Statement of Organization Packet The Statement of Organization Packet is required for candidates in order to establish a committee with the appropriate Board of Elections. Required forms are the Statement of Organization (CRO-2100A), Certification of Treasurer (CRO-3100), and Certification of Bank Account Information (CRO-3500). Optional forms are Designation of Committee Funds (CRO-3900) and Certification of Threshold (CRO- 3600). These forms are required within 10 days of the committee s inception, along with the first campaign finance report, called an Organizational Report. Instructions on completing each form is located on the NC State Board of Elections website, under the Campaign Finance Tab, along with a sample of most forms. An Organizational Report is due covering the transactions of first few days of the committee, not to exceed 10 days. If the Statement of Organization states that the committee organized on 2/10/2014, then the Organizational Report should cover 2/10/14 to any day within that 10 day period. Coverage between 2/10/2014 and 2/20/2014 is the maximum. For completing the Organizational Report, the committee should sign up for Treasurer Training and Campaign Finance Software Training. Both can be done by emailing the NC State Board of Elections at campaign.reporting@ncsbe.gov. The committee can download the software from the www.ncsbe.gov website.

At a minimum, these include the Statement of Organization (form CRO-2100A), the Certification of Treasurer (form CRO-3100), the Certification of Financial Account Information (form CRO-3500), the Disclosure Report Cover (form CRO-1000) and the Detailed Summary (form CRO-1100). Please note that some banks will not set up an account for a committee until the committee is registered with the board of elections. If this is the case, the Board of Elections will register the committee in advance of receiving the CRO-3500; the committee must provide this form immediately after the account is established. Please refer to the Detailed Summary to determine what other forms might be required. The required form for each transaction is noted on the same line as the transaction description. If you have engaged in any of the activities described, please include the cited form. After the Organizational Report has been filed additional reports will be necessary. Refer to the 2012 Candidate Campaign Finance Guide (page 5) for the schedule of reports due. If you are a candidate eligible to file a Certification of Threshold, the financial disclosure part of the Organizational report (CRO forms 1000 and 1100) is not required. See the 2012 Candidate Campaign Finance Guide to determine Threshold eligibility. State Board of Elections campaign finance staff is available to advise new committees on the proper forms to use for campaign finance reporting. Candidates for statewide, legislative and judicial offices file reports at the State Board of Elections. Candidates for county and municipal offices file reports at the County Board of Elections.

163-278.16B. Use of contributions for certain purposes. (a) A candidate or candidate campaign committee may use contributions only for the following purposes: (1) Expenditures resulting from the campaign for public office by the candidate or candidate's campaign committee. (2) Expenditures resulting from holding public office. (3) Donations to an organization described in section 170(c) of the Internal Revenue Code of 1986 (26 U.S.C. 170(c)), provided that the candidate or the candidate's spouse, children, parents, brothers, or sisters are not employed by the organization. (4) Contributions to a national, State, or district or county committee of a political party or a caucus of the political party. (5) Contributions to another candidate or candidate's campaign committee. (6) To return all or a portion of a contribution to the contributor. (7) Payment of any penalties against the candidate or candidate's campaign committee for violation of this Article imposed by a board of elections or a court of competent jurisdiction. (8) Payment to the Escheat Fund established by Chapter 116B of the General Statutes. (9) Legal expense donation not in excess of four thousand dollars ($4,000) per calendar year to a legal expense fund established pursuant to Article 22M of Chapter 163 of the General Statutes. 170(c) of the Internal Revenue Code of 1986 (26 U.S.C. 170(c)) (c) Charitable contribution defined. For purposes of this section, the term "charitable contribution" means a contribution or gift to or for the use of-- (1) A State, a possession of the United States, or any political subdivision of any of the foregoing, or the United States or the District of Columbia, but only if the contribution or gift is made for exclusively public purposes. (2) A corporation, trust, or community chest, fund, or foundation (A) created or organized in the United States or in any possession thereof, or under the law of the United States, any State, the District of Columbia, or any possession of the United States; (B) organized and operated exclusively for religious, charitable, scientific, literary, or educational purposes, or to foster national or international amateur sports competition (but only if no part of its activities involve the provision of athletic facilities or equipment), or for the prevention of cruelty to children or animals; (C) no part of the net earnings of which inures to the benefit of any private shareholder or individual; and (D) which is not disqualified for tax exemption under section 501 (c) (3) by reason of attempting to influence legislation, and which does not participate in, or intervene in (including the publishing or distributing of statements), any political campaign on behalf of (or in opposition to) any candidate for public office. A contribution or gift by a corporation to a trust, chest, fund, or foundation shall be deductible by reason of this paragraph only if it is to be used within the United States or any of its possessions exclusively for purposes specified in subparagraph (B). Rules similar to the rules of section 501(j) shall apply for purposes of this paragraph.
