GENERAL TERMS AND CONDITIONS FOR DEBIT CARD 1. PHRASING Words importing only the singular shall include the plural and vice versa. Where the Account is a Joint Account, reference to single customer shall be reference to all customers in the names of whom the account is opened, unless the text indicates otherwise. The words importing any gender shall include all genders, words importing person shall include a sole proprietor, partnership, firm, company, corporation or other legal person. 2. DEFINITIONS In these Terms and Conditions, the following expressions shall have the meanings as designated unless the context otherwise require: (i) Agents Means any person or persons appointed or approved by the Bank to support or offer Banking Services. (ii) Bank Means Arab Bank for Investment & Foreign Trade Al Masraf, Its successor(s) and/or assignee(s). (iii) Banking Services Means any kind of banking service(s) offered by the Bank such as and without limitation Branch Banking, Internet Banking, Phone Banking, Mobile Banking, Withdrawals, Deposits and Payments through Automated Teller Machines (ATM) and Cash Deposit Machines, making Payments through the Internet or any other technology, and/or any other kind of Banking Services provided to the Customer at any time. (iv) Beneficiary Means the authorized recipient of any funds through our Banking Services. (v) Business Day Means any official working day on which the Bank is open for business. (vi) Call Centre Means the Bank s customer service call center which the Customer can reach the Bank on telephone. (vii) Card or Debit Card Means Automated Teller Machine Card (i.e. Al Masraf Visa Card and/or Master Card) or any other Card which the Bank issued to the Customer to access Customer s Account electronically like cash withdrawal from Automated Teller Machines (ATM) or purchase of goods and services through the internet, phone or any other means where the Card is not physically available at the time of the transaction is made. This can also be referred to as Debit Card (viii) Cardholder Means any individual (including you) to whom the Bank issued the Card to undertake financial transactions through the Account. The Cardholder includes the principal Cardholder and/or supplementary Cardholder, if applicable.
(ix) Supplementary Cardholder Means a cardholder nominated by the principal cardholder under condition 3(below) (x) Customer Means any natural or legal person who has an Account with the Bank and/or subscribed to utilizing any of the Bank Services. (xi) Electronic Instructions Means the Bank s electronic documentation via the Internet, ATMs, Mobile Banking, and Phone Banking, operating instructions or reference guidelines issued by the Bank in any written form or in the guide published on the Bank s Website. (xii) Internet Means a collection of information stored in a computer available throughout the world. (xiii) PIN Means the Personal Identification Number the Bank issued to the Customer and/or the Customer have selected to enable his/her ATM Card to be used at an ATM, retail outlet accepting the ATM Card, and other self-service terminals. (xiv) POS Means the Point of sale is the time and place where a retail transaction is completed. It is the point at which customer makes a payment to the merchant in exchange for goods or after provision of a service. (xv) UAE Means United Arab Emirates. (xvi) Website Means the Bank s Website, www.almasraf.ae 3. SUPPLEMENTARY DEBIT CARDS The Bank may issue Supplementary Debit Cards to persons nominated by the Principal Cardholder. However, the Principal Cardholder will be irrevocably and fully liable for all amounts which may arise from the use of such Supplementary Debit Card(s) or Debit Card number(s). 4. ATM/ DEBIT CARD SPECIFIC TERMS AND CONDITIONS (i) If the Customer has an Account with the Bank, subject to its sole discretion, it may issue to the Customer a Debit Card called Al Masraf Debit Card. (ii) The Customer accepts that Al Masraf Debit Card is a property of the Bank and it has the discretion to cancel its validity. In case the Bank exercises its right, the Customer accepts that these Terms and Conditions will remain applicable to the Account until all liabilities incurred with respect to Al Masraf Debit Card are paid and settled. (iii) The amount of any of the Card transaction in a currency other than United Arab Emirates Dirham (AED) will be converted into AED at a rate of exchange determined by the Bank on the date when the relevant transaction is debited from the Customer s Account. The Customer accepts that the Bank will impose charges on all transactions processed through the ATMs of other banks whether in the UAE or abroad.
