Factsheet Using direct payments or a personal budget This factsheet is relevant to you if you have had a needs assessment and qualify for council support. Your personal budget is the amount of money that the council has calculated is needed to meet your social care needs. Direct payments are one way of receiving this personal budget, so you can arrange your own social care support. A personal budget gives you more choice and control over your care: who provides it, where it s provided and when. Section one: Getting social care support from the council Personalisation and personal budgets The government wants all social care support to be personalised. Personalisation is about making sure that social care services work for each person. It means that you should have choice and control over any care and support that you need to live your daily life and stay independent. It s about looking at the whole of your life - your needs, preferences and hopes, and tailoring your care and support to you. This is why personal budgets were introduced so people can get the care that suits them best. Using direct payments or a personal budget - July 2015 4

Assessing your needs Your personal budget is the amount of money that the council has worked out is needed to meet your needs. You have a legal right to know what your personal budget is. To receive a personal budget, you must qualify for care services from your local council they decide this using the national eligibility criteria. To see if you qualify for support, a social worker from the council s social services department must carry out a needs assessment. For information about the needs assessment, please see our factsheet Assessment and services from your local council in England (0800 319 6789, independentage.org). Based on your needs assessment, the social worker will be able to tell you if your needs meet the eligibility criteria. If you do qualify for support If you are eligible for council support, the second step is to have a financial assessment, to see whether you need to contribute any of your own money towards the cost of your support. Depending on your finances, your personal budget could be: - made up totally from money provided by the council - a combination of some money from the council, and some of your own money - an independent personal budget so you pay for all of your support. You will only get financial help from the council if you have savings below 23,250 (although some councils may have a higher savings limit). If you have more savings than this, the council can help you to arrange the support you need, if this is what you want, but you may need to pay for it all yourself. If you end up paying for all your support yourself It is still important to have a needs assessment and find out what your independent personal budget is. As of April 2020, this amount will be tallied up in a care account, so that what you are spending on your own support will count towards the new care cap. The care cap: From April 2020, people s spend on their care will be limited to 72,000 in their lifetime. If the amount tallied up in your care account reaches this limit, the council will need to take over paying your support costs. Using direct payments or a personal budget - July 2015 6

