COMMERCIAL UMBRELLA LIABILITY UNDERWRITING AND RATING GUIDE ELIGIBILITY 1. All underlying General Liability coverage must currently be written by Germantown Mutual Insurance Company. 2. No policy may be bound by the agent without authorization from the Company. Each applicant or application must be approved by the Company prior to binding umbrella coverage. 3. A signed ACORD commercial application (including both the Applicant Information and Umbrella Sections) must be completed for all new risks. The Commercial Umbrella Renewal Questionnaire must be completed and signed every three years for the renewal of each risk. 4. Primary coverages not written by Germantown Mutual must be written in insurance companies with a Best s rating of B+ or better. 5. Back dating of coverage on a Commercial Umbrella is not permitted. The earliest date coverage on an authorized account may be bound, is the date on which the agent actually contacted the company to bind the umbrella coverage. 6. New Business: MVR s are obtained on all new business. Renewal: The Company will obtain violation data through a third party vendor. This vendor will provide violation data provided to them by state agencies responsible for accumulating such data on all drivers insured by the Company. This information is supplied to the company four months prior to the renewal of the risk to allow sufficient time to underwrite the account. MINIMUM UNDERLYING REQUIREMENTS 1. Automobile Liability (including non-owned 500,000/500,000 BI and auto and hired car coverages) 100,000 PD or 500,000 CSL Underinsured/Uninsured Motorists available 500,000/500,000 BI and only in states where mandatory. Limit must 100,000 PD or 500,000 CSL be same as carried for owned auto liability. 2. Commercial General Liability: Premises/Operations 500,000 each occurrence/ 1,000,000 general aggregate Products/Completed Operations 500,000 each occurrence/ 1,000,000 aggregate Personal Injury/Advertising Injury 500,000 3. Accident & Health, Fidelity & Surety, Fiduciary Liability, ERISA & Employee Benefit Liability, Financial Guarantee, Credit & Insolvency, Boiler & Machinery, Nuclear Energy Liability, Railroad Liability, Hospital Professional Liability, War Risk, Products Integrity, Impairment or Produce Recall, EPL (Employment Practices Liability). 4. Manufacture, storage, sale, transporting or wholesale distribution of explosives, fireworks, explosive substances, corrosives, munitions, chemicals, gasoline (other than gasoline stations or service stations), natural or artificial fuel gases, propane or liquefied petroleum gas (other than retail refilling or exchange of propane or LPG tanks). 22. Manufacture or wholesale distribution of cosmetics, hair and skin products, drugs, pharmaceuticals, vitamins, medical products, animal feeds, mobile equipment, bicycles, toys, valves or pressure vessels, industrial machinery, ladders or scaffolding, tires, cranes, automobiles, trucks, motor homes, motorcycles, mobile homes, snowmobiles, or trailers, including critical parts. 23. Manufacture or repair of any boiler or pressure vessel, or assembly thereof. 24. Mining of any type, including underground mining or tunnel operations. 25. Movie theatres. 26. Power equipment rental and sale of used equipment. 43. Risks with unfenced pools, or pools with diving boards or slides. 44. Senior citizen housing, congregate living facilities, homes for the aged, retirement homes and complexes, and convalescent homes in excess of 3 stories. 45. Lead poisoning and mold exposures. 46. Risks with receipts greater than $15,000,000 and/or developing a first $1,000,000 Umbrella premium greater than $10,000 are ineligible for this program. 47. Association, Pool and Syndicate business, to include business accepted by the Company as Reinsurance. 48. Automobile exposure relative to: A. Automobile drivers with more than two moving violations or at fault accidents in a three-year period or any conviction for reckless driving or driving while intoxicated within 10 years or as limited by state law. B. Automobile racing and race tracks. C. Truck men/common Carriers. D. Automobile Fleets consisting principally (51% or greater) of heavy (20,001-45,000 lbs GVW) or extra heavy (45,001 lbs GVW and up) licensed power units. 