The carrier returned the information the information sheet, drivers list and vehicle list as requested. A copy of the carrier's profile and their MCS 150 Form were obtained through MCMIS and reviewed prior to the opening. The carrier passed a new entrant audit on 6/19/12 and had one previous non-rated investigation for the Hours of Service Compliance BASIC conducted on 4/29/13. During that investigation the carrier was given a copy of Your Guide to Achieving a Satisfactory Safety Rating and is familiar of the Federal Motor Carrier Safety Regulations. CDLIS (DRIVER LICENSE) CHECK: In accordance with the efotm, twenty commercial drivers' license status/history was required to be checked. The carrier currently employs 39 drivers with CDL's. Commercial drivers' license status /history were checked through Washington State DOL licensing and through CDLIS. efotm requires a minimum sample of 20 CDL drivers to be checked and results were all valid with two exceptions. Mr. Petr Shaporda's CDL is inactive, also his CDL return does not show a medical certification on file with DOL. CDLIS return shows driver Konstantin Timofeev's CDL suspended from 05/09/2014 through 06/24/2014. See Part 383 for details. AUTHORITY Quality Relocation Services Inc. is a for-hire common carrier operating in interstate operations. Operating authority was checked through Licensing and Insurance in QUERY. The carrier has active common carrier authority. Docket # is MC761775. The carrier's authority history was checked. There were no suspensions, however there is a revocation pending for cancelled insurance on 7/26/14 on file. INSURANCE Quality Relocation Services Inc. is a for-hire common carrier. Insurance was checked through Licensing and Insurance in QUERY. Form 91X has been filed. The carrier is required to maintain a BPID of $1,000,000. The documents checked show the carrier had a BPID of $1,000,000 effective 6/5/14. The carrier's insurance history was checked. The carrier's insurance was cancelled effective 7/26/14. See Part 387 for details. RED FLAG DRIVERS: Quality Relocation Services Inc. had one driver that was identified as a Red Flag driver. had a CVSA Roadside inspection on 02/02/2014 (WAS72G17810) while driving for Auto Star Transport Inc. (USDOT 1962164). Auto Star Transport changed their MCS-150 on 01/07/2014 to Out of Business status and therefore this inspection should have been credited to Quality Relocation Services Inc. The violation was 383.51(a) driving a CMV while CDL is suspended for a Safety-related or Unknown reason and in state of driver's license issuance. The driver's license was checked during this compliance review through Washington State DOL licensing and CDLIS, the results showed no evidence of a suspension since 2008. No further action is required. DRUG AND ALCOHOL SUPPLEMEMNTAL REVIEW A comprehensive review was conducted. A full investigation of this BASIC was required to be performed. See Part 382 for details. QUALITY RELOCATION SERVICES INC U.S. DOT #: 2186571 Review Date: 08/04/2014 Part C Quality Relocation Services Inc. transports vehicles, flammable liquid powered Hazard Class 9 and utilizes the exception found in CFR 173.220 for Internal combustion engines, self-propelled vehicles, mechanical equipment containing internal combustion engines, battery-powered equipment or machinery, fuel cell-powered equipment or machinery. (h) Exceptions. Except as provided in paragraph (f)(2) of this section, shipments made under the provisions of this section-(1) Are not subject to any other requirements of this subchapter for transportation by motor vehicle or rail car. The carrier is only subject to the insurance requirements in Part 387.9 Part 40 & 382 Controlled Substances and Alcohol Use and Testing Quality Relocation Services Inc. employed 39 drivers that were required to have a Commercial Drivers License and were subject to this Part. Mr. Dmitriy Zhelez is responsible for the carrier's Controlled Substances and Alcohol Use and Testing program. Pre-employment tests were checked for eight drivers: No Pre-employment test was found for drove for the carrier prior to receiving a pre-employment test result resulting in violations of 382.301(a). This investigation was generated by a fatality accident that occurred on 06/20/2014. The carrier was unable to provide post-accident controlled substances test results or post-accident alcohol test results for the driver resulting in a violation of 382.303 (a) & (b). The carrier also failed to prepare and maintain on file a record stating the reasons the