Warranty provision: The limited warranty set forth below is given by ProMedTek with respect to the Replexa Model PMT900 Device and the Replexa Treatment Applicator. The Replexa Model PMT900 Device is warranted against defects in materials or workmanship as follows: for a period of one (1) year from the date that the Government accepts the product. A defective device returned to ProMedTek, and proven to be defective upon inspection as determined by ProMedTek in their sole discretion, will be repaired or exchanged free of charge. The Replexa Treatment Applicator is warranted against defects in materials or workmanship as follows: for a period of thirty (30) days from the date that the Government accepts the product. A defective applicator returned to ProMedTek, and proven to be defective upon inspection as determined by ProMedTek in their sole discretion, will be repaired or exchanged free of charge. ProMedTek shall bear the transportation costs of returning the product to and from the repair facility, or the costs involved with Contractor personnel traveling to the Government facility for the purpose of repairing the product onsite, during the warranty period. This limited warranty covers all defects encountered in normal use of the Replexa Model PMT900 Device and Replexa Treatment Applicator, and does not apply to the following cases: Loss of or damage to the Replexa Model PMT900 Device or Replexa Treatment Applicator due to abuse, mishandling, improper packaging by you, alteration, accident, electrical current fluctuations, failure to follow operating, maintenance or environmental instructions prescribed in ProMedTek s Operating Manual. Without limiting the foregoing, water damage, sand/corrosion damage, dropping the Replexa Model PMT900 Device or Treatment Applicator, scratches, abrasions or damage to the Replexa Model PMT900 body or LCD display, will be presumed to have resulted from Page 3 of 6

misuse, abuse or failure to operate the Replexa Model PMT900 Device or Treatment Applicator as set forth in the operating instructions. If the Replexa Model PMT900 Device has had its serial number or dating altered or removed. You may obtain technical support for the Replexa Model PMT900 Device as follows: Telephone assistance from a ProMedTek Customer Care representative free of change during regular business hours (currently Monday-Friday 8:00am- 6:00pm MST, excluding holidays) at 866.388.2410. 16. Terms and conditions of rental, maintenance and repair: The Rental Agreement set forth below is given by ProMedTek with respect to the Replexa Model PMT900 Device. This agreement is between ProMedTek, Inc. and the Renter of the equipment (hereafter called Renter). RENTAL TERMS AND CONDITIONS Rental Period and Billing of Rental Equipment. Upon receipt of a Purchase Order (P.O.), the Rental Period for the equipment will commence on the day the rental equipment is received by the Renter. The Rental Period will terminate on the day ProMedTek is notified by the Renter to pick up the rental equipment. ProMedTek may be notified by phone (866.388.2410), fax (480.385.2499) or email (customerservice@promedtek.com). Billing begins 30 days after the Rental Period commences. Ownership, Responsibility for and Use of Rental Equipment. ProMedTek is and shall remain the owner of all rental equipment. All rental equipment is being provided on a rental basis, with rental payments due periodically. The rental equipment shall at all times be the sole and exclusive property of ProMedTek and the Renter shall have no rights or property interest in the rental equipment, other than the right of the patient to use it in a reasonable manner consistent with its intended purpose and in accordance with instructions received from ProMedTek and/or the patient's physician. The Renter agrees not to remove or alter any identification on any rental equipment or in any way attempt to transfer any rental equipment. Rental equipment will be returned to ProMedTek in the same condition as it was delivered, reasonable wear and tear excepted. Care of Equipment. The Renter must take reasonable care of the rental equipment, may not abuse the rental equipment and must promptly notify ProMedTek of any problems with the rental equipment while it is in the patient's possession. The Renter must promptly notify ProMedTek and return the rental equipment in good condition if the patient stops using it or no longer needs it. The Renter will remain responsible for and continue to be billed for the rental equipment until it is returned to ProMedTek in good condition. ProMedTek will perform routine maintenance for all rental equipment and make any repairs that are necessary due to ordinary use. Page 4 of 6

Instead of or while making repairs, ProMedTek may provide appropriate substitute equipment. Liability for Damage or Loss. The Renter shall be responsible for (i) any damage to the rental equipment beyond ordinary and reasonable wear and tear; and (ii) the loss of the rental equipment while it is in the Renter s possession. Payment to ProMedTek for any such damaged equipment shall be the cost to repair such equipment. Payment to ProMedTek for any lost rental equipment shall be the Government sale price ($20,000.00 per device). 17.