If you are already getting support from the council If you already receive care services which have been arranged by your council and have not been given a personal budget, you should be told what your personal budget is when your care is next reviewed. You should then be given the option to receive this budget as direct payments, so you can arrange your own support instead of the council arranging services for you. To do If this does not happen, ask what your personal budget is. As of April 2015, you have a legal right to this. If your next review is not for some time and you are keen to receive your support in a different way, you can ask for a re-assessment of your needs and discuss personal budgets with the person who carries out the assessment with you. Personal budgets How can I receive my personal budget? If the council is contributing towards your support costs, there are several ways that you can receive your personal budget: - You can use it as a direct (cash) payment - you buy your own support services - if you prefer, the council can hold and manage your personal budget for you (but you still get to decide how the money is spent on your care) or a third party, such as a local voluntary organisation or someone you trust can manage your personal budget for you - You coud also choose to do a bit of both and take some of your personal budget as direct payments, and leave the rest with the council or another organisation for them to arrange some services for you. See section three of this factsheet for more details about these options. You should be offered information and advice from the council to help you decide which option, or mixture of options, is best for you. This should be part of making sure that you have choice and control over your situation. Good to know you. What you can expect from the council The council has a duty to: - be clear about how they have calculated your personal budget - make sure that the budget is enough to meet your needs taking into account that care may cost more if your needs are complex, and the market rate for home care services bought privately rather than by the council, for example - let you know what your budget is in good time, so that you can start planning your support knowing how much money is available. Personal health budgets These are slightly different from personal budgets, but you may start to hear them being mentioned. Personal health budgets are available for some people who need NHS Continuing Health Care. How are personal budgets worked out? The amount you receive in your personal budget is usually calculated using a resource allocation system (RAS). You usually fill in a questionnaire and a set number of points is awarded for each answer that you give. Each point has a set monetary value, eg 7.50. All the points are then added together to make up your total 'estimated' personal budget. However, the council must then make sure that this amount is reasonable and enough to fully meet all of your needs (including any social, emotional or psychological needs which came up in your needs assessment). This should include consideration of the local market rates for providing the kind of support you may need. This may mean your personal budget is then increased or decreased. The reasons behind how much your resulting personal budget is worth must be explained to you, with clear reasons, and you can ask for this in writing. what happens next? After the council has calculated the costs of the support you need, you ll be means-tested to see if you need to contribute any of your own money towards these costs, and how much (through the financial assessment mentioned earlier). The amount you pay towards your social care must not bring your income below a certain amount. It should also be made clear to you how much your personal budget will be, so that you will be able to plan how much money you will have to spend on your care needs. figure, but it is up to councils to decide how frequently payments should be made. Whatever the frequency of payment, it should be reliable and consider your needs for additional payments in an emergency. If you disagree with the personal budget amount If you feel your personal budget is not enough to meet your needs, or your needs change at a later date, you can ask for the amount to be reviewed by the council. The amount you are awarded must be enough to meet your eligible assessed needs, including necessary costs incurred in securing the service. Any contribution that you are asked to make towards the personal budget amount must be reasonable and should not put you in financial difficulty. The charge should not take your income below 189 for an individual or 288.56 for a couple. If you feel the contribution you are required to make is unreasonable, you can request that social services consider a reduction by asking for a review of the decision, or make a formal complaint using the council s complaints procedure (see section five). Social services cannot withdraw services if you refuse to pay the charges, but they are within their right to pursue this debt if it s established that the charges are reasonable. Personal budgets for people who lack mental capacity People who are unable to make their own decisions about their care, or who would not be able to manage a payment themselves, can also benefit from personal budgets. They can also receive them in all of the same ways as everyone else (such as through a direct payments). Direct payments are available to people who lack mental capacity, as long as they have a suitable person to manage them on their behalf. This must be someone reliable who will manage things in their best interests, like a close family member. It will often, but not always, be someone who has a lasting power of attorney for that person. It can also be someone who has been appointed by the Court of Protection as a deputy under the Mental Capacity Act 2005. The council is responsible for making sure that the chosen person is suitable to take on the role. The councils' other responsibilities If someone without mental capacity has direct payments, the council should still, as far as reasonably practicable, find out their views on the care they get. This could be through direct or indirect communication, or by taking into account what the person had previously said their wishes were. When deciding on the most appropriate person to manage someone s direct payment, the council must also consult with all relevant family members, carers, close friends and people involved in the care and personal welfare of the Using direct payments or a personal budget - July 2015 12

person without mental capacity. This includes asking the opinion of any professionals who are involved. If there are no appropriate family or friends, the suitable person could be a person not personally known to the person lacking capacity. Eg, the suitable person could be an independent care broker, or a solicitor acting as a professional deputy. Using direct payments or a personal budget - July 2015 13

Personal budgets for a carer You have a right to an assessment from the council if you care for someone else. Personal budgets and direct payments are also available to carers. This means that if you are assessed as needing support, you can choose to buy the support services that you want, to support you in your caring role and to maintain your health and wellbeing. Good to know as needing. You cannot use direct payments to buy services for the person you care for. Section two: planning your support The care and support plan After you have had a needs assessment and been told that you qualify for support from the council, you will need to put together a care and support plan, to show how your personal budget will be spent. This plan explains: - what your individual care needs are - what you want to achieve through your support (such as being able to go out more, for example) - what your personal budget amount is - how your support will be organised to meets your needs such as the type of services you will get, and who will be arranging them - the support that others (such as friends and family members) are willing to provide - a risk assessment and actions to manage any risks to your safety - who to contact if you have a problem or your needs change - a plan for emergencies such as if your care arrangements go wrong - your assessed contribution towards the cost of your care - a review date - to check whether your needs have changed. You should be involved in putting this support plan together, and it should reflect the discussions you have had with your social worker about your wishes and the type of support you would prefer. If you feel that your wishes are not being listened to, you may also want to discuss this with an independent advocate. Good to know The council must appoint an independent advocate to support you during discussions about your support needs if the council feels that you have significant difficulty in communicating your wishes, or retaining or understanding information given to you. This duty on councils only applies if you don t have anyone suitable (like a friend or family member) who could support you. Support planning and brokerage Some voluntary organisations offer a support planning service (which is also sometimes called a brokerage service), to help you plan your support and manage your personal budget (particularly if you decide to take your budget as direct payments - see section three). They can help you to dedcide what support will be best to meet your needs, and also help you to arrange that support if necessary. Brokerage services can be used alongside any support and advice that you re entitled to free of charge from your council. You should be referred to local support and brokerage services by your council. Using direct payments or a personal budget - July 2015 16

