ELECTRONIC BANKING SERVICES DISCLOSURES AND AGREEMENT ATM Card You may request an ATM Card that will access your Money Market or Saving Account with the Bank. Your Liability Tell the Bank AT ONCE if you believe that your Card, Card number or PIN has been lost, stolen or used without your permission. Telephoning is the best way of keeping your possible losses down. If you tell the Bank within two business days, you could be liable for no more than $50 if someone used your Card or PIN without your permission. If you do NOT tell the Bank within two business days after you learn of the loss, theft or unauthorized use of your Card or PIN, and the Bank can prove that it could have stopped someone from using your Card or PIN without your permission if you had told the Bank, you could be liable for as much as $500. If your statement shows electronic transfers that you did not make, you need to notify the Bank at once. If you do not notify the Bank within 60 days after the statement was sent or made available to you, you may be liable for the full amount of the unauthorized transfers that occurred after the 60 day time period if the Bank establishes that the unauthorized transactions would not have occurred if you would have notified the Bank in time. If etenuating circumstances (such as a long trip or a hospital stay) kept you from notifying the Bank, the Bank may etend the time periods. Lost, Stolen or Unauthorized Use of Card or PIN If you believe your Card or PIN has been lost or stolen or that someone has transferred or may transfer money from your account without your permission, call 1-866-226-5638 or write to Synchrony Bank, P.O. Bo 5937, Bridgewater, NJ 08807-5937. Business Days For purposes of this Agreement, the Bank s business days are Monday through Friday ecluding federal holidays. Transactions made after 3:00 p.m. ET Monday through Friday and on Saturday, Sunday and federal holidays will be posted on the net business day. Types of Electronic Transfers; Limitations You may use your Card at ATMs to: Withdraw cash from your accounts Make deposits to your accounts Transfer funds between your accounts Determine the available balance in your accounts Pay for purchases at places that have agreed to accept the Card, and Perform any additional services offered by the ATM *Some of these services may not be available at all ATMs or terminals. Non-Synchrony Bank ATMs The use of your Card and/or access to any or all of your accounts at non-synchrony Bank ATMs may vary depending on the location and type of ATM you are using, the ATM network through which the transaction is being performed, or the policies of the ATM owner. A specific ATM or ATM network may not perform or permit all of the above listed transactions. Additionally, transactions at non-synchrony Bank ATMs maybe subject to a surcharge assessed by the terminal owner. Your daily withdrawal limit is your available account balance, up to a $1,000 daily limit for ATM withdrawals and a $500 limit for Point of Sale (POS) transactions. These limits are subject to change from time to time. The Bank in its sole discretion reserves the right to provide a lower limit for certain customers. Applicable law limits your ability to make transfers from your savings and money market accounts, as discussed in the Transaction Limitations section of the Savings and Money Market Account Agreement on page 1. ATM Fees; Surcharges You may be charged a transaction fee (sometimes called a surcharge ) for cash withdrawals or other transactions, including a balance inquiry, at some ATMs and terminals. This fee or surcharge is imposed by the ATM or terminal owner or operator and is beyond the Bank s control. This charge will be in addition to any fees the Bank may impose. Documentation of Transfers You can obtain a receipt at the time you make a transaction at one of the Bank s ATMs, unless, for some reason, the ATM fails to produce a receipt. The Bank will send or make available to you a monthly statement for savings and money market accounts unless there are no transfers in a particular month; then a quarterly statement will be sent or made available. Your statement will show the date, amount and description of each transfer. You may verify posting of a direct deposit or electronic transfer on the net business day after the deposit or transfer is scheduled to be made by calling the Bank at 1-866-226-5638 or visiting the Bank s website.
