HAMAD INTERNATIONAL AIRPORT (RESTRICTED AREAS) REGULATIONS 2012 1. Short Title & Applicability (1) Pursuant to Article 4 of Law # 47 of 2009, and Articles 4, 11 and 24 of Law # 15 of 2002, the Chairman of the Qatar Civil Aviation Authority (QCAA) hereby makes the following regulations. (2) These regulations may be cited as the Hamad International Airport (Restricted Areas) Regulations 2015 PART I - PRELIMINARY 2. Interpretation (1) In these regulations, unless the context otherwise requires- aerodrome is a defined area in land or water associated with buildings, installations and equipment which is either wholly or partly used for take-off, landing and surface movement of aircraft. For the purposes of these regulations, the following additional interpretations apply: International airport means any aerodrome with international commercial air transport operations offered by national and foreign aircraft operators; Designated airport means any aerodrome which offers either international and/or domestic services by national carriers, corporate aviation services or general aviation services, where by virtue of a security risk assessment carried out by the Authority, the Standards and Recommended Practices of Annex 17 to the Convention on Civil Aviation shall apply. aerodrome operator means the holder of an approval from the Authority to manage and operate that aerodrome or airport; aerodrome or airport tenant means any enterprise that is resident at an aerodrome or airport and offers services and products at that aerodrome or airport; aircraft operator means a national aircraft operator or a foreign aircraft operator; Authority means the Qatar Civil Aviation Authority QCAA), as specified to ICAO as the body responsible for the coordination of the development, implementation, and maintenance of the National Civil Aviation Security Programme; Airport Authority means the entity granted approval by the Authority for the management and operation of an aerodrome or airport; Hamad International Airport (Restricted Areas) Regulations Page 4 of 27

Airport Manager means a person appointed to exercise the role of the chief executive of the airport authority; authorized person means a person authorized in writing by the Chairman for the purposes of these regulations and any police officer on duty within the airport; Chairman means the Chairman of the Qatar Civil Aviation Authority; permit means- for the purposes of Part II, a standard permit or a temporary permit issued under article 7 or a replacement permit issued under article 18; for the purposes of Part III, a tenant permit or a temporary tenant permit issued under article 21 or a replacement permit issued under article 25; (c) for the purposes of Part IV, any permit issued under article 27(1) or a replacement permit issued under article 33(1); (d) for the purposes of Part V, any permit issued under this by-law; Permit holder, in relation to a permit, means the person to whom the permit is issued; security restricted area means an area declared under article 4(1) to be a security restricted area. Tenant Restricted Area means an area declared under article 4(1) to be a tenant restricted area. Hamad International Airport (Restricted Areas) Regulations Page 5 of 27

3. Applicability (1) These regulations apply to: a) the operator of Hamad International Airport; b) staff of national aircraft operators; c) staff of foreign aircraft operators; d) aerodrome tenants and/or operators of Tenant Restricted Areas at Hamad International Airport; e) any person in or within the vicinity of Hamad International Airport; f) any person who provides a service to an aircraft operator; g) any person on board an aircraft; and h) all staff having access to Hamad International Airport. 4. Declaration of Security Restricted Areas and Tenant Restricted Areas (1) Without prejudice to paragraph (2), the Chairman may, by order declare- Any area within the airport to be a security restricted area Any area within, or connected to the airport held under lease or license from the Government, or part thereof, to be a tenant restricted area. (2) The Chairman may include any area within the airport over which an airport tenant has a right of way or a right of access, granted by the Government, or any part of such an area, in an area declared under paragraph (1) or. 5. Plans of Security Restricted Areas and Tenant Restricted Areas (1) The Chairman may prepare and certify a plan delineating the area and boundaries of any security restricted area, or tenant restricted area, and may from time to time prepare and certify a new plan in substitution thereto, and may from time to time endorse on such plan or substituted plan, any amendment thereto and shall certify such endorsement. (2) The Chairman s certification of any plan or amendments thereto under paragraph (1) shall be endorsed on the plan under the signature of the Chairman. (3) The original version of every plan certified under this article shall be kept in the office of the Chairman. Hamad International Airport (Restricted Areas) Regulations Page 7 of 27