49. Chemicals, Fertilizers, Insecticides, Herbicides, animal feed, either manufacturing, blending, mixing or application thereof. However, this restriction will not apply to landscaping operations. 50. CATV (Commercial Antenna T.V. or Cable T.V.) 51. Installation, manufacture or service of any vertical or above the ground contrivance for the Movement of people, such as but not limited to, Elevators, Escalators, Trains or Trams, Ski Lifts or Tows. 52. Installation or manufacture of Sprinklers, Fire Alarms, Burglar Alarms or any other such safety devices other than smoke detectors. 53. Legal Liability for personal goods of others when a known exposure exists, unless liability for personal property in the Insured s care, custody or control is excluded. Tire (all types) manufacturing or processors. 59. Tobacco manufacturer or processors. REQUIRED ENDORSEMENTS 1. Restrictive endorsements attached to a primary policy will be attached to the umbrella policy. 2. Known exposures not covered by primary insurance will be excluded. POLICY PERIOD 1. All umbrella policies will be written on an annual basis. 2. Concurrency between primary CGL policy and umbrella policy is required. PREMIUM COMPUTATION FOR FIRST MILLION See attached Automobile and General Liability rating pages. MINIMUM POLICY PREMIUM FOR FIRST MILLION Minimum Premiums First $1,000,000 Risks with maximum one owned automobile $400 exposure (PPT/LT/MED) and receipts of under $1,000,000 ($5,000,000 on office exposures) Risks with up to two owned automobiles $500 (PPT/LT/MED) and/or receipts of under $1,000,000 ($5,000,000 on office exposures) Risks with up to three (PPT/LT/MED) vehicles and receipts $700 less than $2,000,000. Service Use: Automobiles used for transporting the insured's personnel, tools, equipment, and incidental supplies to or from a job location. This classification is confined to automobiles principally parked at job locations for the majority of the working day or used to transport supervisory personnel between job locations. Retail Use: Automobiles used to pick up property from, or deliver property to, individual households. Commercial Use: Automobiles used for transporting property other than those automobiles defined as service or retail. Gross Vehicle Weight: The maximum loaded weight for which a single automobile is designed, as specified by the manufacturer. Notices provided will advise the insured of the availability of higher limits and the right to reject UM &/or UIM, by completion and return of the rejection form. UM may be written without UIM or UIM may be written without UM. BI/PD/UM/UIM limits must be changed to the required underlying limits shown on the revised Schedule of Your Primary Insurance which is included with the PUL policy declarations if the underlying policy does not already include those limits. dates of the PUL policy. If the insured rejects the UM &/or UIM coverage, we will endorse the underlying auto back to the previous limits. The notice included with the renewal will inform the policyholder of these actions. MOTEL AND HOTEL RATING Underwriting Guidelines: A. 100 rooms maximum. B. Not greater than four stories C. No diving board or slide exposures. D. Pool must be fenced/gated. E. Age/construction/presence of protective devices must be documented. F. Properties older than 75 years should have all mechanicals updated in last 20 years. Rating: First $1,000,000 A. Rate per room with no pool exposure $30 B. Rate per room with pool exposure $35 HABITATIONAL: APARTMENT/CONDOMINIUM RATING Underwriting Guidelines: A. No greater than five (5) storied in height. B. No diving board or slide exposures. However, a letter from insured documenting the removal of an existing diving board or slide would render the exposure eligible for program consideration. C. Pool must be fenced/gated. D. Age/construction/presence of protective devices must be documented. E. Properties older than 75 years should have all mechanicals updated in the last 20 years. Rating: Minimum rate $20 per unit. Justification of higher rates based on # of stories/age/building height/pool exposure/urban vs. rural location UNLICENSED RECREATIONAL VEHICLES Definition: Any vehicle not licensed for road use including, but not limited to: snowmobiles, golf carts and all terrain vehicles.
