1967/101 Government Railways (Staff) Regulations 1953, 619 REGULATIONS 1. Title-These regulations may be cited as the Government Railways (Staff) Regulations 1953,, and shall be read together with and deemed part of the Government Railways (Staff) Regulations 1953* (hereinafter referred to as the principal regulations). 2. Arrangement of regulations-regulation 1 of the principal regulations is hereby amended by inserting in subclause (2), after the words "Part XVII-Free Passes", the words "Free Tickets". 3. Interpretation-( 1) Subclause (1) of regulation 2 of the principal regulations is hereby amended by inserting in its appropriate alphabetical order the following definition: "'Observed holiday' means any of the following days: "(a) The 27th day of December or the day immediately following that on which Boxing Day is observed: "Provided that when the 27th day of December falls on a Saturday the observed holiday shall be the 29th day of December: "(b) The 2nd day of January or the day immediately following the day on which New Year's Day is observed: "Provided that when the 2nd day of January falls on a Saturday the observed holiday shall be the 4th day of January. " (c) Anniversary Day, being the day observed in the district where an employee's headquarters are located as the Anniversary Day holiday, or as otherwise detennined by the General Manager:". (2) Subclause (1) of regulation 2 of the principal regulations is hereby further amended by revoking the definition of the term "privilege ticket", and substituting the following definition: " 'Privilege ticket' means a ticket sold under the conditions governing the issue of railway employees' privilege tickets in the General Scale of Charges for the time being in force on the New Zealand Government Railways, or a concession ticket issued to railway employees for a passenger journey on the Cook Strait rail ferries." 4. Special leave for apprentices-regulation 27 of the principal regulations is hereby amended by omitting the word "five", and substituting the word "eight". 5. Permanent appointment of apprentices as tradesmen-regulation 31 of the principal regulations is hereby amended by omitting from the second proviso to paragraph (b) the expression "12 months", and substituting the expression "three months". *S.R. 1953/34 (Reprinted with amendments Nos. 1 to 22: S.R. 1964/197) Amendment No. 23: S.R. 1965/132 Amendment No. 24: S.R. 1966/8 Amendment No. 25: S.R. 1966/150

Promotions from General Division to Salaried Division-( 1) The principal regulations are hereby amended by revoking regulation 54 (as amended by regulation 2 of the Government Railways (Staff) Regulations 1953, Amendment No. 9), and substituting the following regulation: "54. Subject to the provisions of regulations 55 and 56 hereof, as vacancies occur or as the exigencies of the Department may require, members may be promoted from the General Division to the Salaried Division to positions the nature of which in the opinion of the General Manager require that the occupant has been designated and has served in such occupations and for such periods in the General Division as the General Manager may deem necessary." (2) The Government Railways (Staff) Regulations 1953, Amendment No. 9, are hereby consequentially revoked. 7. Observed holidays-( 1) The principal regulations are hereby amended by revoking regulation 69 (as amended by regulation 14 of the Government Railways (Staff) Regulations 1953, Amendment No. 23) and the heading thereto, and substituting the following heading and regulation: uobserved Holidays "69. Every employee holding a position in Class 1, Class 2, or Class 3 of the Salaried Division who is required to be and is on duty on an observed holiday shall be entitled to have one day off duty on pay at some other time." (2) Regulation 14 of the Government Railways (Staff) Regulations 1953, Amendment No. 23, is hereby consequentially revoked. 8. Heading to Part XVII-The principal regulations are hereby amended by inserting in the heading to Part XVII, after the words "Free Passes", the words "Free Tickets". 9. Free passes, free tickets, and privilege tickets-the principal regulations are hereby amended by revoking regulation 182, and substituting the following regulation: "182. No employee shall- "(a) Sell or transfer or offer for sale or transfer any free pass, free ticket, or privilege ticket, or any order for any privilege ticket, or any order to obtain free passenger travel by the Cook Strait rail ferries; or "(b) Permit any person other than the person to whom or on whose behalf any such free pass, free ticket, privilege ticket, or order is sold or issued, as the case may be, to make use of it; or "( c) Use or attempt to use any such free pass, free ticket, privilege ticket, or order without being entitled to do so; or "( d) Alter any such free pass, free ticket, privilege ticket, or order without authority; or '''(e) Make any false statement respecting the age or occupation of any person or respecting any other matter on which the issue of a free pass, free ticket, or the charge for any ticket is dependent."

