Avaya Professional Program Agreement The Avaya Program ( Avaya Program or Program ) awards certificates to individuals that satisfy knowledge and skill competency requirements (the ) to sell, design, implement and maintain Avaya products and solutions. You understand, acknowledge and agree that: 1. OBTAINING CREDENTIALS: To obtain a (s) under the Avaya Program you must achieve a passing grade on specific test(s) or the exam(s) for a given level of, and you must comply with any other requirements outlined on the specific curriculum map and in this Agreement. 2. MAINTAINING CREDENTIALS: Once a is granted, you are responsible for keeping your valid. You must maintain your status by completing, within the time frame specified by Avaya, all continuing requirements that correspond with your specific level of. If you do not complete the continuing requirements in the time frame specified by Avaya, your for that particular level will be revoked without further notice, and all rights pertaining (including the right to use the Avaya Mark, as defined herein) to that will terminate. Avaya may, as a condition to continued use of Avaya s, at any time require you to execute a revised version of this Agreement. 3. CHANGES/MODIFICATIONS IN THE CREDENTIAL PROGRAMS: Avaya reserves the right, at any time without notice, to change the Program including but not limited to the, requirements, test materials, materials, and examinations for s. Additionally, Avaya may require you to update your at any time and without further notice. 4. TRANSFER OF CREDENTIALS: If you leave your current employer and/or begin working with a new organization, you retain your status. However, your status and any rights under this Agreement or the Program, including the right to use the Avaya Mark are not transferable to any other person or entity. 5. CREDENTIAL MARK USAGE: Upon your successful completion of the requirements and for as long as you remain in compliance with all applicable continuing requirements, Avaya hereby authorizes your usage of the Avaya mark (the Avaya Mark ) in accordance with the Avaya Mark guidelines, found at www.avaya-learning.com on the Avaya Professional Program landing page where under Program Information Links and at Avaya Management System where you download your Avaya Mark. The Avaya Mark may be used by only you in any advertising, direct mail, collateral, or other promotional materials as long as you comply with the Avaya Mark guidelines. You shall not alter or modify the Avaya Mark in any way. You agree to provide any materials reasonably requested by Avaya to enable Avaya to determine your compliance with this paragraph 5. 6. CONDUCT OF BUSINESS: You agree to conduct yourself in a professional and respectful business manner. You agree that you will (1) not in any way harm Avaya s reputation; (2) avoid deceptive, misleading, or unethical practices; and (3) not advertise or represent your services or status with regard to the Program in a misleading manner or in a manner injurious to the dignity or integrity of the Avaya Program or Avaya Inc. 7. CONFIDENTIALITY: From time to time Avaya may provide you with confidential information ( Confidential Information ). Confidential Information includes but is not limited to materials, test materials or exams. You understand, acknowledge, and agree that such Confidential Information is the property of Avaya Inc. and you shall not reveal, disclose, display, modify, perform, reproduce or distribute such confidential information in any form except to the extent specifically permitted by Avaya Inc. You acknowledge and agree that monetary damages may not be a sufficient remedy for unauthorized disclosure of the confidential information and that Avaya shall be entitled, without waiving any other rights or remedies, to seek such injunctive or equitable relief as may be deemed proper by a court of competent jurisdiction. For the duration of this Agreement and for a period of seven years following the expiration or termination of this Agreement, you represent and warrant that you will not develop market or make available to a third party: a) any Confidential Information; and b) documentation, products, test(s) or exam(s) that provide substantially similar information and functionality as the Confidential Information. 8. TERMINATION: This Agreement may be terminated by Avaya, in its sole discretion, immediately and automatically without any notice of any kind if (1) you fail to comply with the applicable continuing Program requirements for the ; (2) you fail to perform any of your obligations under this Agreement, including without limitation, the terms related to use of the Avaya Mark; (3) you misrepresent your status or the status of your under the Program; and (4) you are the subject of any adverse publicity. Upon termination of this Agreement for any reason, you shall immediately cease using the Avaya Marks and will return all items, materials or other collateral containing or displaying the Avaya Marks to Avaya. If any term, provision, covenant or condition of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, the remainder of this Agreement shall remain in full force and effect and shall not be affected, impaired or invalidated thereby. 