PART II RESTRICTED AREA PERMITS 6. Prohibition of entry to Security Restricted Area without Permit (1) Subject to these regulation, no person other than a bona fide passenger shall enter or remain in a security restricted area unless he has on his/her person a valid permit issued to him in respect of that restricted area or is being escorted by a permit holder having the authority of the Chairman to escort persons into that security restricted area. 7. Issue of permits to authorized persons and others (1) Subject to paragraph (2), the Airport Manager may issue- to any authorized person free of charge; and subject to article 8, to any other person on an application being made therefore under that article and on payment of the prescribed fee, a standard permit or a temporary permit, whichever is appropriate, in such form and subject to such conditions as may be specified by the Airport Manager in consultation with the MOI Airport Police. Any standard permit may, at the discretion of the Airport Manager in consultation with the MOI Airport Police, give authority to the permit holder to escort any person into a restricted area for which the permit is valid. (2) The Airport Manager, in coordination with the MOI Airport Police, shall refuse to issue a permit if it appears to him that- the person requiring the permit or for whom it is required is for any reason relating to or connected with the security of the airport not a fit person to have access to a restricted area; or access to a security restricted area is unnecessary by reason of the nature of the occupation or employment of the person requiring the permit. 8. Application for Permits (1) Application for the issue of a permit under article 7(1) shall be- (c) made by the employer of the person requiring the permit on behalf of the employee; made to the Airport Manager in the form specified by him; and accompanied by- Hamad International Airport (Restricted Areas) Regulations Page 8 of 27

(i) (iii) the documents specified therein; such other particulars as may be required by the Airport Manager in consultation with the MOI Airport Police; and the prescribed fee. (1) Every permit shall- 9. Contents of permits and duration of validity thereof (c) to the satisfaction of the Airport manager, in consultation with the MOI Airport Police, bear sufficient means of identification of the permit holder; specify each restricted area in respect of which it is issued; indicate the period for which it is issued which- (i) in the case of a standard permit, shall be for such period as may be specified therein; and in the case of a temporary permit, shall not be greater than 6 months; (d) cease to be valid- (i) or (iii) (iv) on the expiration of the period for which it was issued; upon its cancellation under article 10; or where a permit holder ceases to be employed by the person who was his/her employer at the date of the issue of the permit; or upon a demand made by the Airport Manager in consultation with the MOI Airport police in under article 14 for a permit holder to surrender his/her permit to the Airport Manager or the MOI Airport Police. 10. Cancellation of Permits (1) The Airport Manager in consultation with the MOI Airport Police; a) shall cancel a permit if it appears to him that; (i) the permit holder is, for any reason relating to or connected with the security of the airport, not a fit person to have access to a restricted area; or access to a restricted area is unnecessary by reason of the nature of the occupation or employment of the permit holder; and b) may cancel a permit; (i) on the grounds that any condition under which it was issued has been contravened; or on the grounds that the permit holder or his/her employer has contravened any of these regulations; or (iii) in any case where he is satisfied that the permit has been lost, destroyed or defaced. 11. Procedure on Cancellation of Permit (1) Where the Airport Manager or MOI Airport Police cancels a permit under article 10, he shall notify the permit holder and the employer of the permit holder, accordingly. (2) A permit holder, upon receipt of a notice under paragraph (1), shall, save where the notice relates to a permit which has been lost or destroyed, forthwith surrender his/her permit to- (c) the the Airport manager; or an authorized person specified in the notice for the purpose; or the employer of the permit holder if specified in the notice for purpose, as the case may be. (3) An employer to whom a permit has been surrendered by virtue of a notice under paragraph (1) shall forthwith surrender that permit to the Airport Manager or an authorized person. 12. Action by Employer where permit is no longer required (1) The employer of a permit holder shall without delay; if the nature of the employment of the permit holder no longer requires that he has access to any restricted area specified in his/her permit; or if the permit holder ceases for any reason to be employed by him, (i) and (iv) inform the Airport Manager accordingly; and take possession of the permit from the permit holder; surrender the permit to the Airport Manager. 13. Permit to be surrendered on cessation of employment (1) A permit holder who ceases to be employed by the person who was his/her employer at the date of the issue of the permit shall, immediately upon the cessation of his/her employment, surrender his/her permit to that person. 14. Permit to be surrendered upon demand (1) The Airport Manager, in consultation with the MOI Airport Police, may demand a permit holder to surrender his/her permit to the Airport Manager, and the permit holder shall forthwith comply with such demand. 15. Permit to be worn on outer clothing (1) A permit holder shall, when entering, remaining in or departing from a restricted area- (c) (d) wear the permit affixed in a prominent position on his/her outer clothing; comply with the conditions subject to which the permit is issued; comply with all reasonable directions given to him/her by any authorized person; if the permit is a temporary permit, carry on his/her person- Hamad International Airport (Restricted Areas) Regulations Page 11 of 27

