The Court encourages but does not require you to use an attorney in your domestic relations case. If you wish to use an attorney and want to know if you qualify for free legal assistance, please call Legal Services at 1-800-521-6968. You may also hire a private attorney. 2. If you choose to represent yourself, you are acting pro se which means for yourself in Latin. On occasion, a local attorney offers a free legal clinic for pro se parties. To schedule an appointment for the next pro se clinic, call the Court Clerk s office. 3. Self-represented parties must obtain blank copies of all forms that the Court requires you to file. The Court Clerk s office sells packets containing all required forms for $25.00. The Colorado Judicial Branch website at www.courts.state.co.us/chs/court/forms/domestic/domestic.htm makes all the forms available to download for free. For your convenience, this case management order gives the form numbers in parentheses.

INITIAL CONFERENCES 4. The Court orders the parties to attend an initial conference with the Court Facilitator or Judge. The purpose of the conference is (1) to review and explain the dissolution process, (2) to establish a schedule for completing Court requirements, (3) to set the next event in your case, and (4) to confirm any agreements of the parties in writing. 5. The parties must be aware that the Facilitator or Judge does not and cannot represent either party or give legal advice. The Facilitator and/or Judge will not prepare documents for either party. The parties are always encouraged to contact an attorney to assist them in their family case. 6. The conference must be held within 40 days from the date of filing. The Court will schedule the conference at the time of filing. The Court will issue a Notice of Domestic Relations Initial Status Conference to the petitioner at the time of filing. 7. The parties must complete their mandatory financial disclosures prior the conference, pursuant to Colorado Rule of Civil Procedure 16.2(e). The parties must either file before or bring to the conference the following: A completed financial affidavit, and A completed certificate of compliance with Rule 16.2(e) 8. At the conference, the Facilitator or Judge will set the next event in the case either a hearing or subsequent status conference. The next event will be set even if one party fails to attend the status conference. 9. If a party lives outside the 14 th Judicial District, they may attend the conference by telephone. The party must have this Case Management Order and personal calendar with them when they call in. The parties must have already exchanged the Rule 16.2(e) financial documents before the conference. 10. All parties who file an affidavit for decree without appearance with all required documents before the initial status conference shall be excused from the conference. 11. If both parties are represented by attorneys, the attorneys may submit a Stipulated Case Management Plan signed by attorneys and the parties. Attorneys shall exchange the Mandatory Disclosures and file the Financial Affidavit and Certificate of Compliance. If the Stipulated Case Management Plan, Financial Affidavit, and Certificate of Compliance are filed before the initial status conference, the parties are excused from the conference.

FINANCIAL DISCLOSURES 12. Colorado Rule of Civil Procedure 16.2: The parties and counsel shall provide each other full and complete disclosure of all relevant financial documents as quickly as possible (see Colorado Rules of Civil Procedure, Rule 16.2(e) for guidance), so that any necessary orders can be issued as needed, and so final settlement can be explored at the earliest possible time. 13. Colorado Rule of Civil Procedure 16.2 Certificate of Compliance: Once the parties have disclosed all relevant financial documents pursuant to paragraph 12, each party must file with the Court a form entitled Certificate of Compliance. (JDF 1104). The parties must check all appropriate boxes and fill out the Certificate of Service. 14. Financial Affidavits: Each party must file with the Court a form entitled Affidavit with Respect to Financial Affairs (JDF 1111). The party must sign the form in the presence of a notary or Court Clerk. The form asks the party to disclose information on their financial status such as income, expenses, assets and debts. 15. Child Support Worksheets: All parties with children must file the appropriate child support worksheet. (JDF 1820 or JDF 1821) There are two worksheets available to determine child support: one for shared residential responsibility and one for primary residential responsibility. A child support order may be entered by the Court upon motion of either party at any time. PARENTING CLASS 16. Parties with minor children must attend a Parent Information Class that addresses co-parenting after separation and the effects of conflict on children. Failure to comply may result in sanctions from the Court. The parties are responsible for filing their Certificate of Attendance with the Court. A blank Certificate of Attendance is attached. 17. Attached to this order are the class schedules for Routt and Moffat Counties. In Grand County, call instructor Frank Giardino, Ph.D. at (970) 887-2179 for information on the next available class. 18. If you live outside the Fourteenth Judicial District, contact the local state court in your area for information on the next available parenting class for parents going through dissolution of marriage or allocation of parental responsibilities proceedings.

MEDIATION 19. Parties who do not agree on all issues relating to the marriage and/or parenting must attend a mediation session together, unless the Court determines that the case is not appropriate for mediation because of physical or psychological abuse and issues a waiver. 20. No final orders hearing may be scheduled where the parties are not in complete agreement until a Certificate of Attendance in Mediation is filed with the Court. 21. The parties are responsible for making sure that the Certificate of Attendance in Mediation is filed with the Court. A blank Certificate of Attendance is attached with this order. 22. The parties may use an independent mediator of their choosing or may attend mediation with the mediator contracted with the Fourteenth Judicial District. The mediator contracted with the Judicial District charges $60 per hour per person. Independent mediators set their own fees. 23. Failure to comply with the order to attend mediation may result in sanctions from the Court. If one party unreasonably fails to cooperate, the other party may file a motion to waive mediation (JDF 1307, 1308). The party must accompany any motion to waive mediation with an order for the judge to sign and an affidavit outlining their efforts to comply. The Court may assess any fees associated with obtaining the waiver against the non-cooperating party. It is so ordered.
