Adult Social Care Deferred Payment Policy 1 Introduction 1.1 This Policy details how Deferred Payment Agreements (DPAs) are to be operated by Rochdale Council from April 2015. 1.2 When a person enters residential care their fees can be paid either by using their income, capital or Local Authority funding and is usually a mixture of these sources. 1.3 Where a person who is entering into residential care has a property or land that is taken into account when deciding their contribution to their care (see Section 3 below and the Adult Care Charging Policy) we can (and in certain circumstances must) offer a deferred payment. 1.4 A deferred payment allows a person to accrue their charges for residential care against a charge on their property or land, which avoids the need to sell the asset to fund their care. This can be used either as a bridging loan until the property or land is sold (during their lifetime) or can be used long term to fund their residential care, until they die and the fees have been paid out of their estate. A deferred payment builds up a debt which is cleared when the money tied up in a property is released. This can be done by selling the property at a later date or from another source if available. 1.5 The Council will ensure that those considering a deferred payment are informed to consider seeking independent financial advice from a person who is regulated by the Financial Conduct Authority (FCA) and who is accredited by the Society for Later Life Advisers (SOLLA) before entering into a deferred payment agreement. 2 Legal Context 2.1 The Care Act 2014 (sections 34 and 35) requires local authorities to offer Deferred Payment Agreements to allow persons to defer the sale of their main or only home where it is needed to fund care fees. 1

2.2 The Care and Support (Deferred Payment) Regulations 2014 set out the legal framework and local authorities responsibilities in greater detail. The new legal duties will come into force on 1st April 2015. 2.2 The regulations require local authorities to offer deferred payments to people meeting certain eligibility criteria (see section three below). These agreements can be retained until the person dies, with the amount repayable from their estate, but can also be offered to persons who decide to sell their home whilst still alive (the deferred payment providing bridging finance ). 3 Eligibility Criteria 3.1 The Council will offer a deferred payment to those who meet the eligibility criteria: a) Anyone whose needs are to be met by the provision of care in a care home; and b) Anyone who has less than (or equal to) 23,250 in assets excluding the value of their home (i.e. in savings and other non-housing assets); and c) Anyone whose home is not disregarded, for example it is not occupied by a spouse or dependent relative as defined in regulations on charging for care and support (i.e. someone whose home is taken into account in the local authority financial assessment and so might need to be sold). 3.2 The Council is also aware of the additional considerations to be considered, that: The person must have a legal or beneficial interest in the property. There should be no outstanding mortgage on the property (in exceptional circumstances the Council will accept a mortgaged property if, it is believed, the equity in the property is above the capital threshold and is sufficient to pay the fees and any interest and administration costs for a period of at least 12 months). The adult or someone legally authorised to deal with the adults financial affairs must consent to the agreement. The deferred payment must be signed by a person with mental capacity (as defined by the Mental Capacity Act) to make the decision or someone legally authorised to deal with the adults financial affairs 2

(see section 8 for more information on mental capacity and deputyship). If accepting a property as security, it s title must be registered with the Land Registry so the Council can place a charge on the property (a property with an unregistered title will not be accepted) With discretion, the Council may take other forms of security e.g. a third party guarantor If the property is subsequently disregarded (and the person qualifies for local authority support as a consequence) then the deferred payment will be frozen and interest will continue to accrue. 4 Refusing a Deferred Payment 4.1 The Council will refuse a deferred payment if we are unable to obtain a legal charge, by way of mortgage, on the property (e.g. unregistered title or prior mortgage on the property). 4.2 A deferred payment will be refused where a person lacks mental capacity and there is no court appointed Deputy (Property and Affairs) or other person legally authorised to make such a decision. 4.3 Where someone is seeking a top up, the council must consider their request, but retains discretion over whether or not to agree (see Adult Care Charging Policy re additional payments ). 4.4 We will also refuse a DPA where a person does not agree to the terms and conditions of the agreement, for example a requirement to insure and maintain the property. 5 Information and Charges 5.1 The Council will ensure that persons considering entering residential care are made aware of the ability to defer charges against their property for their care. The Council will provide this information during the person s first 12 weeks in residential care, the period of 12 week property disregard when the value of the property is not taken into account. 5.2 The Council will provide a twice yearly statement of the outstanding debt to the person(s) entering into the DPA. A statement can be requested at any time and this will be provided within 28 days of request. 3

5.3 The Council will give the person(s) entering into the DPA at least 6 months notice that the maximum amount to be deferred is due to be reached and provide a meeting to discuss the future cost and funding of care. 5.4 The person or their representative will be advised of the costs of entering into a DPA; these are currently a 500.00 one off fee to set up the DPA and compound interest of 2.65% from the first day of the agreement until all the debt is settled in full. The interest rate is based on the cost of Government borrowing (the 15-year average gilt yield, as set out by the Office for Budget Responsibility twice a year in their Economic and Fiscal Outlook report.). The Council will review this every January and July. The interest, which is compounded will be applied daily in line with the accrual of the debt. Interest will continue to accrue until the debt is repaid in full. 5.5 If we have to instigate the enforced sale procedure in order to recover our debt an admin fee of 500 will be charged, plus any professional costs incurred. All costs can be accrued against the deferred payment agreement. 5.6 The Council is contracted to pay for two additional days care after a service user s death. This will be included in the deferred payment. 5.7 The Council is aware of the responsibility to inform those considering a deferred payment to consider seeking independent financial advice (see section 1.5). 6 Renting the Property Out 6.1 The Council encourages people to rent out their property and will allow 10% of any rental income to be disregarded in the financial assessment. This amount of disregard must be used for property maintenance and other landlord related costs. 6.2 The Council will recommend that Rochdale Boroughwide Housing supports this by offering to place persons from their housing list into the empty property. 6.3 Where a property is rented out the Council will require copies of any tenancy agreements that are in place or put in place and would expect this to be via an assured tenancy. Property owners are encouraged to speak to the Empty Properties Team for advice. 7 Types of Property Ownership 7.1 Where there are co-owners of a property either as tenants in common or jointly owned property all parties must agree with and sign the DPA. 4