(i) an identity card issued to him/her, and approved by the Chairman; or such valid travel document or other means of identification as may be approved by the Chairman. 16. Exemption for bona fide passengers and crews (1) Subject to this article, the provisions of article 6 shall not apply to- any bona fide air-crew member or bona fide air passenger who is in the course of passage through any immigration control or aircraft boarding area or an area set aside for the purposes of the Immigration, which is within a restricted area- (i) having disembarked from an aircraft; or for the purpose of embarking upon an aircraft of which he is an air-crew member or air passenger; any bona fide air passenger awaiting an onward flight in any area reserved for transit or transfer passengers which is within a restricted area. (2) No person shall be exempted from the provisions of article 6 by virtue of paragraph (1) unless- (c) (c) being an air-crew member,, he is in possession of a valid aircrew license or crew member certificate issued in accordance with the appropriate international conventions; or being a military air-crew member of a military aircraft, he is in possession of a valid military identification document; or being a departing passenger, he is in possession of a valid travel document and a valid aircraft boarding pass; or being an arriving passenger or a transit or transfer passenger, he is in possession of a valid travel document. 17. Lost Permit (1) If a permit has been lost the permit holder shall, without delay, report the loss and the circumstances thereof to- his/her employer (if any, or, where the permit holder has no employer or is himself an employer, to the Airport Manager; and the officer in charge of the MOI Airport Police. (2) Where a report has been received by an employer as to the loss of a permit and the circumstances thereof, he shall, without delay, report such loss and the circumstance thereof to the Airport Manager. (3) Any person who finds a permit shall, without delay, deliver it to the Airport Manager or to the duty officer of the MOI Airport Police. 18. Issue of replacement permit (1) Where a permit has been lost, destroyed or defaced, an application may be made to the Airport Manager by the person to whom the permit had been issued, or the employer of that person, for the issue of a replacement permit. The Airport Manager, in consultation with the MOI Airport Police, upon being satisfied as to such loss, destruction or defacement, may, upon payment of the prescribed fee, issue to the permit holder a replacement permit which shall replace the permit which has been lost, destroyed or defaced. PART III TENANT RESTRICTED AREA PERMITS 19. Prohibition of entry to tenant restricted area without tenant permit (1) Subject to these regulations, no person shall enter or remain in a tenant restricted area unless he has on his/her person a valid permit issued to him in respect of that tenant restricted area. 20. Steps to be taken by Airport Tenant regarding security (1) Subject to these regulations an airport tenant shall, if so required by the Chairman, take all such steps as are reasonably practicable having regard to the nature of the business carried on by the airport tenant and to the location, configuration, layout and area of the tenant restricted area under his/her control, in the interests of the security of such tenant restricted area, to ensure- the prevention of access by any unauthorized person into the tenant restricted area; and the protection of the airport restricted area against security or safety risks which may result from entry into the tenant restricted area by any unauthorized person. (2) In complying with paragraph (1) an airport tenant shall give effect to such other matters relating to the security of the tenant restricted area as the Chairman may require or specify. (3) For the purpose of paragraph (1), unauthorized person means any and every person except a person specified in article 21(1) or. 21. Issue of tenant permits (1) The Chairman may require any airport tenant to issue- to- (i) each person employed by him in the tenant restricted area; and any public officer designated by the Chairman, a tenant permit; and Hamad International Airport (Restricted Areas) Regulations Page 14 of 27

to any other person, whose business requires his/her access, from time to time, to the tenant restricted area, a temporary tenant permit. (2) Any authorized person designated by the Chairman and to whom a tenant permit has been issued, shall have access to the tenant restricted area in respect of which the tenant permit was issued at such time or times as may be agreed between the Chairman and the airport tenant for the purpose of this Part. (1) Every permit shall- 22. Form of tenant permit and duration of validity (c) (d) be in such form and be subject to such conditions as may be approved by the Chairman; to the satisfaction of the Chairman, bear sufficient means of identification of the permit holder; specify the tenant restricted area in respect of which it is issued; indicate the period for which it is issued which- (i) in the case of a permit issued under article 21(1), shall be for such period as may be specified therein; and in the case of a permit issued under article 21(1), shall not be greater than one (1) month; and (e) cease to be valid- (i) on the expiration of the period for which it was issued; or upon its cancellation under article 23. 23. Cancellation of Permit (1) A permit may be cancelled by the Chairman or the airport tenant who issued it- on the ground that any condition subject to which it was issued has been contravened; where the permit holder ceases to be employed by the airport tenant; Hamad International Airport (Restricted Areas) Regulations Page 15 of 27

