1. PRELIMINARY 1.1 Cash Rewards is a rewards program whereby use of your Visa Credit Card in eligible transactions may result in Rewards Points being credited to your Cash Rewards Account which are redeemable for cash. 1.2 The Big Sky Cash Rewards Visa Credit Card Terms and Conditions are issued by Ltd ABN 30 087 652 079 ( Big Sky, we or us ) and governs Big Sky customers participation in the Cash Rewards program. 1.3 Accessing any benefits under the Cash Rewards program constitutes your agreement to be bound by the Terms and Conditions of the Cash Rewards program. Therefore, you should read these Terms and Conditions carefully prior to participating in the Cash Rewards program. 1.4 These Big Sky Cash Rewards Visa Credit Card Terms and Conditions are separate from and in addition to the Big Sky Visa Credit Card Conditions of Use of your Visa Credit Card, which are located on our website at. 1.5 Big Sky reserves the right to change these Big Sky Cash Rewards Visa Credit Card Terms and Conditions in its absolute discretion. lf any changes are material in nature, we will give you at least 30 days prior notice. 1.6 Where applicable, we will round up to the nearest cent when calculating cash rewards. 1.7 A Cash Rewards account (S46) is required to be opened as part of the Cash Rewards Visa Credit Card program whereby cash rewards will be credited. The Cash Rewards account is a restricted account only available to customers who have a Cash Rewards Visa Credit Card. 1.8 The S46 Cash Rewards Account is not available for use as an everyday savings account or for everyday banking transactions. The account is designed only to receive credits from redeemed Cash Rewards Points which can then be transferred to an account used for everyday purposes. Our Terms of Use are available from or upon request. 2. DEFINITIONS 2.1 Additional Cardholder means a person holding, with your consent, an additional card issued under your Visa Credit Card Account. 2.4 Eligible Transactions means the purchase of goods or services from merchants accepting your Visa Credit Card, including GST payable for those goods or services by you, excluding any Government fees or charges, credit interest payable on your Cash Rewards Account, corporate cheques, fraudulent transactions, balance transfers and bill payments made through BPAY or any other electronic payments scheme. 2.5 Membership Year means each period of 12 consecutive months that you have been a Big Sky Visa Credit Card holder eligible to participate in the Cash Rewards Program, ending on the anniversary of the first such day. 2.6 Points mean the Cash Rewards Points you earn by using your Visa Credit Card for eligible transactions in accordance with Clause 5. 2.7 Statement Period means subject to Clause 9.3 each calendar month. 2.8 Terms and Conditions mean these Big Sky Cash Rewards Visa Credit Card Terms and Conditions. 3. ELIGIBILITY TO PARTICIPATE IN THE CASH REWARDS PROGRAM 3.1 Participation in the Cash Rewards Program is only available to individuals (natural persons). Companies, partnerships, trusts, Government agencies and other entities are expressly excluded from being eligible to participate. 3.2 Big Sky reserves the right at any time in its absolute discretion to: (a) withdraw the eligibility of particular individuals to participate in the Cash Rewards Program; (b) discontinue the Cash Rewards Program without honouring standing Points balances; and (c) make any changes to the Cash Rewards Program or these Terms and Conditions. 3.3 We will give you at least 30 days notice if we: (a) withdraw your eligibility to participate in the Cash Rewards Program; (b) wiscontinue the Cash Rewards Program; and (c) make any material change to the Terms and Conditions. 2.2 Cash Rewards means the Big Sky Cash Rewards Program. 2.3 Cash Rewards Account means your Cash Rewards account issued by us as part of the Cash Rewards Program to which Points will be credited for eligible transactions. 4. FEES AND CHARGES 4.1 Unless a determination has been notified pursuant to Clause 4.2, there will be no fee or charge for participation in the Cash Rewards Program. 4.2 We may determine to charge an annual or any other type of fee or charge for participation in the Cash Rewards Program by giving you at least 30 days notice prior to any such change taking effect. 4.3 Big Sky reserves the right to pass on to you any fees, charges, duties and taxes that are imposed on the use of the Cash Rewards Program by any Government or regulatory authority. 