1967/101 Government Railways (Staff) Regulations 1953, 621 10. Free tickets-regulation 183 of the principal regulations is hereby amended- ( a) By inserting, after the words "free pass", the words "free ticket": (b) By insertjing in paragraph (a), after the words "free passes", the words "free ticket orders". 11. Forfeiture by persons other than employees-the principal regulations are hereby amended by revoking regulation 184, and substituting the following regulation: "184. Any person, other than an employee, to whom or on whose behalf any free pass or free ticket or free ticket order or privilege ticket or privilege ticket order is sold or issued, as the case may be, pursuant to the provisions of these regulations, who does any of the things prohibited in respect of employees by regulation 182 hereof, or who, while using any free pass or free ticket or privilege ticket, commits a breach of any regulation of the Department, renders himself liable to forfeiture of his right to receive free passes, free ticket orders, and privilege ticket orders either permanently or for such period as the General Manager may determine." 12. Conditions-The principal regulations are hereby amended by revoking regulation 185, and substituting.the following regulation: "185. Every free pass, free ticket, and privilege ticket shall be issued on the condition that, except in the case of an employee travelling to and from his place of employment in the Department, it shall not be used in the exercise of any commercial or professional pursuit. If any suoh free pass, free ticket, or privilege ticket is used in contraventidn of this regulation it shall be liable to confiscation, and the persdn so using it shall be Hable to' the forfeiture of any right he may have to the issue of any further free passes, free tickets, or privilege tickets." 13. Proof of identity-the principal regulations are hereby amended by revoking regulation 186, and substituting the following regulation: "186. Every person presenting or using a free pass, free ticket, free ticket order, privilege ticket, or privilege ticket order shall, on demand, furnish proof of his identity." 14. Conveyance of bicycles-regulation 188 of the principal regulations is hereby amended by adding the words "Tickets issued free for travel by the Cook Strait rail ferries shall not be so endorsed". 15. Restrictions on free tickets-regulation 189 of the principal regulations is hereby amended by inserting, after the words ''free pass", the words "free ticket". 16. Free tickets for administrative officers-the principal regulations are hereby amended by inserting in the heading immediately preceding regulation 190, alter the words "Free Passes", the words "and Free Tickets".

Cook Strait rail ferry tickets for administrative officers-the principal regulations are hereby amended by inserting, after regulation 198, the following regulation: "198A. (1) Where an administrative officer is granted " ( a) An all lines pass; or "(b) All lines free passes under the provisions of paragraph (a) of regulation 193 hereof; or "(c) Single journey free passes under the provisions of regulations 195 and 196 hereof; or "(d) An all lines pass and a single journey pass under the provisions of regulation 197 hereof,- "he may, on application, also be issued with an order authorising the issue of free tickets for one return passenger journey on the Cook Strait rail ferries under the conditions set out in subdauses (2), (3), and ( 4) of this regulation. "(2) The limits of availability of Cook Strait rail ferries tickets issued in accordance with this regulation shall be the same as provided for an administrative officer's all lines free pass, or other passes issued in substitution therefor or in addition thereto. "(3) In respect of anyone leave year, no administrative officer shall qualify for more than one free return passenger journey by Cook Strait rail ferries, except as provided in subclause (4) of this regulation. "( 4) An administrative officer granted an all lines pass pursuant to regulation 198 hereof may be issued with an order authorising the issue of free tickets for one return passenger journey on the Cook Strait rail ferries, notwithstanding the provisions of subclause (3) of this regulation. 18. Privilege tickets for administrative officers-regulation 200 of the principal regulations is hereby amended by adding the words "or available for passenger journeys on the Cook Strait rail ferries". 19. Heading to regulations 201 to 211-The principal regulations are hereby amended by inserting in the heading to regulations 201 to 211, after the words "Free Passes", the words "and Free Tickets". 20. Free tickets for Cook Strait rail ferries for families of employees The principal regulations are hereby amended by inserting, after regulation 211, the following regulation: "211A. (1) A member of an employee's family in whose favour is issued- "( a) An all lines free pass under the provisions of these regulations; or " (b) All lines free passes under the provisions of regulation 206 ( a ) hereof; or "( c) Single journey free passes under the provisions of regulation 208 hereof; or "(d) An all lines free pass and a single journey free pass under the provisions of regulation 211 hereof,- "may, on application by the employee, also receive an order authorising the issue of free tickets for one return passenger journey on the Cook Strait rail ferries.