(c) (c) on the ground that the permit holder has contravened any article of these regulations; in any case where the Chairman or the airport tenant is satisfied that the permit has been lost, destroyed or defaced. (2) In any case where the Chairman or an airport tenant cancels a permit under paragraph (1)- the airport tenant shall- (i) notify the permit holder of such cancellation; and save where the permit has been lost or destroyed, take all reasonable steps to obtain possession of it; and save where the permit has been lost or destroyed, the permit holder shall forthwith surrender the permit to that airport tenant 24. Permit holder to report loss of permit (1) In any case where a permit has been lost, destroyed or defaced the permit holder shall forthwith report such loss, destruction or defacement to the airport tenant or to any person authorized by that airport tenant for the purpose. 25. Issue of replacement permit (1) An airport tenant, upon being satisfied as to the loss, destruction or defacement of a permit, may issue to the permit holder a replacement permit in such form and subject to such conditions as may be approved by the Chairman, and such permit shall replace the permit which has been lost, destroyed or defaced. PART IV SECURITY RESTRICTED AREA VEHICLE PERMITS 26. Vehicles not to be driven into or in security restricted area without vehicle permit (1) Subject to these regulations, no person shall- (c) drive a vehicle into or within a security restricted area; cause or permit a vehicle to be driven into or within a security restricted area; use a vehicle or cause or permit a vehicle to be used within a security restricted area, unless there is a valid permit, issued under article 27, for the vehicle in respect of that security restricted area and such permit is displayed- (i) if the vehicle is provided with a windscreen, on the windscreen in such a manner that it is clearly visible from the front of the vehicle; or if the vehicle is not provided with a windscreen, in a conspicuous position on the vehicle in front of the driving seat in such a manner that it is clearly visible from the front of the vehicle. 27. Issue of vehicle permits (1) Subject to paragraph (2), the Airport Manager may, in consultation with the MOI Airport Police, issue- for any Government vehicle, or any vehicle used or driven by a member of the Qatar Airport Police Force acting in the course of his/her duty, free of charge; and subject to article 28, for any other vehicle on an application being made therefore under that article and on payment of the prescribed fee, a vehicle permit, in such form as may be specified by the Airport Manager and subject to any condition specified therein or applicable thereto. (2) The Airport Manager, in coordination with the MOI Airport Police, shall refuse to issue a permit if it appears to him that- it is unnecessary that the vehicle should be driven into or within a security restricted area; or for any reason connected with the security or safety of the airport, the vehicle should not be permitted entry to a security restricted area. 28. Application for vehicle permit (1) Application for the issue of a permit under article 27(1) shall be- a) made to the Airport Manager by the owner of the vehicle or by his/her employer; b) in such form as may be specified by the Airport Manager; and c) accompanied by- (i) (iii) the documents specified therein; such other particulars as may be required by the Airport Manager; and the prescribed fee. (1) Every permit shall- 29. Contents of vehicle permit & duration of validity (c) (d) bear sufficient means of identification of the vehicle for which it is issued; specify each security restricted area in respect of which it is issued; specify which access control gate the vehicle may use; indicate the period for which it is issued; and Hamad International Airport (Restricted Areas) Regulations Page 18 of 27

(e) cease to be valid- (i) on the expiration of the period for which it was issued; or upon its cancellation under article 30. (1) The Airport Manager- 30. Cancellation of vehicle permit shall cancel a permit if it appears to him that- (i) it is unnecessary that the vehicle should be driven into or within a security restricted area; or for any reason connected with the security or safety of the airport, the vehicle should not be permitted entry to a security restricted area; and may cancel a permit- (i) (iii) on the ground that any condition subject to which it was issued has been contravened; or on the ground that the owner or driver of the vehicle has contravened any of this/her by-law; or in any case where he is satisfied that the permit has been lost, destroyed or defaced. 31. Action on cancellation of vehicle permit (1) Whenever the Airport Manager cancels a permit under article 30 he shall notify the owner of the vehicle accordingly. (2) The owner of the vehicle, on receipt of a notice under paragraph (1), shall, save where the notice relates to a lost or destroyed permit, take all such steps as are reasonably necessary to ensure that the permit is surrendered without delay to the Airport Manager. 