Preauthorized Payments; Stop Payments If you have told the Bank in advance to make regular payments out of your account, you can stop any of these payments. Here s how: Call the Bank at 1-866-226-5638 or write to Synchrony Bank, P.O. Bo 5937, Bridgewater, NJ 08807-5937 in time for the Bank to receive your request three (3) business days or more before the payment is scheduled to be made. If you call, the Bank may also require you to put your request in writing and get it to the Bank within fourteen (14) days after you call. The Bank will charge you a fee for each stop payment order you give. The stop payment will be effective for si (6) months. If you order the Bank to stop one of these payments three (3) business days or more before the transfer is scheduled and the Bank does not do so, the Bank will be liable for your losses or damages. If these regular payments may vary in amount, the person you are going to pay will tell you ten (10) days before each payment, when it will be made and how much it will be. The Bank s Liability for Failure to Complete Transactions If the Bank does not complete an electronic transfer to or from your account on time or in the correct amount, the Bank could be liable for your losses or damages. However, the Bank will not be liable: If, through no fault of the Bank, you do not have sufficient available funds in your account to make the transaction; If the ATM or terminal where you made the transaction did not have enough cash or other supplies; If the ATM or terminal was not working properly and you knew about it when you started the transaction, or other equipment or software malfunctions occurred at the time you initiated the transaction; If circumstances beyond the Bank s control (such as power failure, fire or flood) prevent the transaction from occurring, despite reasonable precautions the Bank has taken; If the funds in your account are subject to legal process or other encumbrance restricting a transfer of funds from your designated account; If your Card or PIN has been reported lost or stolen or the Bank has reason to believe that you or someone else is attempting to make a transfer for fraudulent or illegal purpose; If you or the Bank has terminated this Agreement; If your PIN or Card has been canceled or your account has been closed. Confidentiality The Bank will disclose information to third parties about your account or the transfers you make. Where it is necessary for completing transfers; In order to verify the eistence and condition of your account for a third party, such as a credit bureau or merchant; In order to comply with government agency or court orders; In order to comply with United States law; If you give the Bank your permission or In accordance with the Bank s Privacy Policy. Error Resolution In case of errors or questions about any of your electronic transfers, telephone the Bank at 1-866-226-5638 or write to Synchrony Bank, EFT Research Department, P.O. Bo 1883, Cranberry Township, PA 146066-1389 as soon as you can, if you think your statement or receipt is wrong or if you need more information about a transfer listed on the statement or receipt. The Bank must hear from you no later than sity (60) days after the Bank sent or made available to you the FIRST statement on which the problem or error appeared. You must: Give your name and account number; Describe the error or transfer you are unsure about, and eplain as clearly as you can why you believe it is an error or why you need more information; and Give the dollar amount of the suspected error. If you tell the Bank orally, the Bank may require that you send your complaint or question to the Bank in writing within ten (10) business days. The Bank will determine whether an error occurred within ten (10) business days after it hears from you and will correct any error promptly. If the Bank needs more time, however, it may take up to forty-five (45) days to investigate your complaint or question. If the Bank needs additional time to investigate, the Bank will provide a provisional credit to your account within ten (10) business days for the amount you think is in error so that you will have the use of the money during the time it takes the Bank to complete its investigation. If the Bank asks you to put your complaint or question in writing and it does not receive the written correspondence within ten (10) business days, the Bank may not credit your account. For errors involving new accounts, POS, or foreign-initiated transactions, the Bank may take up to ninety (90) days to investigate your complaint or question. For new accounts, the Bank may take up to twenty (20) business days to credit your account for the amount you think is in error.
The Bank will notify you of the results within three (3) business days after the Bank completes its investigation. If the Bank determines that there was no error, the Bank will send you a written eplanation and may reverse any credit provided. You may ask for copies of the documents that the Bank used in its investigation. Foreign Transactions Withdrawals made in a foreign country and in foreign currencies using your Card will be converted to U.S. dollars at the rate that eists on the date of echange as determined by the foreign bank in accordance with applicable operating rules for international transactions. The conversion rate may not be the same as on the transaction date. The Bank does not have any control over the echange rate or the date or place of the echange. The Bank also does not have any control over any conversion fee that may be charged by a card association or network. ELECTRONIC FUNDING You may elect to make deposits to your account by instructing the Bank to electronically debit funds from an account at another financial institution (initiate an ACH debit). These ACH debits are provisional and will not be credited to your account until final payment is received. You agree that the Bank may reverse any ACH transfer to your account without prior notice to you at any time if (a) the Bank credited your account in an incorrect amount, (b) the deposit represents a duplicate credit to your account, (c) you were not entitled to the deposit, or (d) you were not the intended recipient of the deposit. Deposits made by ACH are subject to applicable law, the rules of the National Automated Clearing House Association and any regional clearing house the Bank may use from time to time. The Bank may reverse any provisional credit to your account for which final payment is not received. NOTE: Electronic funding is not available for IRA accounts. By selecting electronic funding, you represent and warrant that you are the owner of the account at the other financial institution and that you have full right and authority to all funds held in that account. You acknowledge and agree that the Bank is relying upon the information you provide in originating electronic funding on your behalf, and that any errors or discrepancies in the account names and numbers or the ABA routing number and name of the financial institution holding your account are your responsibility. You agree that the Bank has no responsibility to investigate discrepancies between names and account numbers. If you choose random payment verification to validate the eternal account in which electronic transfers will be made, you authorize the Bank to credit your eternal account with two (2) small payments between one and fifty cents. You must verify the amounts of those two (2) payments within 60 days from the date that you elected random payment verification. Once verified, it may take up to 48 hours for your electronic transfer to be credited to your account. For the initial deposit to your account, funds will be available for withdrawal five (5) business days after the deposit has been credited to your account, or funds will be available for withdrawal immediately if you completed the Bank s random payment verification process. For transfers to your account, other than the initial deposit, funds will generally be available for withdrawal no later than the third business day after the day of the transfer. By completing the random payment verification process, the eternal account verified through the random payment process will be registered for future electronic transfers to and from Synchrony Bank. If you choose to fund the initial deposit to your account from an eternal account and you do not use random payment verification, then for a 45 day period, the only withdrawal the Bank will permit from your account is a transfer of the full initial deposit amount received to your eternal account at the other financial institution after a five day waiting period. If you register eternal account transfers for your account other than the initial deposit and you do not use random payment verification to validate the eternal account, funds will generally be available for withdrawal no later than the third business day after the day of the transfer.