5. EARNING CASH REWARDS POINTS 5.1 Eligible Big Sky customers who participate in the Cash Rewards Program will earn Cash Rewards Points when their Visa Credit Card is used in eligible transactions whether in Australia or overseas. Cash Rewards points are calculated on the basis of one (1) Cash Rewards Point for each Australian dollar (or equivalent foreign currency amount) spent on eligible transactions which are charged to your Visa Credit Card. For every 200 Cash Rewards Points you earn, you receive a AU$1.00 Cash Reward, which will be paid monthly into your Cash Rewards Account. 5.2 We may determine to award additional or bonus Cash Rewards Points, and cease to do so, at our absolute discretion. 5.3 Participants in the Cash Rewards Program may not earn more than 250,000 Cash Rewards Points in any one Membership Year. 6. INELIGIBILITY TO EARN CASH REWARDS POINTS 6.1 You will not be eligible to earn Cash Rewards Points if: (a) you are in arrears in any Visa Credit Card payment due to us for more than 30 days; (b) you have reached the maximum number of Cash Rewards Points in the current Membership Year; (c) you or any Additional Cardholder has acted fraudulently or there has been any fraudulent use of your Visa Credit Card; (d) the use of your Visa Credit Card was for other than personal expenditure; (e) you or any Additional Cardholder breached these Terms and Conditions; (f) your Visa Credit Card is suspended or terminated for any reason; or (g) where you lose your Visa Credit Card, until a new card is issued. 7. REDEEMING YOUR CASH REWARDS POINTS 7.1 Cash Rewards Points are redeemable for cash and will be credited to your Cash Rewards Account in the following manner: (a) Cash Rewards Points will be converted into Australian dollars and credited to your Cash Rewards Account once monthly; (b) you may access any credit balance in your Cash Rewards Account by way of transfer to any other Big Sky account which you maintain with us. 8. WHEN CASH REWARDS POINTS WILL BE DEDUCTED 8.1 Cash Rewards Points will be deducted from your Points balance: (a) where they are redeemed in accordance with Clause 7; (b) where they have been incorrectly credited to your Cash Rewards Account and you are otherwise not entitled to those Points; and (c) for eligible transactions for which you have received a refund. You are required to notify us where this occurs. Note: Failure to notify us of a refund on an eligible transaction as soon as you receive the refund or any part thereof may result in immediate withdrawal of your eligibility to participate in the Cash Rewards Program. You consent to us debiting your Big Sky Visa Credit Card to recover the value of Cash Rewards Points you have used but were not entitled to where you were or should have been aware of this. 9. TRACKING YOUR CASH REWARDS POINTS BALANCE 9.1 You will be able to track the redeemable balance in your Cash Rewards Account via our internet and telephone banking facility and on your statement of account. 9.2 While we will use all reasonable endeavours to ensure that details of your Cash Rewards Points balance are up to date, we will not, to the fullest extent permitted by law, be liable to you if we fail to do so. 9.3 If there have been eligible transactions on your Visa Credit Card we will issue you with a monthly periodical statement on your Cash Rewards Account. If there have been no eligible transactions, we will send you a periodical statement on your Cash Rewards Account at least every six (6) months setting out: (a) the number of Cash Rewards Points earned; (b) the number of Cash Rewards Points redeemed; and (c) any other relevant activity relating to your Cash Rewards Points balance. 9.4 The Cash Rewards Account periodical statement will be sent to you in any manner you nominate including by e-mail, or post to your last notified address. If you use internet banking, you will be able to access your periodical statements electronically. Requests to post out statements may incur a fee. PRIVACY Please view our Privacy Notice which specifically lists the matters you need to be aware of when providing your personal and/or credit-related information to us. Please view our Big Sky Privacy & Credit Reporting Policy for further information on our privacy and credit reporting obligations in general. 11. GENERAL 11.1 You may not charge, bequeath, assign or transfer your Cash Rewards Points, nor assign to any person any right or obligation under these Terms and Conditions. 