If the brokerage service isn t free, you may need to pay for this service, but associated costs should be included as part of your personal budget given to you by your council. To do... Section three: ways to receive your personal budget Direct payments Direct payments are one way of using your personal budget. You can receive a cash payment from social services (perhaps once a week or once a month) into a nominated account, which you then use to arrange the care and support you need, as detailed in your care plan. This is useful if you want to have flexibility about the times you receive services or to allow you to choose a care worker, as you can employ someone directly using your cash payment rather than social services providing the service for you. Eg, if the council has agreed that you need this kind of support, you could use your direct payment to: - employ someone of your choice to give you care at home, at a time that suits you best - employ someone to help you attend activities outside your home such as going shopping or to a lunch club - employ someone to help you maintain your fitness by driving you to a local exercise class or going on a walk with you. help with shopping). You must use the money to meet the needs that social services have assessed you as having (such as a need to get out and meet people in your community, or a need for Using direct payments or a personal budget - July 2015 18

As long as you are meeting those needs, you have the flexibility to buy the services or equipment that best suit you and your personal lifestyle. Eg, you may have been assessed as needing a meals on wheels service, but you can choose to use your personal budget to go to a café, or to meet friends for lunch. How much will I get? The amount you receive in a direct payment can alter as your needs change. A direct payment will not affect any welfare benefits you receive and is not liable for income tax. Arranging your care services Social services should give you information and advice about the services that are available for you to buy. They should also provide you with details of a local support or brokerage scheme which can help you with managing direct payments. To do... Managed budgets If you decide that you do want to set up your care, but don t want to have the responsibility of managing your personal budget yourself, you can ask for one of the following options: - your council can manage your budget for you, and make sure that your care is arranged to meet your wishes and preferences. This is sometimes known as a virtual budget - an account can be set up with another third party, often a service provider, which could be a voluntary organisation. This is also sometimes known as an Independent Service Fund (ISF) - you could ask for an account to be set up for a carer, family member or friend. This is called a User-controlled Trust and allows your chosen trustees to manage the budget on your behalf, but in the way that you want them to - a mixture of all of the above mentioned options, which best suits you and your particular needs. User-controlled trusts Having a user-controlled trust (also known as an independent living trust) means that although the money (your personal budget) belongs to you as beneficiary of the trust, it is managed by three or more trustees. The trustees could be: - friends - family - a solicitor - an accountant - an independent advocate - or another appropriate person. Legal authority is given to the trustees without taking power away from you, and you should still be in charge of all decision-making about how your care needs are met and how the money is spent. The trustees can manage the practical side of things, such as: - employing care staff - operating bank accounts, and managing money on your behalf - making sure that contingency arrangements are in place, should something go wrong with your care. Generally, the trustees should make sure that your needs are met in the way that you want. Using direct payments or a personal budget - July 2015 21