9. INDEMNIFICATION: You agree to indemnify and hold Avaya harmless against any loss, liability, damage, cost or expense (including reasonable legal fees) arising from or related to your, failure to achieve a or use of or inability to use the Avaya Mark or arising from or related to the termination of your, even if Avaya has been advised of the possibility of such damages, including any claim for damages by any third party resulting from your representation to such third party of your status as an Avaya authorized or certified individual, whether or not such representation is accurate. 10. CANDIDATE INFORMATION: On occasion Avaya may, but is not obligated to, share an individual s status and/or training records with select third parties such as Avaya partners and customers, based upon their request. For the purpose specified in this agreement it may be necessary to transfer personal information to different countries, including countries outside the EEA/EU. As a condition of registering as a user of Avaya s learning management system (LMS) or taking a exam you will be asked to acknowledge that you have read and understand this Avaya Program Agreement and agree that Avaya may share your status and / or training records with select Avaya partners, customers or third parties, for purposes of determining compliance with Avaya s Programs. registering on Avaya s LMS or taking an Avaya exam, you acknowledge and agree to these procedures. 2. Validation Avaya Professional Sales Specialist (APSS), Avaya Professional Design Specialist (APDS), and Avaya Certified Design Specialist (ACDS) s are valid for 24 months. A s date of completion will be the date on which the last requirement was completed. If the is not extended before 24 months have passed, the will expire. Exception: APSS Avaya Aura Application Server 5300 (APSS -1101) remains a one year until further notice. Avaya Implementation Professional Specialist (AIPS), Avaya Support Professional Specialist (ASPS), Avaya Certified Implementation Specialist (ACIS), Avaya Certified Support Specialist (ACSS), and Avaya Certified Solution Expert (ACSE) s are valid for 24 months. A s date of completion will be the date on which the last requirement was completed. If the is not extended before 24 months have passed, the will expire. NOTIFICATION A student will receive an automated e-mail notification upon the completion of an Avaya. Notifications will be sent to the e-mail address specified in the student s Avaya Management (CMS) profile. To ensure that all automated e-mails are received appropriately, the e-mail address on a student s Avaya Management System profile must be current. A student will receive an e-mail notification in case of an extension of an Avaya or change to their Avaya transcript record. The notification will be sent to the e-mail address specified in the student s Avaya Management System profile. To ensure that all automated e-mails are received appropriately, it is important that the e-mail address on a student s Avaya Management System profile is kept current. Avaya advises that the email used on the student s Avaya Learning Center profile match the email used for registering at Avaya Management System and at Pearson VUE for Avaya certification exams. This approach reduces problems with records not matching for holders. CERTIFICATES AND LOGOS Upon the completion of an Avaya, a student will be able to download the appropriate Certificate and Avaya Logo for that within Avaya Management System. 3. Online Test and Proctored Exam Information Avaya Online Test(s) and Proctored Exam(s) are components of the Avaya Professional Program. Each targets the Avaya portfolio of communication systems, applications and services. AVAYA ONLINE TEST AND ASSESSMENT RETAKE POLICY Applies to Online Tests and Assessments delivered via the Avaya Learning Center. Avaya Online Tests for Sales s are free. Testing fees apply for all Support categories. The Global list price for Avaya Online Tests for Support s is $90 USD per attempt. The student fee at enrollment is based upon the student s geographic location and audience type on their Avaya Learning Center Profile. Candidates that have passed a specific Online Test or Assessment are not allowed to take it again (defined as an Online Test or Assessment with the same number). Candidates who do not pass must re-register to attempt it again and where applicable pay the associated testing fees. Candidates are allowed three pre-course attempts for all Online Tests