11.2 We may assign some or all of our rights and obligations under these Terms and Conditions to any person by providing notice to you in accordance with Clause 14. 11.3 If any part of a Clause of these Terms and Conditions is illegal or unenforceable, that part or Clause may be deleted however, the remaining provisions of the Terms and Conditions will continue in full force and effect. 11.4 Any waiver by Big Sky of any obligation owed by you under these Terms and Conditions is effective only to the extent set out in any written waiver from us. 11.5 These Terms and Conditions are governed by financial services laws and regulations. 12. DISCLAIMER AND LIMITATION OF LIABILITY 12.1 This Clause does not exclude or limit the application of any provision of any statute (including the Competition and Consumer Act 2010) or financial services legislation or regulation where to do so would: (a) contravene that statute/legislation/regulation; or (b) cause any part of this Clause to be void. 12.2 We exclude all implied conditions and warranties except any implied condition or warranty the exclusion of which would contravene any statute/legislation/regulation or cause any part of this Clause to be void (Non- excludable Condition). 12.3 Our liability to you for any Non-excludable Condition is limited to supplying the relevant services again. 12.4 We recommend that you obtain independent tax advice to ensure that you understand the possible tax (including fringe benefits tax) implications, if any, related to your membership or participation in the Cash Rewards Program. 13. DISPUTE RESOLUTION 13.1 You should contact us via any of the methods detailed in Clause 13.2 if you have any queries, complaints or disputes in connection with the Cash Rewards Program or the services provided to you in connection with it. 13.2 You can contact via any of the following methods: (a) Telephone on 1300 654 321 Monday to Friday (excluding public holidays) Eastern Standard Time; (b) Email at bigsky@bigsky.net.au; (c) Fax on 03 8682 4390; (d) In person at one of our Service Centres (locations are detailed on our website at ); or (e) Post to GPO Box 1801, Melbourne Vic 3001. 13.3 We will endeavour to resolve any queries, complaints or disputes when you first contact us. If we are unable to resolve your issue at that time, we will: (a) let you know who is handling your complaint; (b) keep you informed of what is happening; and (c) endeavour to resolve your complaint within 21 business days from when you first contacted us. 13.4 If you make a complaint in writing or request a written response to your complaint, we will promptly inform you of the outcome of the complaint in writing. If the dispute is not resolved in a manner acceptable to you, we will explain the reasons for the outcome and the further action you can take. 13.5 Big Sky is a subscriber to the provisions of the epayments Code (the Code), which regulates electronic payments, including ATM, EFTPOS and credit card transactions, online payments, internet and mobile banking, and BPAY. As such, Big Sky is bound by the conditions within the Code in relation to the handling of disputes regarding electronic payments and facilities. 13.6 If you are not satisfied with how Big Sky responds to your complaint or dispute you may refer the matter to our external dispute resolution provider. 14. NOTICES 14.1 We may send you notices and statements: a) by post, to the address recorded in our records or to a mailing address you nominate; b) by fax; c) via secure internet banking (notification of statement being available is by email); or d) by advertisement in the media, for some notices only. If you agree, we may, instead of sending you a notice or statement, post notices or statements to our website for you to retrieve. We will tell you when information is available for you to retrieve, either at the time or on setting up a facility that will have regular postings to the website. If you wish to receive communications electronically, we will need your specific consent to do so. You can change your email address, or revert to receiving paper notices or statements, at any time by informing Big Sky immediately of any such request. Requests for paper notices or statements may incur a fee. Please refer to our Fees and Charges Schedule located on our website at for further information. 14.2 You must notify us in writing as soon as practicable of any change to your contact details including your name, address, email or telephone number. In certain circumstances, we may request proof of such change from you before we can process any changes.