Section four: more on direct payments Before direct payments start Before your direct payments start, you should discuss and agree the following things with your council: - your support plan (you should receive a copy and have the opportunity to agree that you are happy with it) - which needs, as stated in your support plan, the direct payments will cover - what outcomes or goals the direct payments will help you to achieve - what direct payments can and cannot be used for - which services you intend to spend your direct payments on to meet your needs - whether you need help to manage your direct payments - what the back-up arrangements should be to cover emergencies - when the payments will start, how often they will be made, and how much each payment will be - how much of your own money you will be expected to contribute towards the cost of your care (see section below about direct payments and your contribution) - what information you need to provide to the local council about the way the money is spent, and how the council will monitor your spending - any conditions attached to the direct payments - the date when your arrangements will next be reviewed - any circumstances under which the council might stop your direct payments, and the notice period the council will give if it decides to discontinue the direct payments - how any outstanding payments will be handled if the direct payments are discontinued, and the circumstances under which the council might ask you to repay the money. Direct payments and your contribution towards the cost of your care There are two ways for councils to pay direct payments to you: 1. The council may pay the full personal budget amount (gross) to you in direct payments, and then invoice you for the amount they assess you as being able to contribute. 2. Or the council can pay the net personal budget amount to you in direct payments, less the amount that they assess you as being able to contribute. The council may have a usual practice but should be flexible depending on your preference and circumstances. What you can t use direct payments for You cannot normally use direct payments to pay the following people for any care they provide to you: - a spouse, partner or civil partner - a close relative living in the same household as you - a spouse or partner of that close relative. Good to know Where the local authority is satisfied that it is necessary to meet your needs, eg - the only way that your care and support needs can be met is by one of the above people, the council can allow you to pay this person using your direct payment. Some examples It may be that you have severe dementia and your behaviour can only be managed by your spouse, or your first language is not English and you could only make your wishes known if you were cared for by someone who spoke your language (like a close relative). Direct payments may also not be used to: - purchase services provided by social services - councils are not legally allowed to sell their own services in this way - purchase services or equipment that the National Health Service (NHS) has a duty to provide, such as a nursing bed - purchase services provided by housing authorities - pay for permanent residential care (see information below about direct payments in a care home) - this is currently being trialled in some areas - pay for adaptations to your home when you would be eligible for a Disabled Facilities Grant. Direct payments in a care home At the moment, direct payments cannot be used to pay for permanent care in a care home. This is currently being trialled in some areas, with the aim that people will be able to use direct payments to pay for long-term residential care from April 2016. However, direct payments can be used to pay for a short stay in a care home for a maximum period of four consecutive weeks in any 12-month period. Good to know If you stay in a care home for less than four weeks, and then do the same thing again less than 28 days later, these two stays are added together. If your separate stays in a care home are more than four weeks apart, they are not added together. If you are considering moving out of a care home If you are already living in a care home, you may be able to use direct payments for a trial period of independent living before you decide to permanently move out of the care home. You can also use the payments to help you take part in day-time activities such as day centres, cultural trips or exercise classes. Using direct payments or a personal budget - July 2015 26

Your responsibilities if you have direct payments Accountability If you receive direct payments, either for yourself or as a suitable person on behalf of someone who lacks capacity (see section one), you are accountable to the council for the way you spend the money. You must have a separate bank account for the payments and keep careful records of how you spend them. A local support service may be able to help you with arranging this (see section below on getting help). If you spend the money on items or services that the payments were not intended for, the council has the power to request that some or all of the money is paid back to them; they may also stop the direct payments altogether. You should discuss it with your social worker if you are being refused direct payments for a service that you believe is suitable to meet your needs. Employer responsibilities If you receive direct payments and decide to employ someone directly to meet your assessed care needs, there are some legal responsibilities you will have to consider as an employer. These include: - providing your care workers with terms of employment and a contract - observing the National Minimum Wage - deducting income tax and National Insurance contributions - managing holiday and sick pay Using direct payments or a personal budget - July 2015 27

- making sure you follow health and safety legislation (there is information about this below). To do... They will also be able to tell you about direct payments support services such as payroll services that can take responsibility for administering the wages, tax and National Insurance for your care worker(s) to make direct payments easier for you to manage. Health and safety responsibilities If you employ someone to care for you, you will have a responsibility to provide a healthy and safe place for your care workers to work in. Your care workers also have a responsibility to work in a way that avoids risk to them and to you. Taking a common sense approach will help to avoid most dangers and causes of accidents. It s important to discuss with your care workers what tasks you need doing and what would be the safest way of carrying them out. Using direct payments or a personal budget - July 2015 28

