PETITION FOR CREATION OF SAINT GEORGE PLACE MANAGEMENT DISTRICT TO THE TEXAS COMMISSION ON ENVIRONMENT QUALITY: We, the undersigned, hereafter called Petitioners, both holding title to and/or interest therein the boundaries of the proposed Saint George Place Management District, herein-after described, and acting pursuant to Chapter 375 of the Texas Local Government Code, and Title 30, Texas Administrative Code (TAC), Sections 293.11(a)(7) and 293.11(j)(1). Pursuant to both, we hereby respectfully petition the Texas Commission on Environmental Quality to give the required public notice, to hold the required hearing, and to create the Saint George Place Management District, hereinafter referred to as the District and submit to the Honorable Commission the following facts and findings: I. The proposed District is comprised of owners of real property in the district, according to the most recent certified county property rolls, and this petition is signed by both, whose combined property value total of the total value in the District. II. The proposed area of the District is an area devoted primarily to residential development and business activity and located wholly inside the boundary of the City of Houston, Texas. The proposed area is also currently located wholly inside the boundary of the Lamar Terrace Public Improvement District Number Two, City of Houston (the PID ) and the proposed District will replace the PID and the supplemental services provided by it. The area is also wholly located within the Tax Increment Reinvestment Zone Number One, City of Houston (the TIRZ), which has been the financing vehicle to replace blighted infrastructure within a previously municipal designated blighted community. The TIRZ and PID are managed by a Redevelopment Authority (the Authority ), which contracts for services and manages projects. III. The boundaries of the proposed District, consisting of contiguous parcels of land, are described in Exhibit A attached hereto and made a part hereof by this reference. IV. The specific purposes of this District are to further the public purposes set forth in Chapter 375 of the Texas Local Government Code, as recently amended by SB 1234, 82 nd Texas Legislature. V. The general nature of the work, projects, or services proposed to be provided will consist of safety and security services and landscape maintenance and zoning enforcement through an interlocal agreement with the TIRZ as is currently being accomplished through the PID. Maintenance is necessary as significant capital investment has been made in the district along public rights of way and in public easements, and will deteriorate without proper attention, and such maintenance will include landscaping public property. Maintenance activities will comprise of mowing and weeding the green spaces on a regular maintenance schedule. Plant material will be maintained with watering, pruning, weeding and replacement as needed. Trees and shrubs will also receive periodic maintenance as needed to keep the tree stock healthy and vibrant. It is also anticipated that there will be a regular schedule of pickup along the corridor to keep a tidy appearance in the District. The District will also provide maintenance of a pocket parks within the district boundary, with mowing, cleanup, and up-keep of outdoor fixtures, dog stations to maintain and enhance the green space.
The District will maintain signage, sound barrier walls, street pavers and entry monumentation placed within the District. Security is necessary to maintain a public sense of safety to further the economic development of the District and encourage residential development and maintenance of values. The District will provide enhanced security patrol service for the area residences and businesses, either through the contracting with a private vendor for this service, or by agreement with Harris County for constable patrol services. The District may also consider the possible use of mobile security cameras, similar to those used by other management district in the area to provide 360 degree camera surveillance with high resolution cameras, coupled with high definition digital recording equipment. A networking of the area businesses with law enforcement entities will also be a focus, with the use of a safety and security committee, meeting regularly to discuss security issues, and disseminate relevant information to District property owners and lessees. Zoning Enforcement is currently handled through a contract between the city of Houston, the TIRZ and the PID. It is anticipated that the District will continue the service as required by the current Bi-Party Agreement with the City of Houston as the District will replace the PID functions. The cost of the provision of these projects and services are estimated to be approximately $397,320 (Three Hundred Ninety Seven Thousand Three Hundred Twenty Dollars), per year to be financed by assessments in the District. (See Exhibit B ) VI. The name of the proposed District is the Saint George Place Management District. VII. The proposed list of initial directors and initial terms of service are described on Exhibit C, attached hereto and made a part hereof by this reference. Also provided herein is a summary of the qualifications of each director and affidavits executed by each petitioning the Commission for appointment to the board of directors as initial directors. VIII. The District has perpetual succession under current law. The Board, however, may consider action as shall be appropriate to dissolve the District, if it determines and concludes the District is not a benefit to the area included with the District, and to the city of Houston and Harris County. Attached as Exhibit D and made a part hereof by this reference is a certified copy of the resolution by the City Council of the City of Houston in support of the creation of the District. IX. X. Attached as Exhibit H and made a part hereof by this reference is a certified letter from the Harris County Appraisal District, dated February 9, 2012, providing validation as required by Section 49.184 of the Water Code of the metes and bounds of the district, verified against the appraisal district facet maps, and certified copies of the list of accounts comprising the district as proposed, with related parcel map detailing each parcel. XI. The District may do anything necessary, convenient, or desirable to carry out the powers expressly granted or implied by the state law.
Wherefore, Petitions pray that proper notice be issued, and that proper hearings be held, upon such hearing the Texas Commission on Environmental Quality finds this District and project is feasible and necessary and would benefit the public considering the availability of comparable services from other systems, including special districts, municipalities, and regional authorities and the reasonableness of the proposed public purpose projects and services that this Commission issue its Order creating the Saint George Place Management District stating the specific purposes for which the District is created and appointing the initial directors. GEORGE PLACE MANAGEMENT DISTRICT The undersigned Petitioner (the Petitioner ) hereby petitions for the provision of services and improvements, and assessments in payment thereof, within St. George Place Management District (the District ), and in support of this petition the Petitioner presents the following: Section 1. Standing of Petitioner. The Petitioner is an owner of the Land within the District described below as determined by the current roll of the Harris County Appraisal District. The Petitioner, along with all other petitioners submitting petitions to the District in connection with the District, constitutes the owner of taxable property within the District sufficient to meet the requirements of Section 375.022, Texas Local Government Code. Section 2. Service and improvement plan. The Petitioner hereby consents and petitions for the adoption of a Service and Improvement Plan in substantially the form attached hereto as Exhibit A; provided that, the attached plan shall not serve as a prohibition against the adoption of a different plan if it is determined necessary by the District s board as required to serve the District.