controlled substances post-accident test and the post-accident alcohol test was not properly administered resulting violations of 382.303 (d)(1) and (d)(2). The carrier had two other accidents in 2013, both were involving One was on 01/18/2013 and the other was 04/16/2013, both were outside the 365 day window for inspecting post-accident drug testing as per efotm. The carrier does have a random testing program in place. The carrier uses CLEANfleet as their consortium. Their address is 10350 N. Vancouver Way #106 Portland, OR and the MRO is C. Kirby Griffin, MD. Quality Relocation Services Inc. averaged (19) driver positions in 2013. The consortiums testing pool averaged 2,677 participants in 2013. The consortium met the testing requirements by conducting 1,419 controlled substance tests, exceeding the 1,339 tests required and conducting 287 Alcohol tests exceeding the 268 requirement. A check of the carrier's drivers enrolled in the consortiums random pool revealed the carrier employed two drivers with of the same name. Driver (WA License/ SSN ) was not added to Quality Relocation Services Inc. random testing pool for 2013. The signed drivers list shows he was he was a driver for Quality Relocation Services since 12/28/2012. He was not added to the random testing pool. According to the signed drivers list provided by the carrier driver (IL License/ SSN ) was added to Quality Relocation Services as a driver on, prior to that he was employed by Auto Sta Transport; however his name (and SSN) appeared in the random testing pool for 2013 for Quality Relocation Services. Four selections were recorded throughout 2013: 1/16/2013, 5/8/2013, 8/12/2013, and 10/14/2013. A violation of 382.305(i)(2) Failing to ensure that each driver subject to random alcohol and controlled substances testing has an equal chance of being selected each time selections are made. There were no drivers that tested positive. Mr. Dmitriy Zhelez is trained in reasonable suspicion. Quality Relocations has a controlled substance and drug testing policy in place that meets the requirements of 382.601. Documentation for Administrative Action was prepared for violations of CFRs 382.301(a), 382.303(a), 382.303(b), and 382.305(i)(2) Part 376 Lease and Interchange of Vehicles Quality Relocation Services Inc. leases 10 trucks and ten trailers from Auto Star Transport Inc. Lease agreements on file meet the requirements of Part 376. Part 380 Special Training Quality Relocation Services Inc. does not operate long commercial vehicles or employed any entry level drivers therefore was not subject to Part 380. Part 383 Commercial Drivers License Quality relocation Services Inc. employed 39 drivers with CDL's. Commercial drivers' license status /history were checked through Washington State DOL licensing and through CDLIS. The efotm requires a minimum sample of 20 CDL drivers to be checked and results were all valid with two exceptions. Resulting in a violation of CFR 383.37(a) CDLIS return shows driver CDL suspended for safety reasons from 05/09/2014 through 06/24/2014. A check of both drivers records of duty status show both drivers drove while disqualified. Resulting in a violation of CFR 383.37(b) Documentation for Administrative Action was prepared for violations of CFR 383.37(a) and CFR 383.37(b) Part 387 Financial Responsibility Quality Relocation Services is an interstate for-hire common carrier of property and is subject to this Part. The carrier was required to maintain $1,000,000 in liability coverage. The carrier's insurance company cancelled their insurance effective 7/26/14. The carrier did have a copy of the MCS-90 Form on file at the principal place of business as required. The Antanov Insurance Agency is the carrier's insurance agency and their policy was underwritten by Sparta Insurance Company. The policy # was 013TU0041300. The insurance agency contact is Nikolay. His phone number is (503) 772-1090. The vehicles owned by the carrier are currently uninsured. There is no record of the vehicles operating under Quality Relocation Services Inc. after 7/27/14. Truck #21was stopped on 7/27/14 in Montana. The truck was running under authority from Transport Express Inc. USDOT #2420740 Part 390 General Quality Relocation Services Inc. has a current MCS-150 Form that was last updated 6/27/ 13. The carrier's VMT (Vehicle Miles Traveled) was 271,500 in 2013. A copy of the carrier's loss run statement was requested but was not provided during the review. Quality Relocation Services Inc. had one recordable accident in the last year. The carrier