(iv) If the Bank issues Al Masraf Debit Card to the Customer and it does not receive any confirmation of receipt or activation within four weeks or any period that it may determine from the date that it was issued, the Bank will cancel it and the Customer will need to request the Bank to issue a new one at his own cost. (v) In case of Joint Account, all the Joint Account holders shall be jointly and severally liable to the Bank under these terms and conditions. (vi) The Bank is not responsible for any loss or damage arising directly or indirectly from any malfunction or failure of Al Masraf Debit Card or the ATM or the temporary insufficiency of funds in such machine or failure of any retailer or supplier to accept or honor Al Masraf Debit Card and the manner in which the refusal was communicated to the Customer. (vii) In general, the Bank reserves its right at all time and without the need to give notice to the Customer to refuse to authorize any purchase, cancel or suspend the right to use Al Masraf Debit Card or PIN in respect of all or specific or transactions and refuse to renew or replace Al Masraf Debit Card if requested. (viii) The Customer agrees that in case the Customer has a Supplementary Card linked to his Account or Joint Account, all transactions done on other ATMs and purchases carried out using the Supplementary Card will be recorded only on the primary Al Masraf Debit Card and the Account from which Al Masraf Debit Card was issued. (ix) The Customer accepts that when he participates in any promotions related to Al Masraf Debit Card, the promotion will be subject to specific Terms and Conditions announced by the merchant and the Customer understands that the Bank is not and shall not be responsible for such promotions. (x) Cash deposits made through the Bank s ATMs will be credited to the Customer s Account on the following working day subject to physical counting and verification by the Bank. Cheque deposited will be credited to the Customer s Account upon realization. 5. USE OF THE DEBIT CARD (i) The Debit Card must be signed by the Cardholder immediately on receipt and may only be used: (ii) (iii) (a) by the Cardholder, (b) Subject to the terms and conditions current at the time of use. (c) Within the available balance in his/her Bank Account. (d) during the validity period embossed on the Debit Card, (e) subject to the right of the Bank, in its absolute discretion and without prior notice, at any time to withdraw the right to use of the Debit Card for, or to refuse any request for authorization of any particular Debit Card Payment and to communicate any such withdrawal or refusal to any third party. The Card may be used for cash withdrawals or purchases within the daily limit determined by the Bank at its sole discretion and communicated to the customer from time to time. The Customer shall ensure that there is sufficient balance available for drawing from the Account before making any withdrawals or transaction. The Bank will debit the Account with the total amount plus fees and charges, when applicable, with respect to the cash withdrawals, transfers, direct debits and payments for goods and services made at any ATM machine or the POS and any other payments the Customer has made by using Al
(iv) (v) Masraf Debit Card. If for any reason the Account is overdrawn resulting from the use of Al Masraf Debit Card, the Customer accepts that he will be responsible for repayment of such debit balance together with interest, charges and commission upon demand. The Customer accepts that any failure to settle the overdrawn balance, the Bank will exercise its right of set-off and take the necessary legal action. The Customer accepts that the Bank has the right without the need to refer to the Customer to increase or decrease the maximum daily number and amount of ATM cash withdrawals or payment transactions that can be done using Al Masraf Debit Card. In case the Bank does so, the Bank will notify the Customer of such changes through appropriate channels. The Customer shall only use Al Masraf Debit Card for lawful purpose, and purchase of goods and services that are legally acceptable in the UAE and/or in the Country of purchase. The Bank reserves the right (subject to applicable law) to refuse settlement of any Al Masraf Card transaction on the Customer s behalf if the Bank is of the reasonable opinion that Al Masraf Card transaction is for goods/ services which the Bank considers illegal. 6. RENEWAL (i) The Bank will renew the Debit Cards at its respective expiry date and will debit the renewal fee, if applicable to the Bank Account and will continue to do so until and unless the Cardholder instructs the Bank in writing to stop the renewal of either the Primary or the Supplementary or both Cards at least 45 days prior to the Card Expiry Date. (ii) In case the Bank agrees to close the Account, the Customer shall promptly return Al Masraf Debit Card to the Bank. 7. SAFEGUARDING THE CARD AND PIN (i) The Debit Card and related PIN are issued by the Bank at the full risk of the Cardholder. The Bank shall not be held responsible in any way whatsoever for the loss/misuse of the Debit Card and/or PIN. (ii) The Customer should take the maximum care to prevent Al Masraf Debit Card from being lost, mislaid or stolen and the Customer undertakes not to pass Al Masraf Debit Card to any other person. (iii) The Customer shall at all times be liable for any transaction made using Al Masraf Debit Card and he shall indemnify the Bank for all losses or damages including those caused by the unauthorized use of Al Masraf Debit Card or related PIN. The records of transactions processed using Al Masraf Debit Card electronically or otherwise are conclusive and binding evidence for all purpose. (iv) In the event that Al Masraf Debit Card is lost or stolen or the PIN is disclosed to any other party, the Customer should immediately report the said loss, theft or disclosure, together with the particulars of Al Masraf Debit Card to the Bank either through its Branches or by calling its Call Centre. The Customer accepts that he will be responsible for the transactions processed using Al Masraf Debit Card and the Bank is not liable from the loss, theft or disclosure of the PIN to third party. (v) The Bank will not be held responsible in case a lost or stolen Debit Card is used prior to receipt by the Bank of written notice of such loss or theft.