32. Lost vehicle permit (1) If a permit has been lost, the owner of the vehicle in respect of which the permit was issued shall, without delay, report the loss and the circumstances thereof to- the Airport Manager; or the officer in charge of the MOI Airport Police. (2) Any person who finds a permit shall, without delay, deliver it to the Airport Manager or to the officer in charge of the MOI Airport Police. 33. Issue or replacement vehicle permit (1) If a permit has been lost, destroyed or defaced, the Airport Manager may, upon being satisfied as to such loss, destruction or defacement, issue- for any Government vehicle free of charge; subject to paragraph (2), for any other vehicle on an application being made therefore under that paragraph and on payment of the prescribed fee, a replacement permit, in such form as may be specified by the Airport Manager and subject to any condition specified therein or applicable thereto. (2) Application under paragraph (1) for the issue of a replacement permit shall be- made by the owner of the vehicle to the Airport Manager in the form specified by the Airport Manager; and accompanied by- (i) (iii) the documents specified therein; such other particulars as may be required by the Airport Manager; and the prescribed fee. 34. Removal of vehicles from security restricted area (1) The Airport Manager or any authorized person may remove from within any part of a security restricted area any vehicle which in his/her opinion constitutes through its presence a risk in regard to security or safety of the airport or a danger to any person. 35. Definitions (1) In this Part, owner, in relation to a vehicle, has the meaning assigned to it by the appropriate section of the legislation governing the registration and licensing of vehicles. PART V GENERAL 36. Offences and penalties (1) Any person who contravenes article 6, 13, 19, 26, or 32 shall be guilty of an offence and shall be liable under the Qatar Penal Code. (2) Any person who contravenes article 15 may, upon investigation of the circumstances, have his/her permit cancelled or suspended for a specified period of time. (3) Any person who contravenes article 17 may, upon investigation of the circumstances, have his/her application for a replacement permit denied. (4) Any person who- makes use of, or retains in his/her possession, any permit which he knows or ought reasonably to know- (i) has been cancelled; or has ceased to be valid; (c) without reasonable excuse, parts with the possession of a permit issued to him; without reasonable excuse, defaces, alters or destroys any permit; (d) in, or in connection with, an application under article 8, 18, 28 or 33(2) makes any statement or gives any information which he knows or ought reasonably to know is false in any material particular; (e) being a permit holder, contravenes any condition subject to which the permit was issued, shall be guilty to an offence and shall be liable. (5) Any of the following persons, who without reasonable excuse and being- a permit holder, who contravenes article 11(2), 13, 14, 15, 17(1) or, 23(2) or 24; or (c) an employer, who contravenes article 11(3), 12 or 17(2); or an airport tenant, who contravenes article 23(2); or (d) the owner of a vehicle, who contravenes article 31(2) or 32(1), shall be guilty of an offence and shall be liable. 37. Power to detain persons (1) An authorized person, not being an MOI Airport Police officer, may, if he has reasonable grounds for believing that any person has contravened article 6, 19 or 26, may detain that person until he/she can be delivered into the custody of an MOI Airport Police officer, in order to be dealt with in accordance with the MOI Airport Police requirements for charging persons committing offences against any laws. (2) Provided that in no case shall any person be detained for more than 48 hours without being charged and brought before an appropriate court of law with jurisdiction over such offences. (3) For the purposes of these Regulations, an authorized person is a person as defined in Article 74 of the Hamad International Airport, Airport User Regulations 2015. 38. Extent to which articles not binding on the Government (1) Articles 6 and 19 shall not apply to, and article 26 shall not apply in respect of a vehicle being used by, an Airport Police officer, an immigration officer, an officer of the Fire Services, a member of the Military, or other Government department, who requires access to the airport or any part thereof for the performance of his/her duty in circumstances of such urgency that the performance of his/her duty might be frustrated or seriously impaired if such articles were to apply to him or in respect of the vehicle being used by him. 39. Fees Schedule (1) The fees prescribed under these regulations are set out in Schedule No. 1. 40. Schedule of Airport Security Restricted Areas (1) The areas within Hamad International Airport that are described in Schedule No. 2 are declared to be security restricted areas for the purposes of these regulations. 41. Schedule of Tenant Restricted Areas (1) The areas within, or connected to, Hamad International Airport that are described in Schedule No. 3, are declared to be tenant restricted areas for the purposes of these regulations. 42. Offences and Penalties (1) Any person who contravenes any of these Regulations shall be guilty of an offence and shall be held liable. 43. SCHEDULE 3 TENANT RESTRICTED AREAS 1. Those Tenant Restricted Areas within, or connected with, Hamad International Airport, that are designated as TRAs under Regulation 5, are specified in the approved Hamad International Airport Airport Security Programme (ASP), or the appropriate approved Tenant Security Programme.
