Terms and Conditions Your contract with us These terms and conditions and your plan schedule set out the terms and conditions of your Zurich Simple Life Insurance Plan. The plan is provided by Zurich Assurance Ltd so where we refer to we, us, our or Zurich we mean Zurich Assurance Ltd. Where we refer to you or your we mean the life insured. In these terms and conditions, where we can use our discretion, make a decision, ask for information or evidence or use our judgment, then we will do so acting reasonably, proportionately, fairly and in accordance with the law and regulations. This version of the terms and conditions applies from July 2014. You are responsible for the following: a) Taking reasonable care to give us accurate and honest information to the best of your knowledge when we reasonably ask for it. b) Letting us know if your name, address or contact details change. Please do this as soon as possible if you do not, we may send confidential information about you and your plan to your old address. c) Keeping any passwords secret and the documents for this plan safe. You must also let us know straightaway if you know about or suspect identity theft. d) Regularly reviewing your plan and its benefit. We do not give advice about the suitability of this plan to your needs; you are responsible for that decision. e) If you decide to move to another country outside of the UK, you need to tell us about any change in your residency before the change happens. For more information, please see Moving Abroad in section 13. 1. Who can have the plan? You can only take out the plan for yourself. You must be at least 18 and not more than 50 years old when the plan starts. You must be a UK resident and intend to stay in the UK for the near future. You can only have one Zurich Simple Life Insurance plan and the maximum cash sum you can apply for is 150,000. 2. When we will pay the cash sum We ll pay the cash sum shown in your plan schedule if you die during the plan s term. The plan will stop at the end of the term or when we pay the life insurance cash sum, whichever happens first. 3. When we won t pay the cash sum We won t pay the cash sum if: you haven t made all the payments that were due, or if you did not answer the questions we asked you before you started your plan honestly and truthfully as this would have affected the terms we would have offered you, or 3

you commit suicide during the period between the insurance cover start date and the end of 12 months from the plan start date. This means that the most likely cause was that the life insured took their own life whether or not this is shown as a verdict or cause of death on a death certificate or coroner s report. The insurance cover start date (where applicable) and the plan start date are shown in your plan schedule. If your plan schedule does not show an insurance cover start date, then it is the period during which we won t pay the cash sum if you commit suicide, which will run for 12 months from the plan start date. In these circumstances, we ll refund any payments you ve made. 4. Does the plan have a cash-in value? The plan doesn t have a cash-in value. This means you won t receive any payment if you cancel the plan after the 30 day cancellation period (see below). 5. Your cancellation rights You can cancel your plan within 30 days of receiving the plan documents (the cancellation period). If you notify us of your wish to cancel during the 30 day cancellation period, we ll refund any payments you have made. 6. How long will the plan last? The plan will run for the plan term shown in your plan schedule. 7. Making payments You must make all the payments that are due over the plan s term. Your plan schedule says how much you need to pay each month and how long the plan will run. Your payments will not change during the plan s term. If you don t make a payment when it is due, the plan will continue for 30 days. If the outstanding payment is not received by the end of the 30 day period, the plan will end and you won t get any of your payments back. If we accept a claim during this 30 day period under the terms of your plan, we ll deduct any due payment from the amount we pay. The first payment is due from the start date of the plan. If this payment is not made, the plan will not provide any life insurance. Payments are due on the first day of every month and you need to make them monthly by direct debit. We ll collect your payments on the first day of the month. However, if this falls on a weekend or public holiday, we ll collect your payment on the following working day. Your payments to us will stop on the earliest of the following events: you die, or the end of the term. 8. How flexible is the plan? The plan is designed to be simple and basic. Once the plan has started you cannot change the payments you are making or the cash sum. 4

9. Making a claim The person making the claim should firstly phone us on 0870 243 0827. They will then need to complete and sign a form we provide. We ll also need proof of death, proof of identity and, where applicable, reasonable evidence that the person making the claim is entitled to claim (for example, a grant of probate showing that he or she is the executor of your estate). They must pay any costs incurred in providing these. There may be other reasonable requirements such as medical evidence and reasonable evidence of death, including cause of death. We ll tell the person dealing with your affairs what we need when they make the claim. 10. Changes we can make to the plan To the extent that any change is proportionate and reasonably required, we may alter the terms and conditions of your plan, including your payments and benefit for any of the following reasons: a) so we can look after your plan more efficiently or effectively, or to reflect changes in technology or insurance industry practice; b) to take account of a decision by a court, governmental body, ombudsman, regulator, industry body, or similar body; c) to take account of changes to, or to comply with, the law, taxation, official guidance, relevant codes of practice or how we are regulated, including the amount of capital our regulators say we must hold; and d) if in our reasonable opinion we are at material risk of becoming insolvent and this may be avoided by changing the terms and conditions of your plan and those of other plan owners with similar plans and the changes are in the interests of our plan owners as a whole. We ll write and tell you of any changes to these terms and conditions 30 days before the change takes effect, where this is reasonably possible. Otherwise we ll let you know as soon as we reasonably can. 11. General terms If the ownership of this plan is transferred to someone else, we need to be informed by a notice of assignment at our address in the How to contact us section. This protects the legal position of the person you have transferred it to. Notices of assignment must give the date and details of the assignment, including the full name of the person you have transferred the plan to. If the currency of the United Kingdom is replaced by the euro, we ll change the payments and benefit to euros. If any of the details you have provided are wrong, we can change the terms of this plan to reflect the correct details. Only you (or if you die the person managing your affairs or the person who is entitled to benefit from the plan) can enforce the terms of your plan. We exclude the rights of any other persons under the Contracts (Rights of Third Parties) Act 1999. 5

12. Law Our relationship with you and these terms and conditions are subject to English law and the exclusive jurisdiction of the English courts. 13. Zurich will only use the personal information you have given us for the purposes of processing and administering your plan. If a claim is made on the plan, we will need to collect more information but we ll ask for this at that time. More information about how your personal information is used can be found in our data protection leaflet held on www.zurich.co.uk. Zurich Assurance Ltd will keep the information for the duration of the plan and for a period after it has ceased. Compensation We are covered by the Financial Services Compensation Scheme (FSCS). You may be entitled to compensation under the scheme if we cannot meet our obligations. Any compensation you receive under the scheme will be based on the FSCS s rules. For life assurance products the FSCS s first responsibility is to ensure the life insurance continues rather than pay compensation. 6

Moving abroad If you move to another country outside of the UK your plan may no longer be suitable for your individual needs, and you may no longer be eligible to make payments into your plan. The local laws and regulations of the jurisdiction to which you move may affect our ability to continue to service your plan in accordance with its terms and conditions. Therefore, you need to tell us of any planned change in your residency before the change happens. The plan is for customers who are UK residents. We do not offer tax advice so, if you decide to live outside the UK, we recommend you obtain advice on the tax consequences of changing your country of residence in relation to your plan. We will not be held liable for any adverse tax consequences that arise in respect of you or your plan due to a change in your country of residence.