8. REFUNDS AND CARDHOLDER CLAIMS (i) The Bank will not maintain copies of signed Debit Card transaction vouchers (sale vouchers). In case of a dispute, the bank may, upon the written request of the Cardholder, provide a photocopy or microfiche copy of the disputed transaction voucher as a documentary proof of the debit transaction, provided that such request is presented to the Bank within 30 days from the relevant statement date. In no event will such request be entertained if the disputed transaction date is over 60 days (ii) The Bank Account will be credited with a refund in respect of a Debit Card payment or only upon receipt by the Bank of a refund voucher or other refund verification acceptable to it. Subject to any rights vested in the Cardholder by law, no claim by a Cardholder against a third party may be the subject of a defense or counter claim against the Bank. (iii) The Bank shall not be liable in any way if the Debit Card is not honored by a third party. (iv) The Bank shall not be responsible for goods or services purchased by the Cardholder on the Card and in all circumstances the Cardholder must honor all vouchers / transactions executed. 9. VARIATION OF TERMS AND CONDITIONS (i) The Bank may vary these Terms and Conditions at any time or times whether or not a similar variation is made to the Terms and Conditions with any other Cardholder(s). Subject to the requirements of law, notification of any such variation shall be given to the Principal Cardholder by the Bank either in writing or by publication thereof by such means as the Bank may select and a variation so notified shall be binding on the Cardholder. (ii) The Bank will consider that the Cardholder has accepted the changes if the Cardholder keeps or uses the Debit Card thereafter. 10. GENERAL (i) Al Masraf Debit Card is issued for use through electronic terminals via Point of Sale machine (POS) to purchase goods and services or withdraw money through the ATM Machine. This can also be used to do transaction over the internet, telephone or mail order. The Customer cannot use Al Masraf Card to obtain credit of any type. (ii) Card may be collected by the cardholder or the Bank will send Al Masraf Debit Card to the Customer by normal post or courier to the given address appearing and maintained in the Bank s records and at the Customer s own risk and responsibility. In the event that the Customer is not available at the given address, Al Masraf Debit Card sent by courier may be given to a third party specified by such Customer available at such address. In such case, the Customer agrees that Al Masraf Debit Card has been duly delivered by the Bank. (iii) When the Customer received Al Masraf Debit Card the customer shall sign the signature panel on the back of the Card immediately, such signature and/or Card activation and/or use of the Card will constitute binding and conclusive evidence of the customer s confirmation to be bound by these terms and conditions. (iv) Cardholder must verify all Card transactions appearing on his/her Account statement. In case of any discrepancy (ies) or dispute, Cardholder must notify the Branch Manager or Al
Masraf Card Centre in writing within 15 days of the statement date, failing which, all Card transactions will be confirmed as correct. (v) The Bank issues Debit Cards on the understanding that goods, tickets or services obtained with a Debit Card will not be resold or returned for cash refund. However, goods or tickets may be returned for credit to the Bank Account provided the merchant accepts such returns. (vi) To ensure international acceptability, information about a Debit Card Account may be transferred confidentially within the worldwide VISA and/or MasterCard networks, at the Bank s sole discretion. (vii) The Bank may at its sole discretion or if required to do so, disclose any information concerning the Debit Card Account, any data relating to Cardholder which the Bank deems fit: (a) To Its Agent(s) (if any) appointed at any time in connection with the administration of the Debit Card. (b) To any member of Al Masraf, any other bank or financial institution. (c) To Etihad credit bureau, agency and/or any other institution as required in order for the Bank to consider Cardholder s application or provide the Cardholder with its services. (d) The Bank may in certain cases be obligated to report information and account balances of Cardholder whom it deems, due to reasonable expectation, to be a foreign resident, citizen or person of a foreign government or jurisdiction. This information will only be shared with the relevant foreign tax authority or government of that foreign jurisdiction. Cardholder acknowledges that the Bank will perform this duty without any liability on its part and it shall not be considered a breach of any duty of confidentiality owed to the Cardholder. (e) Cardholder authorizes the Bank to obtain and/or verify, from time to time, any information or data relating to Cardholder as the Bank may deem appropriate from any third party as the Bank in its sole discretion may determine. Cardholder also understands that he/she will receive marketing communication in the form of e- mail or SMS from the Bank from time to time. (f) The Cardholder shall immediately notify the Bank in writing, of any change of his/her name or address. (g) Registration for Internet shopping: Cardholder agrees to register for Master Card Secure code and agrees to be fully liable for any transactions conducted via Internet without registration should they be reported as unauthorized/fraudulent later. 11. APPLICABLE LAW These Terms and Conditions shall be construed and governed by the laws of the United Arab Emirates and the competent courts are the UAE courts. 12.