You should also get advice from the council's social services department on health and safety. Part of your needs assessment should include a health and safety risk assessment, carried out by an experienced risk assessor. The social worker should highlight any possible risks and suggest ways of managing them, such as storing cleaning materials in a safe place. You should be given a written record of this. To do... If you have difficulty getting in and out of a bed, chair or bath, it s important to have an occupational therapy (OT) assessment before these tasks are carried out. The occupational therapist will look at what equipment could be used to reduce the risk to yourself and your care worker when carrying out daily tasks. This could include things like using a hoist to help get you out of bed. If you use your direct payments to employ a care worker through a home care agency, the agency should make sure their care workers have relevant, up-to-date training and you have the necessary equipment, so that they can assist you in a safe way. Getting insured To cover you and your care workers against accidents, it s important that you take out employers liability insurance and public liability insurance. Employers liability insurance will cover you if your care worker is injured or becomes ill as a result of an accident in your home. Public liability insurance covers you for any damage or injury you or your carer cause to anyone else while your carer is working for you. It is your responsibility as the employer to arrange these two types of insurance, but as these are compulsory employment costs, they should be included in the direct payments given to you by your council. Similar cover may also be available through your household insurance policy. Get advice from your insurance company, or local support service mentioned earlier. Deciding who to employ When thinking about employing someone yourself, it may be useful to consider: - what kind of person you want to employ - how many staff you will need (including back-up for holidays and sick leave) - what tasks you want them to do - what skills and qualities the person will need. (Eg, if you want to be escorted and driven to places, they will need a driving license and access to a vehicle with the correct car insurance) - what hours you need them to work - the rate of pay: rates are usually higher in the evenings and weekends, and on bank holidays people usually Using direct payments or a personal budget - July 2015 30

expect double pay so you have to make sure that you have enough money in your personal budget to cover this. All wages must meet the national minimum wage of 6.50 an hour for workers aged 21 and over. - how you will recruit staff perhaps by word-of-mouth, through friends or relatives, or by placing an advert in your local post office, newspaper or jobcentre. You should have someone with you when interviewing candidates for safety reasons and to get a second opinion - at interview, be sure to ask all questions that may be important to you such as does the person smoke? What are their dietary preferences? Eg, if they are vegetarian, are they willing to prepare meat? You should also check whether they provide their own overalls and rubber gloves, or will you have to provide these? Once you have successfully identified a possible candidate, you should: - ask for two references from previous employments and follow them up with a telephone call for confirmation - ask for identification documents, such as a passport or visa, for proof that they have the right to work in the UK. Good to know You could employ a care worker through an agency rather than employing them directly yourself. Once the care begins When the care package begins you could get a friend, or someone you trust, to spend some time with you and your new care worker. If you are unhappy with the person caring for you, as a responsible employer you will need to give them feedback about what is not working for you and give them an opportunity to improve their performance before you look elsewhere. You may wish to get advice from a local support service or independent living centre (see useful contacts listed at the end of this factsheet). Care registration If your carer works for you directly, without an agency or another employer being involved to manage or direct the care that the carer provides, the carer does not need to be registered with the Care Quality Commission (CQC). This is because the CQC has set out registration exemptions for those using personal budgets. Individual user trusts, set up to make arrangements for nursing care or personal care on behalf of someone who lacks capacity to do it for themselves, are also exempt. Criminal records checks People who are employed directly by personal budget holders as personal assistants do not currently need to have a Disclosure and Barring Service (DBS) check (formerly called a Criminal Records Bureau (CRB) check). If you do still want to have your carers DBS checked, or you have been advised to do so by social services, any costs for this should be included within your personal budget amount. Timesheets Independent living centres or local support services may offer administrative services to help you manage timesheets and general record keeping for your carer. When you receive care from a care worker (also known as a personal assistant), it s important to check and sign the timesheet, to record the help you have been provided with and its duration. This is to make sure that you are only charged for the care you have actually received. Using direct payments or a personal budget - July 2015 33

Section five: however you receive your personal budget Your right to complain You have the right to complain if you disagree with any decision made about your personal budget or direct payment. If you receive a personal budget or a direct payment, you are entitled to access the local council s complaints system in the same way as if you were receiving a service provided directly by the council. If you have purchased your own services from a care agency using your personal budget and you are unhappy with these services, you will need to first address your complaint to the care agency and request a copy of their complaints process. If you are unhappy with their response, you should let the council know so that it can look into the services provided by that agency and make sure they are safe. If you are still not happy If you are still unhappy, you can contact the Local Government Ombudsman so that your complaint can be further investigated (0300 061 0614, lgo.org.uk).
