AMENDMENT 3 [Addendum No. 1] to CONTRACT AGREEMENT 03/PKK/PMAC-C.10/2009 between SATUAN KERJA PENGEMBANGAN KINERJA PENGELOLAAN AIR MINUM PROVINSI JAWA TENGAH Dinas Cipta Karya dan Tata Ruang Provinsi Jawa Tengah and PT. INDOMAS MULIA for CONSULTING SERVICES for PROVINCIAL MANAGEMENT ADVISORY CONSULTANT (PMAC) TO THE PROVINCIAL PROJECT MANAGEMENT UNIT (PPMU) PROVINCE OF CENTRAL JAVA (PACKAGE C-10) This Contract Amendment No. 3/Addendum No.1 (hereinafter called Addendum ) is made on August 9, 2011 to further amend Contract Amendment No. 2 dated December 1, Contract Amendment No. 1 dated November 06, 2009 and the Original Contract dated August 26, 2009 between, on the one hand, Satuan Kerja Pengembangan Kinerja Pengelolaan Air Minum Provinsi Jawa Tengah Dinas Cipta Karya dan Tata Ruang Provinsi Jawa Tengah (hereinafter called the Client ) and PT. Indomas Mulia (hereinafter called the Consultant ). WHEREAS (a) Letter from the Director of Water Supply Development to Satker PK-PAM No.: Pr.01.03/Ca/511 dated October 11, 2010 regarding the revision to the Terms of Reference [TOR] of the PMAC scope of works and request to amend the Contract; (b) Letter from the Director of Water Supply Development to Satker PK-PAM No.: Pr.01.03/Ca/528 dated October 18, 2010 regarding the recruitment of a short-term districtbased financial monitoring assistant; (c) In response to the Client s letter No. 88.3/PMAC/PamsimasJT/10/2010 dated October 21, 2011 requesting the estimation of costs for the above additional scope of works, the Consultant in its letter dated October, 2010 submitted the cost estimation which was subsequently negotiated and approved by the Client as per the Minutes of Cost Negotiation Meeting and Detailed of Breakdown of Cost Negotiation dated January 6, 2011 No: 01/BA/Ca.WII/2011; (d) The percentage of consultants services to be finance by IDA Credit 4204-IND was amended from 100% of expenditure incurred in FY 2008 and FY 2009, 40% in FY 2010 and 15% thereafter to 100% of expenditure incurred up to and including FY 2010 and 15% thereafter; (e) Pursuant to Clause 2.6 of the General Conditions of Contract, it is deemed necessary to legally administer the changes in the Form of Contract Amendment.

NOW THEREFORE the parties hereto hereby agree as follows: 1. The following documents shall be deemed to form an integral part of this Addendum: a. General Conditions of Contract no change b. FY 2010 and 15% thereafter Amount Eligible for IDA funding : IDR 6,931,427,815 Amount Eligible for APBN-RM : IDR 10,672,737,113 2. To amend Appendix A Description of Services to accommodate the change of the Consultant s Terms of Reference related to the scope of works and the recruitment of a local government specialist and financial monitoring assistant; 3. To amend Appendix B Reporting Requirements to accommodate additional reporting requirements of the local government specialist; 4. To amend Appendix C Personnel and Sub-Consultants Hours of Work for key Personnel to accommodate the recruitment of local government specialist and financial management assistant; 5. To amend Appendix E - Cost Estimates in Local Currency to accommodate the changes in the scope of works referred to in 2) above and the associated cost and expenses. 6. All terms and conditions in the Contract other than those specifically revised by this Amendment shall remain in full force and effect.