8 The Mental Capacity Act 2005 8.1 The Mental Capacity Act 2005 (MCA) applies to care, treatment and support of people aged 16 years and over, in England and Wales, who are unable to make some or all decisions for themselves. Staff working with people who lack capacity must have regard to the Mental Capacity Act. 8.2 The Council can only enter into a DPA with someone who has got the mental capacity to understand this, or the person legally authorised to deal with that persons financial affairs. This may be a Deputyship, Lasting Power of Attorney or Enduring Power of Attorney which has been registered at the Court of Protection or in some circumstances a specific order from the Court of Protection. We require a certified copy of the document for our records. 8.3 Where there is no legal authority yet in place but where somewhere is applying for it, the Council will pay the provider and invoice the person who is applying for Deputyship. A letter of undertaking to pay the care fees will need to be signed by the person seeking the deputyship. 8.4 Where no-one is available to apply for Deputyship the Council will consider applying for Deputyship (see the Client Financial Affairs Policy). 8.5 The interest charge of 2.65% compound will apply to these invoices. 9 Securing the Deferred Payment Agreement 9.1 The Care Act 2014 section 34 subsection 4 states that we may refuse a DPA unless we can obtain adequate security for the payment of the deferred amount. 9.2 The Care & Support (Deferred Payments) Regulations 2014 states (Regulation 4 subsection 1a) that a local authority MUST obtain adequate security for the payment of the adult s deferred amount and of any interest and administration cost. 9.3 Where a property is owned outright with no mortgage or other charge on it we will secure a first legal mortgage against the property on the Land Register. Where the property is jointly owned all parties will have to agree to the charge being placed. 9.4 The Council may accept a property with an existing mortgage or other charge, as security where there is at least 12 months worth of funding in the equity. 5

The Council must be provided with an up to date statement from the lender of the debt outstanding. 9.5 We may accept other forms of security such as a third party guarantor, a solicitors undertaking letter and an agreement to repay the amount deferred from the proceeds of a life assurance policy. 9.6 Equity is defined as: the value of a person s share in the property, less any charge on the property, less 10%, less 14,250 ( 14,250 being the current lower capital limit). 9.7 We will obtain an independent valuation on the property from a valuer registered with the Royal Institute of Chartered Surveyors. If this valuation is disputed by the owner than a separate valuation from a RICS registered valuer can be obtained at their own expense and the Council will take the average of these valuations. 9.8 The Council will re-value the property annually, where the revaluation is disputed by the owner then an independent valuation in line with 9.7 above can be sought at the owner s expense. 10 Ending the Deferred Payment Agreement 10.1 A Deferred Payment Agreement will end in the following circumstances: a) At any time by the person(s) who entered into the DPA by repaying the full amount due b) When the property (or other form of security) is sold and the authority is repaid c) When the person dies and the amount is repaid to the LA from their estate. 10.2 Debt will stop accruing against the DPA when the equity limit is reached; the person(s) entering into the DPA will be informed 6 months before the equity level is likely to be reached. The Department of Works and Pensions (DWP) will be informed of the changes in circumstances so that a benefits review can be undertaken. 10.3 Where a property is being sold the Council requires 30 days notice of the completion date. The net sale price will be used to calculate the final debt due. The net sale price being the actual sale price less associated fees. 10.4 Upon the persons death; the Council will inform the Executor of the estate of the final debt within 28 days. Where the debt is not repaid within 90 days it will be passed to the Debt Management Process (see Adult Care Charging Policy). 6

10.5.1 The Council will issue an invoice for the total debt once the DPA ends and interest will continue to accrue until the debt is paid in full. The legal charge on the property will not be removed until the debt is repaid in full. 10.5.2 If someone decides not to continue accruing their care charges against the deferred payment agreement and can pay the charge from another source instead, 30 days written notice is required to stop the debt accruing. Interest will continue to accrue until the debt is repaid in full. 10.6 If any invoice is not paid following the Debt Management process the Council will issue a Section 103 notice in line with the Law of Property Act (1925). The Notice provides for a period of three months within which the invoice may be paid. If at three months the debt has not been settled the Council can force a sale to recoup the debt thereby becoming the Mortgagee in Possession. The property may be sold at auction or otherwise and any outstanding debt and fees relating to the sale will be deducted from the proceeds, the balance being returned to the person or their estate. 11 Personal Expenditure Allowance 11.1 We will allow up to 144 per week as personal expenditure allowance for a person deferring their charges under a DPA. The difference between the actual personal expenditure allowance and the standard personal expenditure allowance (currently 24.40 per week) will be deferred. 12 Review 12.1 This policy will be reviewed every January and June in line with the Office for Budget Responsibility in their Economic and Fiscal Outlook report and when there is a change in legislation. 13 Version Control Version Date Author Changes 0.1 19.01.15 Helen Murphy Draft produced 7