1967/101 Government Railways (Staff) Regulations 1953, 623 "(2) Cook Strait rail ferries tickets issued to any person under subclause (1) of this regulation shall be subject to the following conditions: "(a) The limits of availability of the tickets shall be the same as provided for the all lines free pass issued in his favour, or other passes issued in substitution therefor or in addition thereto: "(b) In respect of anyone leave year no employee shall qualify for more than one free return passenger journey by Cook Strait rail ferries in favour of a member of his family, except as provided in regulation 215 hereof." 21. Heading to regulation 214--The principal regulations are hereby amended by inserting in the heading to regulation 214, after the words "Free Passes", 'the words "and Free Tickets". 22. Free tickets on Cook Strait rail ferries for families of retiring employees-the principal regulations are hereby amended by inserting, after regulation 214, the following regulation: "215. Where a retiring member or a retiring employee is issued with a free all lines pass in favour of his wife or any dependent child, he may, on application, also be supplied with an order in favour of his wife or dependent child, authorising a free return passenger journey on the Cook Strait rail ferries. 23. Privilege tickets for families of employees on Cook Strait rail ferries-regulation 217 of the principal regulations is hereby amended by adding the words "or for passenger journeys on the Cook Strait rail ferries". 24. Privilege tickets for employees' male children over 18 years of age-the principal regulations are hereby amended by revoking regulation 218, and substituting 1he following regulation: "218. Privilege ticket orders may, on application, be issued to any employee referred to in regulation 216 hereof in favour of any male child of his- "(a) Who has not passed his twenty-second birthday; and "(b) Who is a full time student at a school, college, or University; and "(c) Who, in the opinion of the General Manager, is substantially dependent on the employee for his maintenance; and "(d) Who is residing at home, or is residing away from home, solely for educational purposes." 25. Privilege tickets for children of retired members-regulation 220 of the principal regulations is hereby amended by adding the words "except in a month when a Cook Strait rail ferries privilege ticket is received, in which case the child may receive one additional privilege ticket in that month".

Privilege tickets for children of deceased retired members Regulation 222 of the principal regulations is hereby amended by inserting in subclause (2), arrter the words "in any month", the words "except in a month when a Cook Strait rail ferries privilege ticket is received, in which case the child may receive one additional privilege ticket in that month". 27. Privilege tickets for children of deceased members-regulation 224 of the principal regulations is hereby amended by revoking subclause (2), and substituting the following subclause: " (2) A child under 14 years of age shall be en ti tled tu receive not more than 52 privilege tickets in any year. A child 14 years of age or more, but under 16 years of age shall be entitled to receive one privilege ticket in any month, except in a month when a Cook Strait rail ferries privilege ticket is received, in which case the child may receive one additional privilege ticket in that month. The orders may be issued on the application of the widow or of the person normally in charge of the child, as the case may be; and the issue thereof shall cease upon the remarriage of the widow." 28. Privilege tickets for children of retired temporary employees Regulation 229 of the principal regulations (as substituted by regulation 9 (1) of the Government Railways (Staff) Regulations 1953, Amendment No. 18) is hereby amended by adding the words "except in a month when a Cook Strait rail ferries privilege ticket is received, in which case the child may receive one additional privilege ticket in that month". 29. Privilege tickets for children of deceased temporary employees (1) Regulation 229c of the principal regulations (as substituted by subclause (1) of regulation 10 of the Government Railways (Staff) Regulations 1953, Amendment No. 18) is hereby amended by revoking subclause (2) (as substituted by regulation 15 of the GOvernment Railways (Staff) Regulations 1953, Amendment No. 23), and substituting the following subclause: "(2) Any such child shall be entitled to receive one privilege ticket per month, except in a month in which a Cook Strait rail ferries privilege ticket is received, in which case the child may receive one additional privilege ticket in that month. The orders may be issued on the application df the widow or of the person normally in charge of the child, as the case may be; and the issue thereof shall cease upon the remarriage of the widow." (2) The Government Railways (Staff) Regulations 1953, Amendment No. 23, are hereby amended by revoking regulation 15. 30. Privilege tickets for children of deceased temporary employees Regulation 229D of the principal regulations (as substituted by regulation 10 (1) of the Government Railways (Staff) Regulations 1953, Amendment No. 18) is hereby amended by revoking subclause (2), and substituting the following subclause:

Any such child 14 years of age or more, but under 16 years of age, shall be entitled to receive one privilege ticket in any month, except in a month when a Cook Strait rail ferries privilege ticket is received, in which case the child may receive one additional privilege ticket in that month. They also define observed holidays in the Department, extend the number of hours leave of absence each week for apprentices to attend day classes, reduce the time within which apprentices who have completed their apprenticeship may be considered for the permanent staff, and amend the Salaried Division Classification.