had an accident register with all the required information. All the carrier's vehicles are properly marked in accordance with CFR 390.21 Part 391 Qualification of Drivers In accordance with the efotm a review of eight driver qualification files was required. The eight drivers that were selected for sampling were as follows The following violations were noted for 391.51(b)(1): failed to list the dates that he resided at his residence address for the previous three years, it also showed only one year of employment history through failed to list the dates that he resided at his residence address for the previous three years. He had only listed six years of employment history through while working for other motor carriers, missing the required 10 year employment history. application has the company he is applying for listed as Auto Star Transport Inc. The dates he resided at his current residence were missing. He had listed only two years of employment history, through while working for another motor carrier, missing the required 10 year employment history. The employment application was not signed. failed to list the dates that he resided at his residence address for the previous three years. had only listed two years of employment history, through while working for another motor carrier ), missing the required 10 year employment history. The employment application was not signed. driver qualification file contained two applications. One application shows the company name he was applying for was Auto Star Transport Inc. The second application does not list a name or address of a company for which he is applying and appears to be a photo copy of the first application prior to adding the Auto Star company name. application does not list the company or address of the carrier he is applying with. Driver abstracts were checked and two were found to be missing for a violation of 391.51(b)(2). Both driver driver were missing their initial abstracts from the time of hire in their qualification file. They both had a copy of the driving record request; however no results or returns were located. Annual abstracts were reviewed for the applicable drivers and violations were noted for the following: 391.51(b)(4), 391.51(b)(5), and 391.51(b)(6). Driver no current annual abstract, his last annual abstract was dated 4/17/13 and the last certificate of violation and annual review was dated 06/25/2012. Driver and driver were missing the annual abstract, as well as the annual review and list of violations. Driver was also missing the annual abstract, review and list of violations as the most current copy was dated 5/16/2013, over a year ago. A violation was noted for 391.51(b)(7) for as the most current medical certificate in the file showed an expiration date of 06/14/2014. The drivers return showed a valid medical certificate expiring on 05/13/2016; however it was not located in the file. medical certificate on file expired on 11/17/2012 for a violation of 391.51(b)(7). DQ file displayed a medical certificate showing an expiration of 08/14/2014, however this was not on file with the Department of licensing. The medical certificate on file with the State of Washington shows expiring on 05/17/2014 and the driver is not valid for CMV operation; a violation was not noted though as a valid certificate was on file. 8/5/2014 7:59:20 AM Page 5 of 8 Capri 6.8.8.5

This request was based on the media release from the New York State Police following the fatal accident on 6/20/14 that involved. The release stated that Mr. failed to recognize the restrictive signage in the vicinty of the accident, spoke very little english and required a russian interpreter. refused to be interviewed on the advise of his attorney. There was sufficient information based on the media release and the refusal to be interviewd to support a violation of CFR 393.11(b)(2). QUALITY RELOCATION SERVICES INC U.S. DOT #: 2186571 Review Date: 08/04/2014 Part C Quality Relocation Services Inc. is an interstate for-hire common carrier of property. The carrier has active common carrier authority, the docket # is MC761775. The carrier's authority is pending revocation effective 7/27/14. The carrier is subject to the Uniform Carrier Registration Program UCR. Carrier is currently registered through 12/31/14. I discussed with Mr. Zhelez load securement requirements, pre-trip inspections, and the prohibition on the use of radar detectors and texting in commercial vehicles. Also discussed was the law requiring hands free devices when using cell phones while