5000/- each in default 3 months S.I for the offence u/s 379/34 I.P.C. Total amount of fine is Rs 10,000. Let a copy of the judgment be furnished to the accused persons free of cost immediately. 4