and Assessments. Candidates who have not passed after the third attempt will need to complete the associated learning activity prior to the next attempt. Upon completing the learning activity, the candidate must contact the Avaya Learning Center Help Desk and request access to the Online Test or Assessment. Please note: This policy applies to Avaya Learning Online Tests and Assessments. It does not apply to Avaya Certification Exams. Taking an Avaya Online Test Avaya online tests are taken via the Avaya Learning Center. Students are required to log in to the Avaya Learning Center via Avaya Single Sign-on (SSO) process. Upon the completion of an Avaya Online Test or Proctored Certification Exam, the pass/fail results are provided to the student. This score report indicates the candidate s overall performance on the exam. CERTIFICATION EXAM RETAKE POLICY Applies to all Avaya Certification Exams delivered at Pearson VUE Testing Centers Worldwide. Avaya Proctored Exam fees are $125 USD global list price per exam attempt and vary by student geographic location. Candidates that have passed a specific exam are not allowed to take it again (defined as an exam with the same exam number). Candidates who do not pass must re-register to attempt it again and where applicable pay the associated testing fees. Candidates who do not pass an Avaya Certification exam must wait at least 72 hours before retaking the same exam. Candidates may attempt the same exam 3 times within a 12-month period. A 4th attempt, if needed, must be at least 12 months from the date of the first attempt. All attempts are subject to the 72-hour waiting period. 4. Candidates can challenge new Online Test(s)/ Proctored Exam(s) any time prior to s expiration date and are encouraged to do so to validate the latest skills and competencies and renew their early. The new expiration date is two years 1 from the date the new requirement(s) are met and not the s previous expiration date. A Renewal Notification is issued to the student via email. When Requirements Have Not Changed Since the Was Last Earned Avaya Professional s are evaluated for automatic renewal 6 months (180 days) prior to the s expiration date. Based upon the requirements in place 6 months prior to expiration, when the requirements have not changed since the date the was last earned or renewed, the will be renewed for another two year term. The new expiration date is two years 1 from the s previous expiration date. A Renewal Notification is issued to the student via email. 1 APSS/APDS 2 Year terms awarded with completion of Online Tests refreshed in FY2014. When the Certificant Lets the Expire Expiration Alert Notifications are sent to the Certificant at 180, 90, 30 and 14 day intervals prior to expiration until the new requirements are met. Should the Certificant let the expire, a final Expiration Notification is issued. The individual must pass the current requirements to re-earn the. Two-Tier Requirements Certain Avaya s require satisfying lower level requirements in addition to the higher level Online Test(s) / Proctored Exam(s). When this occurs the requirements outlined and tracked in the Avaya Management System will indicate holding a current lower level (not passing individual Test(s) / Exam(s) associated with that ) plus the Online Test(s) / Proctored Exam(s) associated with the higher level. Candidates are only given credit for the lower level if it is current. Expired s are not recognized. Once the required Online Test(s) / Proctored Exam(s) are passed for the higher level and the is awarded it does not auto-renew lower level s required to achieve it. o An example would be certain ACSS s require the candidate hold the associated ACIS in addition to passing the ACSS exam. Once the ACSS is granted it does not auto-renew the ACIS. Candidates are expected to conduct themselves with honesty and integrity at all times and during all phases of the achievement process - including test or exam preparation, testing, and re-credentialing. If a candidate is believed to have acted with dishonesty or with intent to misrepresent at any time during the credentialing process, Avaya reserves the right to bar that individual from the Program immediately and for a period at Avaya s discretion. Evidence of cheating may include visual observation during the testing period or other tangible evidence, including data forensics. Cheating and misconduct may include (but is not limited to) unfairly gaining test information or providing unfair assistance to another candidate at any time during the test preparation or delivery period. Avaya Employees are reminded that cheating is a violation of the Avaya Code of Conduct; candidates who are observed unfairly gaining information or assisting others in doing so will be referred to their management for disciplinary action, up to and including termination.