driving. Part 395 Hours of Service Quality Relocation Services employed 39 CDL drivers during the last 365 days. During the last six month period the carrier employed 36 drivers In accordance with the E-FOTM 7 driver's hours of service records were required to be checked for a 30 day period. This required that 210 records be checked. The carrier does not use the agricultural or the short haul exceptions found in CFR 395.1. Hours of service records were checked on the following drivers: drive more than 8 hours since the end of the driver's last off duty or sleeper berth period of at least 30 minutes resulting in violations of CFR 395.3(a)(3)(ii). drove after having been on duty 70 hours in 8 consecutive days resulting in violations of CFR 395.3(b)(2). Washington and Oregon Scale crossing reports, Roadside Inspection Reports, Illinois I-Pass Toll History reports, various fuel and trip receipts, co-driver logbooks along with Microsoft Street and Trips were utilized to check for false records of duty status., made critical false entries in their logbooks resulting in multiple violations of CFR 395.8(e). failed to prepare record of duty status in form and manner prescribed resulting in violations of CFR 395.8(f) & (h)(5)., failed to forward within 13 days of completion, the original of the record of duty status resulting in violations of CFR 395.8(i). Documentation for Administrative Action was prepared for violations of CFR Part 395.3(a)(3)(ii), 395.3(b)(2), 395.8(e) and CFR 395.8(i) Part 393 & 396 Maintenance and Inspection During the last 365 days Quality Relocation Services Inc. has operated 13 trucks and 13 trailers with a gross vehicle weight rating or combined gross weight rating of 80,000 pounds. In accordance with the E-FOTM eight vehicle maintenance files were required to be checked. Files were checked on Unit #s 2, 5, 7, 8, 9, 18, 28, and 34. All eight files had complete Basic Descriptions, Nature & Due Date of Next Service and Record of Repair & Maintenance. In addition all eight files checked had copies of annual inspections for 2014 performed by Anthony Truck Repair of Tacoma WA. Officer Tom Yates was asked to contact Anthony Truck Repair and interview Mr. Igor Sayenko to verify he meets the qualifications required to sign off as the annual inspection inspector. Mr. Sayenko provided a copy of his Diesel & Heavy Equipment Mechanic certificate from Bates Technical College and an Annual Vehicle Inspection - Inspector Certification letter. Officer Yates interviewed Mr Sayenko on the phone. Mr. Sayenko stated he did not know what appendix G was. Officer Yates asked how he knew what criteria to use in doing the inspections and Mr. Sayenko kept referring back to his certificates and experience but admitted he does not use appendix G or any reference material. For example, Officer Yates asked how Mr. Sayenko measured the brake stroke and he stated how he limited every measurement to 2 inches. Mr. Sayenko did not seem to know there are different measurements for different size and types of brake chambers. Mr. Sayenko's lack of knowledge to properly conduct the required annual inspections invalidated all the annual inspections he conducted. This resulted in violations of CFR 396.17(a). Local shop mechanics perform all other routine maintenance on the vehicles. Mr. Zhelie Andrii and Mr. Peter Bezverkhov are employed by the carrier as mechanics. Both mechanics have brake inspector certifications on file. In accordance with the E-FOTM seven vehicles DVIR's (30 each = 210) were checked. Thirty four of the required 210 DVIR's were missing. Unit #8 missing 2, #9 missing 9, #5 missing 10, #18 missing 2, and #2 missing 11. Resulting in violations of CFR 396.11(a)(1). One DVIR failed to have defective equipment listed on the day prior or the day of a roadside inspection conducted on 6/4/2014. Unit 18 was found to have a tire below minimum tread depth that was not recorded on the DVIR resulting in a violation of CFR 396.11 (a)(2). The eight vehicle maintenance files should have contained copies of 64 roadside inspection reports conducted during the last 365 day period. Ten of these roadside inspection reports were missing. Unit #8 was missing 2, #9 was missing 5, #2 was missing 1, #34 was missing 1, and #28 was missing 1. This resulted in violations of CFR 396.9(d)(3). Per E-FOTM guidance five vehicle inspections were required to be completed. Level 5 inspections were conducted during this investigation on vehicle #s 2, 4, 20, 21, and 35. Two vehicles were placed out-of-service for defective brake lines.
